Residential Lease Agreement

Landlord agrees to lease the real property located in the City of________________,
State of Texas, located at___________________________________________________
to __________________________. (Resident).
1.

RENT

Resident agrees to pay the a base rent in the amount of $_______________per


month. There may be an additional monthly CAM fee which may change from time to
time if taxes and or insurance costs go up or down. All payments are due on the 1st day
of each month. There is a 5 day grace period. The lease will begin 30 days after move-in
and will continue on a month to month basis & will automatically renew until one party
notifies the other of termination.

UTILITIES, SECURITY DEVICES

Resident has agreed to provide all deposits needed to turn on utilities for
electricity, water, gas, etc. Resident has agreed to take full responsibility to maintain all
security and exterior door locks and Smoke Detectors. Resident has expressly waived
any obligation from the Managing Agent to provide security or smoke detectors for the
Property.
4.

LATE CHARGES

In the event rent is not received prior to 5:00 PM. on the 10 th day of the month,
regardless of cause including holidays and dishonored checks; Resident agrees to pay the
Landlord or Managing Agent a late charge of $100 plus additional charges of $10 per
day thereafter until rent is paid in full.
5.

REPAIRS

Landlord pays zero. Resident is taking property in as-is condition and is


responsible for all repairs including lawns, roofs, plumbing, electrical, structural,
termites, etc. and to keep the property in accordance with any home owner association
rules or regulations. Resident agrees to keep the property clean and sanitary; to promptly
dispose of all garbage in appropriate receptacles; to supply and change heating and air
conditioning filters at least once a month; to supply and replace light bulbs and smoke
detector batteries; to promptly eliminate any dangerous condition on the property caused
by the Resident or the Residents guests; to take precautions to prevent broken water
pipes when freezing; to replace any lost or misplaced keys; to pay any periodic,
preventive, or additional extermination costs desired by Resident.

6.
HOA FEES
It is the Residents responsibility to pay any HOA fees whether they are annual fees,
one time fees, or monthly fees.
7.

FIRST RIGHT OF PURCHASE


Resident has first right of purchase if the Landlord elects to sell the property.

8.

DEPOSIT
The deposit amount held will be the equivelent of one months rent.

10.

SPECIAL PROVISIONS

Tenant agrees to make agreed improvements to the property in lieu of payinng a one
month deposit. This lease is subject to Landlord successfully purchasing the property
from the owner of record.
11.

AGREEMENT OF THE PARTIES

Waiver: Landlords past delay, waiver, or non-enforcement acceleration, contractual or


statutory lien, rental due date, or any other right will not be deemed to be a waiver of any
other breach by Tenant or any other term, condition, or covenant in this Lease.
This is intended to be a legal agreement binding upon final acceptance. READ IT
CAREFULLY. If you do not understand the effect of this Lease, consult your attorney
BEFORE signing.
