complaint in this action which is.filed in October of 2008 doesn't say anything about the census. Everything we heard so far from Mr. Strung pertains to the census, but the complaint doesn't mention the census at all. So this is not an appropriate

application to make on the October 2008 complaint. Number two, I don't see any urgency in the relief that he is seeking. There is not any showing

that would justify temporary restraining order against anyone. And, of course, from what I've heard

and from what I've seen in this case, Mr. Strunk seems mainly concerned to restrain the New York City Police Department, possibly the United States Department of Commerce, the Census Bureau. These
