New proposal made for former theater site


The Menomonee Falls Plan
Commission got a first look
Jan. 5 at a new conceptual proposal for land at the northeast
corner of Lisbon and Pilgrim
Roads.
The property had been the
location of a drive-in theater
from 1950 to 1986 and has been
owned by the Brookfield
Assembly of God Church since
1988.
During 2015, HSI Properties
had requested the land use for
the site be changed from the
Institutional to the Medium
Density
Residential
and
Commercial land use classifications to allow for a proposed
development that included 10
single family homes, 174 apartments in 12 buildings, and a
commercial development at the
corner of Pilgrim and Lisbon
roads. However, that request
was rejected by the Village
Board Aug. 17. The item was
returned
to
the
Plan
Commission, at which point HSI
requested the matter be tabled.
HSI has submitted a new

proposal, asking the land use


for the site be changed to a
medium density residential
classification. Ryan Schultz of
HSI Properties said the new
proposal calls for 77 single family lots. The average lot size
under the conceptual proposal
will be 13,000 square feet, with
some of the lots as large as one
acre.
"There's still a lot of challenges to this property,"
Schultz said, citing ground
water and bedrock issues on
the property. He said an engineering firm would be hired to
study the site and examine the
feasibility for single family
homes in specific areas of the
site.
He said while the company
"feels good" about the layout,
there will still need to be engineering work that will need to
take place. He added that HSI
"have been talking with at least
one very reputable builder on
what is the best way to lay out
these lots to maximize the variety of different types of house

style and architecture.


A public hearing will be
held on the request at the Feb.
2 Plan Commission meeting.
A rezoning request was also
on the board agenda for the
same property. The rezoning
was tabled until the Feb. 2 commission meeting.
In another matter, the commission approved an industrial
for Nova-Kem LLC to occupy a
building at W141 N9501
Fountain Blvd. According to
information from village staff,
the company produces high
purity chemicals used in memory chips and other devices. The
company has a manufacturing
plant in Georgia and a packaging facility in Germantown."
According to the applicant,
Nova-Kem has developed new
products but lacks the ability
for large scale production at
their current facilities," the village staff report stated.
Nova-Kem will build out the
current facility in 2016 and
begin production in 2017.

Village to examine changes on polystructure regulations


The Menomonee Falls Village Board
will meet as a Committee of the Whole
to review options for changing the
ways polystructures are regulated by
the village.
The item was discussed by the
General Government Committee Jan. 4.
The item was placed on the committee
agenda at the request of trustees
Bonnie Lemmer and David Glasgow.
A polystructure is defined by the
village code as "an enclosure having
a frame of steel or other materials
which is covered with plastic,
polyurethane, vinyl, canvas, or other
flexible
sheeting
material."
Polystructures are currently allowed

Village Manager Manager Mark
Fitzgerald said the current village ordinance on polystructures "was meant to
prevent as many of these as possible,
but it's the wrong approach."
Fitzgerald said conditional use is
meant to establish factors for mitigation, but suggested a zoning permitting process instead that would be similar to people installing sheds in their
back yard. Fitzgerald said a "small percentage of properties" in the village
have polystructures.
Trustee Bonnie Lemmer said polystructures deteriorate over time and
their appearance worsens, which is

why something should be done.


"If we want to maintain our neighborhoods, if we want our neighborhoods to be the kind that we want to
draw people to move in, I think we
have to maintain the values. Putting
some regulation on these as a permit
should be done," Lemmer said.
Trustee Steve Raymonds said he
could see a safety issue at hand if the
plastic structure flies away and only a
steel structure is left, which would also
be a nuisance issue.
Trustee Chris Smolik questioned the
need for the regulations.
"Where does this end? Are we start
regulating garden gnomes and pink

asked.
"If you lived next door to one and
it affected the value of your house, it
would bother you if you saw this part
floating around and stuff like that,"
Lemmer replied.
After further discussion, the committee agreed to send the matter to a
Village Board committee of the whole
meeting to discuss having polystructures regulated through a zoning permitting process instead of the current
conditional use process.

The bail for a former educator
accused of having sex with a child
under age 18 was reduced during an
appearance in Waukesha County Circuit
Court Jan. 4.
April M. Novak, a former reading
interventionist at Menomonee Falls
High School, is charged with 12 counts
of sexual assault of a child by school
staff in alleged incidents that occurred

$10,000 fine, six years in jail, or both.
During an appearance in court Jan.
4, Novak waived her right to a preliminary hearing. Defense attorney Michael
Hart entered a not guilty plea on behalf
of Novak. Bail had been set at $100,000
for Novak after she was charged Dec.
22. Hart requested that the bail be
reduced. He noted that Novak had not
engaged in any criminal conduct previously and had earned a master's degree.
"I don't, under any analysis, understand the $100,000. I believe that not
only to be excessive but grossly excessive," Hart said. "There was no argument or evidence presented at the time
of the initial appearance that Ms. Novak
was at risk for flight."
He added that Novak "has some
mental health issues that require treatment. While at a bare minimum she is
receiving (medication) at the county
jail, she is certainly is not receiving the
amount of care and treatment we as a
system,would hope people in her situation, would receive."
He said that a cash bail is appropriated and requested bail be reduced to
$10,000.

Szczupakiewicz said "a substantial cash
bail is appropriate given the nature of
the charges and the number of
charges.
Szczupkiewicz added that during the
initial hearing there were statements
presented in which Novak said to officers she had thoughts of crashing her
car with her children in the vehicle. In
response, Hart noted one of the conditions included Novak not having unsupervised contact with her two children.
Court Commissioner Thomas Pieper
reduced the bail to a $10,000 cash bail
and a $25,000 signature bond.
Conditions that she not have contact
with the victim or students at
Menomonee Falls High School or unsupervised contact with anyone under age
18 remain in place.
Afterward, Hart said he hoped
Novak to make the bail "to get her the
help she needs. She's a sick woman,"
adding that his client had mental
health issues.
The next hearing on the matter will
be before Circuit Judge Ralph Ramirez
at 10:30 a.m. Jan. 22.

Menomonee Falls Police Blotter


The following report was taken from
records at the Menomonee Falls Police
Department.
Bail jumping
A male subject was taken into custody for bail jumping at 2:59 a.m. Dec.
12 after police responded to the report
of an altercation in the 15000 block of
Main Street. The aforementioned male
was found to be intoxicated which was
a violation of his probation terms.
Battery
A 46-year-old man was arrested for
domestic violence/battery and domestic
violence/disorderly conduct at 1:59
a.m. Dec. 20 after a physical altercation
with his wife and pregnant daughter at
a residence in the 12000 block of Grove
Street. The man reportedly returned
home intoxicated and then got into an
argument with the women, shoving his

wife and pulling his daughters hair. The


subject was placed in jail.
Drug violations
A 20-year-old woman was arrested
for possession of drug paraphernalia
Dec. 15 after police responded to a 911
open line call at her residence in the
18000 block of Pleasant View Drive. The
subjects mother reported that her
daughter was under the influence of
drugs. The 20-year-old admitted to
using heroin intravenously, and multiple syringes and other drug-related
items were located in the womans bedroom. The subject was medically cleared
at Community Memorial Hospital and
then placed in jail.
A 22-year-old Milwaukee man was
cited for possession of marijuana at
2:08 a.m. Dec. 18 after he was stopped
for speeding and expired registration at
Pilgrim Road and Appleton Avenue.

Operating while intoxicated


A 43-year-old man was arrested for
operating
while
intoxicated-first
offense at 3:04 a.m. Dec. 13 following a
stop sign violation on Fond du Lac
Avenue.
A 30-year-old Lake Geneva man
was arrested for operating while intoxicated-first offense at 4:02 a.m. Dec. 19
following a traffic stop at Highway 41
and County Line Road.
A 33-year-old woman was taken
into custody for operating while intoxicated-second offense at 12:21 a.m. Dec.
20 after performing an unsafe lane
deviation near Highway 41 and County
Line Road.
Retail theft
An unknown subject stole eight
250-foot rolls of electrical wire valued
at a total of $382.16 from The Home
Depot, N94 W18375 Thunder Ridge

Road, Dec. 14.


Warrants
A 36-year-old Milwaukee man was
taken into custody on a Milwaukee
County Sheriffs Office warrant at 6:18
p.m. Dec. 14 in the W16000 block of
Menomonee Avenue.
A 30-year-old Milwaukee man was
taken into custody on a Greenfield warrant at 7:16 a.m. Dec. 14 in the 19000
block of Silver Spring Drive.
A 29-year-old Milwaukee man was
taken into custody on a Wisconsin
Rapids warrant at 8:05 p.m. Dec. 18 following a traffic stop at Appleton
Avenue and Northpoint Drive.
A 32-year-old Wauwatosa man was
taken into custody on a Milwaukee
County warrant and a Germantown warrant Dec. 19 following a traffic stop at
Good Hope Road and Appleton Avenue.

Residents warned of scam


The village of Menomonee Falls last
week alerted residents to a scam involving payment of utility bills.
In an alert sent out over the village's Twitter feed and posted on the
village's Web site, the village said that
several customers had received calls
demanding payment for overdue water
utility bills.
"These calls are fraudulent, as the
utility will not call demanding payment
for unpaid utility bills. The caller also

requested the customers bank account


number, which our utility would not
do," the village stated.
Anyone who receives a call like this
is asked to record the call information
and contact the Menomonee Falls Police
Department at (262) 532-8700.
"Citizens should remember that the
Menomonee Falls Water Utility will not
call your home or business demanding
payment," the village stated.

2016 Young at Art: Student Merit
Exhibition reception Jan. 11
The Art Guild of Menomonee Falls,
along with MFHS National Art Honor
Society, proudly presents an art show by
the young artists in our community.
Each student piece in the exhibition was
chosen by the students art instructor for
its outstanding merit. The pieces on display will range from drawings, paintings,
collage, metals to sculpture.
The Guild and MFHS will be hosting a
free opening reception with the young
artists present, on January 11, 6:30 8

January is National Radon Action Month


Wisconsin health officials, as part of
National Radon Action Month, are
encouraging homeowners to check their
home's radon levels because exposure to
radioactive radon gas is the leading
cause of lung cancer among non-smokers nationwide.
Radon is an odorless radioactive gas
that is naturally present in the ground
and can enter buildings through their
foundations. Both old and newer homes
can be susceptible to radon. Between 5
and 10 percent of Wisconsin homes
have elevated airborne concentrations
on the main living level where people
spend the most time, according to state
data.
An estimated 20,000 lung cancer
deaths are caused by radon annually
among non-smokers, according to
reports
by
the
Environmental
Protection Agency and the U.S. Surgeon
General.
Radon is an easily mitigated heath
risk. The small cost of the kit, available
either through the County or at your
local hardware store, is well worth the

peace of mind knowing that your home


and family are safe and healthy, stated Waukesha County Executive Paul
Farrow.
More than 60 radon mitigation contractors in Wisconsin are nationally certified and install highly effective soildepressurization radon control systems.

Few people in American history have
had as strong an impact on the United
States as Martin Luther King, Jr., the civil
rights leader who was slain in 1968 at the
age of 39. Through his message of nonviolence and civil disobedience as a means

King changed the lives of millions. Those

century after his death.
Though his death was tragic, King's
