There were also other loopholes. There was USDA oversight for school lunches and foods with minimal nutritional value, like soft drinks. But school food sold in vending machines, a la carte lines, or school stores were not restricted. As society's trend for improved fitness and health expanded, many restaurants and food establishments began to voluntarily provide nutritional information about food calories and content to their customers. Fast-food chains joined to match

nutritional disclosures furnished by their competitors. Then, in 2006, New York City adopted a regulation requiring mandatory nutrition labeling at food service establishments that were already in voluntary compliance. After this law was successfully challenged as being too restrictive, it was later revised to apply to all covered food service establishments and upheld by the courts. Many other states and localities followed suit. Some of the labeling laws were limited to number of calories, while others required full nutritional disclosure. This resulted in a hodgepodge of conflicting laws, and renewed calls for federal legislation. In 2008 the U.S. Congress proposed the MEAL and LEAN Acts that would require point of purchase menu labeling of calories and nutrition content by restaurant chains with more than 20 locations. The acts would also preempt conflicting state or local laws. These laws were not enacted, but now form the basis of similar proposals that have become part of pending health care reform. The U.S. House passed its healthcare reform bill on Nov. 7. The U.S. Senate approved its version on Dec. 24. The reconciled final bill is scheduled to be available for signature by the President in early 2010. Key provisions currently in the bills are: � Nutritional disclosure required for standard menu items in large chain restaurants, defined as "those with 20 or more outlets.'' � Visible point of purchase nutritional disclosure also required for operators running 20 or more vending machines. � Regulation of all food sold at schools, including vending machines. The bill's final version may or may not include them.
