CYBERCRIME PREVENTION ACT 2016

A bill to create a nationwide cybercrime software that is free to business and the public to detect
cybercrime activity.

4 SECTION 1. CYBERCRIME PREVENTION ACT 2016

This act may be cited as the Cybercrime Prevention Act of 2016.

7 SECTION 2. FINDINGS
8 Congress hereby finds and declares that,
9 1) More than 80% of companies responded that endpoint security is compromised because careless
10 employees.
11 2) 68% of funds lost during an attack are unrecoverable.
12 3) Estimated global annual cost of cyber activity ranges from US $ 300 B to US $1 Trillion.
13 4) Nearly 75% of all legitimate websites have unpatched vulnerabilities because website
14 administrators fail to secure their websites.
15 5) There has been a 176% increase in the number of cyberattacks, and a 96% increase since 2010.
16 6) Identity theft is now the fastest growing crime in America.
17 7) According to an FBI survey, 90% of respondents detected security breaches in the past year but
18 only 34 percent reported those attacks to authorities.
19 8) Cyber-attacks cost businesses $400-$500 billion a year, not including the large number of cyber
20 attacks which are not reported.
21 9) Only 38% of global organizations are prepared to handle a sophisticated cyberattack.
22 10) The FBI had to notify over 3,000 U.S. companies that they were victims of cyber security
23 breaches in 2013.

25 SECTION 3. STATUTORY LANGUAGE
26 A) The Cybercrime Prevention Act of 2016 shall create a nationwide cybercrime software that is free
27 to businesses and the public to detect cybercrime activity. A portion of this bill shall provide funding
28 to Corporations and individuals who are vulnerable to cyberattacks. This Bill shall include employee
29 training to promote awareness to prevent careless errors. Educating employees of large companies
30 shall include what to look for and how to identify methods of malicious cyber activity. The software
31 included in this Bill shall enhance Firewalls and secured password protection in order to prevent
32 cyber attacks. A Firewall is a network system that forms a wall that filters trusted and untrusted
33 information. This software ensures that Corporations are given the most secure firewall security
34 network system.
35 B) The Enforcement Agency for this Bill will fall under the jurisdiction of the Federal Government
36 and the Federal Bureau of Investigation due to the fact that many of the cyberattacks that victimize
37 individuals and large corporations are cross-jurisdictional and often times International. The funding
38 source for this Bill shall be provided by the Department of Homeland Security through current tax
39 revenues. Fund matching by each Corporation and Department of Homeland Security shall be offered
40 as an additional funding source if necessary.
41 C) The Cybercrime Prevention Act of 2016 shall be enacted on January 1, 2017. This Bill will expire
42 on January 1, 2022.
