AgenciesUnveilNewChesapeakeBayCleanupStrategy,NewGrowingGreenerAhead

After30yearsofworkthathaspreventedmillionsof
poundsofpollutantsfromreachingPennsylvanias
waterwaysandtheChesapeakeBay,theCommonwealth
continuestofaceimmensepressurefromtheU.S.
EnvironmentalProtectionAgencytoimprovewaterquality.
Inordertomeetthoseobligations,PennsylvaniaThursday
unveileda
comprehensivestrategytorebootthestates
efforts
toimprovewaterqualityintheCommonwealthand
theBay.
Thenewplan,developedjointlybythedepartmentsof
Agriculture,ConservationandNaturalResources,and
EnvironmentalProtection,aswellasthe
StateConservationCommission
bringsnewfocustothe
stateseffortstohelpprotecttheChesapeakeBaywhileemphasizingtheneedforbalanceand
resilience.
Thestrategyreliesonamixoftechnicalandfinancialassistanceforfarmers,technology,
expandeddatagathering,improvedprogramcoordinationandcapacityandonlywhen
necessarystrongerenforcementandcompliancemeasures.
ThisisanimportantissuetothefutureofagricultureinPennsylvaniaandthroughoutthe
watershed,andmustbemanagedtoachievethecoequalgoalsofhavingbothcleanwaterand
viablefarms,saidAgricultureSecretaryRussellRedding.Theagricultureindustryis
responsibleforcontributingthreequartersofthetotalnutrientreductionsexpectedofstatesby
2025.Thatsasizeablesum,andnosmalltask,butweknowtherearecountlessfarmerswhoare
doingtheirpart.PartoftheproblemisthatPennsylvaniaisnotgettingfullcreditfortheworkwe
aredoing.Thisplansetsouttorectifythat,plusgivethosefarmerswhoneedhelpor
encouragementtheincentivestoassistthem.Weallhavearolehereandagriculturestandsready
tobepartofthesolution.
PennsylvaniahasnotmettheEPAsrequirementstoreducewaterpollutionunderthe
requirementsoffederalcourtordersandregulations,saidDEPSecretaryJohnQuigley.The
Wolfadministrationisworkingtofocusandincreaseresourcesandtechnicalassistance,
reinvigoratepartnerships,andcreateacultureofcomplianceinprotectingPennsylvaniaswater
quality,andbyvirtueofthat,thequalityoftheChesapeakeBay.
Ofthemanybestmanagementpracticesthatimprovethequalityofwatersandhabitats
intheChesapeakeBaywatershed,thesinglebestmaybetherestorationofriparianforestbuffers

alongstreambankstoprovidecriticalbarriersbetweenpollutinglandscapesandreceiving
waterways,DCNRSecretaryCindyDunnsaid.Wearerenewingourfocusonincreasingforest
buffersinPennsylvaniabydevelopingacomprehensiveapproachtoprovidefunding,training,
andoutreachtofarmersandlandowners.
ThenewplanisinresponsetothefederalCleanWaterAct,courtordersandregulations
finalizedbytheU.S.EnvironmentalProtectionAgencyinDecember2010thatimposeatotal
maximumdailyload,orTMDL,thatrequirePennsylvaniatoreduceannualdischargesof
nitrogen,phosphorousandsedimententeringthebaywatershedinordertomeetwaterquality
standardsby2025.
Pennsylvaniawouldhavehadtoputpracticesonthegroundtoeliminate10million
poundsofnitrogenand212millionpoundsofsedimentfromgoingintoourriversandstreams
bytheendof2016tomeetthe2017milestones.
InJune2014,theU.S.EnvironmentalProtectionAgencyreportedPennsylvaniaexceeded
its2013ChesapeakeBaycleanupmilestoneforphosphorusby242,000pounds,butfellshortin
meetingthenitrogengoalby2millionpoundsandsedimentreductionmilestonebynearly116
millionpounds.
DEPSecretaryQuigleynoteda
2013studybyPennState
saidPennsylvaniawouldneed
toinvest$378.3millionayeartoimplementnonpointsourcebestmanagementpractices.
Currently,only$127.6million,combinedstateandfederalfunding,isnowavailable.
QuigleyalsosaidEPArecommendsinspecting10percentofthe33,610farms.In2014
DEPonlyinspected1.8percentofthesefarms,just592.
HenotedEPAisnowwithholding$3millionofChesapeakeBayrelatedfundingbecause
previousmilestoneshavenotbeenmet.
TheAdministrationscomprehensivestrategycentersaroundsixelements:
1.AddressingPollutantReductionDeficiencies
bymeetingtheEPAgoalsofinspecting10
percentoffarmsintheBaywatershedannually,withincreasedinspectionandcomplianceefforts
intheagriculturesectorusingexistingDEPandConservationDistrictstaff,andwithcontinued
DEPoutreachandprogramdevelopmentforurbanstormwatersystems.
2.FocusingonLocalWaterQualityImprovementandProtection
(LWQ)bylocatingand
quantifyingpreviouslyundocumentedBMPs,andputtingnewhighimpact,lowcostBMP
projectsonthegroundinwatershedsthatarecurrentlyimpairedbyagricultureorstormwaterby
shiftinganadditional15percentofavailablestatewidewaterqualityfunding($1,250,000)to
Baywork.
3.ImprovingReporting,RecordKeeping,andDataSystems
(RRKD)toprovidebetterand
moreaccessibledocumentationofprogressmadetowardPennsylvaniasrestorationeffort,
includingconsiderationofestablishingmandatoryreportingrequirementsfortheagriculture
sectorinplaceofsofarunsuccessfulvoluntaryreportingmeasures.
4.IdentifyingStrategicLegislative,ProgrammaticorRegulatoryChanges
(LPR)thatwill
givePennsylvaniatheadditionaltoolsandresourcesnecessarytomeetthe2025TotalMaximum
DailyLoad(TMDL)reductiongoals.
5.Establishinganew
ChesapeakeBayOffice

withinDEP
toassuretheproperdevelopment,
implementationandcoordinationoftheCommonwealthseffortsforrestorationofthe
ChesapeakeBay,andadministeringDEPsChesapeakeBayProgramgrant.
6.Obtainingadditionalresourcesforwaterqualityimprovement
byparticipatinginplanning
anewroundofGrowingGreenerfunding,whichwillhaveBaycomplianceasaprimarygoal,

potentiallymakingavailableseveralhundredmilliondollarstodevotetolocalwaterquality
issuesandultimatelyBaycompliance.
Inastrategypaperreleased
withtheannouncement,thereare12specificactions,
immediateresourcerequirementstobetakeinthenext18monthsand20longertermproposed
actionstoimprovewaterquality.
Reddingnotedtheadministrationhasbeenactivelyengagingstakeholdersasitdeveloped
thisplan,andithassoughtadditionalresourcesfromthefederalgovernment,suchasthroughthe
U.S.DepartmentofAgriculturesRegionalConservationPartnershipProgram.
TheadministrationhasbeenengagingwithEPA,conservationdistrictsandinstitutionsof
highereducation,includingPennStatesCollegeofAgriculturalSciencestodiscussthemost
effectivewaterqualityimprovementstrategies.
Theadministrationhasalsobeenworkingwithfarmorganizationstoassistincapturing
onthefarmdataofbestmanagementpracticesonfarmsthroughouttheChesapeakeBay
watershed.
CapturingthisdataisessentialtoPennsylvaniareceivingfullcreditintheEPAsmodel,
whichisusedtomeasureprogresstowardpollutionreductiongoals.
DCNRsBureauofForestrywillleadanefforttoworkwithnumerousagencies,partners
andlandownerstoexpandforestbuffersalongwaterwaysintheCommonwealth.
Between1985and2013,Pennsylvaniahasmadesignificantstrides,reducingyearly
nitrogenloadsbymorethan11.5millionpounds,phosphorousby1.46millionpounds,and
sedimentbynearly434millionpounds.
Thesereductionstheresultofmorethan$4billionbeingdirectedtowardChesapeake
Bayrestorationduringthatperiodthroughloanandgrantprogramsequatetoa25percent
reductioninphosphorous,asixpercentreductioninnitrogen,andanearly15percentreduction
insediment.
Despitethisprogress,achievementstodatehavebeendeemedinsufficientbytheEPAto
meetwaterqualityexpectations,asreportedbythefederalgovernmentsmostrecentinterim
evaluation,releasedinJune2015.
Accordingtothatassessment,Pennsylvaniaisontargettomeetits2017TMDLgoalfor
phosphorus,butsignificantlybehindtargetsfornitrogenandsedimentreductions.Excess
phosphorus,nitrogenandsedimentsaretheleadingcausesofbaydegradation,andPennsylvania
isoneofsixstatesobligedtoachievenutrientreductiongoals.
Thestatemustreducenitrogenloadsbyanother31.4millionpounds,phosphorousbyan
additionalonemillionpounds,andsedimentbyanother648millionpoundsbytheTMDLs
2025target.
BecauseofPennsylvaniaslackofattainmentinmeetinginterimgoals,lastmonth,the
EPAadvisedDEPthatitwaswithholding$2.9millioninfunding,andwillconsidertaking
additionalactionsthatincreasethefederalagencysroleininspections,permittingand
compliance,ifprogressislacking.
MorethanhalfofPennsylvaniaslandareadrainsintotheChesapeakeBay,withthe
SusquehannaRiverbeingthelargesttributaryinthewatershed.TheSusquehannaRiverprovides
90percentofthefreshwaterthatflowsintotheupperbayregionandhalfofthetotalflowinto
theentireestuary.

unveiledanewstrategy
forcleaningupitspolluted
waterways,andthe
ChesapeakeBay
FoundationPA
iscallingonleadersinHarrisburg
tomakethenecessaryinvestmentstoensureits
success.
"ThisnewplantocleanupPennsylvania'swater
containsallthebasic,fundamentalcomponents
necessarytoestablishtheframeworkforsuccess,"
saidHarryCampbell,CBF'sPennsylvania
ExecutiveDirector."Anyplanisonlyasgoodasits
implementation.RestoringPennsylvania'sriversand
streamsrequirestheresources,leadership,andcommitmentfromGov.TomWolfandthe
legislature.OnlythiswillgettheCommonwealthbackontracktowardmeetingitscleanwater
commitments."
In2010,theBaystatesandtheU.S.EnvironmentalProtectionAgencysetpollutionlimits
thatwouldrestorewaterqualityinlocalrivers,streams,andtheChesapeakeBay,andeachstate
developeditsownplantomeetthoselimits.Thiscameaftermorethan30yearsoffailed

restorationcommitments.
Thestatesalsomadetwoyearmilestonecommitmentstotakespecificactionstoensure
progresswasbeingmadetoachievethenecessarypollutionreductions.Thegoalistoimplement
60percentofpracticestorestorelocalwaterqualityintheCommonwealthby2017,and100
percentimplementationby2025.
"ThepeopleofPennsylvanianeed,deserve,andhavearighttocleanwater,"Campbell
said."ButtheDEPacknowledgesthatitalonecannotprovideandprotectcleanwatercalledfor
inthenewplanwithoutcritical,additionalresources."
Roughly19,000milesofriversandstreamsinPennsylvaniahavebeendamagedby
pollution.Effortstoreducenitrogenandsedimentpollutionfromagricultureandurbanpolluted
runoffremainofftrackbymillionsofpounds.DepartmentofEnvironmentalProtection
SecretaryJohnQuigleyhasacknowledged
thatthestatewillnotmeetits2017goal.
Thenewplanestablishessixessentialrecommendationscomprisinganumberof
immediateandlongertermactionsdesignedtogetPennsylvaniabackontrack.
"Thisplancallsforasignificantincreaseinthenumberoffarminspections,"Campbell
said."TheDEPestimatesonlyabout30percentoffarmsintheCommonwealtharecurrentlyin
compliancewithPennsylvania'sexistingcleanwaterlaws,someofwhichhavebeeninplacefor
decades.Moreinspectorsaresorelyneeded.Atcurrentstaffinglevels,itwouldtakealmost57
yearsforeachfarmtobeinspectedjustonce."
Intheplan,theDEPintendstoutilizeconservationdistrictstaffanditsownstaffto
accelerateitsinspectionratetomeettheEPArecommendationofinspecting10percentoffarms
annually.DEPinspectedlessthan2percentoffarmsin2014.
Thenewplanalsocallsforacceleratingtheplantingofstreamsidebuffers,themost
affordablesolutionforfilteringandreducingtheamountofharmfulrunoffofnitrogen,
phosphorus,andsedimentpollution.
Theplanalsoproposesessentialstepsandinnovationsnecessarytoaddressthe
challengesofpollutedrunofffromurban/suburbanareas,includingupdatedpermitrequirements
andimplementationplansbylocalgovernmentsandthedevelopmentofinnovativefinancing
opportunities.
"Payingforimplementationoftheplanrepresentsafundingchallenge,"Campbelladded.
AccordingtoaPennStatestudy,itwillcostnearly$380millionperyear,or$3.8billion
overthenext10years,toimplementjusttheagriculturalpracticesthatwouldgetPennsylvania
backontracktowarditscleanwatercommitmentsfor2025.
"Ifthisnewplanhasaweakness,itisinidentifyingsustainablefundingsources,"
Campbelladded."AnewGrowingGreenerinitiative(asmentionedintheplan)wouldbeadown
paymentforsuchefforts,butmoreresourceswillbeneeded."
Investingincleanwaterpaysdividends.Conservationpracticesnotonlyimprovewater
quality,butcanimprovefarmproductionandherdhealth,reducenuisancefloodingin
communities,improvehuntingandfishing,beautifyurbancenters,andevencleantheair.
A2014economicanalysisfoundthatfullyimplementingPennsylvania'scleanwater
planswillresultinanincreaseinthe
valueofnaturalbenefitsby$6.2billionannually
.
ThreatstohumanhealthandtheeconomyarerealconsequencesforPennsylvanianot
keepingupwithitscleanwatercommitments.Implementingthisnewplanmightalsoallowthe
KeystoneStatetoavoidfurtherrepercussionsfromEPA,whichhasalreadywithheldnearly$3
millioninfederalfundingfromtheCommonwealth.

"Itgoeswithoutsayingthatadequatefundingandtechnicalassistancearekeyaspectsfor
thesuccessofthisplan,"Campbelladded."ThisiswheretheGovernorandlegislaturemuststep
inandensurethattheCommonwealthlivesuptothecommitmentsitmadetofellow
Pennsylvanians."

PresidentWilliamC.Bakerandpartnersissuedthefollowing
statementTuesdayregardingtheirbriefcallingfortheU.S.SupremeCourttoletstandthelower
courtsrulingsonchallengestoBayrestoration.
Thatbrief,alongwithabrieffromtheU.S.EnvironmentalProtectionAgencywasfiled
Tuesday.JoiningCBFareCitizensforPennsylvaniasFuture,DefendersofWildlife,the
SouthernEnvironmentalLawCenter,theMidshoreRiverkeeper,andtheNationalWildlife
Federation.
InDecember,2010,theBayjurisdictionsandEPAissuedpollutionlimitsthat,if
achieved,wouldrestorewaterqualityinlocalrivers,streams,andtheChesapeakeBay.The
statesdevelopedindividualplanstoachievethoselimits,withagoalof60percent
implementationby2017and100percentby2025.
Inaddition,thestatescommittedtoevaluatingprogressandtakingspecificactionsin
twoyearincrementscalledmilestones.
Together,thelimits,plans,andmilestonesmakeuptheChesapeakeCleanWater
Blueprintandrepresentwhatmanyconsiderthemomentintimeforcleanwaterinthe
ChesapeakeBay.

AneconomicanalysiscommissionedbyCBFfoundthatachievingthepollutionlimits
wouldalsoreturn$22billionannuallyinnaturalbenefits.
Withinweeksofthe2010announcement,the
FarmBureauanditsallies
filedsuitin
federalcourtclaimingEPAoverreach.
AfterlosinginfederalDistrictCourt,theyappealedtothefederalThirdCircuitCourtof
Appeals.ThatcourtagreedwiththelowercourtandrejectedtheFarmBureausclaims.They
subsequentlyhaveappealedtotheSupremeCourt.
Mr.Bakersaid:
NoneoftheBaystatesortheDistrictofColumbiahavejoinedtheFarmBureauandits
allies.ThatshouldsendastrongmessagetotheU.SSupremeCourtthattherehasbeenno
overreachbyEPA.
JudgeSylviaRambo,whoheardtheinitialcasefoundthattheChesapeakeCleanWater
Blueprintwasamodelof"cooperativefederalism,"exactlywhattheCleanWaterActintended.
AunanimousdecisionbytheThirdCircuitCourtofAppealsfoundtheargumentsofthose
opposingtheBlueprintunpersuasive.
CBFbelievesthatthereisnoreasonfortheSupremeCourttotakethiscase.
NationalWildlifeFederationPresidentandCEO,CollinOMarasaid,The
sciencebasedChesapeakeBayBlueprintisessentialtokeepingthesixstatesandtheDistrictof
ColumbiaworkingtogethertowardsahealthyBay.TheChesapeake'sfish,crabsandother
wildlifecannotwaitanylonger.
JaneDavenport,seniorstaffattorneyatDefendersofWildlifesaid:"TheChesapeake
CleanWaterBlueprintwillprotectthewatersandwildlifeoftheBayandhelprestorethe
incredibleeconomicandrecreationalbenefitsthataclean,healthybaywillprovideforour
region.
LarrySchweiger,PennFuturepresidentandCEOsaid:Theimpactofpollutionon
waterwaysisnotlimitedbystateboundaries,soitisessentialthatthemultistate,sciencebased
plantocleanuptheChesapeakeBaythatisinplacenotbedisturbed.Importantly,
PennsylvanianswillbenefitnotonlyfromrestoringtheBay,butalsofromtheimprovementsin
localwaterqualitythatareessentialtopublichealthandrecreationintheKeystoneState.

KristinDavis,StaffAttorneyatSouthernEnvironmentalLawCentersaid:Thecourts
haverecognizedtheEPAsauthoritytodevelopacleanupplanforthisnationaltreasure.We
believetheSupremeCourtwilldenythispetition,findingitunnecessarytorevisittheissue.
TimJunkin,Founder/Advisor,MidshoreRiverkeeperConservancysaid:Thereisagreat
dealofpositivemomentumbuildingontheEasternShoretowardcleanwaterstewardship.
Countiesaregettinginvolved,spendingmoney,andputtingprojectsontheground.The
communityisgettinginvolvedandvolunteeringtocleanupourlocalriversandstreams.I
attributemuchofthistotheCleanWaterBlueprintthatthestatesandEPAagreedto.Itwouldbe
acatastropheifafewspecialinterestsderailedthismomentum.

Wolfsaidtheplanisdesignedtoprotecttheenvironmentandpublichealth,reduce
climatechange,andhelpbusinessesreducethewasteofavaluableproductbyreducingmethane
leaksandemissionsfromnaturalgaswellsites,processingfacilities,compressorstationsand
alongpipelines.
PennsylvaniaisthesecondlargestproducerofnaturalgasinthenationbehindTexas,
saidGov.Wolf.Weareuniquelypositionedtobeanationalleaderinaddressingclimate
changewhilesupportingandensuringresponsibleenergydevelopment,creatingnewjobs,and
protectingpublichealthandourenvironment.ThesearecommonsensestepsthatPennsylvania
cantaketoprotectourairandreducewasteforindustry.Thebestcompaniesunderstandthe
businesscaseforreducingmethaneleaks,aswhatdoesntleakintotheatmospherecanbeused
forenergyproduction.
Methane,theprimarycomponentofnaturalgas,hasbeenidentifiedbytheU.S.
EnvironmentalProtectionAgencyasthesecondmostprevalentgreenhousegasemittedinthe
UnitedStatesfromhumanactivities.Ithasmorethan28to36timesmorewarmingpowerthan
carbondioxide,accordingtodatafromthefederalgovernment.
WithfederalestimatesthatthenaturalgasandoilindustriesaccountforaquarterofU.S.
methaneemissions,reducingmethaneleaksfromtheoilandgassectorisoneoftheessential
stepsneededforgovernmenttoworkwithindustrytoreduceglobalgreenhousegasemissions
andreducetheimpactsofclimatechange.
Industryreportedmorethan5millionmcf(thousandcubicfeet)almost115,000tons
ofmethaneemissionsfromunconventionalwellsandmidstreamoperationsinPennsylvaniain
2014.Thisisconsideredalowestimate,sincefugitiveemissionsaredifficulttoquantify.

Asthebasisforourmethanestrategy,weveidentifiedmeasuresthatthebestcompanies
intheindustryarealreadyemploying,orthatarerequiredbytheFederalgovernment,orother
states.Thesemeasureswillpayforthemselvesinrecoveringsaleableproductthatisotherwise
lost,saidDepartmentofEnvironmentalProtectionSecretaryJohnQuigley.
Pennsylvaniawillreduceemissionsduringdevelopmentandgasproduction,processing,
andtransmissionbyrequiringleakdetectionandrepair(LDAR)measures,efficiencyupgrades
forequipment,improvedprocesses,implementationofbestpractices,andmorefrequentuseof
leaksensingtechnologies.
Thefourpointplan:
Toreduceleaksatnewunconventionalnaturalgaswellpads,DEPwilldevelopanewgeneral
permitforoilandgasexploration,development,andproductionfacilities,requiringBest
AvailableTechnology(BAT)forequipmentandprocesses,betterrecordkeeping,andquarterly
monitoringinspections.
Toreduceleaksatnewcompressorstationsandprocessingfacilities,DEPwillreviseits
currentgeneralpermit,updatingbestavailabletechnologyrequirementsandapplyingmore
stringentLDAR,otherrequirementstominimizeleaks.Anewconditionwillrequiretheuseof
Tier4dieselenginesthatreduceemissionsofparticulatematterandnitrousoxidebyabout90%.
Toreduceleaksatexistingoilandnaturalgasfacilities,DEPwilldeveloparegulationfor
existingsourcesforconsiderationbytheEnvironmentalQualityBoard.
Toreduceemissionsalongproduction,gathering,transmissionanddistributionlines,DEP
willestablishbestmanagementpractices,includingleakdetectionandrepairprograms.

Actiontoreduceoilandgasemissionsisbuilding.InAugust2015,theU.S.
EnvironmentalProtectionAgencyproposedthefirstnationallimitsofmethaneemissionsfrom
theoilandgasindustry,followingsimilarstepstakeninColorado,Wyoming,Ohioand
California.
EPAsrulestargetmethanereductionsfromfutureoilandgasoperationsanddonot
addressemissionsfromoilandgasfacilitiesalreadyinoperation.Pennsylvaniasproposal,if
turnedintoregulation,willhelpreduceemissionsfromthethousandsofoilandgasfacilities
alreadyinoperationinPennsylvania.

Abroadcoalition,whichincludesenvironmental,parent,andfaithgroups,Tuesdayapplauded

Gov.TomWolfforhisproposalonrulestocutmethanepollutionfromoilandgasoperationsin
Pennsylvania.
TheGovernor'saction,theysaid,willpavethewayforstrongrulesthataddressbothnew
andexistingsourcesofpollution,includingthemanythousandsofgaswellsinthestate.
"ThisannouncementiswelcomenewsforPennsylvaniansforcedtocoexistwithan
industryplayingbyitsownrulesnomatterhowdamagingtopeopleandtheplanet,"saidLarry
Schweiger,presidentandCEOofPennFuture."Gov.Wolf'sboldleadershiptakesanimportant
andmuchneededsteptowardprotectingthehealthofPennsylvaniacitizensfromdrillers'

Methane(CH4)istheprimarycomponentofnaturalgasand,alongsideothertoxic
copollutants,leadstotheformationofgroundlevelozone(smog)thatcontributestoincreasing
incidenceofasthmaattacksinchildrenaswellaspulmonaryandheartdiseaseinseniorsandthe
disadvantaged.

reducingemissions.Onerousandunnecessarynewregulationscouldhaveachillingeffectonthe

Tuesday,Gov.WolfannouncedthattheDepartmentof

measurestocontrolmethaneemissionsfromtheoilandgassector.
Methaneisverymuchattheforefrontofnationalawarenessgiventhe
AlisoCanyondisaster
thatcontinuestounfoldinCalifornia,wherean
estimated100,000poundsofmethanearebeingsentintotheaireach
hourataSanFernandoValleynaturalgasstoragefacility.
WhiletheAlisoCanyonincidentisparticularlyegregious,itstill
standsasanexampleofaproblemthatshappeningeverydayin
Pennsylvania,astheoilandgassectoristhelargestindustrialsource
ofmethanepollution.Beingthesecondlargestproducerofnaturalgasinthenation,
Pennsylvaniaisthusoneoftheleadingproducersofoilandgasmethaneemissions.
Methaneisreleasedintotheatmospherewhennaturalgasisleaked,vented,orflared.Itis
apotentclimatepollutantresponsibleforaboutaquarteroftodaysanthropogenicglobal
warming.ExtensivestudiescommissionedbytheEnvironmentalDefenseFundandothers
demonstratethatmethaneisleakingateverystageoftheoilandgassupplychain.
Itisdifficulttoassesshowsevereandwidespreadtheproblemofmethaneemissionsisin
Pennsylvania.Whilecertainsegmentsofindustrycurrentlyreporttheirknownemissions,those
numbersarelikelyasignificantunderestimateoftheoverallpicture.
First,onlylargeroperationsarerequiredtoreportthisinformation.Second,these
estimatesareoftenbasedonformulasthatdonttakeintoaccountmajorleaksorequipment
failures.Themoretheissueisstudied,themoreevidenceemergesthatmethaneemissionsarefar
greaterthanwhatiscurrentlyreportedoracknowledged.
AddingtotheproblemisthefactthatPennsylvaniahasanuntoldnumberofabandoned
ororphanedwellspotentiallytensofthousandsthatareleakingmethaneuncheckedintothe
atmosphere.
Pennsylvaniahasaknownknownsandaknownunknownsproblemwithmethane
emissions,whichmakestheannouncementbyGovernorWolfthatDEPwilladdressboth
existingandnewsourcesofemissionssocriticallyimportant.
Giventhatweareoneofthelargestcontributors,itmakessensethatPennsylvaniatake
theleadinadvancingrulesthatdramaticallyreducethoseemissions.
PECisstronglysupportiveofthiseffort,andwelookforwardtoworkingwiththeDEP
andotherpartnersinadvancingpoliciesthatreducePennsylvaniasgreenhousegasfootprint.

grantsuntilFebruary15.ThisisthefirststepintheFoundationsgrantprocess.
The
Foundationservesanarea
generallywestofthemainstemoftheSusquehannaRiver
totheOhioandNewYorkborders.

Gov.TomWolfWednesdayannouncedtheinvestmentof
$78.3millionfor12
drinkingwater,
wastewaterandnonpointsourceprojectsacross12countiesthroughthe
PAInfrastructure
InvestmentAuthority
.
ThePennVESTBoardofDirectorshasonceagaincometotheaidofanumberof
communitiesacrosstheCommonwealthwheresafeandadequatedrinkingwaterisneededand
wherebothhumanandanimalwasteiscontaminatinglocalstreams,saidGov.Wolf.These
conditionssimplycannotbeallowedtocontinueandIapplaudtheBoardseffortsandits
initiativeinaddressingtheseconditions.Pennsylvaniaisasafer,healthierandmore
environmentallypleasingplacetoliveasaresult.
Ofthe$78.3million,$60.3millionisallocatedforlowinterestloansand$18millionis
awardedthroughgrants.
Thenonpointsourcesprojectsincluded
ArmstrongCountyConservationDistrictreceiveda$761,400grant
toinstallavarietyof
streambankstabilizationmeasuresalong3.5milesoftrailswherewetweatheriserodingthetrail

surfaceandsurroundingground,resultinginsedimentbeingcarriedintoRedbankCreekandthe
AlleghenyRiver.
ChesterCountyConservationDistrictandSamuelStolzfusreceiveda$314,550grant
to
constructnewmanuremanagementandstoragefacilitiesandotherimprovementsonadairy
operationwherethereisuncontrolledmanurerunofffromtheexistingcattlelot.Also,thereis
currentlynomanurestoragecapacity,whichresultsinmanurespreadingduringwinterandother
timesoftheyearwhenthesoilisrelativelyimpervious.Alloftheseconditionscurrentlycause
manureandthenutrientsitcontainstorunoffintoOctoraroCreekandultimatelythe
ChesapeakeBay.
Thefundingcomesfromacombinationofstatefundsapprovedbyvoters,federalgrants
toPennVESTfromtheU.S.EnvironmentalProtectionAgencyandrecycledloanrepayments
frompreviousPennVESTfundingawards.
Fundsfortheprojectsaredisbursedafterbillsforworkarepaidandreceiptsare
submittedtoPennVEST.

AgrowingnumberofMontgomeryCountymunicipalitiesintheWissahickonCreekwatershed
havepassedresolutionstojoinanewpartnershiptoaddressunhealthywaterqualityandreduce
damagingfloodsintheregion.
The
CityofPhiladelphia
,whichgets10percentofitsdrinkingwaterfromthe
WissahickonCreek,hasagreedtoparticipateintheWissahickonCleanWaterPartnership,
joiningUpperGwyneddTownship,SpringfieldTownship,AbingtonTownship,Ambler
Borough,WhitpainTownshipandLowerGwyneddTownship
"TheWissahickonisincriticalcondition,andit'snotgoingtocleanitselfupweneedto
takeaction,"saidDennisMiranda,ExecutiveDirector,
WissahickonValleyWatershed
Association
."Thisbeautifulresourceinourbackyardsisbeingconstantlydamagedbypolluted
runoffandfrequentfloodingthatharmsbusinessesandhomes.Thereisnoeasyorcheap
solution,butnowtownsandsewerauthoritieshaveanunprecedentedopportunitytowork
togethertodevelopourownsolutionstofinallyrestoretheWissahickonCreek."
ThisvoluntarypartnershipwouldworktogetherwiththeDepartmentoftheEnvironment
todevelopawatershedwideplantomakesignificantwaterqualityimprovementsandpublic
investments.
ThepartnershipwouldevaluatethefactorsdamagingtheWissahickonCreekanddiscuss
differentapproachestofixingtheproblem.Thescopewouldincludepotentialactionstoimprove
waterquality,suchasstreambankandriparianbufferrestorationprojects,waterquality
monitoringandapossibletimeline.
TheWissahickonValleyishometoalmostaquarterofamillionpeople.Inthishighly
developedarea,waterrunningoffofroofs,driveways,lawnsandparkinglotspicksup
contaminantslikemotoroil,lawnchemicals,weedkiller,petwasteandotherpollutantsand
washesthemintolocalwaterways.
WaterqualityreportsshowtheWissahickonCreekisunhealthyandevendangerous,with
sedimentandphosphoruspollutionlevelsthatfarexceedfederalCleanWaterActstandardsdue
todecadesofpoorlyplanneddevelopment,populationgrowthandpollutedrunoffmadeworse
byeverincreasingstorms.
Thisnotonlythreatensanimportantsourceofdrinkingwater,italsocausesdamaging
streambankerosionandflashfloods,harmsfishandotherwildlifeandendangersvaluablepublic
recreationareas.
JeffandMargotClark,wholiveinWyndmoorandarevolunteerCreekWatchersforthe
WissahickonValleyWatershedAssociation,werealarmedbyafishkilllastAugust.
"TheWissahickonCreeklookscleanandserenemostofthetime,butweknowitisan
impairedstream,"saidMs.Clark."Wewereshockedtoseetwentyonedeadfishfloatbyour
observationsiteinlessthananhour.Theseweregoodsizedfish.Ifsomethinginthecreekis
killingthefish,thenwhatmightthatpollutantbedoingtous?"
TheWissahickonCreekemptiesintotheSchuylkillRiverjustupstreamfromasitewhere
thePhiladelphiaWaterDepartmentdrawswaterforoneofitsdrinkingwatertreatmentplants.
"AsCreekWatchersweareveryexcitedaboutthepartnershipandhopeeveryonecan
worktogethertofindwaystorestoreourpreciouscreek,forthehealth,safety,andwelfareofall

residentsinthewatershed."
SixteenmunicipalitiesinthewatershedhavebeenaskedtojointheWissahickonClean
WaterPartnership:AbingtonTownship,AmblerBorough,CheltenhamTownshipHorsham,
Township,LansdaleBorough,LowerGwyneddTownship,MontgomeryTownship,NorthWales
Borough,PhiladelphiaCounty,SpringfieldTownship,UpperDublinTownship,UpperGwynedd
Township,UpperMorelandTownship,WhitemarshTownship,WhitpainTownship,and
WorcesterTownship.

ChiquesCreekReenvisionedpartnersdiscussmonitoringactivitiesinthewatershed.
DrawingfrompastsuccesseswiththeConewagoCreekInitiative,theAECteamplansto
facilitatecollaborativeworkamongdiversestakeholdersinthewatershed.
TherearemanygroupsalreadydoinggreatworkintheChiquesWatershed,andtheAEC
teamhopestobringallstakeholderstogethertoincreasesuccessesandshareresources.
TheprojectismeanttocomplementthealternativeTMDLapproachworkthatthe
DepartmentofEnvironmentalProtectionandtheSusquehannaRiverBasinCommissionhave
beenleadingoverthelastyear.
Bybringingtogetherpublicandprivateentities,theChiquesCreekReenvisioned
partnershiphopestoincreaseoutreachandengagementoflandownersinthewatershedand
acceleratetheadoptionoflandmanagementpracticestoimprovewaterquality,insupportof
existingandcontinuedeffortsinthewatershed.
Proposedactivitiesfortheprojectincludelandscapeprofessionaltraining,homeowner
workshops,waterqualitymonitoring,andimplementationofbothurbanandagriculturalland
managementpractices.
Thisprojectwillalsohelpsupportthecontinuedworkofthe
GreeningtheLower
SusquehannaVolunteerCorps
whichhasbeenhardatworkforthepastthreeyearsplanting
trees,installingraingardens,performingmaintenanceactivities,andpickinguplitterinorderto
improvestreamhealtharoundtheregion.

DEPReleasesFindingsOnSeptember2015OdorEventFromScrantonSewerSystem

TheDepartmentofEnvironmentalProtectionFridaysaidithasconcludeditsthreemonth
investigationregardingasubstanceandodorthatranthroughtheGreenridgesectionofScranton
SewerAuthorityinSeptember2015.
Theinvestigationrevealedthatthesourceofthepetroleumbasedliquidcannotbe
determined,andthesubstance,anundeterminedsmallamount,waslikelyintroducedintothe
systemduringaonetimerelease.
Thedepartmentspentsignificantresourcestryingtopinpointwhoorwhatwas
responsibleforthissubstancebeingillegallydumpedintothesewersystem,saidMikeBedrin,
DirectorofDEPNortheastRegionalOfficeinWilkesBarre.Weworkedcloselywithauthority
inspectorstodeterminewhathappenedandhow.Findingtheanswerstothosequestionsand
determiningaresponsiblepartywerenotpossibleinthiscase,whereasmallquantityofmaterial
wasdumpedintoalargesewersystem.
DEPsEmergencyResponseTeamwasfirstcalledtothesewerlineatDrinkerPlaceand
CapouseAvenueforareportofahorrendousodorcomingfromthelineonthenightof
September24.
DEPandSSAinspectorsmonitoredtheupstreamsewerlinetoidentifytheoriginofthe
chemicalodor.AsimilarodorwasdetectedalongReevesStreet,MonahanAvenue.
Handhelddeviceswereusedtodetectairreadingsatallthreelocations.Volatileorganic
compoundsweredetectedatlevelssignificantlyhigherthanbackgroundlevels.Tocleartheodor
fromthesewerline,DEPrecommendedthatSSAbeginflushingthelinewithwater.
DunmoreFireDepartmentrecommendedevacuationoftheSleepInnasaprecaution.
StaffatSt.JosephsCentermoveddormitorystudentstoanotherbuildingoncampus.
DEPinspectedKeystoneLandfillsleachatetreatmentplantthatnight,andobservedno
odorotherthanammonia,commonduringleachatetreatment.Leachatesamplesfromthelandfill

andrawsewagesamplesfromSSAwereanalyzedbyDEPBureauofLaboratories.
Theleachatesamplesfromthelandfillwerenotconsistentwiththesubstancethatcaused
theodor.Therawsewagesamplescontainedapetroleumbasedcomponentconsistentwiththe
substancethatcausedtheodor.
Thelandfillwasnotdischargingtreatedleachateintothesewersystemonthenightofthe
incident.
SSAidentifiedandinspected23commercialusersintheareaofthesewerline,noneof
whomwereidentifiedastheresponsibleparty.Atelevisioncamerainspectionofthemainlines
alongMonahanandReevesStreetsinDunmore,,showednosignsofthepetroleumbased
substance.
OnSeptember25,DEPreceivedasecondodorcomplaintnearSandersonAvenueand
DettyStreet.DEPandSSArespondednoodororunusualflowwasdetected.

selfservicetooltoaccessandanalyzepublichealthdata.
Theinitiallaunchofthe
EnterpriseDataDisseminationInformaticsExchange
(EDDIE)
featuresadozenofthemostfrequentlyrequesteddatasets,suchasvitalrecordsandcancer
incidence,thatmaybeaccessedthroughacustomizedsearchfunction.
SincethelaunchofGOTIME,stateagenciesandemployeeshavecommitted
themselvestomakingPennsylvaniasgovernmentworkmoreefficiently,saidGov.Wolf.Im
thrilledtohearaboutthisnextsuccessinmaximizingefficiency,modernizingstategovernment
operations,andprovidingthehighestqualityservices.
InsupportofGov.WolfsgoalofcreatingaGovernmentthatWorks,weare
improvingandstreamliningourabilitytoprovideusefulinformationtothepublic,said
SecretaryMurphy.ImplementingthisnewdatatoolkeepsPennsylvaniaonthecuttingedgeof
informationtechnologyandprovidesthebestservicespossibletocommonwealthresidents.In
addition,havingamorerobustandmodernsystem,whichiseasiertomaintainandupdatethan
ourcurrentsystems,willsaveasignificantamountofstaffhoursandwillresultinamuchbetter
experiencefortheenduser.
Inthecomingweeks,EDDIEwillgainadditionalfeatureslikeenvironmentalhealthdata
andcountylevelassessments.
GeographicalvisualizationcapabilitieshavewillalsobeaddedtoEDDIE,suchas
mappingandchartingfunctions.Bystreamliningthesefunctionsanddatasets,thenewportalis
notonlymoreefficientandlesscostlybutalsoraisesthevisibilityofthedatasetsthemselves.
TheDepartmentofHealthisdedicatedtoenhancingtheprofileofpublichealthdataby
enablinggreaterdatadisseminationanddecisionmaking.Wehaveincreasedthevalueofallthe

datawecollectbypreparingandsharingitforeveryonetouseandlearnfrom,saidDepartment

TheAssociation,whichrepresentsthemajorelectronicswasterecyclingcompaniesinthe
Commonwealth,reportsthestatesewasterecyclingeffortisshrinkingdramaticallyandmajor
changesneedtobemadetocorrecttheproblemswiththeAct.
TheycalledonthesegroupstomakeSenateandHousemembersawareoftheproblems
andurgedthemtotakeactiontochangethelawtogettheprogrambackontrack.
Thetextoftheletterfollows
TheElectronicsRecyclingAssociationofPennsylvania(ERAP)isleadingpursuitof
amendmenttoAct108,theCoveredDeviceRecyclingAct.ERAPisengagedinmany
stakeholderdiscussionsandasksforyoursupport,pleasereadforward.
InNovember2010,Act108,theCoveredDeviceRecyclingAct(CDRA),wassigned
intolaw.CDRArequireselectronicsmanufacturerstocollecttheirshareofelectronicssoldin
Pennsylvania.
Theseelectronicsincludedesktopcomputers,laptopcomputers,computermonitors,
computerperipherals(suchaskeyboards,mice,printers),andtelevisions(includingflatpanels).
TheCDRArequiresrecyclingfor85percentofPennsylvaniacitizenry.
InJanuary2013,underCDRA,adisposalbanwentintoeffectforelectronicsand
residentscouldnolongerdisposeoftheseelectronics.Theprogramwasphasedinoverthree(3)
yearswithmanufacturersexpectedtopayforthecollection,transportation,andprocessingof
electronics.
SincetheCoveredDeviceRecyclingActbegan,therearenegativeimpactsthatoccurred
hereareafew.
1.PennsylvaniaEScrapRecyclingIsShrinking,NotGrowing:
Thetotalquantityof
collectionsitesfor2015wasverifiedandofthetotalsites,approximately150sitesacceptedall
CDRAlistedelectronics.Comparedtothe85percentcoveragegoalundertheAct,these150
sitesonlyaccountfor63.5percentofthePennsylvaniapopulation.Withoutadequateelectronic
manufacturerfinancialsupportforcoverageofcollection,transportation,andrecycling,
recyclingcoveragewilldecrease,asweareobservingamongst2016sites.
2.AdditionalRecyclingSitesAreClosingIn2016:
In2016,andlargelyduetoinadequate
electronicsmanufacturersupportasrequiredintheCDRA,additionalsitesareclosingoropting
outofservicetoPennsylvaniacitizens.Theresultisthat:
Over20regionalrecyclingsitesareclosinginwesternPennsylvania
2CountiesinsouthcentralPennsylvaniahavelostservice

Underservedcountiesincludethefive(5)countyareasurroundingPhiladelphia
CollectionlocationsareabsentfromthemajorityoftheRoute79corridorfromButlerCounty
toErieCounty,andmanyoftheruralcountiesintheCommonwealth
Atlastcount,theseeffectsimpactbutarenotlimitedto18CountiesofwhichDEPnotified
electronicsmanufacturersArmstrong,Bucks,Bradford,Cameron,Carbon,Chester,Clinton,
Cumberland,Delaware,Huntingdon,Montgomery,Montour,Perry,Philadelphia,Pike,Sullivan,
Susquehanna,andWyoming.
WhenpairedwiththeelectronicsdisposalbanthatispartofCDRA,thishasleadto
heightenedillegaldumpingofelectronicsinstateforests,abandonedproperties,andoff
roadways,includingcomputermonitorsandoldTVs,whichareknowntocontainheavymetals,
especiallyleadedglass.
3.AmountPaidByManufacturersDoesNotCoverCosts:
Recyclersprovidethecollection,
transportation,andprocessingonbehalfofthemanufacturerswheretheunitratepaidperpound
forelectronicsfromthemanufactureroftenisdepressed.Thisisaflawedmodel,givendynamic
fluctuationsinscrapvalue.
Theelectronicsmanufacturerrateunderthelawdoesnotadjusttochangesinscrapvalue
leavingnotonlyrecyclers,butmunicipallysupportedcollectionprogramswithinadequately
mandatedriskandunfundedliability.
4.RecyclersHaveReducedParticipation:
Since2011severalPennsylvaniapermitted
recyclershaveparticipatedintheCDRAprogram.Twocompanieshaveclosedtheirbusinesses.
Eight(8)companiescontinuetoreduceparticipationlargelyduetocurrentCDRAstructure.
Therecyclersthatremainengagedarefacedwiththeriskandliabilityfortheproper
handlingofelectronicswhilenotreceivingthelegislatedelectronicsmanufacturerpaymentthat
covers100percentofthecostofrecycling.
TheburdenofthisstructuredoesnotprovideadequatelyforPennsylvanianonprofit,
forprofit,andmunicipalorganizationsthatfunctionascollectors.Inmostcases,the
responsibilityfallsonthemunicipality,township,county,orauthority.
5.RecyclingWeightTargetsAre2YearsOld:
CDRArequireselectronicsmanufacturersto
recycleinagivenyearthetotalweightofproductstheysoldtwo(2)yearsago.For2016,an
electronicsmanufacturerisrequiredtorecycletheweightofmaterialtheysoldinPennsylvania
in2014.Manyelectronicslastlongerthan2years.
PicturethisHowdoyouaccountforthe2014reducedweightofatablet,pad,orflat
televisionproductsof2yearsagowhenmanyoftheelectronicsthatweneedtorecycleare
heavy,backbreakingconsoletelevisionsofdecadesago?
Thisarbitrarilyreduceselectronicsmanufacturersrecyclingbecausesalesweightis
goingdown.Thereisnorelationshipbetweendatedelectronicsthatneedtoberecycledand
2yearoldsales.
ThishascausedMarketplaceImbalanceSadly,ithasbecomemoreeffectivefor
electronicsscraprecyclerstodecreaseservicestostabilizerevenueratherthanexpandbusiness
toPennsylvaniacitizens.

Eldridgesaidin2015eLoopcollect7.5millionpoundsofewasteinWesternPA,but
underthecomplicatedprocessrequiredbythestateselectronicsrecyclinglaw,electronics
manufacturerswillonlypayforanallocationof5millionpoundsinthecomingyear.
The8countiesaffectedbythechangegenerated2.5millionpoundsofewastein2015:
Allegheny,Armstrong,Franklin,Huntingdon,Indiana,Mercer,WashingtonandWestmoreland.
eLoopsaiditwouldliketocontinueewasterecyclingintheseandothercounties,but
onlyafeeforservicebasisonly.
Eldridgenotedheandhiscompanyhavebeenworkingtogetthestatesewaste
recyclinglawchangedtobetterprovideforrecycling,butsofarwithoutsuccess.

2014reportontheprogram
totheGeneralAssemblybythe
DepartmentofEnvironmentalProtectionconfirmsthese
findings.
Thereportsaidinpart,Afteralmostfouryearsof
implementation,theCDRAhasnotstimulatedadependable
statewideinfrastructuretoensurelocalgovernments,
collectors,andrecyclersareabletooperateandprovide
recyclingservicesonacontinuingbasis.
Televisionsandcomputermonitorsthatcontaincathoderaytubes(CRTs)areespecially
problematicforrecyclingduetotheleadedglassintheCRTs,absenceoflowcostrecycling
technology,andlimitednumberofCRTprocessors.
Nevertheless,thedemandforopportunitiestorecycleoldtelevisionscontinuestobe
high.Reportsindicatethat,byweight,70to80percentofthematerialsavailableforrecycling
areCRTcontainingelectronics.AsofAugust2015,43percentofallcallsreceivedbythe
statewiderecyclinghotlinepertainedtoaccessissuesforrecyclingoftelevisions.
Pennsylvaniasmostpopulouscounties:Philadelphia,Bucks,Chester,Delaware,and
Montgomeryhave,infact,discontinuedelectronicsrecycling,othershaveoperatedrecycling
programswithoutsupportfromtherecyclinglawbecausethesystemisbroken.
DEPnotifiedthehardwaremanufacturerswhofundtheprogramlastyearthat18
countieshadnoelectronicsrecyclingopportunities:Armstrong,Bucks,Bradford,Cameron,
Carbon,Chester,Clinton,Cumberland,Delaware,Huntingdon,Montgomery,Montour,Perry,
Philadelphia,Pike,Sullivan,Susquehanna,andWyoming.

naturalgaspipelinesandinthenextdecadeDEPexpects30,000moremilesofpipelinestobe
built.Pennsylvaniaalsohas545naturalgascompressorstationstoserve3,264Marcellusand
UticaShalenaturalgaswells.Aboutonethirdofthewellsnowreadytoproducearenot
connectedtopipelinesandcannotdelivertheirproducttomarket.

UGIAsksPUCForFirstBaseDeliveryRateIncreaseIn21Years

TheUGIGasDivisionTuesdayfiledarequestwiththePublicUtilityCommissiontoincreaseits
baseratesforresidential,commercialandindustrialcustomersby$58.6millionannually.
ThebaserateincreaseUGIsfirstrequestin21yearswouldfundongoingsystem
improvementsandoperationsnecessarytomaintainsafeandreliablenaturalgasservice.
Aspartofitsfiling,UGIisalsoproposingtheimplementationofanenergyefficiency
andconservationprogramthatwouldpromoteandrewardcustomerseffortsaimedatincreasing
theirefficientuseofnaturalgas.
UGIisworkinghardtomanagecostsandimprovesystemperformancewhilecontinuing
ourcommitmenttosafelyandreliablydelivernaturalgastoourcustomersandthemany
communitiesweserve,PaulSzykman,UGIVicePresidentofRatesandGovernmentRelations,
said.Currently,UGIGasDivisionhasthelowestnaturalgasresidentialdistributionratesinthe

CommonwealthofPennsylvaniaamongmajorgasutilities.
Initsfiling,UGInotedthatsinceitslastratecasein1995,UGIhasmadeover$1.0
billioninsysteminvestments,increasingtheCompanysratebasebyover120percent.
Wearecurrentlyinvestingapproximately$150millionannuallyincapitalprojectsto
upgradeoursystem,Szykmansaid.UGIiswellunderwayonanaggressiveinfrastructure
bettermentinitiativethatisreplacingallnoncontemporarypipelineswiththosemadeof
contemporarymaterials.
UGIsbaserateincreaserequestwillimpactoneofthetwomajorcostcomponentsthat
appearoncustomersnaturalgasbills.Thedeliverycharge,whichthisproposalwouldincrease,
providesautilitywiththefundsneededtoown,operateandmaintainthegasdistributionsystem
andprovidecustomerserviceandemergencyresponseservices.
Theothercomponentofcustomersbills,whichwillnotbeaffectedbytodaysbaserate
filing,isthepurchasedgascommoditychargeandreflectstheactualcosttheCompanypaysto
purchasegasonthewholesalemarket,withnoprofitmarkup.
Infact,inDecember2015,UGIlowereditsgascommoditycharge,whichwasthethird
purchasedgascostdecreaseenjoyedbyUGIGasDivisioncustomersinthepastyear.The
December2015purchasedgascostdecreaseisacontinuationofasevenyeartrendof
moderatingnaturalgasprices.
UGIisalsoupdatingitsestimatedaveragemonthlycustomerusageofnaturalgas,which
isutilizedinestablishingnewrates.UGIismakingthischangeinrecognitionofchangesinthe
naturalgasmarketoverthepasttwodecadeswhichinclude:expandeduseofhighefficiency
appliancesmoreenergyefficienthousingandgreaterconsumerawarenessofenergy
conservation.
Theresultofthesechangesistheaveragecustomerusessignificantlylessnaturalgas
todaythanatthetimeofUGIslastratecasein1995.
IfUGIsbaseratecaseisapproved,thebillforatypicalUGIGasDivisionresidential
heatingcustomerwhouses57.3hundredcubicfeetofgas(ccf)permonthwillincrease$10.20
orby19.7percentfrom$51.77to$61.97permonth.
ThebillforatypicalUGIGasDivisioncommercialcustomerwhouses32.3thousand
cubicfeet(Mcf)permonthwillincrease$20.00orby7.4percentfrom$270.71to$290.71per
month.
ThebillforatypicalUGIGasDivisionindustrialcustomerwhouses132.7thousand
cubicfeet(Mcf)permonthwillincrease$33.53orby3.2percentfrom$1,062.77to$1,096.30
permonth.
UGIisrequestingthatthenewgasratestakeeffectMarch19,2016.However,thePUC
typicallysuspendstheeffectivedateforgeneralbaserateproceedingstoallowforinvestigation
andpublichearings.
ThePUCproceedingisexpectedtolastapproximatelyninemonths,whichwoulddelay
implementationofthenewratesuntillateOctober2016.

expansionofSEPTAs1.8MWbatterystoragepilotprogramcompletedin2014,thenew
networkbringstheagencystotalbatterystoragecapacitytomorethan10MW.
SEPTAsSustainabilityProgramisallaboutfindinganddeployingcuttingedge
innovationstoreducecostsinadditiontoimprovingenvironmentalperformance.Thisprojectis
rightinthatsustainabilitysweetspot,andwearepleasedtopartnerwithConstellationand
ViridityinbringingittomarketrighthereinthePhiladelphiaregion,anemerginghubfor

Theproject,whichisamongthefirstcommerciallydeployedbatterystoragesystemsina
transitoperation,requiresnoupfrontcapitalinvestmentfromSEPTAandwillbefinanced
througha20yearbatteryservicesagreementwithConstellation.
Asacompetitiveenergysupplier,weaimtoprovideourcustomerswiththebest
longtermeconomicandbusinesssolutionsforhowtheirenergyisproducedandsupplied,said
GaryFromer,seniorvicepresidentofdistributedenergyatConstellation.Thisbatterystorage
network,alongwith$26millioninguaranteedsavingsfromefficiencyimprovements
ConstellationisimplementingforSEPTA,willhelpSEPTAdeliveronitsbudgetandenergy
resiliencygoals.
ThestoredenergywillhelptobalanceelectricloadonthePJMInterconnection,the
regionaltransmissionorganizationthatmanagesthemovementofwholesaleelectricityin13
statesandtheDistrictofColumbia.
ViridityEnergy
willprovideenergymarketservicesfortheproject,biddingthebatteries
intothePJMmarketasfrequencyregulationresourcestohelpmatchgenerationwithdemand
andmaintainthedesiredelectricalfrequencyonthegrid.

canbeusedbytransitsystemstocreatesubstantialcostsavings,generaterevenue,andcontribute

streambankwhichhelpshadeandpartiallyprotectthestreamfrom
theimpactofadjacentlanduses.Theshadefromthevegetationcools
thestreamtemperature,increasingoxygensupplyavailabletofish
andotheraquaticorganisms.Theyhelpstabilizestreambanksandare
importantforgoodwaterquality.
TheseriparianbufferprojectshavetargetedFrenchCreekandConneautCreek
watershedsthatfeedintoLakeErie,improvingwaterqualityonestudentatatime.
Atypicalriparianbufferprojectincludesidentifyingalandownerwhoiswillingto
improveabufferontheirproperty.Aplaniscreatedandmappedouttodeterminehowmany
trees,treeshelters,andspeciesareneeded.
Whilethisishappening,localteacherseducatetheirstudentsabouttheimportanceof

riparianbuffersandpreparethemwiththeknowledgeofwhytheyareneededinthelocal
watersheds.
AvarietyofgrantsourcesaresecuredincludingGrowingGreenergrantstopurchase
equipment,plantmaterial,bussingandsubstituteteachersfortheday.
Lewissurveysthelocationanddeterminesthebesttreespeciesforthegrowing
conditions.Hepreparesthesiteforthestudentsbypaintingcolorcodeddotsontheground
wherethecorrespondingtreeandshrubspeciesshouldbeplanted,sometimesmarkingthearea
withmorethan2,900seedlinglocations.
Onplantingday,thestudentsgatheratthesiteandagaindiscusstheimportanceof
riparianbuffers,whyeachspecieshasbeenselectedforeachsite,howtoplanttheseedlings,and
whytheyaredoingwhattheyaredoing.
Thelandowneralsoispresenttoengagewiththestudentsandtolendafaceandhandto
theproject.Oncecompleted,thestudentsaretiredandsatisfiedthattheyhaveparticipatedina
localprojectthatbenefitsthenaturalresourcesintheircommunity.

MarkLewisinvolvementhasresultedinastoundingmeasuresofsuccess.
Overthepast15years,itisestimatedthatthenumberoftreesandshrubsplantedtotals
morethan75,000withthehelpof4,500studentsfrom12localmiddleandhighschools
completing97differentconservationprojects!Notably,MaplewoodHighSchoolhasbeen
involvedeveryyearsince2000.
WhenLewiswasaskedwhythisprogramhasbeensuccessful,heimmediately
responded,Engagementoftheteachers!Wetrytomakeiteasyforthembyhandlingthe
logisticsinordertokeepteachersinvolved,reallygoodteacherswithgoodadministratorswho
areengagedandseethebenefitandvalueofwhatthestudentsarelearninganddoing.
Asimpressiveasthenumbersare,thiseffortisnotaboutthenumbers.Thesuccessisalso
measuredbytheconnectionsthatthestudentsmakewiththeirlocalnaturalresource.
Engagingstudentsinacommunityeffort,connectingtolocalnaturalresourcesand
servingasapathwaytoemploymentarealsomeasuresofsuccess.
Onestudentparticipantbecametheerosionandsedimentationspecialistinthelocal
countyconservationdistrictandanotherstudentisnowalocalforester.
Lewisalsosaidthatthisyearsawtheparticipationofachildofoneofthefirstproject
participants,makingitthefirst,secondgenerationparticipanttocontinuetheconservation.

Thursday,theFishandBoatCommissionpurchasedthree
easementsandonepropertyalongErieCountysElkCreek,furtherexpandingthepublicfishing
corridoralongthepopularsteelheadstream,andanupdatedTroutManagementPlan.
ThesteelheadfisheryinLakeErieanditstributariesisapopulardestinationforanglers
andgeneratestremendouseconomicbenefitstotheregion,saidPFBCExecutiveDirectorJohn
Arway.AndourFishingandBoatingAccessStrategyranksthiswatershedasthetoppriority
foraccessimprovementstatewide.Withtheadditionoftheseeasementstoday,weregreatly
increasingtheopportunitiesforanglerstofishthisstream.
Theaccessareasinclude:
Easementsof1,175and870linearfeetalongElkCreekinFairviewTownship,ErieCounty.
TheeasementsarelocatedoffofElkValleyRoaddownstreamofFairviewTownshipsStruchen
Flatspropertyandwereacquiredfor$18,000and$13,500respectively.Theadditionofthese
twoeasementscreatesa1milecorridorofconnectedpublicaccess.
Aneasementof410linearfeetalongElkCreekinMcKeanTownship,ErieCounty,acquired
for$5,500.TheeasementareaislocatedoffofRickRoadupstreamofthePFBCsRickRoad
access.
Approximately1,600linearfeetoffrontageonElkCreekoneightacresoflandinMcKean
Township,ErieCounty.ThePFBCpurchasedthelandfor$100,000.Thepropertyislocated
immediatelywestofInterstate79attheendofSkinnerRoadnearMcKean.
Todate,thePFBChasacquiredmorethan20milesofpublicfishingaccessintheErie
watershedthrougheasementsandlandpurchasesundertheErieAccessImprovementProgram.
TheCommissionalsoadoptedanupdatedtroutmanagementplanfor201617.Someof
thekeyissuesaddressedintheplanincludetheprioritizedsamplingofunassessedwaters
protectionofClassAwildtroutwatersstockedtroutefficiencymanagementofwatersthrough
fingerlingstockinginstreamflowandhabitatprotectionandimprovementpublicaccessto
troutwatersandtheLakeEriesteelheadandbrowntroutstockingprogram.
TheplanwasdevelopedbasedoninputfromaworkgroupconsistingofPFBCstaff,
anglersaffiliatedwithavarietyofsportsmensorganizations,andindependentanglersnot
affiliatedwithasportsmensorganization.
