A BILL
To amend the Toxic Substances Control Act to reauthorize and modernize that Act, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Frank R. Lautenberg
4
Chemical Safety for the 21st Century Act’’.
5
SEC. 2. FINDINGS, POLICY, AND INTENT.

Section 2(c) of the Toxic Substances Control Act (15
7
U.S.C. 2601(c)) is amended—

(1) by striking ‘‘It is the intent’’ and inserting
1
the following:

‘‘(1) A
DMINISTRATION
.—It is the intent’’;
3
(2) in paragraph (1) (as so redesignated), by
4
inserting ‘‘, as provided under this Act’’ before the
5
period at the end; and
6
(3) by adding at the following:

‘‘(2) R
EFORM
.—It is the intent of Congress
8
that reform of this Act in accordance with the
9
amendments made by the Frank R. Lautenberg
10
Chemical Safety for the 21st Century Act—
11
‘‘(A) shall be administered in a manner
12
that—
13
‘‘(i) protects the health of children,
14
pregnant women, the elderly, workers, con-
15
sumers, the general public, and the envi-
16
ronment from the risks of harmful expo-
17
sures to chemical substances and mixtures;
18
and
19
‘‘(ii) ensures that appropriate infor-
20
mation on chemical substances and mix-
21
tures is available to public health officials
22
and first responders in the event of an
23
emergency; and

‘‘(B) shall not displace or supplant com-

mon law rights of action or remedies for civil
2
relief.’’.

SEC. 3. DEFINITIONS.

Section 3 of the Toxic Substances Control Act (15
5
U.S.C. 2602) is amended—
6
(1) by redesignating paragraphs (4), (5), (6),
7
(7), (8), (9), (10), (11), (12), (13), and (14) as
8
paragraphs (5), (6), (7), (8), (9), (10), (12), (13),
9
(17), (18), and (19), respectively;
10
(2) by inserting after paragraph (3) the fol-
11
lowing:

‘‘(4) C
ONDITIONS OF USE
.—The term ‘condi-
13
tions of use’ means the intended, known, or reason-
14
ably foreseeable circumstances the Administrator de-
15
termines a chemical substance is manufactured,
16
processed, distributed in commerce, used, or dis-
17
posed of.’’;
18
(3) by inserting after paragraph (10) (as so re-
19
designated) the following:

‘‘(11) P
OTENTIALLY EXPOSED OR SUSCEPTIBLE
21
POPULATION
.—The term ‘potentially exposed or sus-
22
ceptible population’ means 1 or more groups—
23
‘‘(A) of individuals within the general pop-
24
ulation who may be—
