AFFIDAVIT - COMPLAINT
I am SP01 Nilo Bontres Cabansl, members of the Philippine National Police D m ^ u .
assigned at tho Police Station 8 of Bagulo City, do hereby depose and state THAT:
1. That I am a momber of the Baguio City Police Team who conducted a buy-bust
operation at Brgy. Magsaysay .Baguio city_, together with the Philippine Druo
Enforcement Agency (PDEA).
2. Said operation stemmed from a report of our confidential informant Rolex Jurister
Oawaton for violation of Section 5 and 11 Article II of Republic Act No. 9165 (RA
9165) or the Comprehensive Dangerous Drugs Act of 2002. which was referred to
our office by the informant himself against JUANCHO DELA CRUZ, 28 years old,
Single, Filipino, and residing at 666 Upper Quarry, Baguio City.
3. The team conducted a quick surveillance, on November 8, 2015 to ascertain the
truthfulness of the report made by Dawaton about DELA CRUZ* alleged drugrelated activities, we planned a buy-bust operation.
4. At around 3:30 p.m. on November 10, 2015, SP01 Leslie Raguindin and I, together
with Dawaton and the PDEA proceeded to Brgy. Magsaysay .Baguio city , to
conduct a buy-bust operation.
5. Upon reaching Brgy. Magsaysay .Baguio city , we immediately spotted Juancho
Dela Cruz about 8 meters away from our position, selling dry goods in his stall,
just very near to his house.
6. I, who acted as the poseur-buyer and with a one thousand peso bill (Php1,000.00)
bearing Serial No. 9802073_ (Annex A) approached DELA CRUZ.
7. I pretended to buy kitchcn utensils and said the secret code "I will buy Magic
Sarap" which is alleged to be the phrase used by customers to refer to a 0.25
gram of methamphetamine hydrochloride, commonly known as shabu.
8. As I handed the marked one thousand peso bill to DELA CRUZ, he latter in turn
handed to him a small plastic sachet containing white crystalline substance
believed to be shabu.
9. At that immediate instant,! executed the pre-arranged signal, which is to raise his

10. In view of the arrest, wt hav..- recovered the following items:

disposition.

13 Upon reaching the police station, OELA CRUZ was apprised of his constitutional
right* using the dialect, and made sure he understood them.
14. in the same date at around 5:00 p.m., OELA CRUZ was brought to the PNP Crime
Laboratory to got tested for the presence of Bright Yellow Ultraviolet Fluorescent
powder on his palm, which would indicate that he has indeed received the one
thousand peso bill marked money.
15. At around 5:15 p.m. the PNP Crime Laboratory Group issued a report with
Identification No. 123456 (Annex C) that revealed OELA CRUZ w a s POSITIVE for
the presence of Bright Yellow Ultraviolet Fluorescent powder on both palm and
right dorsal portion of the hands.
16. At around 6 p m on the same day, the recovered 0.50 grams of white crystalline
powder was also brought to the Forensic Chemist of the Philippine National Police
(PNP) Crime Laboratory to confirm its classification.
17. On November 14, 2015, the Forensic Chemist of the Philippine National Police
(PNP) Crime Laboratory issued a report with Identification No. 123456(ANNEX O),
identifying the 0.50 grams of white crystalline powder as a dangerous drug known
as methamphetamine hydrochloride or shabu.
I executed this joint affidavit to attest the truthfulness of the foregoing facts and to
support the filing of Criminal Cases against J U A N C H O OELA C R U Z for violations of
Section 5 and 11 Article II of Republic Act (R.A.) No. 9 1 6 5 (the Comprehensive
Dangerous Drugs Act of 2002).

11. DELA CRUZ was immediately handcuffed and was brought to the Police Station 8
of Baguio City together with the recovered evidences for booking and proper
disposition.
12. Upon reaching the police station, DELA CRUZ was apprised of his constitutional
rights using the dialect, and made sure he understood them.
13. The seized items were marked for physical inventory and photographed in the
presence of Juancho Dela Cruz, member of the media Faye Makiling, a
representative from the Department of Justice Atty. Arra Apuan, and Barangay
Captain Bevlenne Malateo together with Barangay Kagawad Azell Aberln. They
were required to sign the copies of the inventory and each were given a copy
thereof.
14. In the same date at around 5:00 p.m., DELA CRUZ was brought to the PNP Crime
Laboratory to get tested for the presence of Bright Yellow Ultraviolet Fluorescent
powder on his palm, which would indicate that he has indeed received the one
hundred peso bill marked money.

15. At around 5:15 p.m. the PNP Crime Laboratory Group issued a report w i ^
Identification No. 0210-02-02 (Annex C) that revealed DELA CRUZ was POSH

for the presence of Bright Yellow Ultraviolet Fluorescent powder on both palm

and right dorsal portion of the hands.
16. In the same day, the recovered 0.25 grams of white crystalline powder was also
brought to the Forensic Chemist of the Philippine National Police (PNP) Crime
Laboratory to confirm its classification.
17. On November 14, 2015, the Forensic Chemist of the Philippine National Police
(PNP) Crime Laboratory issued a report with Identification No. 00-220-01 (ANNEX
0), identifying the 0.25 grams of white crystalline powder as a dangerous drug
known as methamphetamine hydrochloride or shabu.
I executed this joint affidavit to attest the truthfulness of the foregoing facts and to
support the filing of Criminal Cases against JUANCHO DELA CRUZ for violations of
Section 5 and 11 Article II of Republic Act (R.A.) No. 9165 (the Comprehensive
Dangerous Drugs Act of 2002).
