Johnson. We're just going to start off, and,

About 5:30, 6:00, Darisabel came in the room.

Our bedroom was the living room where her mother

sleeping at.

I told her to go in the corner

until we get up. We always told her to go to the

corner basically until we get up. I woke around 11 : 30, 12: 00. That's when somebody texted my

phone.

So Darisabel came in the living room while you

and Elizabeth were lying down watching TV, and for her being up that early, for her punishment

you had her go stand in the corner; correct?

Yes.

Then you said you woke up at 11 :30, 12:00

because?

Somebody texting my phone, and then when I got up, somebody told me to go check on my bar

because there was a white car in back of my car.

So I went to check my car for like five or seven minutes, maybe. 10 at most.

So there was another car behind your car?

That's why I went out.

So that's why you went out because you thought

somebody was messing with your car?

That's why I went outside because there was a car

parked behind my car.

Okay. So what happened when you came back in?

I came back in. , Elizabeth was aggravated and frustrated, and I asked her why, and she woul dn' t answer me. So I assumed Darisabel was playing on the stairs again like ,she was doing two days before and the day before. So I took her in her

room and I spanked her for a couple seconds, and

I told her in five or ten minutes I'll have a

conversation with her. She had -- her mother

real i zed for real, for real, she was smell i ng

,like shit and the thing was soggy.

said Elizabeth seemed frustrated, and you asked

That she was smelling like shit, so I told her

mother to come ch arrq e her Pamper. When her

mother came changed her Pamper, the bottom of it was ripped open.

So her diaper was soiled and had, you know, poop

and pee and everything else in it?

Yes.

And you had called Elizabeth to come help change

it?

And when she changed it, she shit on herself. She took the Pamper off, and Elizabeth went to

the kitchen. Her mom was angry, and she walked

off. After she come up and wal ked, off, so I picked her up and put her in the tub, and I ran

the water. Water's al ready runni ng, and I run

the water more. I realized she still had stuff

coming out of her back, out of her butt.

Okay.

So I went upstairs to the attic to get a Onesie.

You know what that is?

It's like a pullover and has little snaps

I went to the attic, the third floor of the

house, for some Onesies because we just moved in,

so everything's in bags still.

Okay. So you went upstairs to get Darisabel some clothes, and when you came back down, what

happened?

She was in the tub face forward, face down like

she fell on her face.

Okay.

But she was just fooling so I rei~spect -- I didn't suspect so much until I saw her face. Okay. So she was face down in the tub in the

water. How much water was in there, do you

think?

Like it hit her cheek, like coming up on her

face.

Okay. So her face was down in the water, ~ut it was only halfway up her face?

Okay. And then you picked her out of the water, obviously, and what happened? You saw --

I seen a lump on her head.

Where was the lump at?

This side.

On the left side of her forehead?

When I seen the lump on her head, I panicked

because she wasn't really responsive.

Now, when you say she wasn't responsive, were her

eyes opened or were they closed?

They were open but closed at the same time

because I know how she is, she's hyper. She acts

like agitated.

She wasn't moving at all?

No.

Okay. So she wasn't movi ng at -all. What di d you do then?

I picked her out of the tub and I called Elizabeth, and we both met in the middle of the

hallway, and we started arguing with each other. So you guys are yelling back and forth at each

other because?

There's something wrong in the baby. Something's wrong with the baby, and you guys just don't know -- you don't know what to do?

After that, we took her to the attic, and·r put her on my shoulder. Took her to the attic. She sat on her mother's leg. Her mother rubbed her back like this, you know what I mean? While r hold her and blow a breath, blow, giving her CPR

like this, and water started coming out.

So water started coming out her mouth?

Yeah. So I started rubbi ng her bell y, started

rubbing her stomach very hard.

Every time you

rub her stomach, you would hear her gag and the water's all coming out, so that's why we kept

rubbing her stomach as I was rubbing.

So every time you heard -- you started rubbing her belly, you could hear her breathing, but it

It was getting better and better, so I kept rubbing. That's one reason we didn't call the cops. I tho~ght she was going to get better. So she started breathing a little bit, and it

started getting better than it was, so that's the reason you did~'t call 911 because you thought she was getting better?

So what happened next, after you guys are doing

that on the third floor?

It was like 15, 20 minutes, and I'm like just

calm down, calm down. So we went to the kitchen.

We sat in the kitchen. I'm rubbing her because I was holding. her. I was shaking her, wake up,

like get the fu-- get up, get up, get up. After

that, she woke up for some reason. She got up.

She responded, so I'm like, well, she's good. So

we go in the kitchen. I'm holding her, and she

breathing, and I give her to her mother. Then I

went downstairs to get the phone because my phone

, wasn't goi ng through, I guess.

Okay.

And then got the kid's phone.

I didn't use it.

I tri ed to use it, but after I was usi ng it, she

started breathing, so I'm like let's just leave it, see what happens first.

Okay. So she was breathi ng. You went to get the phone, but she was still breathing a little bit? Yeah.

Okay. And then what happened?

I guess after I got the phone, I sat there, and

just screamed, and I be like, I'm calling the

them, and then I left to my brother's house

across the street. When I came back from my

brother's house, my brother, and then I was

arrested.

Okay. So when the police showed up, you left and

went to your brother'S house?

I walked out, yeah.

Because -- what was the reason you went to your

brother's house? Just because you wanted --

I was confused.

Okay. And then you went to your brother's, got your brother, and then you came back to the

house?

I came back to the house. I was arrested.

have to walk spaces, but Elizabeth's pregnant

After that you stated that you walked out to your car because you saw another car behind your

And that's when you saw that she was

unresponsive, and there was a bump on the left side of her forehead?

Yes, with a gash in it. Was it a gash?

It was a bump with a gash in it.

So it was a bump, and it had a cut in it?

And then you stated that you left to go downstairs to get your neighbor's phone?

Yes.

And you were pacing because you didn't know what

to do. And then when you came back, you di dn' t call 911 right away because

I was scared of the bruises on her arm.

It was the bruises on her arm, and she was

breathing okay at this time?

At the time she was breathing, her eyes dilated

again and came back and she was breathing. I was nervous because of the bruises. I was really

nervous of the bruises. That's why I wouldn't take her to the hospital. I didn't want to call the ambulance. I was going to drop her off. I didn't want to get in trouble for the bruises.

That's the whole thing of why it took so long to

get to her to call because I was concerned about

the bruises. I was scared.

Okay. So basically the reason, like you said, you didn't want to call the police .because you

were scared because you had just spanked her with the Xbox cord, and you were nervous that you
