SEC. 2. DEFINITIONS.

In this Act:

(1) A
BANDONED HARDROCK MINE STATE
.—The
3
term ‘‘abandoned hardrock mine State’’ means each
4
of the States of Alaska, Arizona, California, Colo-
5
rado, Idaho, Montana, Nevada, New Mexico, North
6
Dakota, Oregon, South Dakota, Utah, Washington,
7
and Wyoming.

(2) A
PPLICANT
.—The term ‘‘applicant’’ means
1
any person that applies for—
2
(A) a permit under this Act; or
3
(B) a modification to, or a renewal of, a
4
permit issued under this Act.
5
(3) B
ENEFICIATION
.—The term ‘‘beneficiation’’
6
means—
7
(A) the crushing and grinding of locatable
8
mineral ore; and
9
(B) any processes that are employed to
10
free the mineral from other constituents, includ-
11
ing physical and chemical separation tech-
12
niques.

(4) C
ASUAL USE
.—
14
(A) I
N GENERAL
.—The term ‘‘casual use’’
15
means mineral activities that ordinarily result
16
in no or negligible disturbance of Federal land
17
or resources.

(B) I
NCLUSIONS
.—The term ‘‘casual use’’
19
includes the collection of geochemical, rock, soil,
20
or mineral specimens using hand tools, hand
21
panning, or nonmotorized sluicing.

(C) E
XCLUSIONS
.—The term ‘‘casual use’’

does not include—
