EffectiveOctober1,2015registeredmedicalmarijuanadispensariesmayselllimitedmarijuana
products(seeds,driedleavesandflowers,andimmaturemarijuanaplants).Theseproductsmaybe
soldonlytoindividuals21yearsorolderaftertheirageontheirgovernmentissuedIDhasbeen
verified.DispensariesmustoperateinaccordancewithOAR3330081000through3330081502;OAR
3330081500to1502willbereleasedonorbeforeSeptember24,2015.
MedicalmarijuanadispensariesmustnotifytheMedicalMarijuanaDispensaryProgram5ormoredays
beforestartingretailsalesinordertoselllimitedretailmarijuanaproducts.OnorbeforeSeptember
24,2015,aformwillbeavailableatmmj.oregon.gov.
Ifadispensaryislocatedinacityorcountythathasadoptedanordinanceprohibitingretailsalesor
earlyretailsalesofmarijuana,thedispensaryisnoteligibletoparticipateinearlysalesoflimited
marijuanaproducts.Foralistofcitiesandcountiesthathaveoptedout,pleaseseetheprograms
website:mmj.oregon.gov.
Theuseofdeliveryorcourierservicesisnotallowed.
Ifyouareplanningonchangingyourfloorplan,perOAR3330081080youarerequiredtonotifythe
Authoritywithin10calendardaysofanychanges.
Acopyofthefinalrulesregardingearlysales,thenotificationform,andinformationonwhereto
downloadtherequiredpostersareexpectedtobereleasedonSeptember24th,2015.Anemail
notificationwillbesentwhenthisinformationisavailable.

NewGeneralRequirements:

Onlyonequarterounceofdriedleavesandflowermaybepurchasedbyaretailcustomerin
oneday.Thereisnolimitonthenumberoramountofseedsthatcanbesoldtoacustomer.

Amedicalmarijuanadispensarymayonlysell4immaturemarijuanaplantstothesame
individualbetweenOctober1,2015andDecember31,2016.

Concentrates,extracts,edibles,topicalsandothermarijuanaproductsmayonlybesoldto
OMMPpatientsandcaregivers.

Freegiveaways,samplesorotherwisegivingorsharingmarijuanaproductsotherthanthe
limitedmarijuanaproductslistedabove(concentrates,extracts,edibles,topicalsorother
marijuanaproducts)toretailcustomersisnotallowedinsideoroutsideofthedispensary.

EachretailcustomersvalidgovernmentissuedIDmustbecheckedtoensurethatthe
individualis21orolderbeforeentryintothedispensaryandbeforeapurchaseismade.

Adispensarymustcollectataxof25%onalllimitedretailmarijuanaproductsalesstarting
January4,2016underrulestobeadoptedbytheDepartmentofRevenue.

RequirementsforDocumentationofTransactions:

Adispensaryisnotrequiredtodocumentthenameoftheretailcustomertowhomalimited
marijuanaproductwassold.

Adispensarymustdevelopawrittenpolicythatspecificallyoutlinesthestepsitwilltaketo
ensurethatnomorethantheallowedamountofretailmarijuanaproductissoldtooneperson
inaday.

RequiredSignageandInformationtobeDistributed:
Aregistereddispensarymustposttheapplicablesigns,inbold,80pointTimesNewRomantypefaceand
affixedtotheexteriorofthedispensaryinaconspicuouslocationthatcanbeeasilyseenbythepublic
fromoutsidethedispensaryatanypointofpublicentry.

If a dispensary is only transferring marijuana and immature plants to OMMP patients and
caregivers,thedispensarymustpostasignthatreads:
"MedicalMarijuanaPatientsOnly"

IfadispensaryhasproperlynotifiedtheAuthoritythatitintendstoselllimitedmarijuanaretail
products,thedispensarymustpostsignsthatread:
"MedicalMarijuanaPatientsandPersons21andOlderPermitted"
and
NOPERSONUNDER21PERMITTEDONTHEPREMISESWITHOUTANOMMPCARD.

AregistereddispensarythathasproperlynotifiedtheAuthoritythatitintendstoselllimitedmarijuana
retailproductsmustalso:

Distributetoeachindividualatthetimeofsale,aMarijuanaInformationCard,prescribedby
theAuthority,measuring3.5incheshighby5incheslongthatcanbedownloadedat
www.healthoregon.org/marijuanaonorbeforeSeptember24,2015.

ViolationsandEnforcement:
Anydispensarythatisfoundtobeviolatinganyofthenewearlyretailsalesruleswillbeprohibited
fromcontinuingtoselllimitedretailmarijuanaproductstoindividuals.Inaddition,adispensarys
registrationmaybesuspendedorrevoked.
MedicaldispensarieswillnotbeabletoselllimitedretailmarijuanaproductsafterDecember31,2016.
