Semonite ‘Commanding General and Chief of Engineers U.S. Army Corps of Engineers 441 G Street NW Washington, DC 20314-1000 Dear Madam Attorney General, Madam Secretary and Lieutenant General Semonite: Re: North Dakota Protest Camp, U.S. Government Property and Dakota Access Pipeline As Sheriff of Mercer County, North Dakota, | want to make very clear to you the situation we face locally. Hundreds of individuals are continuing to illegally occupy Army Corps of Engineers property adjacent to the Oahe Reservoir at the site of the proposed crossing of the Dakota Access Pipeline. Lest you think otherwise, these are not peaceful protestors. They are armed, hostile, and engaged in training exercises which can only be intended to promote violence, whether on Corps property or elsewhere. These rioters have left Corps and Standing Rock property on multiple occasions and travel several miles to enter private property to assault employees, private security personnel and ‘damage property that will take millions of dollars to repair. A number of these individuals have been observed brandishing weapons. As the Sheriff of Mercer County and also Deputy Incident Commander at Morton County Emergency Operations Center, itis my responsibilty to ensure public safety and enforce the law. This is a sufficient challenge under the best of circumstances. But when the Corps continues to harbor, and thereby implicitly condone lawlessness on and beyond federal property, that challenge becomes all but insurmountable. As you are aware, we have made numerous requests to the Corps, the Department of Justice and other federal agencies for federal assistance in protecting people and The Honorable Loretta E. To date, we have not received any federal assistance of any type despite our repeated requests. In addition, we have requested that the Corps not continue to allow these hostile protesters to occupy Corps land in such close proximity to the construction activities of the Dakota Access Pipeline as this occupation is a recipe for disaster. In my opinion the Department of Justice, Corps, and Department of Interior should share responsibility if anyone is hurt Thank you for your attention in this matter.
