Good day!

I am Kjerrimyr R. Andres, a III AB MA POS bona fide student of Ateneo de Manila University, and I
would like to file a motion for review regarding the extension of elections by Ateneo Comelec for February
24, 2015.
This is based on the grounds of:

Article XIC Sec 3c of the Sanggunian Constitution


Provide information to the student body on all election laws, procedures, decisions, and other matters related to
Sanggunian candidacy, campaign, elections, plebiscites and or referenda
That the Comelec has not been immediately and directly transparent on the decisions for the
extension of elections because their Memo No. 201527 does not state any reason at all for the
extension of elections.1 The Memo was released February 23, around 8:30 to 9:00. Their reason for
extension was unusually released via Memo 201528 only three hours stating that they had "problems
in manpower at the polling stations."2 Additionally, during the crisis of the low voter turnout
scenario and the scare for not reaching the quota, the dull reason of Comelec was only released
sometime around midnight, three hours after their decision. The tone and the brevity of their analysis
on their second memo states their hasty and insubstantial decision on the matter, "We think that this
affected the voter turnout" (emphasis mine).

Article XC Sec 2 of the Sanggunian Constitution


Abstentions. The student bodys right to abstain must always be respected in all electoral exercises. Should
abstentions garner the majority of votes, the contested position shall remain vacant. In the case of a majority of
abstentions in plebiscites and referenda, the status quo shall be maintained.
That the memo stating the said negligence might have been conveniently placed during the peak of
crisis over quota and failure of elections.

Article IX Sec 1.6 of the Electoral Code of the Comelec


During the counting of votes, the only persons allowed in the immediate vicinity where the votes are counted are the
Ateneo COMELEC members, SJC representatives, and Office of Student Activities professionals.
Witnesses have seen other people, including members of the Sanggunian and those running for
Sanggunian offices, in the immediate vicinity of Comelec base of operations immediately after the
closing of elections at 6:00 PM, February 23, 2015.

Many students and organizations of the Ateneo, including Ateneo Debate Society, have expressed their
dismay over the "arbitrary extensions of elections"3, violating Article XIC Sec 3c of the Sanggunian
Constitution and the sanctity of ballots and the election processes as a whole.
