In the application, it has been alleged that the applicant/

accusedhasbeenfalselyimplicatedinthepresentcaseandhehasnothing
todowiththeallegedmurder. Itissubmittedthatuncle(tau) ofthe
applicanthasexpiredon3rdMay2015andtehrviofhisuncleisscheduled
on13.05.2015.Itisfurthersubmittedthat applicant/accusedbeingthe
eldestsoninthefamilyisverymuchrequiredinordertoperformlastrites
of his deceased uncle as per custom. It is, therefore, prayed that the
applicant/accusedbereleasedoninterimbailforaperiodof15days.
Ld. Addl. P.P. for the State has strongly opposed the bail
applicationoftheapplicantontheallegationslevelleduponhim.Ithas

dismissed.
Inthepresentcaseapplicantalongwithothercoaccusedhas
been chargesheeted and being tried for the offences under Section
302/34IPC.Accusationagainsttheapplicantisthathealongwithhisco
accusedhadcommittedmurderononRahulGulia.
Aspertheverificationreport,familyofdeceaseduncleofthe
applicantwasresidingseparatelyandthedeceaseduncleoftheapplicant
hashisownsonagedabout42yearsandthereareothermemberinthe
familyofdeceasedwhocandotheritualsofdeath.
Keeping inviewthereportsubmittedbytheI.O.,Iamnot

On 07.08.2011, I was posted as HC in Special Staff Outer

District,Delhi.OnthatdayIwaspresentinmyoffice. Atabout10.00
amonesecretinformercameintheofficeofSpecialStaffandinformed
methatonepersonnamelySatish@Kalawhohadfiredonthepolice
partynearTikriVillageandwhoiswantedinthatcasewouldcameat
DDA Flats, Sector A5, Narela to meet his associates. I shared the
informationwiththeSeniorOfficersnamelyInspectorPuranPant.On
thedirectionofInspectorPuranPant,Ifoundaraidingpartyconsisting
ofSIMukesh,HCNarender,HCNaresh,Ct.Krishan,Ct.Kuldeep,Ct.
AmitandCt.Praveen.Ibriefthesecretinformationtothemembersof
raidingpartyandmemberoftheraidingpartyalongwithsecretinformer
reached at Sector A5, Narela. At about 11.30 am, secret informer
pointedouttowardsonepersonwhowascomingfromthesideofNorth.
PriortothisIrequestedfourfivepublicpersontojointheinvestigation
butnone had agreedto jointhe investigationand they left thespot
withoutdisclosingtheirnameandtheirparticulars.
On the pointing of secret informer that person was
overpowered with the help of Ct. Kuldeep and Ct. Krishan. On
interrogationthatpersondisclosehisnameSatish@Kala.Atthisstage
witnesshaspointedouttowardsoneaccusedwhosenameisMahesh
againsaid,whenwitnesshaspointedouttowardsthepersonbyfinger
he told the accused is standing at 3rd number witness has correctly
identified the accused Satish @ Kala. Thereafter, accused was

interrogated and he was arrested u/s 41.1(c)Cr.PC same is already

exhibited as Ex.PW20/A1 which bears my signatures at point C.
Thereafter, accused had made his disclosed statement same is
Ex.PW20/A2whichbearsmysignatureatpointC.Thereafter,Iprepared
a Kalendra against accused Satish @ Kala U/s 41.1(C)Cr.PC same is
alreadyexhibitedasEx.PW20/Awhich bearsmysignatureatpoint A.
Thereafter, I alongwith the police party and accused went to SGM
Hospitalwhereaccusedwasgotmedically examinedandonthevery
samedayaccusedwasproducedbeforethecourtconcerned.

Crossexaminationisdeferredatrequestofallaccusedpersonsastheir
