Color of Law,

When are those of authority truly held responsible for abuse of


authority, or breaking the law in which they are supposed to be carrying out?
Here is a short story of my own hardships due to the system violating my
rights, as well as breaking their own rules, and possibly committing a crime.
Violations of my 1st, 4th, and 14th amendments are violated leaving me
distraught and terrified of the ones who are supposed to be here to protect
and serve. I am in great turmoil in which i am unsure of where to turn, when
it's the local government bringing my life to uncertainty. When I break the
law, I get punished! When they break the law or tbeir own rules, what
happens to them?
All started on 07/17/15 when my attorney (Patricia O'Neil)failed to
carry out my request in which was only to mention the fact, that I by law (W.I.
s.s.973.155) should have had another almost 2 months of credit. A few days
later I filed a Request for Modification asking the Judge (Honorable Elliot
Levine) for the credit owed and because of violations on a furlough was
denied. Which if my attorney had fulfilled my wishes, I never should have had
because I would have served my sentence already. Therefore his denial of
sentence credit due to my violations and short sentence, abuses his authority
by not carrying out the law under (W.I. s.s.973.155) and granting the credit
due. So I am forced to serve almost 2 months more than my sentence. A few
months later after illegally searching my residence, by one, never receiving
permission to enter the residence, and two, never knocking on my bedroom
door before kicking it in. Officer reports state they had permission and
knocked on the door first, yet the investigator on stand admits neither of
those were truthfully stated. Then the same Judge who falsely imprisoned
signs a search warrant knowing that the facts and evidence used to obtain
the warrant were obtained by already searching. Only question he had for the
investigator was if I was in fact at the residence. Violating my 4th
amendment under the "Color of Law" which on the F.B.I. website
"http://www.fbi.gov/about-us/investigate/civilrights/color_of_law" states that
any person depriving an individual of his rights under "color of law" should be
accounted for. These actions led me having to be jailed and released on a
signature bond. When moving from my residence due to the illegal search,
officers tried locating me due to an arrest warrant for unpaid court costs
which was signed by the same Judge. This should have only been a civil
matter and in all my past cases this is the only case in which this occurs.
Furthermore, I was pulled over while on bond because of the warrant being
executed by the officers involved in illegally searching my residence. Had
there had never been acts violating my rights never would have known my
face. After being arrested for bail jumping and O.A.R. I was placed in jail with
my belief of excessive bail due to the fact we are innocent until proven guilty.

After a few weeks I took a plea to 6 months probation or 6 months E.M. I was
sentenced to 2 years of probation. Yet, The D.A. admitted in first place to my
first attorney that she should never have filed the criminal complaint in which
included possession charged after illegally searching my residence. I felt I had
been punished enough and keep getting punished due to a series of events
obviously to deprive me of my life, liberty, and equality. I took a plea in fear
of the system doing further harm if I were to contest these facts. Thereby,
violating my right of due process by, being on probation stemming from an
illegal search and seizure in the first place. Still under even greater turmoil, I
stride to stand up for my own rights and seek the peoples attention in order
to see our system and how it fails the community by deminishing the
confidence of the public. The preamble of the Code of Judicial Conduct even
states, "Our legal system is based on the principle that an independent, fair
and competent judiciary will interpret and apply the laws that govern us."
Apply the laws in which were never followed under 973.155 to begin. SCR
60.03 (1) A judge shall respect and comply with the law and shall act at all
times in a manner that promotes public confidence in the integrity and
impartiality of the judiciary. SCR 60.04 (e) A judge shall perform judicial
duties without bias or prejudice. A judge may not, in the performance of
judicial duties, by words or conduct, manifest bias or prejudice, including bias
or prejudice based upon race, gender, religion, national origin, disability, age,
sexual orientation or socioeconomic status, and may not knowingly permit
staff, court officials and others subject to the judge's direction and control to
do so.
The fact is, I'm a lower class American who is in fear of being
deprived of my rights therefore never receiving a fair and equal opportunity
to live life without judgment or bias conclusions due to my past. If I'm subject
to penalty of law, why aren't the one's whom we have given powers to,
subject to the same? Where is Fairness? Where is Equality? Where is Life?
Where is Liberty? Where is Justice? When are the wrongs done to the lower
class righted?
