Letter from Derek Lee, M.P. to Dept.

of Justice

Item 5

January 27, 2010 Ms. Carolyn Kobernick Assistant Deputy Minister Justice Canada 284 Wellington Street Ottawa, Ontario K1A 0H8 Dear Ms. Kobernick, RE: Powers to Send for Persons, Papers and Records I have had the opportunity to read your letter of December 9, 2009 to Robert Walsh outlining the position of the Department of Justice on the powers of the House to send for persons, papers and records. There may have been some misunderstanding of the provisions of parliamentary law which would govern the subpoena powers of our House and its Standing Committees. I invite you to review same and reconsider the Department’s position before the House resumes next. My office would be pleased to assist yours with any reference materials, should you require same in the interim. Yours truly, [ORIGINAL SIGNED BY] Derek Lee, MP cc: Robert Walsh, Law Clerk and Parliamentary Counsel Hon. Ujjal Dosanjh, MP Hon. Robert Nicholson, Minister of Justice
