RECOMMENDATION
WHEREFORE, In view of the foregoing, it is respectfully recommended to the Honorable
Court that the petition for probation of SARAH JAEL AMION y RUSIANA be GRANTED for a
period of ONE (1) YEAR, to be counted from Probationers initial report for supervision and subject
to the following conditions:
1. Probationer shall report initially to the Chief Probation and Parole Officer at Bukidnon
Parole and Probation Office, No. 1, Manolo Fortich, Bukidnon within seventy-two (72)
hours from the receipt of the Order granting probation.
2. She shall, thereafter, report to her supervising Probation and Parole Officer once a
month unless otherwise modified by the Chief Probation and Parole Officer.
3. She shall reside at 074 Virgen de Regla Village, Zone 2, Tablon, Cagayan de Oro
City and shall not change her residence without prior approval of the Chief Probation
and Parole Officer, or Court, as the case may be.
4. She shall secure a written permit to travel outside the jurisdiction of the Parole and
Probation Office from the Chief Probation and Parole Officer and from the Court if such
travel exceeds thirty (30) days.
5. She shall not commit any crime or any other offense.
6. She shall render community service and will participate in tree-planting activities.
7. She shall allow the supervising Probation and Parole Officer or an authorized Volunteer
Probation Aide to visit her home and place of work.
8. She shall meet her family responsibilities.
9. She shall devote himself to a specific employment and shall not change said
employment without prior notice to the supervising officer and/or pursue a prescribed
secular study or vocational training.
10.
She shall refrain from associating with persons of questionable character.
11. She shall cooperate with his program of supervision, and shall satisfy any other
condition related to her rehabilitation and not unduly restrictive of her liberty
incompatible with her freedom of conscience.
12.
She shall plant ten (10) trees during her probation period and shall see to it its
proper growth and survival.
In the event that Petitioner fails to observe the preceding conditions and/or has committed
any material misrepresentation in his application for probation, his probation may be revoked by
the Court or the conditions thereof modified.

RECOMMENDATION

WHEREFORE, in view of the foregoing, it is respectfully recommended to the Honorable


Court that the petition for probation of _________________________________________ be
DENIED pursuant to Paragraph a and b, Sec. 8 of PD 968 as amended which states that the
probation shall be denied if the petitioner is:
xxx (a) the petitioner is in need of correctional treatment that can be provided most
effectively by his commitment to an institution.

another offense.
and/or Section 9 of PD 968 as amended which states that the benefits of probation shall

(a) sentenced to serve a maximum term of imprisonment of more than six years;
(b) convicted of any offense against the security of the State;
(c) who have previously been convicted by final judgment of an offense punished by
imprisonment of not less than one month and one day and/or a fine of not less than Two
Hundred Pesos;
(d) who have been once on probation under the provisions of this Decree; and
(e) who are already serving sentence at the time the substantive provisions of this Decree
became applicable pursuant to Section 33 hereof.

When she was a kid, her parents always quarreled because her mother was a nagger. As
consequence, his father had an affair with another woman. At first, they found it very difficult to
accept his infidelity especially on the part of their mother but gradually they were able to handle the
situation especially that her father has already 3 children with the woman when they discovered
their affair.
Because her father was a Supervisor of the City Water District in Cagayan de Oro City, he
was able to give full support to his 2 families at the same time. He was able to send all his children
to school until college.

Offenders Statement
The petitioner alleged that he went to the town fiesta of Camp 9, Libona, Bukidnon and shared
a drink with his friends. He was so depressed then because his wife was 4 months away and
hadnt come back since she went to her brothers house in Kisolon, Bukidnon. He was extremely
drank and said he was not in his right mind when he forced the victim to go with him.

ANALYSIS AND EVALUATION


When the petitioner committed the offense, he was experiencing an emotional problem
because his wife left him for several months. He turned to drinking to forget his problem but instead
of easing the pain he got involved in a very big trouble that put him to jail. During his incarceration,
he was able to reflect the mistake he has done and the bad effect of too much drinking. Now, he
promised reformation if given another chance.
The petitioners wife is now back in their home and they are now complete. The petitioner
promised to quit drinking for the sake of his family.
The Barangay officials certify no criminal complaint of similar offense ever filed against the
petitioner in their office. They also signified support to petitioner in his program of rehabilitation if he
will quit drinking.
Results of the records check conducted show that the instant case was petitioners first
infraction of the law. He deserves a life outside prison bars.

The petitioners father was a former Barangay Chairman of Basak, Talakag, Bukidnon for
22 years but prior to that, he was Barangay Kagawad for 10 years.
The petitioner said that he was not happy with the life they had before. As a politician, his
father had almost no time for his family. Even in the financial aspect, sometimes he gave first
priority the needs of his constituents than the needs of his own family.
The petitioners mother is very caring to all her children. Even if she is an illiterate, she is
very supportive to all her children. As a matter of fact, three of petitioners siblings finished a
college degree.
The familys main source of income is derived from farming. His father who is an industrious
man has planted hard wood trees, coffee and fruit trees that they are still enjoying now.

The petitioner and his wife admitted that because of their desire to earn more money, they
were tempted to try buy and sell of timber products without thinking of the possibility of being
apprehended. And because they found the business lucrative, they forget the risk of what they were
doing. The instant case became an eye-opener to them. It was too late when they realized their fault.
The petitioner has a good reputation in the community. His neighbors said that he is not a
problem to them even if they knew about his illegal transactions . They are in favor of giving him
another chance.
