In accordance with Articlc 36 (2) and 40 (x) of the Statiite
of the International Court aild of Articlc 32 (2) of the liules of
the Court, 1 have the haiiour to submit the present Application
instituting proceedings i ~ i the name of thc Governme~it of t h e
Pri~icipalityof Liechtenstein against the Governrnent of Guatemala.
2. The subject of the dispute and the statement of what in
the vieii: of thc Government of the Principality of Liechtenstein
are the relcvaiit facts are coritaiiied in the Note addressed on
6 July rggI by the Goveriiinent of the Principality of Liechtenstein to the Governineilt of Guatemala and appended as Annex
No. I to the present Application. In the aid S o t e the Governrnent
of the Principality of Liechtenstein drew the attention of the
Government of Guatemala to the fact that the latter Government
have acted towards the pcrson and property of Mr. Friedrich
Nottebohm, a citizen of Iiechtenstein, in a manner contrary to
international 1 s ; ~that,

they have esposed him to uiijustifiable measrires of cletention,
iiiternment aiid expulsion ; and that they have sequestrated and

compensate him for the losses suffered as t h e result of the iinlawful

Government of the Principality of Liechtenstei~iintirriated t h a t
iii the absence of a satisfactory settlenient they would have no
alternative but to subrnit the case to the Interriatioiial Court
of Justice. On 24 July 1951 the JIiiiistry of Foreign hffairs of
Guatemala acknowledged the receipt of the nbove Note (Annes
No. 2). On 24 October 1951 the Goveriiineiit of the Principality
of Liechtenstein informed the Governrnent of Giiatemala that as

Conformment aus articles 36 (2) et qc (1) du Statut de la Cour
ititernationaie de Justice, ainsi qu' l'article 32 (2) du Reglement
de la Cour, j'ai I'hoiineur dc 1~00stransmettre la prsente recliite
introductive d'inst:~nceau nom du Gouverriement de la Prir-icipniit
du Liechtenstein contre le Gouvernemcnt du Guatemala.
2. L'objet du diffrend et l'nonc dc ce qui, selon le Goii\*ernenient de la Principaut du Liechtensteiri, constitue les faits pertinents, figurent dans la note que le Gouvernement de la Principaut
du Liechtenstein a adresse au Gouvernement du Guatemala,
la date du 6 juillet IgjI. Dans cette iiote, qui est jointe en ariiiese
no I la prseiite requte, le Gouvcrnemcnt de la Principaut clu
Lieclitenstein attirait l'attention du Gouvernement du Gu:itcmrila
siii- le fait que cc dernier gouvernement avait pris, contre la persoiine et les b i w s de M. Friedrich Nrittebohin, ressortissant clu
Liechtenstein, dcs mesures qui taient contraires au droit international. Il aurait notamment trait 31. Nottebohm, ressortissant
d'un Etat neutre, coinme si celui-ci tait un ressortissant enriemi ;
il loi aurait fait subir diverses mesures irijustifiables : dteiltion,
iiiternement et expulsion, et lui aiirait sqriestr puis ccinfisqu
ses biens. Dans la note prcite, le Gouvernement de Ia Principaut
clu Liechtenstein exprimait l'opinion rlue le Gouvcrnemcnt du
Guatemala Citait tenu, en droit internatini~sl, restituer les .liens
dc M. Nottebohm et 3. lui accorder rparation pour les llertes
qu'il avait subies la suite des mesures illgales ]->risesppar lc Gouvernement du Guatemala. Dans la mme. iiote, le Gorivernement
de la Principaiit du 1-iechtenstein indiquait que, faute d'lin rglement satisfaisant, il se verrait oblig de soiimettre l'affaire la
Cour internationale de Jiistice. Lc 24 juillet 1951, le ministre
des Affaires trangbres du Guatemala accusa la rception cte la
note prcite (annexe no 2). Le 174 octobre 1951,le Gouverriement
de la PrinciputC du Liechtenstein informa le Gouvernement du
Guatemala que, n'ayant reu aucune rbpoiise sa note du 6 juillet

6. 'The claim of the Governmerit of the Principality of Lieclitcnstein i : (a) that the Government of Guatemala has acted contrary
to international law and has incurred international responsibility by
the unjustified detentiGn, internrnent and espulsion of &Ir. Xottebohm and by the sequestration and confiscatio~iof his property ;
(b) that the Government of Guatemala is houiid ta restore t o
Mr. Nottebohm his movable and immovable assets a s showxi in the
Iist appended to the Note of 6 July 1951 jdnnex No. 1) ; ( c ) that
the Government of Guatemala is hound to grant full compensation
to &Ir. Nottebohm in respect of such property as it is not in a positioii to restore to him owing to physical destructio~lor for other
reasons; ( d l that the Government of Guatemala is boiind t o pay fuli
compensation for the use of and profits derived from the sequestratcd
and corifiscated asscts and proycrties as well as for damage, deprcciation and other losses sustained in respect of t h e aid asets and
properties as the result of or in connection with their sequestration
or confiscation ; (e) that thc Government of Guatemala is bound to
pay full compensation for the unlawful detention and internrnent
of Mr. Nottebohrn as well as for preventing hirn, in a rnaiiner
amouiiting to uxijustified expulsioli, from returning to Guatemala ;
( j ) that the Court shall determine the amount of compensation due
t o the Government of the Principality of Liechtenstein under ( c ) ,
(d)and (e) above.

6. La demande du Gouvernement de la Principaut du Liechtenstein comporte les points suivaiits : a) le Gouvernement du Guatemala a agi contrairement au droit international, et a cngagi: sa
responsabilit internationale en procdant, sans justes motifs, la
dtention, l'ititerncment et l'expulsion de M. Nottebohrn, ainsi
qu'au srluetrc et A la corifiscatioii de ses biens ; b j le Gouvernement du Guatemala cst tenu de restituer M. Nottebohm les biens
mobiliers et immobiliers de celui-ci, selori la liste jointe la note
du 6 juillet I g j I (annexe no r) ; c) le Gouvernement du Guatemala
est tenu, envers M. Xottebohm, rkparation pleine et entire pour
les biens qu'il ii'est pas en mesure de restituer raison de destriiction matrielle OU pour d'autres motifs ; d) le Gou\~eriieineiitdu
Guatemala est tenu rparation pleine et entire pour l'usage des
biens et avoirs squestrs et confisqus, pour les bnfices qu'il en
a tir&, ainsi que pour les dommages, ln dprciatiori et les autres
pertes que ces hieris et avoirs ont subis la suite oii A propos de
leur squestre ou coiifiscation ; e ) le Gouvernement di1 Guatemala
est tenu rparation pleine et entire pour avoir illgalement procd
la dtention et a l'internement de M. Nottebohm et pour avoir
empch le retour de celui-ci au Guatemala, ce qui quivalait ririe
expulsion injustifie ; f ) il incombe la Cour de fixer le montant de
l'indemnit duc au Gouvernement de la Principaut du 1,iechteristein pour les chcfs prcits c ) , d ) et e ) dc la demande.

Quelque temps aprs le dbut de son internement - au commcncernent de 1944 -, les biens mobiliers et immobiliers de M. Friedrich
Nottebohm ont t squestrs, Dans la mesure oir les autorits
guatmaltques ont expliqu les mesures prises l'encontre de
M. Nottebohm, elles ont mentionn le fait que son nom avait figur
sur la liste noire 'britannique et amricaine. A cet gard, il convient
de relever qu' la date du 7 mars ~ g q ql'attach

Sa Majest britannique en Amrique centrale, j'ai men une
enqute approfondie au sujet de l'entreprise Nottebohm Hermanos et de ses directeurs. Nous avons examin, un expert
comptable et moi-mme, les oprations commerciales auxquelles cette entreprise avait procd depuis aot I939
jusqu' septembre 1943, et n'avons pu ddcouvrir un seul
exemple d'assistance donne par cette maison l'ennemi. Cette
enqute m'a convaincu que les accusations portes contre
Nottebohm Hermanos et qui avaient entran son inscription
sur la liste statutaire de 1939 taient fondes sur des renseignements errons et sur des dclarations confuses, nonces de
bonne foi. J'ai procd en mme temps une enqute sur la
vie des associs Frederic Nottebohm et Karl Heinz Nottebohm et suis arriv la conclusion qu'ils n'avaient ni l'un
ni l'autre donn aide aux Nazis, soit dans leurs affaires, soit
titre priv. Cette enqute, de mme que ma connaissance
personnelle des associs, me conduisent l'opinion qu'ils ne
sauraient tre considrs comme des sympathisants nazis.
