U.S, Department of Justice Office of Justice Programs Office of the General Counsel Washargion. DC. 20531 March 25, 2015 Ms, Lori Handrahan, Ph.D. Washington, D. . 20007 Re: OJP FOIA No. 15-00094 Dear Ms. Handrahan: This letter responds to your December 5, 2014, Freedom of Information ActPrivacy Act request that was received in the Office of Justice Programs (OJP), Office of the General Counsel for processing and responding directly to you. You requested information on Internet Crimes Against Children (ICAC) information and statistics. ‘The response to your specific requests are indicated below: 1. How many ICAC funds each state receives, per annum, from DOJ? The amount of funding each ICAC Task Force receives annually can fluctuate based on a formula run each year, This formula is based on direction provided in Section of the PROTECT Our Children Act of 2008. Each ICAC Task Force reeeives a minimum amount annually as directed by the PROTECT Our Children Act of 2008. You may access information on yearly funding amounts (fiscal years 2007 to 2014) at: http://www.ojidp.gov/funding/funding.htmi 2. How many arrests each state reports, per annum, to DOJ? ‘The Office of Justice Programs has conducted a search of its records and enclosed is a copy of one document, consisting of nine pages that is appropriate for release in full and without excisions. 3. Demographic breakiown of those arrests, such as race, profession, education level, gender, ete. OJSDP does not collect demographic information for individuals arrested by ICAC Task Forces. Page 2 of 3 Kind and volume of the child porn found on defendant al time of arrest. PTHC? Infant and Toddler? OJJDP docs not collect information regarding the volume and type of child pornography the defendant/arrestee possessed at the time of arrest. Were any efforts made to identify and rescue the children? If so. how many children identified and protected? ICAC Task Forces routinely attempt to identify and rescue children in child pornography viewed by investigators. All Task Forces submit images to the National Center for Missing and Exploited Children (CVIP) for possible identification under the Child Victim Identification Program. For the years 2009 through 2013, ICAC Task Forces investigated cases where there were 50,135 images where the child victim had been identified (however, this does not mean that the ICAC rescued the child — the child may have been identified/ rescued/recovered by a separate law enforcement agency); identified 9,435 children as victims of abuse where there were no known. ‘images, and submitted 201,086 cases o NCMEC for possible identification of the child, Prosecution Information, Once arrested does ICAC/DO3 follow the case and note what occurred at prosecution? OJIDP requires ICAC Task Forces to track all cases referred for prosecution by the ICAC Task Force Lead Agency and any affiliates (receiving >S20,000 per year) and report this data to OJJDP on a quarterly basis. This reporting requirement began July 1, 2009. Information submitted tracks the case status through disposition. What do ICAC investigative officers do with the child porn caches they seize from defendams? ICAC Task Force investigative personnel follow their specific agency’s policies and procedures regarding evidence. OJJDP does not set these policies and procedures and cannot speak on behalf of each of the 61 ICAC Task Force Lead Agencies on this matter. Js any effort made to seize and/or trace profits made from the child porn that defendants are caught with? ‘OJIDP does not seize or trace the profits that defendants make through trading child pornography as OJJDP is not an investigative agency. Page 3 of 3 This completes the processing of your request by OJP. For your information, Congress excluded three discrete categories of law enforcement and national security records from the requirements of the FOIA. See 5 U.S.C. 552(c) (2006 & Supp. IV 2010). This response is limited to those records that are subject to the requirements of the FOIA. This is a standard notification that is given to all our requesters and should not be taken as an indication that excluded records do, or do not, exist. If you are dissatisfied with this response, you may administratively appeal by writing to the Director, Office of Information Policy (OIP), United States Department of Justice, Suite 11050, 1425 New York Avenue, N.W., Washington, D.C. 20530-0001. Your appeal must be received by OIP within sixty days from the date of this letter. Both the letter and the envelope should be clearly marked: “Freedom of Information Act Appeal.” Sincerely, G 67 4T j, heuer yO Khe Dorothy A!
