Acting Justice James McCarthy of State Supreme Court in Oswego

ruled that Mario M. Cuomo, the governor at the time, ''exceeded his
authority'' by entering into the 1993 compact with the Oneida
nation without legislative approval.

What effect, if any, the court decision has on Turning Stone, a sprawling casino resort
that attracts 4.2 million visitors a year, is uncertain. Turning Stone, in Verona, in
central New York, now includes a huge casino, three championship golf courses, three
luxury hotels, a spa, a convention center, a cabaret-style showroom and an arena.

The legitimacy of the agreement was challenged by Upstate Citizens for Equality, a
group created by central New Yorkers to oppose the Oneidas. It says the casino has MOST POPULAR
eroded non-Indian businesses.
