EL101 ELEMENS OF LAW
SYNOPSIS
This subject is designed to provide a sound knowledge of the core elements of Malaysian
Business law. The subject commences with a review of the important components of the
Malaysian Legal System, the judicial process and the means by which the disputes are
resolved or litigated. While the subject concentrates on civil aspects mainly commercial,
contract and torts, other areas of importance are also dealt with.
OBJECTIVES
Upon completion of this subject, students should be able to:
identify and explain the key features of the Malaysian Legal System, in particular,
the main sources of law, the court system and the administration of justice;
explain the main aspects of Hire Purchase, including formation of hire purchase
agreements, implied terms, misrepresentation, rights and liabilities of the hirer,
procedures for repossession and rights of the hirer if goods repossessed;
explain the rules of Agency as they apply to sole traders, partnerships and companies;
apply those laws to factual situations and coming to reasonable conclusions, and
discuss legal topics in a confident manner and possess good analytical skills.

out of 60 marks if there is an examination for this subject.
Attempt ALL areas of assessment; and achieve a total result of 50% or better

ASSIGNMENT
Assessment Details
This is an individual assignment. The word count should not exceed 1500 words.
a) Discuss revocation of proposals under Contracts Act 1950.

b) Ali is a dealer in second-hand goods. Ali entered into a contract with Ben for the
purchase of an old grandfather clock from Ben for RM200. Ben has since refused to
sell the clock to Ali, stating that the price is too low and that the actual value of the
clock is RM2,000. Ali also contracted with Ashley, aged 16, to sell her a vase for
RM15,000. Ashley has refused to honour the contract, stating that it is void. Ali was
also contacted by Ahmad who made an offer to sell Ali his antique table fan for
RM5,000. Ahmad told Ali that if he hears nothing from Ali, he will assume that Ali
has agreed to his offer. Ali did not respond and now, Ahmad is insisting that there is
a contract between them for the sale of the fan. Advise Ali.
