June 3, 2016 City of Jackson Department of Equal Business Opportunity Attn: Mike Davis 2005S President St. Jackson, MS 39201 RE: EBO Violation and Non-Compliance of Siemens Contract Mr. Davis, This letter in reference to the Siemens project with the city of Jackson. As you know, MAC & Associates, ULC was selected to perform all of the general construction services for this project. in the Siemens proposal, it stated the focal companies, their scopes of work and their EB percentages of the total EBO goal. The total goal percentage was 58.29% which was the largest minority participated percentage in the history of this city and Siemens. Of the 58.29%, MAC & Associates had the largest percentage of the goal at 21.9% which covered the entire construction for the project. In the beginning, MAC selected Hemphill Construction to assist in performing the O&M and sewer repair work for this project and Pedal Valves was selected to assist in the water meter installation phase of the project. After the city executed the contract, Siemens removed a portion of the scope of work from MAC's contract and issued Pedal Valves their own separate contract along with the contingency funds that were associated with the contract. By issuing a separate contract to Pedal and taking some of MAC's scope of work, decreased the contractual goal of MAC's 21.9%. The contract also stated that there were NO CHANGE ORDERSII! Siemens has made change orders on MAC's contractual amount totaling almost $1 million dollars without MAC's authorization or consent. Siemens has also changed MAC's total dollar amount on the BO audit reports without MAC's authorization or consent, Because of these EBO violations and by not complying with the £60 terms of the contract, we are asking the city of Jackson to exercise the penalties of this contract by 1) withholding the 10% or requiring Siemens to pay the city 10% of the contract proceeds back for being out of compliance and 2to issue a shutdown of the project until the compliance issues are resolved. The CLIENT'S failure to execute such statement within ten (10) days will void the MSP end release SIEMENS from any further obligations with respect to the MSP. 13.6 _ If the MSP scope of Services provides for equipment maintenance, repairs andior replacements of equipment by SIEMENS, those Services are limited to restoring the proper working condition of such equipment, SIEMENS will not be obligated to provide replacement equipment that represents significant capital improvement compared to the original Exchanged components become the property of SIEMENS, except Hazardous Materials, which under all circumstances remain the property and responsibility of the CLIENT.
