Theseconditionsareestablishedasareasonableandimpartialmethodofregulatingadvertisingstructures
inordertoensuresafeconstruction,light,air,andopenspace,toreducehazardsatintersections,to
preventtheaccumulationoftrash,toprecludetheestablishmentofstructureswhichwouldaffordhiding
placesforimmoralorcriminalactivities,andtoprotectpropertyvaluesoftheentirecommunity.
Theregulationsforsigns,billboards,andotheradvertisingstructuresareindicatedbelow.The
interpretationofnomenclatureinthischaptershallbeasdefinedinChapter18.10SCC.(Zoningordinance
Art.5,8).
18.140.020Generalregulations.
Inanyzoningdistrictwheresignsarepermitted,thefollowinggeneralregulationsshallapply:
(1)Nosignshallbeerectedormaintainedatanylocationwherebyreasonofitsposition,wording,
illumination,size,shape,orcoloritmayobstruct,impair,obscure,interferewiththeviewof,orbeconfused
withanyauthorizedtrafficcontrolsign,signal,ordevice.
(2)Nosignshallcontainormakeuseofanyword,phrase,symbol,shape,form,orcharacterinsuch
mannerastointerferewith,mislead,orconfusetraffic.
(3)Nosignhavingflashing,intermittent,oranimatedilluminationshallbepermitted.
(4)Noilluminationsignshallbepermittedwithin50feetofpropertyinanyresidentialdistrictunlessthe
illuminationofsuchsignissodesignedthatitdoesnotshineorreflectlightontosuchproperty.
(5)Nobillboardorgroundsignshallbeerectedtoexceed20feetabovethegroundlevelor50feetin
length.Thebottomcopingofeverygroundsignshallbeatleastthreefeetabovethegroundorstreetlevel.
(6)Allroofsignsshallbesoconstructedastoleaveaclearspaceofnotlessthansixfeetbetweentheroof
levelandthelowestpartofthesign.Noportionofanyroofsignstructureshallprojectbeyondanexterior
wall.Noroofsignshallbeatanypointover24feetabovetherooflevel.Roofsignsshallnotexceedthe
heightlimitofthezoningdistrict.
(7)Nopartofanywallorprojectingsignthatisattachedtoabuildingshallbeerectedtoaheightgreater
thansuchbuilding,unlessthebuildingandsignarearchitecturallyintegratedanddesignedasaunit.

(8)Billboardsandothersimilaroutdooradvertisingstructuresshallbeerectedorplacedinconformitywith
thesideandrearyardrequirementsofthedistrictinwhichlocated.However,nobillboardshallbeerected
orplacedcloserthanwithin100feetofanyresidentialdistrict,anditshallbesetbackfromtheestablished
rightofwaylineofanystreetorhighwayatleastasfarastherequiredfrontyarddepthforaprincipaluse
insuchdistrictandforeverysquarefootbywhichsuchbillboardexceeds100squarefeetsuchsetbacks
shallbeincreasedbyonehalffoot,butnottoexceed300feet.
(9)Noadvertisingsignshallbelocatedinanyareadesignatedbytheplanningcommissionasoneof
scenicbeautyorhistoricalinterest.
(10)Nobuildingwallsshallbeusedfordisplayofadvertising,exceptthatpertainingtotheuseonthe
premises.
(11)TemporarySigns.
(a)Alltemporarysignsmustbemountedonabuilding,withtheexceptionofsandwichboardsigns,
whicharefurtherregulatedinthischapter.
(b)Temporarysignsshallbeincludedwhendeterminingthetotalareaofsignserectedordisplayed
onaproperty.
(c)Innocaseshallmorethanonetemporarysignbelocatedonanybuildingstorefront.
(d)Notemporarysignsmayexceed30squarefeetinarea,withtheexceptionofsandwichboard
signs,whicharefurtherregulatedinthischapter.
(e)Temporarysignsshallnotbeerectedorotherwisefixedonanypole,tree,stone,fence,building,
structure,oranyobjectwithintherightofwayofanystreet.Notemporarysignshallbeerectedatthe
intersectionofanystreetinsuchamannerastoobstructfreeandclearvision,orbeconfusedwith
anyauthorizedtrafficsign,signal,ordevice.
(f)Atemporarysignshallnotbesuspendedacrosspublicstreetsorotherpublicplaces,exceptas
permittedbytheplanningcommission.
(g)Withtheexceptionofsandwichboardsignswhicharefurtherregulatedinthischapter,nosign
shallbeplacedinanypublicrightofway,exceptpubliclyownedsigns,suchastrafficcontrolsigns,
directionalsigns,andsubdivisionidentificationsigns.
(12)MotorVehicleSigns.Signsdisplayedonmotorvehiclesoperatedorparkedonpublicorprivate
propertywhenvisiblefromanypublicstreetshallbepermitted,providedthefollowingrequirementsare
met:
(a)Themotorvehicleisprimarilyusedforpurposesotherthanthedisplayofadvertising
(b)Motorvehiclesignsmaynotincludeanyillumination,includingflashing,pulsating,rotation,or
blinkingsigns
(c)Motorvehiclesignsmaynotincludeelectronicchangeablecopysigns,includingsignscontaining
lightemittingdiodes(LEDs),fiberoptics,lightbulbsorotherilluminationdevicesusedtochangethe
advertisingdisplayedbysuchsigns.
(13)Signserectedandoverhanginganysidewalkmustbeplacedatleast10feetabovethesidewalkand
mayextendoverthesidewalkadistanceequaltoonehalfthewidthofthesidewalk,butinnocase

exceeding10feet.
(14)Polesignsshallbenotover30squarefeetinareaandshallbelocatednotcloserthan10feettoany
streetrightofwaylineandfivefeetfromanyotherpropertyline.
(15)Professionalsignsforhomeoccupations,wherepermitted,shallnotexceedtwosquarefeetinarea,
provided,suchsigniseitherawallorgroundsignlocatednotcloserthan20feettothestreetrightofway.
(16)Theareaofasignshallbedeterminedbythesmallestcircle,triangle,orrectanglethatcanbeusedto
enclosethesign,exclusiveofsupportingmembersthatbearnomessage.Asigndesignedtobeviewed
fromtwooppositedirectionsshallbeconsideredasonesignprovided,thatthetwosignfacesshallnotbe
morethantwofeetapartifparallel,norformanangleofmorethan90degreesifangular.Whenmorethan
onesignispermittedonalot,thenetsignareashallbethesumofthosesignsdesignedtobeviewed
fromonedirection,andsuchsignsshallnotbelessthan20feetapart.
(17)Azoningpermitisrequiredpriortoerectinganypermanentsign.(Ord.201004.ZoningordinanceArt.
5,8).
18.140.030Residentialdistrictregulations.
Inresidentialdistricts,thefollowingregulationsshallapply:
(1)ForSingleFamily,TwoFamily,andMultifamilyDwellings.Nameplatesnottoexceedonesquarefoot
inarea,shallbepermittedforeachdwellingunitsuchnameplatesshallindicatenothingotherthanname
and/oraddressoftheoccupantsorpremises.
(2)ForMultifamilyandGroupDwellings.Identificationsigns,nottoexceedninesquarefeetinarea,shall
bepermittedsuchsignshallindicatenothingotherthannameand/oraddressofthepremises,andthe
nameofthemanagement.Suchsignshallbeattachedflushwiththeprincipalbuildingandmayhave
indirectillumination.
(3)AnnouncementofChurch,School,orPublicBuilding.Bulletinboardsoridentificationsigns,notto
exceed20squarefeetinareashallbepermittedsuchbulletinboardsoridentificationsignsshallindicate
nothingotherthannameand/oraddressofthepremises,andscheduleofservicesorotherinformation
relevanttotheoperationofthepremises.Suchsignshallbelocatednotcloserthanonehalftherequired
setbacksandmayhaveindirectillumination.
(4)Onlyonesignperstreetfrontageshallbepermitted.
(5)Flashingorintermittentilluminationisprohibited.
(6)Billboardsandotheradvertisingstructuresareprohibited.(ZoningordinanceArt.5,8).
18.140.040Businessdistrictregulations.
Inbusinessdistricts,thefollowingregulationsshallapply:
(1)SandwichBoardSigns.
(a)Inanydistrictzonedforbusinessorprofessionaluseonesandwichboardsignispermittedper
storefrontandshallbeexemptfromtheprovisionsofChapters18.83and18.85SCC.Asandwich
boardsignshallbeconsideredtobeatypeoftemporarysignandnosignpermitisrequired.
Sandwichboardsignsinthedowntownbusinessdistrictshallberegulatedasprovidedinsubsection
(4)(d)ofthissection.

(b)Location.
(i)Asandwichboardsignshallbelocatedwithinthesameparcelboundariesasthebusinessit
advertises
(ii)Sandwichboardsmaybelocatedinapedestrianrightofwayonlywhentheprimaryfaceof
thebuildingislessthanfivefeetfromthepedestrianrightofwayandmustprovideatleasta36
inchwideclearanceforpedestriantravel
(iii)Sandwichboardslocatedonanypublicpedestrianrightofwayshallbeplacedwiththebase
ofthesignperpendiculartoandinfullcontactwiththebuildingface.
(c)Size.Sandwichboardsshallbenolargeroverallthanfourfeetinheightandtwofeetinwidth.
(d)Suchsignshallhavenoilluminationofanykindandmaybedisplayedonlyduringthehoursthe
businessisopentothepublic.
(e)Sandwichboardsignsmayadvertiseproducts,sales,grandopenings,oraddressanyother
advertisingpurposesolelyforthebusinessinfrontofwhichthesignislocated.
(2)ForPublicRecreationUses,CommunityFacilities,Hospitals,andClinics.Bulletinboardsor
identificationsignsshallnotexceed20squarefeetinarea.
(3)ForGasolineServiceStations.Twopolesignsnotexceeding30squarefeeteachinsurfacearea.
Otherbusinesssigns,theaggregateareaofwhichdoesnotexceedonesquarefootforeachonelinear
footoflotadjoiningapublicstreet.
(4)Forotherpermittedprincipaluses,businesssignsshallbepermittedasincidentaluses,nottoexceed
thenumberofsignsnortoexceedthenetareaforallsuchsignspermittedasfollows:
(a)P1ProfessionalDistrict.Foranyuse,bulletinboardsoridentificationsignsshallnotexceed20
squarefeetinarea.Onlyonesignperstreetfrontageshallbepermitted.Flashingorintermittent
illuminationisprohibited.Suchsignshallbeattachedtothebuildingorlocatednotcloserthanone
halftherequiredsetbackfromthestreetrightofwayandmayhaveindirectillumination.
(b)B1LocalBusinessDistrict.Businesssignsnottoexceedonesquarefootperfivesquarefeetof
usablefloorareaortwosquarefeetperonelinearfootofstreetfrontage,whicheveristhegreater.No
signorportionofanysignshallbeerecteduponoroverhanganypublicproperty.Nogroundsigns
shallbelocatedwithin10feetofanypropertyline.
(c)B2GeneralBusinessDistrict.Businesssignsnottoexceedtwosquarefeetofsurfaceforeach
onelinearfootoflotfrontingonapublicstreet,butinnocaseshallthesurfaceareabelimitedtoless
than50squarefeet.Allsignsshallbemountedeitheronbuildingsoronsigndisplaydevicesaffixed
permanentlytotheground.Allgroundsignsshallbelocatednotclosertoanypropertylinethanone
halftherequiredsetbacks.
(d)SpecialRegulationsfortheDowntownBusinessArea.
(i)Purpose.
(A)Signsconstituteaseparateanddistinctuseofthelanduponwhichtheyareplacedand
affecttheuseofadjacentstreets,sidewalksandotherpublicplacesandadjacentprivate
placesopentothepublic.Theunregulatedconstruction,placementanddisplayofsigns

constituteapublicnuisancedetrimentaltothehealth,safety,convenienceandwelfareofthe
residentsofthecity.
(B)Thepurposeofthissubsection(3)(d)istoestablishreasonableandimpartialregulations
forallexteriorsignsandthoseinteriorsignsdesignedtoattracttheattentionofpersons
locatedoutdoorsinorderto:reducethetraffichazardscausedbysuchunregulatedsigns
whichmaydistractandconfuse,andimpairthevisibilityof,motoristsandpedestrians
ensuretheeffectivenessofpublictrafficsignsandsignalsprotectpropertyvaluesby
ensuringthecompatibilityofpropertywiththatsurroundingitprovideanattractivevisual
environmentprotectthecharacterandappearanceofthedistrictattracttouriststothecity
protectthepublicinvestmentinstreets,highwaysandotherpublicimprovementsand
protectandimprovethepublichealth,safety,andgeneralwelfare.
(C)Theregulationscontainedinthissubsection(3)(d)advancethesesignificant
governmentalinterestsandaretheminimumamountofregulationnecessarytoachieve
them.
(ii)DowntownBusinessAreaDefined.Thedowntownbusinessareaisdefinedasembracingthe
propertiesabuttingonLewisStreetbeginningatitsintersectionwithWestBeverleyStreetand
extendingtotheintersectionofLewisStreetwithMiddlebrookAvenue,thencealongMiddlebrook
AvenuetoitsintersectionwithSouthNewStreetExtended,thencealongSouthNewStreet
ExtendedtoitsintersectionwithGreenvilleAvenue,thencealongGreenvilleAvenuetoits
intersectionwithNorthCoalterStreettoitsintersectionwithEastFrederickStreet,thencealong
EastFrederickStreettoitsintersectionwithNorthNewStreet,thencealongNorthNewStreetto
ChurchvilleAvenue,thencealongChurchvilleAvenuetoitsintersectionwithLewisStreet,thence
alongLewisStreettoitsintersectionwithBeverleyStreet,thepointofbeginning,aswellasall
propertieswithintheareahereindelineated.
(iii)Definitions.Forpurposesofthissubsection(3)(d),theinterpretationofnomenclature
containedhereinshallbeasdefinedinChapter18.10SCC.
(iv)GeneralRequirements.Inadditiontotheregulationsapplicabletotheunderlyingzoningofa
parcelsituatedinthedowntownbusinessarea(exceptasspecificallymodifiedorchanged
hereby),thesegeneralrequirementsareapplicabletothepropertieswithinthedowntown
businessarea:
(A)Noperson,firmorcorporationshallerect,alter,repairorrelocateanysignwithinthe
areawithoutfirstobtainingacertificateofappropriatenessfromthecityshistoric
preservationcommission(HPC)orthedirectorofplanning(incaseswherethedirectoris
givenauthoritytoissuesuchcertificatewithoutreferraltotheHPC).Asignpermitshallnot
berequiredforroutinemaintenanceorachangeincopythatresultsinnoalterationtothe
signstructure.
(B)Abuildingpermitisrequiredfortheerectionofasignover2.5squarefeetinarea.A
windowsign,ifauthorizedherein,doesnotrequireabuildingpermit.
(C)Nosignshallprojectabovethebuildingparttowhichitisattached.
(D)AllsignsmustmeettherequirementsoftheVirginiaUniformStatewideBuildingCode
(USBC).

(E)Nosignotherwisepermittedherein,thatlieson,overoracrossanystreet,road,
highway,alley,sidewalkorotherpublicrightofwaymaybeerected,displayed,constructed,
repairedoralteredunlesstheownerobtainsapolicyofgeneralpublicliabilityinsurancewith
acompanyauthorizedtodobusinessinthestateofVirginia(approvedbythecitymanager).
Saidpolicyshallnamethecityasanadditionalinsuredandshallprotectandholdharmless
thecity,itsagentsandemployeesfromandagainstanysuit,action,claim,causeofaction,
damages,losses,liabilityandexpenses(includingwithoutlimitation,litigationexpensesand
attorneysfees)resultingfrom,arisingoutof,orincidentaltotheconstruction,alteration,
reconstruction,maintenance,repair,removal,fallingorcollapseofthesign.Theminimum
bodilyinjuryprotectioninsaidpolicyshallbe$300,000perpersonand$600,000per
occurrence,andtheminimumpropertydamageprotectioninsaidpolicyshallbe$150,000
peroccurrence.Saidpolicyshallcontainaprovisionthatthepolicyshallnotbecanceledor
changedunlessthecityisgiven30daysnoticepriortosaidcancellationorchange.Failure
tomaintainthepolicyinfullforceandeffectshallbeduecauseforthecity,actingthroughits
directorofplanning,toorderremovalofsuchprojectingsignimmediately.
(F)Thedirectorofplanningmayremoveanysigninviolationoftherequirementsofthis
chapter,notremovedbytheownerafternoticetodosobythedirector,andshallimpound
thesignwithin24hoursofsuchremoval.Thedirectorshallnotifytheownerandthe
businesssubjectofsaidsigninwriting,ifownershipisreadilydeterminable,ofthelocation
atwhichthesignisbeingstoredandoftheownersrighttoretrievethesignuponpayment
oftheimpoundfee($100.00),plusastoragefee($10.00)perdayforeachdayorfractionof
adayofstorage.Iftheownerofthesigninviolationcannotbereadilyascertainable,the
business,subjectofsaidsign,shallbesonotified.Signsnotsoretrievedwithinaperiodof
30daysofthemailingofsuchnoticemaybedestroyedbythecity,andtheimpoundfeeand
storagechargemayberecoveredagainsttheownerofthesignandthebusinesssubjectof
saidsign,jointlyandseverally.
(v)Permit/CertificateofAppropriateness.
(A)Theapplicationforacertificateofappropriateness(requiredbysubsection(3)(d)(iv)(A)
ofthissection)shallcontain(1)thelocationofthesignstructure,(2)thenameandaddress
oftheownerofthesignandoftheperson,firmorcorporationofthesigncontractor(ifany),
(3)adrawingshowingthedesignandcopytobedisplayeduponthesign,and(4)such
otherinformationasthedirectorofplanningand/orthebuildingofficialmayrequiretoensure
compliancewiththiscodeand/orotherordinancesofthecity.Theapplicationshallbemade
tothedirectorofplanning.
(B)Theapplicationshallbeaccompaniedbyafeeof$15.00,orsuchotherfeeasfixedby
thegoverningbodyfromtimetotime.
(C)Acertificateissuedhereundershallbecomenullandvoidiftheworkforwhichthe
certificatewasissuedhasnotbeencompletedwithinsixmonthsofthedateofissuanceof
thecertificate,unless,however,thecertificateallowsalongertimeforcompletion.
(vi)SignsPermittedintheDowntownBusinessArea.
(A)Thefollowingtypesofsignsarepermittedinthedowntownbusinessarea(subjecttothe
grantingofacertificateofappropriateness):
(1)Flatwallsigns

(2)Projectingsigns
(3)Freestandingsigns
(4)Awningsigns
(5)Marqueesigns
(6)Windowsigns
(7)Flag
(8)Banner
(9)Churchsigns.
(B)Thetotalsignareaforabusinessshallbecomputedonaratioofonesquarefootofsign
foreachlinealfootofbuildingfaceoccupiedbythebusiness,exceptthatnosignon,or
attachedto,aparticularbuildingfaceshallexceed30squarefeetinarea.Buildingfaceas
usedhereinmeansthatfaceofthebuildingthatfrontsuponastreet(orsidewalk)and/oran
improvedalleyway.Signareashallbecalculatedastheareawithinaparallelogram,triangle,
circle,semicircleorotherregulargeometricfigureincludingallletters,figures,graphicsor
otherelementsofthesign,togetherwithanymaterialorframingthatisanintegralpartofthe
displayorusedtodifferentiatethesignfromthebackdroporstructureagainstwhichitis
placed.Thesignareashallnotincludedecorativebarironcrestingabovethesignand/or
decorativebarironbracketsbelowthesignifthebarironisnolargerthanthreequartersof
aninchbyoneandonehalfinchesincrosssection.Doublefacedsigns(twosignfaces
parallel,backtoback,andnotmorethantwofeetfromeachother)shallbecountedasone
sign.Vsigns(twosignfacesonanangle,notparallel)withananglegreaterthan60
degrees,shallbeprohibited.Thesupportingframeworkofthesignshallnotbeincludedin
determiningsignareaunlesssuchsupportingframeworkformsanintegralpartofthesign
display,asdeterminedbythezoningadministrator.Ifthesignislocatedonadecorative
fenceorwall,whensuchfenceorwallotherwisemeetstheseorotherordinancesor
regulationsandisclearlyincidentaltothedisplayitself,thefenceorwallshallnotbe
includedinthesignarea.
(1)Thecontentoradvertisingmessagecarriedbypermittedsignsshallpertainto(a)the
businesslocatedonthesamepremisesasthesign,(b)anyotherwiselawfulnoncommercial
messagethatdoesnotdirectattentiontoabusinessoperatedforprofit,or(c)acommodity
orserviceforsale.
(2)Forsignswithchangeablemessagepanelsorziptracks,thechangeablemessagearea
ofthesignshallnotexceed25percentofthetotalsignarea,exceptforgasolinepricesigns,
whichshallnotexceed75percentofthetotalsignarea.
(C)Churchsignsnotexceeding40squarefeetinareaarepermittedprovidedthatonlyone
suchsignmaybeerectedordisplayedonanystreetfrontage.Churchsignsmustbeset
backatleast10feetfromthelotlinefacingastreetexceptwhentherequiredbuilding
setbacklineislessthan10feetfromaparticularlotline.
(vii)GeneralRegulations.
(A)Size.

(1)Thetotalsignareaforthefaceofanybuilding,howeverallocatedamongsigntypes(flat
wall,projecting,freestanding,awning,window,and/ormarquee),shallbecomputedonthe
ratioofonesquarefootofsignforeachlinealfootofbuildingfacenottoexceed75feet,
exceptthatnosignattachedtoabuildingfaceshallexceed30squarefeetinarea.
(2)Projectingorfreestandingsignsshallhavenomorethantwosidesandshallhavea
maximumsizepersideofninesquarefeetforbuildingfaceswithfewerthan30linealfeetof
frontage,andamaximumof15squarefeetpersignfaceforbuildingfaceswith30ormore
linealfeetoffrontage.Thelargersignsizeisrestrictedtobuildingswithsingleoccupantsor,
forbuildingswithmultipleoccupancy,tooneprojectingsignsharedbyall.Thesizeof
freestandingsignstobekeyedonthesizeofthelot:smallerthan50linealfeetequalno
morethansixsquarefeet.Lotsbetween50and100linealfeetequalninesquarefeetand
greaterthan100equal30squarefeet.
(3)Thetotalareaofwindowsigns,includingthoseadvertisingsales,inanyonewindow
shallnotexceed20percentoftheareaofthewindow.Thetotalareaofwindowsignsshall
beincludedindeterminingthetotalareaofsignserectedordisplayed.
(4)Intheabsenceofabuilding,thetotalsignareashallnotexceedninesquarefeetper
side.
(5)Freestandingsignsshallbemountedonbasesamaximumofthreefeethigh.No
freestandingsignshallexceed12feetinheightfromgrade.
(B)Number.
(1)Twosignsshallbeallowedperbuildingface,withnotmorethanoneprojecting,
freestanding,ormarqueesignallowedperface.
(2)Morethanoneprojectingsignmaybehungperbracket,providedotherrequirements
relatingtoheightaremet.
(C)Location.
(1)Flatwallsignsmaybelocatedanywhereonthesurfaceofthebuilding.Noportionofa
wallsignshallprojectabovethecornice,roofline,orcoping.
(2)Signageshallnotconcealorobstructsignificantarchitecturalfeaturesofabuilding.
(3)Projectingsigns,whichshallallbeapprovedbythehistoricpreservationcommission,
shallextendnocloserthanonefoottothecurblineandaminimumclearanceofeightfeet
aboveapublicsidewalk,andshallnotprojectoverapublicstreetorvehicularalley.
Projectingsignsshallhavenomorethanonebracketforeveryfull15feetofbuilding
frontage.Neitherthebracketnoranyportionofaprojectingsignmaybeplacedmorethan
20feetabovethefrontsidewalk,orintheabsenceofasidewalk,abovethestreet.Liability
insurancepolicyshallbemaintainedinaccordancewithsubsection(3)(d)(iv)(E)ofthis
section.Signplacementshalltakeintoconsiderationhistoricalplacementofsigns.Historic
signswhethertheyareflat,freestanding,orprojectingmaybeapprovedprovided,thatthe
applicationpresentsevidenceofalocalhistoricalprecedent.Anysignprojectingovercity
rightofwaymustbeapprovedbythecitymanager.

edgeofthemarqueeorawning.Thebottomsofmarqueesignsshallbenotlessthaneight
feetabovethesidewalkorgradeatanypoint.
(D)Content.Signsallowedshallbeidentificationsignsonlyforbusinessesonthepremises,
exceptasotherwisepermittedherein.Attheclosingofabusiness,allrelatedsignageshall
beremoved.
(E)Illumination.Onlyexternalilluminationofsignsispermitted,butinaccordancewiththe
restrictionssetforthbelow:
(1)Thelightfromanyilluminatedsignshallbesoshaded,shielded,ordirectedthatthelight
intensityorbrightnesswillnotbeobjectionabletothesurroundingarea.
(2)Nosignshallhaveblinking,flashing,orflutteringlightsoranyotherilluminationdevice
thathasachanginglightintensity,brightness,orcolor.Beaconlightsshallnotbepermitted.
(3)Nocoloredlightsshallbeusedatanylocationorinanymannersoastobeconfused
withorconstruedastrafficcontroldevices.
(4)Neitherdirectnorreflectedlightfromprimarylightsourcesshallcreateatraffichazardto
operatorsofmotorvehiclesonpublicthoroughfares.
(5)Noexposedreflectivebulb,strobelight,orincandescentlampthatexceeds15watts
shallbeusedontheexteriorsurfaceofanysignsoastoexposethefaceofthebulb,light,
orlamptoanypublicstreetoradjacentproperty.
(6)Awningsmustnotbeilluminated.
(F)DecorativeFlags.Wallmounteddecorativeflags,eachshallnotexceed15squarefeet
inarea.Decorativeflagsshalldisplayonlythelogoofabusinessoradecorativedesign
relatedtothebusinessandshallnotdisplaythewordsorphrasesrelatedtobusiness
activityonthepremises.Anational,state,orlocalgovernmentflagshallalsobelimitedto15
squarefeet,oneperbuilding.Allflagsshallnotprojectabovethehighestpointoftheroofof
thebuilding,norshallitbeattachedtoormountedontopofaroof.Theareaofthe
decorativeflagsshallbedeductedfromthebuildingmountedsignareaallowedby
subsection(3)(d)(vii)(A)(1)ofthissection.
(G)GasolinePumpIslandSigns.Nonilluminatedgasolinepumpislandsignsshallbe
permittedsubjecttothefollowingrestrictions:
(1)Twoselfserveorfullservesignsperpumpislandnottoexceedtwoandonehalf
squarefeeteach(nohistoricpreservationcommissionapprovalorsignpermitshallbe
required).
(2)Onefuelpriceorpromotionalinformationsignmounted/incorporatedintoeachfuelpump
nottoexceedonesquarefoot(nohistoricpreservationcommissionapprovalorsignpermit
shallberequired).

(3)Anyothersignsonthecanopyorpumpislandsshallbesubjecttotherequirementsfor
buildingmountedsignageinsubsection(3)(d)(vii)ofthissection.
(H)StateInspectionCenterSigns.Officialstateinspectioncentersignsforcertifiedstate
inspectionstationsshallbepermittedforservicestationsandautomobiledealerships.These
signsshallbenonilluminatedandlocatedonthebuilding.Themaximumsignareashallbe
sixsquarefeet.Onesuchsignshallbepermitted.Nohistoricpreservationcommission
approvalshallberequired.
(I)MenuBoards.Portablesignsdisplayingmenuitemsforarestaurantonthepremises
shallbepermittedifthefollowingconditionsaremet(nohistoricpreservationcommission
approvalorsignpermitshallberequired):
(1)Numberofsignspermitted:onesignforthemainentrancetotherestaurantbutwherea
restauranthasarearentrancefromanadjacentparkinglot,oneadditionalmenuboardmay
beplacedattherearentrance.

(J)DirectorySigns.Freestandingorbuildingmounteddirectorysignsshallbepermittedfor
shoppingcentersifthefollowingconditionsaremet:
(1)Numberofsignspermitted:onedirectorysignforeach10businessesintheshopping
center.
(2)Maximumsignarea:sevenandonehalfsquarefeet.
(3)Maximumheightforfreestandingsigns:sevenandonehalffeet.
(4)Projectionoveracityrightofway:prohibited.
(5)Locationonacityrightofway:prohibited.
(6)Illumination:prohibited.
(K)ShoppingCenters.Onefreestandingorbuildingmountedsignshallbepermittedfor
eachcityblockoccupiedbytheshoppingcenter.Saidsignsshalldisplayonlythename
and/orlogooftheshoppingcenter,orofaparkingfacilityfortheshoppingcenter,andshall
beinadditiontothesignallowedforindividualbusinessesbysubsection(3)(d)(vii)ofthis
section.
(1)Signareashallnotexceed20squarefeet.

(2)Signheightshallnotexceed12feet,exceptfordecorativebarironcrestingabovethe
signwhichmayextendabovethe12footheightprovided,thatthebarironisnolargerthan
threequartersofaninchbyoneandonehalfinchesincrosssection.
(3)Locationonacityrightofwayisprohibited.
(4)Freestandingsignsshallbemountedonbasesamaximumofthreefeetinheightand
shallnotexceed12feetinheightfromgrade.
(5)Separatesignsattachedtoafreestandingsignoritssupportingstructure,advertising
servicessuchas,butnotlimitedto,automobiletravelclubsandcreditcards,shallbe
prohibited.
(6)Multiplefrontagesignsmusthaveaminimumseparationofonethirdofthefacadelength
fromanycornerofthefacade.
(L)CanopySigns.Signsmountedunderacanopyorcoveredwalkwayanddesignedtobe
viewedprimarilybypedestriansshallbepermittedforshoppingcentersifthefollowing
conditionsaremet:
(1)Onecanopysignforeachbusinessintheshoppingcenter.Thissignshallnotcount
towardthemaximumsignareapermittedbysubsection(3)(d)(vii)ofthissection.
(2)Maximumsignarea:threesquarefeet.
(3)Projectionoveracityrightofway:prohibited.
(M)PortableandSandwichBoardSigns.Oneportableorsandwichboardsignshallbe
permittedperstorefrontuponthefollowingconditionsandshallbeexemptfromthe
provisionsofChapter18.85SCCandrequirenopermit:
(1)Suchsignshallbeplacedimmediatelyinfrontofthestorefrontforwhichitadvertises
(2)Ifplacedonanypublicpedestrianrightofway,suchsignshallbepositionedwiththe
baseofthesignperpendiculartoandinfullcontactwiththestorefrontbuildingface,or,
whereanypublicpedestrianrightofwaydoesnotadjoinadesignatedonstreetparking
area,itmayalsobepositionedperpendiculartoandinfullcontactwiththebackofthecurb
(3)Suchsignshallbenolargeroverallthanfourfeetinheightandtwofeetinwidthand
shallnotrestrictthewidthofthepublicpedestrianrightofwaytolessthan36inches
(4)Suchsignshallhavenoilluminationofanykindandmaybedisplayedonlyduringthe
timewhenthebusinessisopentothepublic.
(viii)ExemptionsfromHistoricDistrictSignRegulations.Thefollowingtypesofsignsare
exemptedfromalltheprovisionsofthischapter,exceptforconstructionandsafetyregulations
andthefollowingrequirements:
(A)PublicSigns.Signsofanoncommercialnatureandinthepublicinterest,erectedbyor
ontheorderofapublicofficerintheperformanceofhispublicduty,suchassafetysigns,
dangersigns,trespassingsigns,trafficsigns,memorialplaques,signsofhistoricalinterest,
etc.

(B)InstitutionalSigns.Signssettingforththenameoranysimpleannouncementforany
public,charitable,educational,orreligiousinstitution,locatedentirelywithinthepremisesof
thatinstitution,uptoanareaof24squarefeet.Suchsignsmaybeilluminatedin
accordancewiththeregulationsshownabove.Ifbuildingmounted,thesesignsshallbeflat
wallsignsandshallnotprojectabovetheroofline.Ifgroundmounted,thetopshallbenot
morethaneightfeetabovegroundlevel.
(C)IntegralSigns.Namesofbuildings,datesoferection,monumentalcitations,
commemorativetablets,etc.,whencarvedintostone,concrete,orsimilarmaterialormade
ofbronze,aluminum,orotherpermanentconstructionandmadeanintegralpartofthe
structure.
(D)PrivateTrafficMovementSigns.Signsdirectingmovementontoapremisesorwithina
premises,notexceedingthreesquarefeetinareaforeachsign.Illuminationofthesesigns
shallbepermittedinaccordancewiththeregulationsabove.
(E)MenuSigns.Menusaffixeddirectlytotheinsideofadoororwindow,oranexterior
glassfronteddisplaycasenotexceedingfoursquarefeetinareaandnotprotrudingmore
thanfourinchesfromthesurfaceonwhichitismounted,stationary,andattachedflat
againstabuilding,fence,orwall,inwhichispostedmenu(s)forarestaurant.
(F)RentalorSalesSigns.Signsonapremisesannouncingroomsforrent,tableboard,
apartmentorhouseforrent,andnotexceedingfoursquarefeetinarea.
(G)VehicleSigns.Signsontrucks,buses,trailers,orothervehicles,whilesuchvehiclesare
inuseinthenormalcourseofbusiness.Thissubsectionisnottobeinterpretedtopermitthe
parking,fordisplaypurposes,ofanyvehicleortrailer,towhichsignsorportablesignsare
attached,inadistrictoronalotoflandwheresuchsignsarenotpermitted.
(H)Signslocatedmorethanfourfeetbehindtheplaneofastorefrontwindow.
(I)Governmentalflags,ortheflagsofanynonprofitorganizationheadquarteredinthecityof
Staunton.Theheightofaflagpoleshallnotexceed25feetintheresidentialdistrictsandfor
allotherzoningdistrictstheheightofaflagpoleshallnotexceedthemaximumbuilding
heightallowedforthezoningdistrictinwhichitislocated.Themaximumsizeofaflagshall
notexceed45squarefeetwhenattachedtoaflagpolewithaheightof35feetorless,and
shallnotexceed65feetwhenattachedtoaflagpolewithaheightgreaterthan35feet.All
flagsshallbemaintainedingoodconditionsoastopresentaneatandorderlyappearance.
Thezoningadministratormaygivewrittennoticetoremoveorreplace,within48hours,any
flagthatbecomesfadedortattered.Failuretocomplywillbeconsideredaviolationofthis
chapter.
(J)TemporarySigns.Temporarysignsshallbenonilluminatedandlimitedtothefollowing
types:
(1)Constructionsigns,whichidentifythearchitects,engineers,contractors,andother
individualsorfirmsinvolvedwiththeconstruction.Suchsignsshallberemovedupon
issuanceofacertificateofoccupancy.Themaximumareaofsuchsignsshallbe32square
feet,andnomorethanonesignshallbepermittedforeachstreetfrontage.
(2)Realestatesigns,advertisingthesale,rental,orleaseofthepremisesorpartofthe
premisesonwhichthesignsaredisplayed.Themaximumsignareashallbeeightsquare

feetinresidentialdistricts,and30squarefeetinnonresidentialdistricts.
(3)Politicalcampaignsignsannouncingthecandidatesseekingpublicpoliticalofficeand
otherinformationpertinentthereto.Thesesignsshallberemovedwithinsevendaysafter
theoccurrenceoftheeventtowhichtheypertain.
(4)Signsadvertisingonlythename,time,andplaceofanybonafidefair,festival,bazaar,
horseshow,orsimilarevent,whenconductedbyapublicagencyorforthebenefitofany
civic,fraternal,religious,orcharitablecauseprovided,thatallsuchsignsshallberemoved
within24hoursafterthelastdayoftheeventtowhichtheypertain.Themaximumsignarea
shallbe32squarefeet.
(5)Buildingmountedgrandopeningsignsnotexceeding30squarefeetshallbepermitted
provided,thatsuchsignorsignsshallnotbedisplayedformorethan30days.Asignpermit
shallberequired.
(6)Seasonalorholidaydecorationsexceptthatseasonalbannersnotexceeding10square
feetinareashallbeallowed.Suchbannersshallnotdisplaythenameofabusinessor
shoppingcenter,northewordsopen,sale,vacancy,orothersimilarwordsorphrases
relatedtothebusinessactivityonthepremises.Thesedecorationsshallberemovedwithin
sevendaysaftertheholidayorseasonalevent.
(7)Changeofbusinessnamebanners/hoods/coversoverexistingbuildingmountedand
freestandingsignsshallbeallowed,whilenewsignsarebeingmanufacturedprovided,that
suchsignorsignsshallnotbedisplayedformorethaneightweeksandshallnotexceedthe
permittedsignareaforthatsite.
(8)SpecialExhibitionSigns.Abuildingusedprimarilyasamuseumorartgalleryshallbe
permittedtoerectabuildingmountedbannerannouncingspecialexhibitions,specialshows,
orspecialdisplaysinprocesswithinthebuildingifasignpermitisobtainedandthefollowing
conditionsaremet:
(a)NumberofBannersPermitted.Onebuildingmountedbannerforeachbuildingused
primarilyasamuseumorartgalleryprovided,thatthebannershallbeplacedonthe
buildingnoearlierthanthreedaysbeforeandremovedwithin24hoursafterthelastdayof
theexhibitiontowhichitpertains.Limitfor30dayswithoutanewpermit.
(b)MaximumBannerArea.Fifteensquarefeetforabuildingwithasetbackoflessthan100
feet,and200squarefeetforabuildingwithasetbackof100feetormore.Setbackshallbe
measuredperpendicularfromthepropertylineatthestreettothecenterofthebanner.
(ix)ProhibitedSignsinBusinessDistrict.
(A)Signsthatcontainorareimitationsofwarning,orsimilarwords,andthataresolocated
astobevisibleandsimilartoofficialtrafficsignsorsignalsorcontainthewordsstop,go
slow,caution,danger,applicabletooperatorsofmotorvehiclesonapublicstreet.
(B)Signsthatareofasize,location,movement,content,coloring,ormannerofillumination
thatmaybeconfusedwithorconstruedastrafficcontroldevicesorthathidefromviewany
trafficorstreetsignorsignal.
(C)Signsthatvisuallyinterferewithtraffic.

(D)Flashingoranimatedsigns.
(E)Signsthatadvertiseanyactivity,business,product,orservicenolongerconductedon
thepremisesuponwhichsuchsignislocated.
(F)Signsthatmoveinanymannerorhaveamovingpart.
(G)Signsthatcontainorconsistofbanners(exceptundersubsection(3)(d)(viii)(J),
TemporarySigns,ofthissection),posters,pennants,ribbons,streamers,stringsoflight
bulbs,spinners,orothersimilarlymovingdevicesandfestoons.Thesedevices,whennot
partofanysign,aresimilarlyprohibited,unlesstheyarepermittedspecificallybyother
legislation.
(H)Anysign,exceptofficialnoticesandadvertisements,whichisnailed,tacked,posted,or
inanyothermannerattachedtoanyutilitypoleorstructureorsupportingwire,cable,or
pipe,ortoanytreeonanystreetorsidewalkortopublicpropertyofanydescription.
(I)Separatesignsattachedtoafreestandingsignoritssupportingstructure,advertising
servicessuchas,butnotlimitedto,automobiletravelclubsandcreditcards.
(J)Anysignthatisattachedtoormountedonarooforprojectsabovetheplaneofthe
buildingfacade.Thisshallincludedecorativeroofssuchasmansardroofs.
(K)Mooredballoonsorotherfloatingsignsthataretetheredtothegroundortoastructure.
(L)Timeandtemperaturesignsconsistingofflashingorintermittentlightsoranintermittent
displaythatisindirectlyilluminated.
(M)Anypermanentortemporarysignaffixedto,paintedon,orplacedinoruponanyparked
vehicle,parkedtrailer,orotherparkeddevicecapableofbeingtowed,whichisobviously
andconspicuouslyparkedsoastoadvertisethebusinesstothepassingmotoristor
pedestrianandwhoseprimaryfunctionistoprovideadditionalonsitesignageoristoserve
thefunctionofanoutdooradvertisingsign.Excludedfromthissubsectionare:
vehicles/equipmentinoperatingcondition,currentlyregisteredandlicensedtooperateon
publicstreetswithavalidinspectionsticker,andactivelyusedinthedailyfunctionofthe
businesstowhichsuchsignsrelatevehicles/equipmentengagedinactiveconstruction
projectsvehicles/equipmentofferedforrenttothegeneralpublicandstoredonpremises.
(x)NonconformingSigns.
(A)Signsthatdonotconformtotheregulationsprescribedbythischapter,butthatwere
erectedinaccordancewithallapplicableregulationsineffectatthetimeoftheirerection,
shallbeconsideredtobenonconformingsigns.Nonconformingsignsshallnotbeenlarged,
extended,modified,reconstructed,orstructurallyalteredexceptinaccordancewiththis
chapter.Nonconformingsignsshallnotberepaintedorrefacedwhentheseactionschange
thewording,composition,color,ormaterialofthesign.
(B)Nonewsignageforabusinessshallbeapproveduntilallnonconformingfreestanding
andbuildingmountedsignspertainingtothatbusinessareremovedormodifiedtocomply
withalltheregulationsprescribedbythischapter.
(C)Nononconformingsignshallbemovedonthesamelotorbuildingortoanotherlotor
buildingunlessthesignasrelocatedismodifiedtocomplywithallrequirementsofthis

chapter.
(D)Ifanonconformingsignisdamagedtoanextentgreaterthan50percentofitscurrent
replacementcost,itshallnotberebuilt.
(xi)Maintenance.Allsignsandcomponentsthereofshallbekeptingoodrepairandinasafe,
neat,clean,andattractivecondition.
(xii)RemovalofAbandonedSigns.Asignshallberemovedbytheownerorlesseeofthe
premisesuponwhichthesignislocatedwhenthebusinessthatitadvertisesisnolonger
conductedonthepremises.Iftheownerorlesseefailstoremovesuchsign,thezoning
administratorshallgivetheowner15dayswrittennoticetoremoveit.Uponfailuretocomply
withthisnotice,thezoningadministratorortheadministratorsdulyauthorizedrepresentative
mayremovethesignatcosttotheowner.Suchsign,removedbythezoningadministrator,shall
bestoredwithfeesassetforthinsubsection(3)(d)(iv)(F)ofthissection.
(xiii)EnforcementofChapter.
(A)Thezoningadministratorand/orthedirectorofplanningisherebyauthorizedand
directedtoenforcealloftheprovisionsofthischapter.Uponpresentationofproper
credentials,thezoningadministratorortheadministratorsdulyauthorizedrepresentative
mayenter,atreasonabletimes,anybuilding,structure,orpremisesinthecitytoperform
anydutyimposeduponthembythischapter.
(B)Wherethereisanyambiguityordisputeconcerningtheinterpretationofthischapter,the
decisionofthezoningadministratorshallprevail,subjecttoappealasprovidedin
subsection(3)(d)(xiv)ofthissection.
(xiv)Appeals.Anyperson,firm,orcorporationaggrievedbyanydecisionmadehereunderbythe
historicpreservationcommissionorthedirectorofplanningorthezoningadministrator,may,
within30daysoftheactionordecisiongivingrisetosuchcomplaint,appealthesameinwriting
tothecouncilforthecityofStaunton.Suchcomplaintshallbeheardbysaidcouncilwithin30
daysofreceiptbytheclerkofcouncil.Acopyofthewrittenappealshallalsobemailedor
deliveredtothedirectorofplanningatthesametimetheappealismadetocitycouncil.
(xv)Severability.Thischapter,andthevariousparts,sections,andclauseshereof,arehereby
declaredtobeseverable.Ifanypart,section,orclauseisadjudgedinvalid,theremaindershall
remaininfullforceandeffect.(Ord.201004Ord.200921.ZoningordinanceArt.5,8).
18.140.050Industrialdistrictregulations.
Inanyindustrialdistrict,thefollowingregulationsshallapply:
(1)Businesssignsnotexceedingonesquarefootperonelinearfootofstreetfrontage.Suchsignshallbe
locatednotcloserthanonehalftherequiredsetbackfromallpropertylines.
(2)Flashingtointermittentilluminationisprohibited.
(3)Billboardsandotheradvertisingstructuresareprohibited.(ZoningordinanceArt.5,8).
18.140.060Permittedsigns.
Inanydistrict,thefollowingsignsshallbepermitted:

(1)Foreachpermittedorrequiredparkingareathathasacapacityofmorethanfourcars,one
nonilluminatedsign,notmorethantwosquarefeetinarea,designatingeachentrancetoorexitfromsuch
parkingarea,andonenonilluminatedsign,notmorethanninesquarefeetinarea,identifyingor
designatingtheconditionsofuseofsuchparkingarea.
(2)Onenonilluminatedforsaleorforrentsignnotexceedingfoursquarefeetinareaandadvertising
thesale,rental,orleaseofthepremisesonwhichthesignislocated.Alargersignshallbepermittedfor
twoormorelotsinsingleownershiporforpropertiesinexcessof100feetinwidthprovided,thatthearea
ofsuchsignshallbeincreasedonagradedscaleofonesquarefootincreaseintheareaforeach
additionalfivefeetoffrontageover100feet,butinnocaseshallthesignexceedintheaggregate200
squarefeet.Suchsignshallbeagroundorwallsignandlocatednotcloserthan20feetfromthestreet
line.
(3)Foreachrealestatesubdivisionthathasbeenapprovedinaccordancewiththeregulationsofthecity,
onesign,notover100squarefeetinarea,advertisingthesaleofpropertyinsuchsubdivision.Suchsign
shallbepermittedonlywhenlocatedonsomeportionofthesubdivisionbeingadvertisedforsaleandshall
notencroachuponanyrequiredyard.Suchsignmaybeilluminated,butnoflashing,intermittent,or
animatedilluminationispermitted.Suchsignshallbemaintainedonlyduringsuchtimeassomeportionof

Wheneveritshallappeartothezoningadministratorthatanysignhasbeenconstructedorerectedoris
beingmaintainedinviolationofthetermsofthischapter,orisunsafeorinsecure,suchsignshalleitherbe
madetoconformwithallsignregulationsasprovidedbythischapterorshallberemovedwithin10days
afterwrittennotificationthereofbythezoningadministrator.Suchsignshallberemovedattheexpenseof

18.140.080Permitsandfees.
PermitsandfeesshallberegulatedbythecodeofthecityofStaunton.(ZoningordinanceArt.5,8).
