PETITIONER'S RESPONSE TO RESPONDENT'S
MOTION TO RECOVER APPELLATE COSTS FROM PLAINTIFF

Matthew Chan as Respondent, now replies to "Petitioner's Response to Respondent's


Motion to Recover Appellate Costs" as follows:
Respondent disputes and challenges the claim and assertion that Petitioner has
transmitted the amount of $379.54 due to him. Respondent acknowledges receiving from the
Petitioner an undeposited Western Union money order (to an unnamed payee) via U.S. Mail in
the amount of $379.53 (Exhibit A). Respondent does not yet know if the money order is, in fact,
valid payment because he has not yet deposited or redeemed the incomplete payment.
Respondent also does not know whether Petitioner made an unintentional clerical error or
whether it was a deliberate act to withhold the .01 payment.
Regardless of the reason for Petitioner's incomplete payment to Respondent, Respondent
recognizes the shortage as a "de minimus" amount. Out of respect and consideration for the
Court's resources, Respondent shall accept and deposit Petitioner's incomplete money order
payment of $379.53 to settle the matter of the Motion to Recover Respondent's Appellate costs.
