AN
ORDINANCE
PRHOBITING
TUMULTS,
DRUNKNNESS
OR
INTOXICATION, OR BEHAVIOR IN A DRUNKEN, BOISTEROUS, RUDE,
OR INDECENT MANNER IN ANY PUBLIC PLACE OR PLACE OPEN TO
PUBLIC VIEW, DISORDERLY GATHERING IN PUBLIC PLACES, AND
PROVIDING PENALTIES THEREAT:Be it ordained by the Municipal Board of the City of Naga, that:
Section 1:- It shall be unlawful for any person or persons to create
tumults or disturbances in places where there are public gathering, or shall
form disorderly gathering or congregations in public streets, public alleys,
plazas and other public places creating or tending to create disturbance to
the peace and tranquility of the people thereat;
Section 2:- It shall be unlawful for any person or persons to drink wine,
beer, or any intoxicating liquor in public streets, plazas, public alley, public
schools, churches, and in public market, except in those cases provided for
and authorized by law and ordinance; or walk in a state of drunkenness or
intoxication, or behavior in a drunken, boisterous, rude, or indecent manner
in any public street, public alleys, plazas, and other public places, or place
open for public view, or in any place or premises in the annoyance of other
person or tending to offend against decency or good custom by any
scandalous conduct; or shall exhibit indecent or immoral acts or scenes.
For the purpose of this section, drunkenness is defined as that state or
condition which inevitably follows from taking excessive quantities of an
intoxicant to such a degree as to deprive him or her of reasonable selfcontrol.
Section 3:- Any person or persons violating any of the provisions of this
ordinance, in the first conviction, shall pay the fine of not less than P20.00
nor shall exceed P200.00 and/or imprisonment for not less than 10 days nor
more than six (6) months, or both, at the discretion of the court; and, in case
of two or more convictions within a period of one (1) year the penalty shall
be imposed under the following graduated scale;
Upon second conviction, the penalty shall be a fine of not less than
P50.00 nor shall exceed P100.00. and/or imprisonment of not
exceeding 2 months, at the discretion of the court;
Upon third conviction, the penalty shall be a fine of not less than
P100.00 nor shall exceed P150.00 and/or imprisonment of not
exceeding 4 months at the discretion of the court; and in case of the

fourth conviction, the penalty shall be the maximum penalty provided


herein should be imposed, at the discretion of the court;
Section 4:- This Ordinance shall take effect after thirty (30) days
publication from date of approval.
