Excellency
Our net has been honored to show you our first and second reports about the
violations of human. Even though the UNHCR in Geneva has only sent an official reply
in 6. Feb. 2006 about the first report, we present the 3rd periodic report of our net to your
highness about the situation of human violation for the duration from October up to the
end of the year 2005. We repeat our being readiness to bring all the proofs, witnesses and
evidences that ensure what's mentioned in our net reports no matter of the risks and
difficulties we work through.

Excellency
As we repeat our demand to investigation of what came in the three reports
accordance with the authority of the UNHCR based on the General Assembly of the UN
resolution 141 / 48 (Item 4) issued in 20. Dec. 1993 to the investigation of the serious
human violation in Iraq and to move the findings of that investigation to the UN to make
the suitable decisions for the protection of Iraqi human rights who are daily killed!

The decision of re-appointing the private reporter and his return has become
with more insisting and importance now more than any other time, so all the activists of
human rights are seeking for the most simple right of theirs where the UN takes a serious
decision for the re-appointing of the private reporter of the human rights in Iraq to study
and observe all violations and crimes still savagely take place more than any other time
and threaten our country for a sectarian war.

Excellency
The Iraqi people hope that the UN will support these legal demands and offer
the more of the efforts to protect human rights for all the Iraqis and have an end to all
those daily violations through encouraging the supremacy of law, returning of the real
sovereignty and end all the occupation left behind problems in our country.

Our net has been honored to show you our first and second periodical reports
through the office of human rights in the mission of the UN in Iraq which is subordinated
to UNHCR, even though we received an official reply dated in 6. Feb. 2006 from you
through Mr. Faraj Fnesh about the first report.

We realize that our demand in re-appointing the private decider of human rights
in Iraq needs the agreement the member countries in the human rights committee, while
the possibility of presenting it to that committee is falling under the duties of the UNHCR
as we think. As we repeat our demanding for the investigating of what came in the last
two reports in addition to the our third report, and according to the resolution of the
General Assembly of the UN 141 / 48 ( Item 4) dated in 20. Dec. 1993 to the
investigation of the serious human violation in Iraq and to move the findings of that
investigation to the UN to make the suitable decisions for the protection of Iraqi human
rights who are daily killed!

Summary:

The observer to the daily events in Iraq will find that the violations
to the Iraqi human rights are very serious and methodical. The daily killing we see in
Iraq for tens of Iraqis, random collective arresting with no legal or human justifications,
sectarian killing and executions out of the law range are all the best proof. So, we don't
find it strange that there is a race between many political sides to accelerate the
establishment of their own special dictatorships that can fulfill their ambitions and
achieve their political agendas in controlling and distribution of influence inside Iraq for
the sake of dividing the wealth as if it's their personal possessions.

That's why the proceedings and legislation of the present Iraqi


governments to ensure that theory. From one side it claims to fight the administrative
corruption and who works on it while it gives a full rein to responsible persons to take
decisions which are contrary to the Iraqi and international law under untrue names and
work under those names to finish their settlements with their opponents. According to
what's been mentioned in the speech of the personal representative of the UN secretary-
general in front of the Security Council dated in 21. Sep. 2005 , the most important
challenges that faced the mission of the of the UN to aid Iraq UNAMI were:
Encouraging and consolidation of the national conciliation through the policies
characterized participation, transparency and response to improve the standard of the
daily deteriorated security.

Respecting the Iraqi ownership of the political process and


strengthening the state security. Developing of the practices of rational rule and
building abilities of the establishment. Encouraging the international and regional sides
to support the transitional period in Iraq.

If we compare that with the daily tragic Iraqi factual situation as


much as it's related to the first item, we'll find that sectarian and ethnic sectioning and
ethnic allegiance were most prominent and more than consolidating the national
conciliation or keeping the national unity. In spite of talking about democracy and
alternating authority, but demanding for the federalism once, and disunion once again
are still continuous with the excuse of not giving the opportunity to dictatorship central

authority. Then why do the groups dominating the present Iraqi government refuse an
of an Arabic national conciliation initiative by the League of Arab States although there's
a pressing need to it in this specific time.

About the second item, we have to ask how can the security of the
state can be strengthened under the existence of the militias and military forces who
refuse to merge in the official state systems. Besides, how can the army and security
forces be formed from militias of the political parties but not from independent sides?
The allegiance of those military and security establishments will mainly be to those
parties but to the law supremacy of law and Iraqi united state.

About the third item, and in spite of the activities done by the mission
of the UN to the present Iraq government related groups to be trained on transparency
subject and rational rule, but we find that the administrative corruption and bribes
either during Ayad allawi government or jaffari present government never changed
anything of the corruption while it had many shapes as some of them are cleared in this
report. Iraq has become one of the most countries where corruption is in all the state
systems.

About the fourth item, what is to be sorry for is that the regional and
international encouraging to this transitional period was to be characterized by financial
support and the increasing of experiences and training the groups related to the
government in a non-programmed way, but came to be employed for the support of the
benefits of the occupation countries and add legitimacy for their actions in Iraq. With the
excuses of supporting the Iraqi people there's a disregarding of the condemnation of
actions of the occupation forces and Iraqi authorities from the dispersion of wealth,
shameful systematic breaking of human rights, effacement of the Iraqi national
identity, exciting the tribalism spirit and sectarianism, In spite of the claims of
sovereignty authority transferring that is more than protection and application of the
law standards and international covenants of human rights.

Chapter one:
International Humanitarian Law:

First: Collective Punishment

The operations of the collective punishment has become the most clear
sign of the American forces practice in Iraq. What's to feel sorry for are the Iraqi
units newly founded inside the ministry of defense and interior when they have
been trained for such operations. For the excuses of looking for terrorists, or to
destroy the insurgents, wide military operation have been done and still going on
in many Iraqi town that resulted to the most ugly violations to the rules of the
international humanitarian law. The most appeared results of those military
operations were the fully turning of towns and residential neighborhoods into
collective cemeteries of the civilian population. The American forces used
excessive force against unarmed civilian mostly without any proportionality of
weapons the resisters had in the places where there is resistance. The most
danger is that the those operations will be concentrated in towns of a majority of
a specific doctrine who refused occupation and its results what makes the
describing of those operations as a genocide to the members of this doctrine
nearer to actuality. It's so terrifying all that could happen under the view and
hearing of the international society and international organizations, and the
crimes come successively with no condemnation and international investigation
as if the goal through this is to efface the facts as long as the side that is
breaking owns a hideous force. May be some of this silence comes as a response
to what the American administration is trying to show that who resists the
occupation are terrorists want to control the region and then the whole world,
and that they should be annihilated using all means!! The most clear examples to
what we said:
1. The crime of killing 40 persons in Albu Obaid and albu Farraj:
The Arabic, western and international media reported in 17. Nov. 2005 reported
by the Pentagon that the American military planes targeted a group of terrorists
in Ramadi and killed 70 armed. The truth is that there was a bomb targeted an
American armored vehicle in Sunday, 15. Nov, which is the same day voting for

the constitution. That was IN Abu Obaid village in the eastern suburbs of
Ramadi town. That operation resulted of five American killed soldiers who were
on that armored vehicle. In the day after, while a crowd of people were gathering
around the remains of the armored vehicle, an F- 15 American fighter shot a
missile towards the crowd and killed twenty immediately.
To justify that massacre, the American forces claimed that those
twenty (terrorists) were trying to lay a bomb in the same place of the
destroyed armored vehicle! While the eye witnesses showed us that
those victims were all civilians, and many children were among them
with the crowd around the destroyed armored vehicle curiously like
always. Sa'ad jawad, a clan chief in the area told us that twenty five
civilians have been killed because of that new massacre. Then the
American fighter continued its vengeful round to the people of
Ramadi to bombard a building in Albu Farraj village and killed
fourteen civilians with a ten years old boy among them.

Second: War crimes and crimes against humanity:


1. Crimes of the American Troops:

A former solider from the American army uncovered the


horribleness his battalion did against Iraqi civilians through the
American invasion in 2003. The former sergeant, Jimmy Messy
said after publishing his book in Paris in November / 2005 that
the training of the American strengthened violence tendency of
those forces which later inflamed the resistance movement seen
in Iraq now. Messy said: "The attack that the Iraqi people were
treated with at the start of the invasion was the main reason in the
daily attacks that targeted the American forces and Iraqis." Jimmy
Messy, who served for twelve years as a solider in the marines and
spent three months in Iraq before he was demobilized with a rank
of honor after his injury talked about those crimes in his book
"kill!! Kill!! Kill!!" which he wrote in cooperation with the French
journalist Natasha Solner and published in France. Messy's, who
left Iraq in May, 2003 composed his book after he left the army
after deep depression because of the war. Messy said "This
experience of writing helped me to bandage my wounds and close
many chapters in my life and answer many questions. The former
marines solider mentioned in his book that he was responsible for
a platoon in the third battalion of the seventh fighting team where
he was charged with the checking points and providing military
cover against armed elements. He said that his platoon killed
more than thirty civilians in Iraq in 2003 within a month and a
half. He added: "As a matter of fact, we raised violence." In his
book, he reviewed an accident took place in April, 2003 when
some elements of the marines took the initiative to shoot fire
against ten of unarmed strikers (nearby Al Rasheed military
complex to the eastern south of Baghdad) who were holding
banners against the American forces saying: "Go back home."
Only when they heard a sound of a gunshot. Messy said that he
shot twelve shots, and only one striker could escape. He also

added: "Al Rasheed complex accident became clear in a


quietness moment and realized that we based the general method
to what Iraqis see and we ourselves showed the savageness with
our action." Messy also tells how did he consult the chief officer
and told him that the American military campaign's "Like
annihilation" and "The only goal was oil and gains." The former
solider said that this widespread violence among the American
soldiers is a result of a training ratified by the highest offices in
the American leadership. In his book, he considered Abu Ghraib
scandals of torturing done by American military forces to
prisoners was only an indication of the problem indications. In his
book, Messy confirmed that the military directions tell the
soldiers: "Every human is a possible terrorist." It raised fears and
panic inside the marines' souls. Messy accused the administration
of the American president George Bush that it's responsible for
"Horribleness, and killing actions committed at the checking
points." Referring to the French copy of the book presented in
markets now. From another side, the spokeswoman of the
Pentagon alleged that Messy's presenting has been investigated
before and it was proved as not correct.
The American forces existing in AlQayim broke into Al-Obaidi
village in 6. Nov. 2005 and arrest a big number of the population
including a girl of seventeen years old from Albu-mahal clan. The
occupation forces exploded three houses later, after evacuating
their residents.
The correspondent of the National Iraqi News Agency (NINA)
reported that the American planes bombed the are of Al-Taji
shore (Al-Tajiyat) at 2:00 a.m. after midnight of Wednesday-
Thursday in 10. Nov. 2005. The number of victims was big
because of the bombing, there were children and women. At dawn
of Thursday, the whole area was surrounded and started a wide
operation of breaking into and checking included houses and
farms. Not any declaration announced by the American forces
about that accident.
The American forces were doing a night breaking in AL-Dhiluiya
three days ago on Saturday, 24. Dec. 2005 at 9:00 p.m. They
arrested many persons after the execution of three shot to death

after in front of their family's eyes after letting them be by the


wall of Ahmed Kareem's (dead) house. They were:
1. Dhirgam Shia' Mahmood.
2. Fouad Obaid.
3. Ahmed Kareem.
All of them were relatives and neighbors living in Khazraj area.
The American forces were breaking into the houses of Al-
Makhlabi neighborhood and Aziz Balad through in 23-26 of Dec.
2005. They American forces destroyd the furniture, robbed money
and humiliated the civilians.
The American forces kept on the siege to Tal Al-Dhahab village in
Yathrib district / Al-Dhuluiya town from 12. Dec. 2005 up to 13.
Jan. 2006 preventing entering of going out. They also did an
arresting campaign, breaking into, killing animals and burning the
house of a citizen. Besides, the American forces cut off the road
that links Baghdad to Mosil and Yathrib Al-Dhuluiya. It's a main
road and important to the families to get public services for their
lives and staying.
The American forces shot fire against civilians when doing
checking campaigns in many streets and lanes of Ramadi, the
biggest town in Al-Anbar, to the west of Iraq in 12. Nov. 2005. A
medical source informed in Al-Ramadi Public hospital that the
hospital receives twelve dead bodies shot with bullets in different
places of their bodies. He informed that five of those victims were
from the employees of Al-Anbar governorate health office, three
were employees in electricity office, three were employees in Al-
Ramadi secondary school in addition to two from the collage of
medicine / Al-Anbar university.
The American forces slaughter Khudhayir Fazza' Al-Zobayi in
front of his house:
The American forces broke into Al-Azzam village in western Al-
Radhwania town in 11. Oct. 2005 after the afternoon prayer. They
started checking the houses and farms. That force broke into the
house of Khudhayir Fazza' Al-Zobayi by force and he wasn't there at
that time. When the force asked his family about the place he exists
the family answered that he's in the farm. Two soldiers went and
brought him in front of the house after letting his family be out. They

put him tied in front of one of the neighbors houses and the soldiers
started torturing him by hitting him with wooden pegs and an iron
hammer where pieces of meat belongs to the victim were found on.
They conducted his body to electricity and the neighbors heard his
screaming and saying the Islamic testify. The forces left quickly after
they made sure of his death according to the victim's family
informing. The neighbor who was tied too heard his crying and
saying the Islamic testify, then the soldiers ran in a hurry to their cars
and left. When the family of the martyr got into the house, they found
him slaughtered and after burying him by his family, the same force
broke into the house of Ibraheem Khaleel and hit him with his son
Khalid. On their way out, they met his other two sons Muhammad and
hamid, so they hit them too. The victim's neck looked as if he was
slaughtered by a knife which showed the hideousness of the
occupiers and its going deep into violation to people, and the victim's
pictures proved. The signs of this kind of crimes started appearing for
there're more than a situation happened to many innocent civilians.

The American forces shot fire against Mr. Ra'ad Salim Hammoudi,
Mosil sport club trainer in 08. Oct. 2005 and killed him while he was
driving in the fifth tunnel bridge before sunset prayer while he was on
his way back home with his friend where both were killed. What's
worth mentioning is that the victim was working in Musil club before
and he started training Aqra club after leaving Musil club. He's
considered as one of the important trainers in Iraq who contribute to
support sport, football (soccer) and supported the activities of sport
teams in Ninawa governorate.
The American forces prevented the Iraqi red crescent from reaching
the families living outdoors in Khalidiya town in 27. Dec. 2005
morning to give aids to people after they seized their lands and swept
away their orchards. The man who's in charge of aid team heading to
the victim village, Mr. Nezar Ahmed passed on that the occupation
forces threatened to bomb an of the Iraqi red crescent that goes into
the area, and asked for an official letter from the government allows
authorizes the team to give the aid in an attempt to stop the aid from
being to people.
Fourteen Iraqis died in 26. Dec. 2005. There were children, women
and old men among the dead after the second night they spent

outdoors because the occupation forces threw them out of their


houses, swept their arable lands and has been used as a military
base. Passed on by a medical source in Khaldiya, Albu-Hzayim village
that fourteen Iraqis spent the second night yesterday outdoors during
biting coldness wave that hit the area. They were four women, three
children and too old men and five other persons. They were taken to
Khaldiya hospital. Our correspondent added passed on the medical
source: "It was clear appeared that they had a clot in their minds with
rigor in their legs while they were outdoors.
The American army announce through the speakers that they would
withdraw from Karabla town after the military airplanes have
destroyed %50 of the town, and specially the contractors street (Al-
Mukawileen st.) where %90 of it was destroyed. Too many civilians
were killed and there were families couldn't leave their houses and
mostly all were annihilated. Al-Karabla people called in a message to
the media asking for the speed of telling about the image left by the
bombing.
The American war planes bombed a house in the district 12th of Rabi'
Al-Awwal (Rabi' I) inside Hsaiba to the west of Iraq. The bombing
caused the killing and injured many of the people living in the house.
The American forces bombed Al-Batha village one day before that
accident. A police officer asked not to mention his name for security
purposes when calling him by phone said: "The American started the
bombing around a house after midnight until dawn." And he didn't
know the number of the victims whom they were transferred from Al-
Batha village nearby Karabla to Al-Qayim hospital. In the hospital, Dr.
Ammar Al-Marsumi said that he thinks that forty civilians were killed
and twenty injured. He added that life guards were still searching to
pick up bodies from under the debris. Later, another doctor in the
hospital whose name's Ahmed al-Aani that 42 dead bodies were
moved to the hospital after the air attack, where women and children
were among them. Mohammed al-Karbuoli, a local tribal leader and
from the air bombing said: "no existence of armed in this area. All are
peaceful families."
The American forces with Iraqi forces joined them started a wide
combing operation called "The raging bull" looking for suspected
armed in the area of Salman pack (Historical Al- Mada'ain town) at the

dawn of Monday, 31. Oct. 2005. The participants in the operation


were 150 of what's called (wolves brigade) subordinated to the
Ministry of Interior with a similar number from the third infantry
division in the American army in addition to a battalion from the
cavalry. The American occupation army mentioned that the operation
on that town, fifteen kilometers south of Baghdad aimed to arrest
about one hundred of the armed elements. Responsible men in the
occupation army referred to arrest about forty armed in the first three
hours since the start of the operation according to their allegation.
The city was exposed to wide sectarian cleansing campaigns many
months ago undertaken by systems subordinated to Al-Ja'ffari
government which made tens of families living there, while many
other families sent an S.O.S. call to the international organizations to
interfere to stop the sectarian cleansing the area has been exposing
to by the hands of governmental militias subordinated to the police of
Kut governorate, 200 km to the south of Baghdad even though Al-
Mada'ain is related to Baghdad administratively. Acknowledging that
the police and national guards are mostly formed from elements
coming from militias of parties following hateful sectarian method in
treating the Iraqis. The tribes council of Al- Mada'ain town sent an
S.O.S. call to the honorable and of the alive humanitarian conscience
in and out of Iraq demanding of rescuing the town and to conserve
women's honor. The call referred to the big number of the forces
from Wasit and Maysan "attacked Al- Mada'ain town (Salman pack)
and broke into houses and stores of innocent civilians and arrested
1315 (One thousand, three hundred and fifteen) persons including a
number of children and women. They also stole many cars of the
civilians and from their private properties like money and valuable
minerals." The tribes council accused the governmental forces and
American occupation forces that they were behind the campaign. The
call issued by the council at that time said: "the operations are still
going on until now, heard and seen, and with the bless from the
occupation forces and other governmental official systems. The
aimlessly arresting operations were with no judicial orders." The call
also demanded the Iraqi Ministry of Human Rights and other
organizations to stop that campaign.

The American war planes bombed Al-Karabla area in Al-Anbar


governorate in 29. Oct. 2005 which led to death of twenty five
martyrs who were all civil citizens.
The occupation war planes bombed Al-Obaidi district in Al-Anbar
governorate in 31. Oct. 2005. The bombing led to more than forty
martyrs; most of them were were civilians. There was also a big
number of wounded and pulling down houses on the heads of their
residential.
On Thursday, 03. Nov. 2005, the first day of the Eid at 12:30 after
midnight, the occupation forces started an airdrop using ten
helicopters supported by a fighter plane. They bombed the area
around the second Al-Sayafia village, south of Dora town in the
capital Baghdad. The citizens were unarmed and sleeping in their
houses. Then the American forces started burning the house of the
citizen (Ali Ahmed Ibraheem) with all the furniture, contents and his
own car, Suzuki 1984 and the power generator of the house. then
they arrested the citizens and took them to unknown place:
1. Ahmed Hussein Alwan (Sick, handicapped, can't move and he's
been arrested by carrying him on a litter).
2. Hamdan Hussein Alwan (War handicapped with his leg cut).
3. Majid Ahmed Hussein.
4. Mahmood Ahmed Hussein.
5. Ala'a Ahmed Hussein Alwan.
6. Mahmood Ahmed Hussein Alwan.
7. Hadi Hamdan Hussein.
8. Ali Hamdan Hussein.
9. Abbas Hamdan Hussein.
10. Hamza Hamdan Hussein.
11. Asa'ad Hamdan Hussein.

burnt with all contents with a Suzuki ca 1984 and a power
generator by the occupation forces).

condemn the American forces for using chemical weapons in their


barbarous attack against the Iraqi town Falluja in November, 2005.
The shown documents assured "Using the white phosphorous bombs
by the American forces in their attack against the town." The program
that came under the title " Falluja, the hidden massacre" included
evidences of former American officers and a show of a film "
documents" using the white phosphorous bombs by the American
forces and the affection on the population of the town, women and
children. The Italian channel also mentioned that the recorded tape "
contradicts" the declaration of the American Ministry of Foreign
Affairs issued in 09. Dec. 2005 mentioned that using the white
phosphorous was only to lighten the "enemy's" locations in town.
Where it showed the use they described as a " Barbarous" of the white
phosphorous and Napalm by the American forces that hit the
unarmed civilians of Falluja population. "White phosphorous" used in
making burn bombs with the quality of fast evaporation and flames
as soon as touching the air causing fire and strong flame clouds of
high heat. Using white phosphorous isn't only used to lighten to
expose the enemy's location during the night, for sometimes it's filled
in hand bombs, artillery ammunition and missiles projects. The
American Ministry of Foreign Affairs hurried up to deny that news
claiming as usual that it was untrue claims, while the sources of the
Pentagon confessed in the end of using it in a clear disparagement
way as a weapon against the fighters in town for those weapons don't
recognize civilians from fighters who stayed in town. The number of
the civilians who stayed in town was estimated as about 40.000 (forty
thousands) civilians according to the UN reports mentioned in the
Italian film. Referring to the American forces joined by Ayad's Allawi
governmental forces have done many war crimes and genocides in
Falluja included finishing off the wounded people and aimlessly
bombing against the town. Iraq statistics said that tens of thousands
from Falluja population were killed or be vagrants for the claims of
the existence of terrorism in town.
The American forces broke into houses of safe people in Al-
Habbaniya town in Al-Anbar governorate on Tuesday, 08. Nov. 2005;
and they started savagely checking the houses. The old man haj

smoke bombs and mistreated him while he's in bed. Then they moved
to the house rooms to hit women and children, broke the furniture
and terrified women, children and the safe population.
A big joint force of the American army and Iraqi police made a raid of
wide arresting campaign in Al-Mujamma' village subordinated to Al-
Nahrawan district in Diyala governorate at dawn of 13. Nov. 2005
when they arrested tens of the population. On the other hand, the
American forces bombed using tanks bombs the two areas of
Hudayda and Hibhib subordinated to Obaid area in the same
governorate resided by Obaid caln. There were many victims and
wounded that couldn't be known. The Iraqi police and national guards
closed the entrances of Baquba town (Governorate center) and
stopped the cars movement inside. Those forces were highly
deployed in town without knowing the reasons for that. There were
also about thirty persons arrested in Al-Tahreer neighborhood. The
population of the neighborhood confirmed assured that those forces
had a list of the names whom they wanted to arrest.
A doctor from the Iraqi Red Crescent said that more than fifty dead
bodies were found inside the garbage of western Hsayba town in Al-
Anbar governorate nearby the Syrian borders which was invaded by
forces led by the United states this week in an attack aiming for the
armed. About two thousands, five hundreds American and one
thousand Iraqi soldiers started the operation Steel Curtain one week
ago since this date around western Hsayba town subordinated to Al-
Qayim town in Al-Anbar governorate. Those forces have done a
searching campaign from one house to another looking for the armed
and destroyed a number of houses in air strokes. The American army
said that one hundred and eighty armed were arrested, and at least
thirty six escaped in the operation that kept on going on in Karabla
town on Friday. They also said that about nine hundreds civilians
escaped from the town and there were near places for them to live
induring the operation. While the population started gradually being
back home in the last few days, Dr. Sayf Al-Ani who works for the red
crescent in Al- Qayim said that they found forty five dead bodies at
least inside the garbage included some women and children. No
respond came from the American army about the questions of the
killed. The army also said that they did their best to avoid killing the

civilians, and referred to an accident previously when five civilians


were killed in a house after they have been arrested by armed men as
hostages in the building. The American army previously accused
doctors in the West of Iraq to distort facts on purpose about the
number of the killed civilians after the American attacks.
A number of Al-Qayim town population said in 12. Nov. 2005 that
American war planes threw internationally prohibited cluster bombs
during the aggression against the town on many sides inside Karabla
and Hsayba towns. The families said that American war planes threw
different sizes bombs on many places of Al-Qayim and the nearby
villages including cluster bombs let to many civilians killed, where the
outcome of victims of the wide American attack on both Al-Qayim
and Karabla under the name (operation Steel Curtain) hasn't known
yet. It was aiming to destroy the armed there and prevent the
entrance of the foreign fighters as the American army declaration
said. While medical sources in al-Qayim said that the humanistic
situations were very difficult and complicated. Dr. Mohammed al-
Azzawi from the Al-Qayim public hospital said that town's living
under the strong pressure of artillery and air bombing, and there's no
possibility to reach to the attacked places the houses in the town
faces because of the curfew there. Besides, the hospital is suffering a
great lack of medical equipments because of the American attacks.
He's warning from a humanistic catastrophe threatening the town
unless the international humanitarian organizations interfere to stop
the bleeding in that area.
The British forces broke into and surrounded many safe houses in the
popular Al-Garma town in Basrah governorate in 13. Dec. 2005 and
arrested one of the citizens with the charge of terrorism.
A number of detainees sat-in Al-Shoayba airbase protesting for not
respecting the sanctity and holiness of the Holy Koran, the book of
Allah what made the occupation forces get angry after they
trespassed the detainees hitting them. Many Basri parties demanded
for an investigation about the subject.

Louiz Arbor, the chief of UNHCR of the UN called on Friday, 18. Nov.
2005 to conduct an international investigation about the conditions in
the Iraqi prisons after serious indictments of violations against
detainees in an arresting center subordinates to the Ministry of
Interior. The Iraqi government declared to conduct an investigation in
discovering one hundred seventy three prisoners have been suffering
from malnutrition, in some other positions been beaten so bad and
some of them have signs indicate to their been exposed to torture.
The UNHCR of the UN said in a declaration that according to the
increasing of international worries level and the importance to restore
to confidence Iraqis, then the conduct to an interior investigation may
not be enough. Arbor said in a declaration during showing the
organized nature as it seemed and also the problem size and the
importance of the public idea trust in any investigation, I (Arbor) urge
the authorities to look for the call to conduct an international
investigation. Her call reflexes demands of politicians from the Arab
Sunni for an international investigation in the claims that a militia
related to the Iraqi Ministry of Interior was behind the torturing and

tortured. Prime Minister Ibraheem Al-Jaffari promised for a full


investigation about what happened in that prison and pointed one of
his representatives for the investigation. However, the investigation
is still of unknown end after it's been clear that the purpose of the
investigation was to obliterate the milestones to prevent it from
affecting the elections results which was held in 15. Dec. 2005, and
the impression of uncovering that prison from international anger
when Mr. Kofi Annan, UN secretary-general called for a full
investigation. That discovering came after more than a year of
uncovering the bad treatment of the American forces for the
detainees in Abu-Ghraib prison. In a previous time on Thursday, 17.
Nov. 2005, the Iraqi Minister of Interior, Bayan Jabor, denied all those
claims and said that the prison wasn't secretly and all the detainees
were legally arrested. He added that only five of them seemed to be
beaten. Two hours later after Jabor's declaration, the American
declaration came and seemed to aim the pressure on the government
to investigate without a delay. Bullock said: " The Prime Minister
agreed a plan of six items to deal with all claims about the detainees
exposed to violation." He added that the USA will assist investigations
and said that among the support will be offered by elements from
the American Ministry of Justice and FBI. He demanded politician
leaders to conduct an international investigation for the charges that
the militias related to the Ministry of Interior is responsible for the
torturing and offense to the prisoners. Badr organization, the main
Shiite militia that relates powerfully with the Ministry of Interior and
the most powerful party in the government, denied on Wednesday,
16. Nov. 2005 any involvement or relation with the cellar scandal. The
majority of those who were found in the cellar were Arab Sunni. The
Iraqi and international media means spread terrifying stories on
Thursday, 17. Nov. 2005 about the way some prisoners have been
treated with. Mohammed Dahham, chief of a group working on
protecting detainees and prisoners to said to Reuters that he found
tools in the cellar used for torturing like saws to cut legs and hands
and tools to detach skin from the body. While the Minister of Interior
Bayan Jabor said that: "this can't be accepted and the claims of those
tools used to cut legs and hands are in vain." Without presenting what

about dealing with war prisoners. He also asked an invitation to NGO


and media means to have a look at any prison ran by the Ministry of
Interior. He denied that the Ministry aims at Sunni people saying that
the Shiite were among the detainees in the building where twenty
nine officers were commissioned with supervising it. The building's a
framework where half of it is under the ground and the other half is
on the ground. Jabor said that all the prisoners have been arrested
according to the arrest warrant when he described them all as
dangerous (Terrorists) and they will get their punishment through the
judicial system. The cellar scandal excited international criticisms.
Mr. kofi Annan, UN secretary-general expressed his worries when he
visited Iraq at the beginning of last week for the first time since the
overthrow of Saddam Hussein in 2003, but he welcomed al-jaffari
declarations that any experience like that is conflicting with the

his evidence was the martyr Khalid Ahmed Harbood Al-Dulaimi, born in
1972, married, was working as a worker and had three children. He's
been arrested from his house in 13. Oct. 2005 at 12:00 midnight and
then been delivered to the forensic medicine by Al-Nasir police station in
Al-Sadr city where they saw the martyr thrown (In the lake square) in Al-

Sadr city in Baghdad. Al-Karrar brigade claim was searching and after
they found nothing, they took him to the battalion headquarters where
prisoners from Al- Mada'ain are moved to Al-Mada'ain museum and then
to Al-baladiyat district (Back headquarters of Al-Karrar brigade).
Torturing is carried out in Al-Nisur prison, and in every battalion
headquarters there's a special secret place for torturing, specially in the
ruins area (Taq Ksra). Some of the tools which are used for torturing :
1. The drill to make holes in the body.
2. Iron hooks to cut and hang the body or parts of the body.
3. Strong hitting by heavy tools on sensitive areas from the body
which cause to breaking of bleeding.
4. Using the ironing instrument.
5. Hanging the body up.
6. Using the nitric acid.
7. Using hand equipments (Wire Cutter) to pull out teeth and
break the nose.
8. kicking with feet in sensitive places in the body.

blood they killed him and four members of his family while they were
sleeping. What's widely known is that the sheikh was known for his goof
life history, clean reputation, helping people, solve problems of people
and had respect and prestige where all kinds of people respected him. It's
clear that the crime was considered as a new method the militias related
to the Ministry of Interior apply after the scandal of prisons in Iraq, so
those militias are going on direct physical liquidation in the houses of the
innocents, and they do such operations during the curfew using cars of
the security systems of the Interior Ministry. The Sunni Endowment and
Association of Muslim Scholars in Iraq (AMSI) condemned that criminal
act.
Common forces from the Iraqi Ministry of Interior and defense
captured hundreds of Iraqis in Diyala' in 10. Nov. 2005 and most of them
were Sunni. A widely known judge, security responsible men, a member
of the governorate council and parties' representatives were among them.
The vice- governor of Diyala' governorate Mr. Auf Abdul-Rahman
emphasized in a call with Al-Jazeera that the Ministry of Interior
commandos made a raid of wide campaign of breaking into many parts of
Baquba city, to the Eastern North of Baghdad and arrested the judge
Say'ib Khorsheed the vice of chief justice of Baquba, responsible of
security committee in the governorate office Mr. Mohammed kamil. Vice-
chief of AMS branch in the governorate and Mr. Emad Salim, a
responsible in the Islamic party. The campaign started within the dawn of
today concentrated on the Sunni milieu in the governorate. Other
responsible men, clans sheikhs and the mayor of Baquba, the biggest
town in Diyala'. Mr. vice-governor of Diyala' described the arrest as an on
purpose movement against the Sunni sect for the sake of affecting their
chances in the elections done in 15. Dec. 2005. Ministry of defense
admitted by the commander of Anti-riot forces leader subordinated to
the Ministry himself that 346 "Three hundreds and forty six wanted have
been arrested in the military campaign framework ." He referred to the
participation of the multi-nationalities forces in the operation done by
600 (Six hundreds) from the commandos and what's called (Wolf brigade)
in the Ministry of Interior. 120 (One hundred and twenty) armored
vehicles participated in the operation according to a security responsible.
In addition to Baquba and its' suburbs, the operation included the nearby

police units entered the city from the North, South and West, closed the
entrances and imposed the curfew. He added: (we'll stay in the area until
we entirely finish cleaning the city".
The gangs of the organized terrorist crimes subordinated to sides
in the present Iraqi government represented by the Ministry of Interior
forces and militias participated in, and where its' members wear the
official uniform of the Interior commandos and militias with known black
caps on their heads as their insignia took 11 (Eleven) young men in Abu-
Tsheer on the suburbs of Baghdad (Poor neighborhood where poor
people and working class live) into a nearby place to their houses in that
neighborhood on Friday night, 11. Dec. 2005 at 10:00 p.m. claiming that
it (center) belongs to the (High crimes) force. In that ominous place which
became a (Den) to execute those crimes in spite of the (religious) front!
What's noticeable is that force passed back and forth in front of a police
checking point with a force of two cars (Batta-Duck), five cars (Opel) and
one car (Kia-Civia) which means that the force was using civil cars even
though some members of the force were wearing police uniform or a
combination with civil uniform where they took the eleven innocents and
four of their dead bodies were found next day morning 12. Dec. 2005.
They are:
1. Mouhannad Hameed Abdullah Al-Rashid.
2. Sa'ad Hamza Naayif (Mouhannad's cousin).
3. Suhayl Najim Alwan.
4. Hameed Najim Alwan (Suhayl's brother). Only eight
hours later and nearby the ominous den in the same place and
mutilated the bodies by the drill, pulled their eyes out and beaten
badly until their bodies turned blue because of the bad torture.
They also ironed the dead people by the electric iron, used ropes
to tie in the ceiling or to hang and shot bullets into the heads with
clear writing using sectarian phrases on the head of each victim!

Forces subordinated to the Ministry of Defense broke into the


place where sheikh (Osama Al-Jada'an Al-Sanad), Al-Karabla clan Sheikh
on Friday, 11. Nov. 2005 in Al-Karrada district nearby Uqba Bin Nafi'
square. The sheikh's guards mentioned that he's been taken from his
place late at night by Iraqi forces, and there were many cars belong to the
national guards and he's in one of the locations of the Ministry of defense
in one of the previous state palaces with the knowledge that Sheikh
Osama has recently appeared on T.V. screens and condemned the act
done by the American forces in Al-karabla. He also condemned the
Ministry of Defense declarations about targeting the houses that lodge
terrorists as the Minister declared, and it seemed that this was the reason
for the arrest.
A force from the Ministry of Interior subordinated to the interim
government arrested tens of citizens on the identity when they broke into
their houses in Al-Furat district in Baghdad on Sunday, 25. Dec. 2005 as
eye-witnesses said. The witnesses said the elements of the force broke
into the houses at 6:15 a.m. using violence to break the doors blocked
their way accompanied with some spies that when those spies refer to
someone, then he'll be one of the 50 (fifty) arrested as an initial number
when we couldn't exactly limit the number of the arrested because of the
terrorist way that force broke into the residential place and preventing us
from going out of our houses and forced us to stay inside. They added
that the number of the force elements was in tens wearing the official
uniform of the Ministry of Interior forces, onboard of about ten cars (Land
Cruiser) of white color with no number plates and heard some of them
who didn't speak Arabic. They also added that the ways those elements
applied were so wild and savage they (Witnesses) never saw before where
non of the houses furniture and contents couldn't be our of their
destruction, and they also robbed whatever was light and expensive that
they stole the car of one of the citizens, many mobiles, gold and money
of millions.
The witnesses said the force elements were aggressive, hit and insulted
citizens. They pulled an old man from his praying carpet where he was
praying with no respecting for his age neither reverence of the praying
the old man was doing standing between the hands of his God. They also
kicked an old woman with their feet until they dropped her on the floor.

The witnesses also added that they were so aggressive with a one and a
half month suckling baby when his mother was trying to calm her baby
and stop him from crying, so they kicked him with their feet and kicked
his bed looking for weapons might be hidden with him!! Asking his
mother using a classical Arabic!! Saying: "where is the weapon?"
They showed how so bad were their words through insulting and
sectarian insults in a hateful way resulting from a hidden malice indicated
that they had no relation with the national and unionist slogans they
falsely raised to laugh at the Iraqis. The witnesses also cleared that one
of the citizens was arrested because he committed a crime where the new
Iraqi democratic law punishes which's that his name's (Saddam) and
nothing more that they threatened him woe and he was still in his house!!
They said that a police captain was among the arrested who's been
arrested more than once, and also one of the arrested tried to get rid of
them by mentioning to the force that he's an officer (Employee) in an
official office and they answered him saying: " The state doesn't lodge
and accept whoresons." Some of the arrested were visitors to their
relatives and not from the house people, but even though they were not
released. After the families showed their fears that the same savage
torture, killing and unknown destiny will happen to their kinship arrested
persons until they ended saying: "Until when the situation will stay like
this with no security or stability?! Will that day come where we'll see a
national government that takes care all the citizens without any
distinction, and with Iraqi forces for real security but not for injustice and
unfairness?! And are there still honest men in the world who can save the
Iraqis from these tribulation and misfortune?".

This arresting crime came one day after the Interior forces arrested
Sheikh (Abdul-Moni'm Faisal Al-Janabi), a member of the AMSI and the
speaker of Fattah pasha mosque in Hai Al-A'amil district and one of his
sons in Baghdad.
A message from the murdered (Muthhir Aziz A'ayid Al-Samarra'i
reached to the Iraq newspaper Al-Wifak Al-Demoqrati (Democratic
Harmony) showed the details of his being a martyr. The message was
confirmed with the forensic medicine report with the No. 2505 dated in
02. March. 2005 entitled to Madinat AL-Tib (Medicine city) police station.
That message reached the newspaper in 11. Nov. 2005 and the victim's
family demanded the Iraqi president, Prime Minister, Minister of Interior
and Minister of Justice and Human Rights to start an investigation about
the savage torture crime that made him die. The family of the deceased
Mudhhir Aziz A'ayid Al-Samarra'I said that the victim was married and
had five children, four sons and one daughter. He was arrested in his
house in 23. Nov. 2004 while he was in good health. He became a martyr
in 31. Dec. 2004, and his family got the body and saw the traces of the
torture which made him die. The family could get the forensic medicine
report two months after its been issued when consulting the competent
authorities. The report (issued by the forensic medicine) very ugly
pictures about the torture against the victim like the ironing by a burning
machine wide spread in the right shoulder, in front of the two legs, in
front below the right thigh. The report also referred to the traces of a
trial to pull out the nails of the hands and feet in addition to the bruises
clear on many places of the body. Reminding that this crime was an
extension to much of scene of prisons in Iraq during the occupation era.
Former news mentioned many torture cases caused to many death cases
also in the American democracy, liberation and human rights which made
many some humanitarian organizations in the world to indicated with the
accusation fingers to the American forces, Iraqi national guards and Iraqi
police for adopting non-humanitarian methods and internationally
condemned by all of the divine laws and the positive legislations. The
newspaper said that they (newspaper staff) put this document evidence in
front of the Iraqi, Arabic and international public opinion and demand in
an urgent way to guarantee all detainees rights arrested in the Iraqi
prisons submissive to the American and Iraqi forces control, and also call

Abdul-Rahman Adnan Al-Sahar Al-Hamdani, Adil Abdullah Al-


Sahar Al-Wardi and Muhammed Fayadh Al-Sahar Al-Hamdani who were
from Al-Radhwania residents, were exposed to a shooting by the guards
of a Hosaynia in Al-Jihad district. One of them immediately and all have
been moved to Al-Yarmook hospital in Baghdad. Later, a force from the
Interior commandos arrested one of the wounded and took him to an
unknown place, while the other was moved to Al-Noor hospital
(Muhammed Baqir Al-Hakeem) in Al-Sho'la town and the killed stayed in
the same hospital. The uncle of the killed did assure that " they were in a
passable way nearby the Hosynia and the armed from a Hosaynia
attacked them in Al-Jihad district, then they were moved to Al-Yarmook
hospital and we found one of them in the same hospital and the other
was moved to Al-Noor hospital." None of the victim family knew the
reasons for moving, torturing and executing him there. He also added: "
The third, Muhammad Fayadh Al-Sahar Al-Hamdani was moved by the
Interior forces to one of their centers even though he was seriously
wounded. These are the events that come in the series of sectarian events
led by militias of some parties and the extremist religious trends. For the
knowledge, Al-Noor hospital in Al-Sho'la town witnesses similar events
like the killing of 11 (Eleven) men from Zoba'a Clan, 6 (Six) from Al-
Ghazalia district and 6 (Six) from Al-Hurria in previous periods.

Eye-witnesses mentioned that civil and military elements from the


Ministry of Interior were on board of four cars (Pickup) and two cars
(Patrol) broke into the victim Yassir Salah Al-Samarraa'i's Housein 13.
Nov. 2005 and asked: " Who is Yasser Abu-Ammar?". They took him to an
unknown place after he answered with official papers concerned the
family members. When his relatives started investigated about him, they
found that he was in one of the Ministry of Interior jails. On Wednesday,
16. Nov. 2005 his dead body with three more of persons including a
seventeen years old boy) who were arrested with him were found with
traces of hideous torture. The victim Salah was arranging for a media
coverage about a story of a husband and a wife (Kais Al-Zoheyri and
Hayfa Nu'aymi) from Al-Ghazalia district who were killed only three days
before the Eid by bullets of armed men and left 5 five children behind. He
was also preparing for an assistance campaign to that afflicted family.
The father of the victim (Yassir) who's the Sheikh (Salah Al-Samarrai') was
a Muslim religious scholar (Cleric), the owner of Al-Turath bookshop in
Adhamia and was executed in 13. Nov. 2993 by Saddam's regime with
the charge of changing the regime which was the same day when his son
Yassir was killed.
A responsible source in the Iraqi Islamic party declared on
Saturday, 12. Nov. 2005 that many brigades from the Iraqi Ministry of
Interior have done an arresting campaign to political and leading symbols
in the Islamic party, the supporter of the political process. The source

also added: "The Ministry of Interior system represented by Al-Hassan,


Al-Hussein, scorpion and wolf brigades and more launched wide
arresting in Diyala governorate targeting the political symbols
participated in the political process this time that it reached some leaders
of the Islamic party, some members of the governorate council, a judge
who was occupying the position of the vice of chief justice in Diyala and
hundreds more without the knowledge of Diyala governorate or the police
and security officials.
A guards in an Iraqi prison opened fire and started shooting
against the prisoners which resulted twenty killed of the detainees when
the detainees tried to escape according to the claims of some sources in
the Interior. The source said: "Twenty prisoners were killed by guards of
one of the prisons in Kadhumia town in Baghdad after they tried to
secape from the prison." He informed: " The reaction of the prison guards
against prisoners attack was shooting them to control the situation and
catch everyone who tried to escape which led to kill twenty prisoners.
An armed group aimlessly shot heavily in the air on Thursday, 28.
Dec. 2005 what made people to hurry up to hide in stores and behind
walls. People had panic in the intersection of Al-Kuwait St. which is a big
commercial street in Basrah. When the armed group saw the people
running, they started laughing because that group represented the militia
of one of the religious parties. Two of them have been recognized that
they were police men in Al-Ash'ar and the rest who were eight persons
were masked and totally covered their faces.
A force from the 4th sector forces came to Bab Al-Zubeir
neighborhood in the main St. of Basrah on Tuesday, 27. Dec. 2005 and
stopped a passengers vehicle, brand Kia and and ordered a man of more
than 60 (Sixty) years old to get out of the car and hit him badly by the
heels of their guns and kicks and left him and go. One of the citizens
took him to the hospital. One of the officers (Lieutenant Colonel) named
(Abu Ahmed) came back one hour later asking for that man named
(Abdullah Mahdi Al-Bahadli) and when they found him they apologized
that he wasn't the meant and that the patrol made a mistake. The man is
still in the hospital until writing this report.

It's mentioned that hundreds of leaders, officers and pilots of the previous Iraqi
army have been exposed to campaigns of chasing by the militias cooperated with
occupation forces during the passed time after the occupation. It resulted killing and
assassinations may of them without any interference of any official side to protect them,
and that's what many Iraqi present officials confessed about that while meeting a group
of those officers.
Iraqi former pilots are afraid to leave home feelings afraid of
assassination:
The Iraqi former pilots in the air force are afraid for their lives after filtering
tens of them since the start of the occupation in April, 2003. A former pilot
brigadier (Rabi' Ahmed Al-Ta'i) summaries in his meeting in 27. Oct. 2005 his
fears about the filtering and kidnapping that got his colleagues who were living
threatening obsessions saying: "I don't leave my house feeling afraid of being
assassinated." Al-Ta'i is from Tikrit the center of Salahuddin governorate added
that not less than 36 (thirty six) of high ranks officers have been assassinated
that 23 (twenty three) of them were pilots from the previous air force "by the
hands of groups supported by Iran to get revenge from us". He clarified that his
colleague the Lieutenant Colonel (Sha'mil Ghafuori) in Baquba "was assassinated
in in broad daylight when he was sitting with the colonel Jasim Hassan -who was
also a pilot- in a commercial store. The other one was shot by many bullets in
his leg and the poice didn't find the criminals but closed the investigation". Al-
Ta'i participated in Iraq-Iran war (1980-1988) when chemical weapons were
used against the Iranian army, and got retired from his position in 1997. He
assured that a large number of the air force officers immigrated "and no one
stayed but only few living in fear and fright" and that the Iraqi president (Jalal Al-
Talabani) met about one thousand of air force officers two weeks ago before this
meeting with Al- Ta'i when the president criticized the aggressions those air
force officers face assuring that "Those air force officers have no guilt because
who disobeys the orders previously would face death penalty". The president
asked and invited them to move to the two Kurdish governorates Suleimaniyah
(330 km North of Baghdad) or Erbil (350 km North of Baghdad) "in case there's
no safe shelter for them." He said: "We'll provide you all the requirements for
living and safe life regardless of party and intellectual belonging." It seems that
the reassurance didn't change anything because two former officers have been
killed in the duration 22-28. Oct. 2005 in karbala governorate (110 km South of
Baghdad). One of them was (Rijab Abdul-Wahid Al-Jaberi), the officer in the

former Iraq air force. The former colonel in the air force from Al-Duor town to
the North of Baghdad Mazin Jalal Al-Salami said that: "the continuous kidnapping
in the army which is ended with killing and torture is uncovered now with the
involvement of the state systems." He added: "I think that getting revenge from
the high officers is losing an opportunity that could return solidity of the new
Iraqi army." A'ayid Stam Al- AL-Jubori who carries the sustenance of his
brother's family the pilot brigadier Amed Stam after the armed assassinated him
when he was out from a mosque in Al-Shrikat (70 km South of Mosul) in August
/ 2004. A'ayid assured that his brother "participated in the war against Iran,
Kuwait war and North cleansing operations when he was leading a Russian made
helicopter" assuring and accusing that: " Peshmerga - Kurdish fighters- was
standing behind the assassination. In his turn, Muhammed Anwar Najim Al-
Deen, 28 years old, son of the pilot colonel Najim Al-Deen Muhammed Al-
Obaidi from Makwhool township (North of Beaji in Salahuddin governorate)
whose father was assassinated three months ago derided from the invitation of
Talabani to the pilots. He accused members from " Peshmerga in assassinating
his father who's killed when he was leaving his house and the killers' car headed
towards Kerkuk road where the two main Kurdish parties are centered.
Muhammed said: "The aim of Talabani's invitation was to observe the movement
of the pilots, and it's a planning to stop who wants to join the legal Iraqi
resistance." He added: "We heard in the news that the government caught a Salafi
group where among them was a planner for the operations who was the Air Vice
Marshal Harbi Abed Khudhayr."
Unknowns assassinated Dr. Sami Ayman in 16. Nov. 2006 in his house to
the west of Tikrit. A family said that an armed group surrounded his house and
killed him in front of his sons before the group escaped. It's monetioned that Dr.
Sami Ayman was considered as one of the best specialists in chronic and
malicious diseases in Iraq.
Unknown armed assassinated a professor in the fine arts institute on
Monday morning in 26. Dec. 2005 in Tobchi district in Baghdad. A source from
the Ministry of defence said that armed men shot a hail of the bullets against the
professor Nawfal Ahmed at 8:00 a.m. while he was leaving home to his work.
A source from the police reported to the correspondent of the Iraqi News
Agency (INA) that unknown armed on board of cars with no number plates killed
A'adil Al-Zubaidi, the lawyer of Taha yaseen ramadhan and shot Thamir Hmood,
the lawyer of Barazan Al-Tikriti. He's injured and was taken to the hospital

nearby the accident when they shot them in Hai Al-A'dil neighborhood, to the
west of Baghdad, on Tuesday noon in 08. Nov. 2005.
A source in the Ministry of Interior said that Baghdad police found three
disintegrated dead bodies early in the morning of Monday, 26. Dec. 2005 which
were picked up from Al-Rostamia project for the treatment of the heavy waters
to the Eastern-South of Baghdad. The source couldn't recognize out the bodies,
but he said: "It's hard to recognize the bodies because they all were
disintegrated." He said that the clothes which the victims were wearing were civil.
A high-ranked officer in the previous Iraq air force was assassinated by
unknowns nearby Karbala, on Tuesday night in 10. Nov. 2005. A source in
Karbala police said that three armed on board of a BMW car opened fire of their
guns against the pilot staff colonel Flayeh Hassan while he was leaving his house
in Sayf Sa'ad neighborhood which is about five kilometers away from the city
center and shot him dead. This accident came two days after the killing (by
armed in the center of Karbala city) of another officer from the previous Iraqi
army officer (major) whose name's Fadhil kadhim. Witnesses said that pilot staff
colonel Hassan who was a squadron commander in the Iraqi Iran war (1980-
1988) came to Karbala to take his family to where he was working in one of the
Arab Gulf countries a while ago.
An official source in Sunni Endowment in Basrah declared that unknown
armed assassinated Sheikh Ibraheem Al-Shaheen (Imam and speaker of Khor Al-
Zubair mosque) on Monday morning, 21. Nov. 2005.
The major general Abu-Awsima, leader of the missiles system surface-
to-surface shot against Israel in 1991 was assassinated in 01. Nov. 2005 in
Mosul when an armed group made an ambush outside his house in Al-Thobbat
district (Officers district) and showered him with a hail of bullets. The members
of that group escaped towards the Kurdish village Faida without chasing them by
the police and security where their patrols were there near the place of the
accident. Well-informed sources mentioned in the city that is full of leaders,
officers and other ranks of the Iraqi army disbanded by the previous American
governor Paul Bremer. The betrayed was the staff major general Nabeel Abu-
Awsima. He was one of the best artillery and missiles officers in the army before
he's been moved to work in the Military Industrialization Organization in 1991
supervising the long-range missiles system belonging to the organization. Those
sources clarified that the staff major general known as (Abu-Awsima = The man
with many medals) because of his courage and getting many heroism medals
and courage badges during the Iraq Ian war in the 80's. He stayed hiding for all

the time after the occupation after he received threats of killing him for his role
in the missiles hitting against Israel through the (Desert Storm) war at the start
of 1991. Units from the Kurdish militias (Peshmerga) broke into his house many
times in different times through the last three years to arrest him for the charge
of participating in hitting Israel with missiles but they couldn't catch him because
he moved to another place to protect himself. It's believed that officials are in the
Ministry of Defense were who gave his name to the armed group that
assassinated him in addition to the military leader from the ministry archive after
he stayed outside the spotlight since the end of 1991 war and sent to be retired
after freezing the Military Industrialization Organization works, destruction of its
facilities and establishments by the international inspection committees .
The students Federation President of Mosul university, the martyr Qusai
Salahiddin was kidnapped with his brother Ahmed. He has organized a
demonstration in Musel university against the rise of the fuels prices. He spoke
in the demonstration against Ja'afari government and criticized Al-Hakeem and
the behavior of his militias. Al-Arabia channel correspondent was in that place,
in the same day when he was kidnapped from his house until his body was found
with the head cut in addition to his brother Ahmed. That matter raised the anger
of Al-Mosul university students what made them go out in a march of 15000
(Fifteen thousands) demonstrators to pay the martyr the last honors and closed
all colleges of the university to sit in against that crime.
The famous Kurdish writer Mr. Omar Miran Al-Agha was killed in 13. Dec.
2005 through an arranged assassination in the North of Iraq. His grandson Dr.
Abdul-Kaa'dir Miran Al-Agha in the obituary clarification published in 23. Dec. in

Finding three corpses of citizens after few hours of kidnapping


them.
On Wednesday, 19. 10. 2005, three corpses of citizens were found thrown
nearby the Gazaliya police station to the West of Baghdad after one hour of
kidnapping them. The three citizens have been kidnapped at 8:00 a.m. on
Wednesday from the sheep market (Al-Joba) in Al- Shu'la district where they
were intending to sell their sheep. The citizens were the 60 years old Jum'a
Aswad Al-Abbasi Al-Zobayi, his twenty three years old son Fadhil jum'a Al-
Zobayi and Salim Za'aytir Jasim Al-Zobayi who's sick a lasting handicapped. All of
them were living in Ibraheem Bin Ali village that is between Al-Shu'la district and
Al-Garma district subordinated to Falluja town. It's mentioned that this crime
wasn't the first of that sort because eleven citizens from Zoba' clan have been
killed after torturing and mangling them by the hands of the repressive systems
subordinated to the caretaker government. Besides, similar accidents happened
in different places. That crime came within less than two days of the aggression
done by an armed group on the prayers in Al-Rahman mosque in Jbala district in
Babil governorate which led to martyrdom some of them and some other were
wounded while they were doing a pay in the blessed Ramadhan.
At the time when the chief of AMNESTY in Germany, Barbra Loghbelar
uncovered for the first time in a meeting held in Berlin last year that the
American administration have secret prisons in Iraq, Afghanistan and Europe
where prisoner of Afghanistan war and Iraqi prisoners are there, but it didn't get
any continuation by the media means contrary to what the report of the
American Washington Post. Loghbelar said: " After the American soldiers in Iraq
tortured the prisoners in Abu Ghraib prison and other prisons, the American
administration put procedures to prevent any other image could appear about
commitment crimes by its soldiers on the Iraqi prisones". She confirmed that the
organization got the information from journalists working in Iraq that the
American soldiers didn't only tortured prisoners, but it reached to confirmed and
killing, and that there are secret prisons in Iraq supervised by the USA where non
humanitarian humiliation are done there. Maps referred to the existence of
eighteen prisons where some are permanent and temporary secret, and criminal
prisons of prisons where there are prisoners have been transferred to. The list of
prisons included a temporary prison, Trans Gel prison, Badoosh prison, juveniles
and children prison in Mosil, Arbil prison, a women prison in Arbil, Al-Sahliya
prison, Sending away prison (Al-Tasfeerat) in Baghdad, Rusafa prison, Kut

prison, Hilla prison, Diwaniya prison, Kerbala prison, Najaf prison and Abu
Ghraib prison. The list also included a number of prisons she said that there are
an intelligence center specialized in torturing and pulling information. Some of
them are Abu Ghraib (inner), Ashraf Camp, Croper Camp and Buka Camp (Um
Qaser Camp). Locations subordinated to different resistance groups referred that
the American military barracks and intelligence offices are used as temporary
secret prisons to field investigations done by the American forces in Iraq. They
added that those secret prisons contain centers specialized in torturing and
investigation in each, supervised by members from the American intelligence
Agency CIA, MD and DID and contain prisoners, women prisoners and children.

Chapter Three: Baidc rights

1. Demographic changes:

The Sheikh Omar Al-Marsumi in Nasiriyah mentioned that elements from


Badr corps and the forces called Interior commandos launched a campaign of
breaking into and arresting on the Sunni people in the town in 20-21.Oct.2005
without any legal argument. The people's money and private properties were
stolen and also arresting the men who were found in those houses. Women have
been hit badly on sensitive regions of the bodies Under the sight of their
husbands and brothers without being able to do anything because they were tied
with ropes. The Sheikh Al-Marsumi also mentioned that those forces arrested
more than 70 (Seventy) persons with no charges to be mentioned on 17
(Seventeen) of them who were found killed in the next morning of 22. Oct. after
the mutilation of their bodies and the traces of the torture were clear like ironing
with fire, electricity and burning with hot water. A delegation has headed to the
governor who refused to meet them and asked his office manager to throw them
out side the building.
The eye witnesses (A.F.), (W.N.) and (H.M.) mentioned the breaking into
many houses in 29. Oct. 2005 by tens cars of the sectarian interior commandos
in Al-Ward'ia and Al-J'ara neighborhoods in Al- Mada'ain historical town and
arrested more than 200 (Two hundreds) citizens all of them were from Al-Jubor

and Al-Dulaim Sunni clans. The witnesses also mentioned that the force had a
list of names of those arrested from the Sunni and the campaign went on for
three days. It's also mentioned that that Al- Mada'ain town witnessed a sectarian
cleansing since the occupation of Iraq done by internal sectarian sides with the
cooperation of the intelligence of one of the neighbors countries that the town
witnessed the displacement of more than 35 (Thirty five) Sunni families. Also, 14
(Fourteen) Sunni farmers were kidnapped, badly ugly tortured and killed two
days after their kidnapping them in the town and we reported that in previous
reports.
A source from the Ministry of Interior assured the killing of one of Al-
Dulaim Sunni clan in 29. Oct. 2005 in Al- Mada'ain town. Another source from
the Iraqi Ministry of Interior also mentioned this morning that an armed group
killed the Sheikh Dawood, the Sheikh of the Sheikhs of Al-Dulaim clan with a
number of his family members after attacking him in his house in Al- Mada'ain
town, to the south of Baghdad. It's to be mentioned that Al-Mada'ain witnessed
armed clashes where there were more than 30 (Thirty) victims on Thursday, 27.
Oct. 2005.
The Washington Post published in its issue dated in 01. Nov. 2005 an
investigation about Kurdish groups who seized a valuable land in Kirkuk in the
North of Iraq. The newspaper assured the role of the Kurdish political parties in
the modification of the demographic composition of the city which provoked a
series of violence actions when the Kurdish political parties of sending back
thousands of Kurdish people to that tensioned city and the villages around.
Those parties give financial support, constructional materials and even designing
drawings. They are doing it all out of the Iraqi constitution that have been signed
lately. These actions makes violence between Arab and Kurdish settlers who are
both minorities here. The fast expansion settlements are made up of concrete
houses of two rooms each where the Kurdish parties put the designs for that.
Practically, it's a repetition for the demographic composition engineering in the
North of Iraq which enables the Kurd to add hundreds of thousands of electors
as it's planned for it in the 2007 at the end on Kirkuk situation. The Kurd want to
join the city and its wide oil reserves to the self independent Kurdistan. The
Kurdish political leaders justify the aim of being back to the city was to correct
the previous policies of the x-president Saddam Hussein who replaced
thousands of Kurds the city by Arabs from the South. The Kurdish parties
handled the operation themselves and the reason as they say was that the
present Iraqi government failed to apply an agreement to let the Kurds be back

to their homes. The military American officials, Arab political leaders and
Western diplomatists warned the parties that this campaign could work to
demolish the young constitutional process and increase tensions as a result of
the Kurdish settlement and being stable in the lands where Arabs live. As the
lieutenant colonel Anthony Weckham (The American liaison officer with the
regional government of Kirkuk) said: "If all are participated in the process, then it
will look as if it's a clean case where you can achieve your goals with it but don't
go to work from behind of people's back." He added that: "Those Kurds have a
bad habit of work. Will that bring stability to Kirkuk? Of course not. It will bring
anarchy." The Arab killed the official Kurdish who was planning for the
settlements in at the end of August disputed village Qoshqayah which is about
24 miles (38.6 Km) to the North of Kirkuk. An Iraqi soldier was killed and six
Arabs wounded before the as a result to the skirmishes with the Kurds before the
American and Iraqi forces controlled the situation by surrounding the village and
arrested 24 (Twenty four) Arabs. The Arab population said that it was the most
new of many violent accidents between the security forces and the citizens in the
region during the last two years. Sheikh Hussein Ali Hamandi said: "We are about
to be ran out of patience. There are 137 (One hundred and seventy three) Arab
houses and only 5 (Five) Kurdish houses and we will protect our land for it's our
honor." The citizen Khaleel Muhammed: " Arabs will never leave Kirkuk." Khaleel
Muhammed is a leader of Arabian bloc inside Kirkuk region council dominated by
the Kurds. He added: "If the USA really wanted to help Iraq, then it has to stop
the Kurds from possessing Kirkuk which will lead to a civil war." The military
American officials attempts went in vain to persuade the Kurdish political to
avoid them from returning the Kurds to the region, but they inflamed tensions in
the whole area with their actions. The disputed city Kirkuk is a city where about
one million of people and it's a home of a multi ethnic belongings mixture that's
able to get burnt which is the complex past and a huge possible wealth.
Therefore, the strict demographic composition of Kerkuk is a conflict source
because the Kurds think that they represent %35 to %40 of the population while
the rest are formed of Arabs, Turk man and a small proportion of Christian
Assyrians. The Kurds allege that they have historical allegation in Kirkuk that
they wish Kirkuk would be fixed to their independent Kurdistand because Kirkuk
is of an oil strategy in addition to the symbolic value that it can be used to lead
the independent Kurdistan economic which is the final goal to most of the Kurds.

(The other main Kurdish political party is the Kurdistan Democratic Party / KDP)
said: "Kirkuk is a part of Kurdistan like Washington D.C. is a part of the USA."
Through the firmly control of the Kurds on the regional government in it, there
are signs of changes and fast movement like the names of many streets,
buildings, schools and villages have been changed from Arabic names into
Kurdish, thousands of Kurds who rushed into Kirkuk after the fall of Saddam's
regime are still living in the football stadium and the old city prison and some
unoccupied pieces of land. The view teems with grey concrete blocks every
where in the new Kurdish settlements. The city destiny was one of the most
complicated cases in the constitutional process in Iraq. The article 136 in the
document signed by the Iraqis in 15. Oct. 2005 will include referendum on the
situation in Kirkuk in 31. Dec. 2007 as a maximum date, but only after the Iraqi
government will take the necessary procedures to take the previous Kurdish
population back and to house again or compensate them because the
constitution fixed a transitional law in March, 2004 which limited the
responsibility of returning to the federal government, but the Kurdish political
parties are doing the operation themselves in all over Kirkuk and across
hundreds of far villages. In Albu-Mahmood, 20 miles (32 Km) to the North of
Kirkuk, we find tens of concrete houses under construction in three complexes
designed by engineers of the PUK and the chief of the village Rasheed Sultan is
supervising the project. He said: "the party is paying $5000 (Five thousands
dollars) to each returned family, and to guarantee the completion of building the
houses, the money is distributed in installments: $500 (Five hundreds dollars)
for the cornerstones, $2000 (Two thousands) when the walls stand and $2500
(Two thousands and five hundreds) when completed. If they break the
conditions, they shall have to pay the money back." Inside the house where
Sultan lives temporarily there were planning drawings (designs) about the new
designs fixed to the wall beside an image taken by the satellite to the village
(printed by his friend's computer), and on the table there were files about the
200 (Two hundreds) families who're planning to move to the village in addition
to addressed orders from the party hanged on the wall: orders of building
houses to return the settlement of people who were internally evacuated. One of
the orders stated that all the houses will contain two sleeping rooms that: "each
sleeping room will not be less than 3m x 4m." The workers mix the cement and
hammer nails to fix the two floors house roof.

been brought back in the city and the surrounding villages in the last year with
the help of the Kurdish parties to many of them, while the Arabic and Turkman
politicians said that about 350.000 (Three hundreds and fifty thousands) of the
Kurds were moved to Kirkuk since the fall of Saddam Hussein. The official kurds
refused to provide us with exact numbers but they said that their parties have
controlled aand organized the processes of the returning of the Kurds to the city
because the Iraqi government's moving slowly and failed to give us with the main
information sources of the Kurdish families who're death-defying in returning to
their houses. According to the Iraqi ownership lawsuit committee which is
specialized in studying the population problems there, where it received about
35.500 (thirty five thousands and five hundreds) claims that they were living in
Kirkuk and they are all Kurds. The committee only judged for 2589 cases. Those
proceedings have been done as it should be falling under the transitional law of
state administration.
Rezgar Ali, chief of the region council and PUK said: "That's what I think where I
can't sit down with empty hands waiting for a decision from the federal
government, so I myself spend them money." That indicated to what the Shiite
Iraqi Prime Minister Ibraheem Jaffari said about Kirkuk. Rezgar added: "I'm not
going to wait for Jaffari to sign a piece of paper and time is passing. Where are
the central government resolutions?." He also added that the PUK spends
"everything without any exception even any dollar in the money drawer" to get
the Kurds back to Kirkuk. That crisis about the jaffari relation with Talabani
about Kirkuk was conferred by journalism.
Within the framework of terrorism and frightening some of the sects to
force them leave their areas through the policy of demographic changing where
there have been arresting and breaking into houses of innocent people in
Baquba town in 30. Oct. 2005 that in spite of the non permissibility for the
collective sanction and its non acceptance, so a village shouldnt be punished
because of an offense done by one person or many persons from it. Also
launching the charges randomly against people shouldn't be because of a
group, party or a guest from another country who breaks or broke the law here
or there, and these are the agreed general facts between nations as a tradition.
While the international law seemed to be buried and is still been buried every day
in Iraq, and from who? From the biggest universal power that leads the civilized
world and occupied Iraq now. Otherwise, how do we explain the arresting of the
following misters below from Baquba and taking them to unknown places by the
common forces from occupation forces, national guards and the Ministry of

The commandos of the Ministry of Interior seized the house of Mr.
Naseem Yaseen Ahmed in Samarra in 20. Dec. 2005 and threw the family out by
force, closed the street where the house is at the intersection in the medicine
factory and Al-Qadisiya neighborhood in addition to the closed roads in the
town.
The Sheikh Nawwaf Ibraheem Moslih in Al-Khaldiya town / Albu-Hzayim
village in Al-Anbar governorate mentioned that 40 (Forty) houses in Albu-
Hzayim village were destroyed in 26. Dec. 2006, and their lands were
completely swept away and the occupation took them as a military base
claiming that it's a strategic location nearby the American (Lion eye) base where
it's been bombed from that village. Sheikh Nawwaf Moslih also mentioned that
356 (Three hundreds and fifty six) Iraqis including children, women, old men
and men were thrown out of their houses and most of the became in the open
in the farms of palm trees or in schools after the occupation closed the door of
the only mosque in the area in their faces, and there were who headed to
relatives in the area to spend the night with. That village was the third in four
days where the lands have been swept after Albu-Shihab and Gartan villages in
Al-Khaldiya and Habbaniya towns.
The Iraqi Islamic party issued the statement NO. 102 (One hundred and
two) in 01. Nov. 2005 about the military operations in Salahiddin and Al-Anbar
governorates. The party denounced what to be described as the premeditation
of the Iraq security forces and occupation forces to hurt the Iraqis under the
excuses of fighting terrorism calling the governments, peoples and international
organizations to stand with Iraqis and give them a hand to help the afflicted
families. The statement confirmed that the American forces have evacuated the
population of Aziz Balad neighborhood in Balad township where the population
is 8000 (Eight thousands) persons under the excuse of killing three officers
from the occupation referring to those forces of separating men from women,
hitting them badly by guns sticks and also hitting them using sticks which

showed fear and panic to people as said by the statement. The statement also
showed that the occupation forces bombed Al-Bedha village in Al-Qayim by
fighter planes which led to 40 (Forty) Iraqi civilians dead from the village where
most of them were the children and women who were from the afflicted families
from Hsayba that witnessed similar military operations as the statement said.

3. Woman Rights:

Two Iraqi girls living in an orphanage in Baghdad said that American


soldiers kidnapped them with other six girls. The names of the other girls are:

1. Zaman Jabbar.
2. Domo ma'an.
3. Zainab Hmood.
4. Fatima.
5. Ahlam Abdullah (She was deaf).
The officials in the orphanage in Al-Rashad town in Baghdad said that 8
(Eight) girls of 15 22 (Fifteen Twenty two) years age have been kidnapped
by the occupation soldiers in 23. Oct. 2005. The manager of Al-Rahma
(Mercy) orphanage Sua'ad Mehdi Al-Khafaji said: "We asked the American
soldiers about the place where the girl are but they said that they didn't
know. We didn't hear about the girls since a week." One of the two girls who
said that they have been kidnapped whose name's Wijadn said: "They took
from the orphanage out by force and let them in the humvee car, and when
we asked them where are you taking us? they hit us. They hit me with a
gun stick on my neck. I started scream, so they threw me in an area I didn't
know, but I could find my way back to the shelter. While we were in the way,
they told us that we had to say that we were seized in the shelter in spite of
our will if the police would ask us."
The other girl Farah also said that she was kidnapped but she was released
in Alawi Al-Hilla area after giving her 2000 I.D. (Two thousands Iraqi Dinars)
to get a taxi and could get back to the shelter. She also said that she's asked
Iraqi officials about her girl-friends but she didn't get any answer.
The American forces arrested the woman Intisa'r with her two
daughters who were three and four years old at the dawn of 24. Oct. 2005. The
arrest took place when those forces broke into her father's house who was the

Sheikh Muhammed salih Al-Nimrawi (One of Albu-Nimir clan Sheikhs) and


arrested him with three of his sons Ahmed, faris and A'adil from their house
which's nearby Al-Quds Al-Shareef mosque in Al-A'amil neighborhood that
those forces messed around with the house contents from 4:40 a.m. until 7:00
a.m.
The scene of arresting women by the American forces is recurred from
time to time to pressure their families and specially men to surrender or to get
information from the armed groups. Those forces arrested Raghad Layth
Muhammed, the employee in Al-Rafidain Bank in 08. Oct. 2005 after breaking
into her father's house in Al-Dora area in Baghdad.
The American forces arrested Sara Taha Khalaf Al-Jumayli with her kids
and old mother in 18. Oct. 2005 after breaking into her father's house at night in
Falluja town in Al-Anbar governorate, then the mother and the kids were
released and the Sara was also released in Falluja in 20. Oct. 2005. Falluja
mosques announced at dawn in the next day Friday that the American forces
released a woman on Thursday night after arresting her on Wednesday. They
also announced that Sara Khalaf, 20 (Twenty) years old woman came back home
in safe after the night prayer and asked the citizens to go on with their works
like usual and stop the strike whom they started after her being arrested. A
source in the police said that the Americans arrested the woman at dawn of
Wednesday while she was in her house with two of her cousins in Al-Andalus
neighborhood in Falluja. The loca authorities threatened to stop any cooperation
with the American army unless Sara's released, started a strike and closed all
stores in Falluja. An American officer (asked not to uncover his name) clarified
that (The situation is very tensioned and the town is boiling).
Iraqi National Association for Human Rights uncovered states of
aggression and raping Iraqi prisoner women inside jails and Iraqi prisons:
A report issued by the Iraqi National Association for Human Rights about Iraqi
arrested women in police stations followed to the Ministry of interior who have
been exposed to disgraceful violations against their civil right included
aggression by hitting and raping by the investigators in addition to pulling out
their confessions under threatening and psychological and physical torturing.
The association expressed its worries about the deterioration of female
situations inside police stations belonging to the Ministry of Interior indicating to
the lack of life requirements in those stations in the minimum limit. The public
prosecution organization belonging to the Supreme Judicial Council confessed

to the Ministry of Interior by investigation officers in those stations. Also, the


Ministry of justice confirmed receiving reports from prisons reformation offices
showing organized civil violations clarifying that foundations belonging to
human rights and others to the Ministry of Justice confirmed the occurrence of
such violations. The Ministry of Interior denied the exposure of arrested females
to any rape or assault by the investigators. The report prepared by the Iraqi
National Association for Human Rights which is a Non-Governmental
Organizations (NGO) indicated to the existence of violations against female
arrested in the police stations belonging to the Ministry of Interior. Mr. Isam Al-
Chalabi, chief of the association confirmed a number of violations infractions
against those detained women in the police stations before sending them to
prisons). He also added: "We formed a team from the association to visit prisons
and stations to know the situations of the detainees and prisoners after the
notification of the Ministries of Interior and Justice in the 4th of last September.
The visits were to the station of Kazumia for women where making sure of the
civil violations against female detainees included organized rape done by the
persons who were in charge of the investigations as well as assault and battery
and compelling women detainees to confess by force accusing some of the
investigating magistrates in overstepping their authorities aside from leaving the
just criteria of the vocational performance of their job and to use facts to the
benefits of the these circumstances or for private personal benefits concerned
with the reports of the forensic medicine." Mr. Chalabi added: "We recorded
similar cases in the police station of Al-Masbah district about getting
information by force in way that disagrees to the article of the Universal
Declaration of Human Rights." A report issued previously by the center of
researches in the Iraqi Human rights organization which uncovered that
detainees from both genders have been exposed to sexual, physical and
psychological offenses included blindfolding the eyes during investigating,
violent beating by clubs and plastic and metallic tubes on the reproductive
organs, kicking, tying aside for many hours and torturing by electricity. The
report that the Human Rights Committee documented five raping cases against
female detainees in Iraqi investigations centers done by elements of the
investigations centers. The public prosecution authority acknowledged of
receiving similar reports from the Iraqi reformation offices (prisons) and from
Ministry of Human Rights reported of the existence of similar violations like
beating, torturing, and raping against the female detainees in the centers of the

Hana' Ali Fayadh that a report has come to the public prosecution authority
uncovered the rape against (Z.A.K) by the major (S) related to the high crimes
directorate which pushed the public prosecution chairmanship which is
responsible for the general right to approach to the achievement court of the
penal claims to move the case according to the article 393 from the penal code.
The female detainee (H.T.A.) also was exposed to torture by the officer (M.A.) in
the police station of Al-Huoria neighborhood and we also moved the penal case
concerning with the mentioned accused according to the article (333) / penal)
assuring the exposing of the female detainee (F.A) to aggression in the center of
the Interior intelligence and police station of Al-Baya' neighborhood by many
persons she ignored their names. While three female detainees were exposed to
aggression in the center of the High Crimes Unit, and we also moved cases still
existing. Fayadh accused the inspector-general office and Ministry of Interior for
ignoring facts and cases presented and their insisting that there were no such
violations. On his part, Ministry of Justice deputy, Busho Ibraheem Ali mentioned
that no observation of a violation of human rights took place inside Iraqi prisons
assuring that violations are taking place in the stations related to the Ministry of
Interior which are before moving the female detainees to prisons related to the
reformation office. Ali said: "We know about those violations which we aware
through female detainees who have been moved to us and then we approached
the competent authorities of those violations to stop them and punish who's
responsible for them." Moreover, Faiza Mahdi Hazza, manager of Kazumia prison
for women meant about the results of a series of field visits done by human
organizations and official sides to confirm the care of our administration to
observe and care about the civil rights of the female detainees aside from not
recording any violation that can be mentioned which were documented by
reports kept with our administration where there were thanks and appreciation
letters. Faiza Mahdi Hazza emphasized on speaking to the responsible
authorities and inform them about the violations committed against female
detainees whether during the investigation duration (Before joining us) or during
spending prison term period. Meanwhile, the Ministry of Interior ignored that
female detainees inside the stations related to it have been exposed to any
assault and battery or sexual aggression. An official source in the Ministry said
to an Iraqi newspaper Azzaman that there were no evidences that can prove one
rape inside a police station. The source follow up saying: "We don't deny the
existence of elements of criminal precedents who sneaked into the police
system after the fall of regime inside the security emptiness situation after the

fall while some of them are still in the service and we have more than a formed
committee in the ministry of Interior to study the files of elements involved in
committing with crimes violating the honor, criminal crimes and administrative
corruption in preparation for their exclusion confessing that some of the
policemen are rude during investigation for the sake of getting further
information which serve the investigation aims and supplying them with names
of their companies while those situations were not considered of high influence
because we refuse that method in the Ministry because it's against human rights
even though we know that we have transferred case to the law where stressing
on the accused people was a crime should be punished by law confessing that
many police elements have sometimes used toughness during investigations

The American forces arrested many boys in Mosul city:


American forces supported by elements from the Iraqi national guards
broke into houses of citizens in Mosul city after midnight and arrested
many boys. Many of the boys' families who were arrested by the American
forces said that those forces broke into their houses in Palestine
neighborhood and Sumer to the South East at 1:00 a.m. after midnight of
Tuseday, 18. Oct. 2005 and arrested more than ten boys over 15 years
and under 20 years. The families of the arrested who are in a bad
situation because of their worries about their sons and that the American
forces supported by the Iraqi national guards broke into the houses in a
savagery way as they described by breaking the doors by the military
troop carrier and using the dogs to check the houses as well as
dispersion the objects in the houses. Those families whom their houses
have been broken into by those forces clarified that the soldiers shot fire
inside the rooms of the houses which scared children and women aside

from the hard cruel treating by the forces during the breaking into their
houses.
The families of those arrested boys called all the governmental
authorities and human organizations to interfere to release their sons
because they are all students and the year is in the beginning showing
their worries that they may be late or the arrest would affect their
psychological condition which negatively reflects on their academic level
even after releasing them. One of the population said that an old man has
got a heart attack and a clot spasm for three times was also arrested with
one of his young sons.

them have been released while the others are still arrested without
knowing the reasons behind their arrest.
Gunmen assassinated five young Sunni men in Dora city to the south of
Baghdad in 27. Oct. 2005. A family of one of the five young victims
named Ahmed Hasan Al-Dulaimi who's a student in the Faculity of Islamic
Studies emphasized that the five young men were sitting in front of on of
their houses in Al-Mu'alimeen neighborhood in Dora city in Baghdad and
only half an hour after having breakfast when the gunmen surprised them
driving a car of the brand Kia / Civia and showered them with their
machine guns barrage of fire and left them dead then the three gunmen
escaped. They added that when the families went out to save what could
be saved of the victims and carried them in their own cars to take them to
the hospital, they have been surprised by the elements of what's called
the hawk brigade related to the Ministry of Interior commandos shooting
them with no reasons made them do that strange action, especially when
the relievers haven't done any armed actions against them except being
busy of saving the victims. The witnesses showed that the elements of
the brigade were using a checking point at the head of the street which's
very near to the crime scene which was the point where the gunmen
entered with their cars and guns to carry out their crime without any
action from the brigade elements against them and specially at that time
at night!! Another witness (S.M.A.) mentioned that more than ten persons
have been assassinated in one day in a continuous assassination
operations in Dora and other places but it's so sorry that none of those
assassinations have been announced by the media but only a little, and
that can be seen through the large number of consolation meetings and
signboards with the victims obituary written with their names. That
compound crime came (only few days after Al-Tawheed mosque in Dora
neighborhood was exposed to an explosion of an explosive charge while
the prayers were leaving the mosque from the nightly prayer in Ramadan)
by militias of some parties and commandos of the Ministry of interior
which led to death of one and another one injuried.

Abdul-Ameer Younis Hussein, correspondent of CBS News channel is still


arrested in Buka camp (Soth of Iraq). The prisoner No. is 339.172.
Abdul-Ameer Younis Hussein, born in Mosul (North of Iraq) is 26 (Twenty
six) years old and was living as a bachelor with his family in a Kurdish
suburb of the town until he was arrested in 08. April. 2005. He was
working for three months as a camera man for the American television
channel CBS News.

The Iraqi Press Syndicate Secretary-General assassination:

Unknowns have assassinated the Iraqi press syndicate secretary-


general Mr. Haroon Muhammed Rasheed in Baghdad in 19. Oct. 2005.
The victim's family said that: "Unknown gunmen blocked Haroon's way on
Muhammed Al-Qasim highway and shot him dead. They added that
Haroon was leaving the center of the Iraqi press syndicate on Wednesday
afternoon companied with his friend when a black Opel car drove by a
number of gunmen who shot many bullets against him and one of them
settled in his hreat and caused his immediately death. Haroon was
heading headship of editing the Political Issue daily newspaper. He was
known for his anti- American military presence attitudes in the country.

Kidnapping the correspondent of the Gardian newspaper in Baghdad:

The guardian newspaper declared that its correspondent in Baghdad


named Rori Carol was kidnapped in Al-Sadr City. The Guardian added
that Carol had the Irish nationality was kidnapped while he was leaving a
house in Al-Sadr city when he was watching the events of the X-president
Saddam Hussein trial on T.V. with an Iraqi family. Bryan Weteker, the
international affairs editor in chief in the British newspaper that carol (33
years) passed nine months for his presence in Iraq was taken by force by
gunmen elements. It was to believe that the militia of Al-Mehdi army
related to the Shiite cleric Muqtada Al-Sadr has a wide influence in the
city. The journalist was released after many contacts between the British
forces and Al-Mahdi Army militia by the mediation of powerful parties

that have strong relations with Al-Mahdi Army militia. The Irish
correspondent in the Gurdian newspaper who's been released in Iraq that
his kidnappers were from Al-Mahdi Army militia who wanted to use him
as an exertion of pressure to release Iraqis loyal to the cleric Muqtada Al-
Sadr.
The journalist Rori carol was released on Thursday night after he was
kidnapped on Wednesday and seized in the Iraqi capital for 36 (Thirty six)
hours. The journalist said that the kidnappers released him after getting
a phone call. He added in declarations published in The Guardian on its
website in the internet on Friday, 21. Oct. 2005: "I heard one of the
kidnappers in the corridor answering a call in his cellular when he
laughed and satisfaction appeared on his voice then he opened the
closed door and said: " I will let you go".

The occupation forces consecrated the policy of confiscating freedom in


all over Iraq with no exception since the first days of invasion which's
contrary to what's been declared about freedom of opinion and thought

we'll review between the local government about democracy, protecting
human rights and how to apply. We'll mention the definition used by the
AMNESTY to submit under the document of the NO. (MDE 14 / 046 /
2005) and titled as : Iraq / Kamal Sayid Qadir / age:48 / Austrian citizen
/ Writer, when the organization told us as the text:"The writer Kamal
Sayid Qadir who has the Austrian nationality was kidnapped in 26. Oct.
2005 by the hands of the Bartizan (Intelligence of the Kurdish democratic
Party which is one of the two Kurdish parties holding the power in the
North of Iraq according to what came) during a visit he was doing to the
region of the Kurdish majority. He's arrested separated from the outer
world and AMNESTY is worried that he could be tortured or badly treated.

Sayid Qadir with Mas'uod Barzani, the Kurdistan President and chief of
the Kurdish democratic Party during his being to a conference in Austria
soon from 20 November. It's mentioned that Mas'uod Barzani has given
assurances to the Austrian president that Kamal Sayid Qadir will be face a
fair trial.. AMNESTY wrote to Mas'uod Barzani in 03. Nov. 2005 asking for
a clarification from him about what happened to Kamal Sayid Qadir but
they didn't get any response. The second declaration of the organization
was: " Issuing the judgment in 19. Dec. 2005 with the imprisonment for
thirty years by the libel charge because of because of the two articles
publication on the internet where he criticized in them the leadership of
the Kurdish Democratic Party. The judgment was issued by a private
security court in Erbil city after a trail took about one hour when Kamal
was notified about the trial before its holding by minutes with presence
of a lawyer appointed by the court and never met before. The judge
immediately issued the judgment Just after a confirmation that he's the
writer of the two articles. We knew that he did a hunger strike in protest
at his imprisonment and not for nothing but expressing his opinion.
We've been told that kamal's health went down and he asked for a doctor
but the prison management ignored his request. Under the title (The
main obstacles in front of Iraq federalism) published in the 14th of July,
the writer described the reason that made the Kurdish parties demand for
the federalism that (it's not free from selfish inclinations and personal
interests) as the Kurdish leaderships and specially when the leaderships

of the two main parties has tasted authority or more accurately the
autocracy with it having great economic privileges and illegally.
Therefore, authority and privileges can't be kept but only in a federal
Kurdish entity that the federal government in Baghdad would not
interfere in its internal affairs and at the same time, the Iraqi state as a
sovereign state will guarantee protecting them from intervention of the
neighboring countries that will miscarry the founding of a Kurdish state
in any time. Then Kurdistan of Iraq is having great natural resources that
the ruling families in the region would like to possess them and turn
them into personal properties. That can't be done unless those families
rule Kurdistan region alone as it is now, so is it the opinion the writer will
pay 30 (Thirty) years of his life for? Or may be it's opinion of the loser and
winner in the new Iraqi constitution in the 4th of August where the
writer described the circumstances of writing the constitution were not
normal because overthrowing the Iraqi x-regime wasn't carried out by
Iraqi hands. The foreign forces that carried out that task under liberation
of Iraqi people title from injustice and the tyranny has been turned later
into occupation forces of a behavior that didn't differ from of any colonial
force behavior in history, therefore the democratic process that the
occupation forces were compelled to launch it in Iraq later having non
Iraqi impression that planted doubts for many of the Iraqis about the
intentions of that operation. The legal academician writer discussed the
political image designed in Iraq now by disassembling it and instigating
the reader to remember its true facts saying: "There who accuses the
Sunni of the partnership with the x-regime in persecuting Shiite and
Kurds, and according to my opinion is a false accusation because a

example to Iraq and even the Middle East and instead of doing that, those
parties changed Kurdistan into a castle of despotism, stealing wealth of
the people and gross violations for human rights like killing, torturing,
cutting noses, cutting ears and rapes. That's all was under the American
protection because the Kurds and others in the region knew exactly that
all what the Kurds got of gains and privileges in Iraq since 1991 was
impossible to be achieved without the direct American support because
America was the one who created the safe region in Kurdistan of Iraq in
1991 and directly protected it. After overthrowing the x-regime in Iraq in
April, 2003, the Americans were behind granting additional privileges to
the Kurds like the federal region and a good share from the Iraqi budget
where nobody knows its destiny until now.
The writer got to a summary after giving many examples that all
evidences showed the heavy loss of the Kurds in the next political battle,
and nothing let in the Kurds' hands except one strategic weapon which is
doing an official referendum about deciding the becoming of Kurdistan
but the Kurdish political Kurdish leaderships will not dare to use that
weapon feeling afraid of the opposite reactions for such a step that will
lead to losing the political Kurdish leaderships where in fact is of some
masterful families on the Kurds by force for their political and material
privileges which are more important than Kurdistan and it's people. Then
what is the crime Dr. Kamal committed? Was it the academic searching in
the state corruption? Or discussing the way to write the constitution? Or
may be the demanding for an official referendum about the becoming of
Kurdistan or the North of Iraq?

2. Freedom of religion and belief:

Abdul-Majeed Khaleel, a member of pilgrimage and Umrah committee in


Iraq declared about his being afraid that the citizens of Anbar, Mosul,
Saladdin governorates will be forbidden for doing pilgrimage this year.

pilgrims since last year who have the preference to go to pilgrimage this
year. He added that a number of the committee submitted their
resignation protesting for that. He showed that the present plan of the
Iraqi selected government is to give %70 of the pilgrimage chairs to the
Shiite, %20 to the Kurdish and the rest of the %10 will be given to the
Sunni parties belonging to the Sunni people and supported the
government in its situations. The pilgrimage has witnesses a wide forgery
about the passports of the pilgrims who won the lot choosing which
made the people who reached KSA more than the fixed number which
compelled the Kingdom of Saudi Arabia to stop receiving Iraqi pilgrims

Entitled information spokesman of the Association of Muslim Scholars
in Iraq made a press-declaration in 31. Oct. 2005 about the Sheikh Jasim
Muhammed Al-Jobuori assassination. He mentioned that: "Unknown
gunmen assassinated Shiekh Jasim Muhammed Al-Jobuori, Imam and
preacher of Al-Rahman mosque in Hor Rijab neighborhood on Friday in
the 18th of Ramadhan month after doing the Friday prayer.
Official Iraqi military forces broke into the house of the Iraqi famous
religious man Ayatollah Ahmed Al-Hasani Al-Baghdadi in Najaf and his
office in Kazumia town in Baghdad on Tuesday, 27. Dec. 2005 in Najaf
city and caused lots of damages and the religious man justified that for
his declaration to Al-Jazeera satellite channel in the same day for the
attitudes refusing occupation and his supporting the Iraqi resistance. Al-
Baghdadi Ayatollah is considered as one of the most considerable
religious men in the religious school in Najaf and well supported in the
Iraqi street from different sects.
Unknown gunmen attacked prayers in one of the mosques in Hilla on
Monday, 17. Oct. 2005 and shot fire randomly against the prayers while
they were doing the night prayer in Ramadhan month which made caused
the killing (martyrdom) one of the prayers and four injuried in a
dangerous precedent as it seemed for the sectarian serial tension under
the presence of the present government. The Imam and speaker of Al-
Rahman mosque in Jbala district that gunmen broke into the mosque and

open their shooting fire against prayers while they were doing the night
prayers in Ramadhan month and escaped. The mosque Sheikh accused
the present government and its security systems the responsibility of
what happened because it's responsible for the security deterioration in
the country. He added that: "The security systems of the government
disarmed the guards from their weapons and arrested most of them and
left the mosques without guarding, so it carries the responsibility of all
that." Those dangerous developments came two days after the
referendum for the constitution where the initial results indicated its
rejection in four governorates which embarrassed the government and
made the Independent Electoral Commission of Iraq (IEC) to postpone the
declaration of the results under the pretense of checking the sorting of
the voices which stimulated fears many of the supervisors as an indicator
for the manipulation of the constitution results.

The American forces arrested Sheikh Dhiab Sa'ad Al-Obaidi, the member
of the Association of Muslim Scholars in Iraq, Imam and preacher of Abu
Sayda mosque in Diyala governorate late at night on Friday in 04. Nov.
2005.
An urgent and emergency meeting was held on Sunday in 25. Dec. 2005
whom the head of Basrah municipality Mr. Muhammed Sa'duon Al-Sbahi

conference. Mr. Al-Sbahi talked about the violations of human rights


happened in the arresting camp of the British forces in Shoayba where
the supervisors of the camp insulted the Holy Kokran and did tread on it
with their feet which made prisoners doing protests faced with truculence
and repression and that led to eight persons hunger strike and until now
while their health started being falling. The council chief threatened with
civil disobedience and clamorous demonstrations in the governorate
unless the British forces apologize within a week after the feasts and stop
doing like those actions.
The American occupation forces arrested three Imams-preachers from
Abu-Ghraib town (West of Baghdad) on Saturday afternoon in 24. Dec.
2005. Eye-witnesses mentioned that a big force from the occupation
broke into the town and arrested three Sheikhs and lead them to unkown
place. They are:
1. Fawzi Jabbar Hantoosh Al-Dulaimi, Imam and speaqker of Al-
Risala neighborhood mosque.
2. Hussein Ahmed Al-Obaidi, Imam and speaker of Ahdussaliheen
(Promise virtuous) mosque.
3. Ali Obaid Al-Hitawi, Imam and speaker of Ali Bin Abi Talib (May
God be pleased with him) mosque.
A force from the Ministry of Interior related to the caretaker government
arrested Sheikh Abdul-Munim Faisal Al-janabi, member of the
Association of Muslim Scholars, Imam and preacher of Fattah Pasha
mosque on Saturday afternoon in 24. Dec. 2005. They also arrested his
son Shakir from their house in Al-Baia' neighborhood in the middle of
Baghdad as witnesses from the arrested family. Some of the force spread
inside the house and on the roof looking for the Sheikh and his sons.
They dragged the Sheikh forcibly from his clothes when they found him
in one of the rooms and put a blindfold on his eyes, tied him up and put
him in one of their cars. They did the same with his Youngman Shakir.
Eye witnesses showed that the members of the force were more than ten
wearing the official uniform of the Ministry of Interior and another one
was wearing normal civil clothes. They were carrying machine guns
named (Ghaddara) and with four cars where one of them was a black
G.M.C called (Bahbahan), two white Land Cruiser (Monica) and the fourth
was a Pick Up of a dark military color with a BKC machine gun on it. The
eye witnesses said that those elements trespassed women beat and

insulted them. They also shot fire inside the house and broke one of the
rooms door. The witnesses also showed that those elements were afraid
and confused during the raid and arresting when they tried to do it within
5 7 minutes and then moved to an unknown place.

Chapter Five :
Economical, sociological, and cultural rights:

1. Environment Pollution:

A study done by experts from the international "Oxfam" organization and


declared in October / 2005 the study uncovered the drinkable water
pollution in Dhi Qar governorate with a ratio crossed the minimum of the
healthy specifications of water refinement, specially in the high
population density in the popular areas. The general coordinator of the
organization works in Nasiriah Mr. Lutfi Salih assured in a declaration to
the independent Iraq Voices news agency on Thursday, 20. Oct. 2005
that the researches and field research done by the organization included
residential areas and neighborhoods that the samples covered all the
parts of the governorate indicating that the water refining stations that
supply the governorate with drinkable water need the materials used in
refining water. It's to be mentioned that water refining stations in the
center of the city has been built for more than forty years with no
maintenance has been done since that time.

2. Education:

Dr. Ahmed Abdul-Melik Al-Sa'di, dean of Al-Ma'arif College (Knowledge


College) in Al-Anbar governorate warned in 23. Nov. 2005 from the
suspension of studying in the college for the year 2005 / 2006 because
of the daily American forces interference which will surely cause
breakdown and deprivation of students from continuing their study for
the year. Al-Sa'di added that: " The college administration failed to call all

human and international organizations as well as Ministry of Higher


Education and Scientific Researches, Iraq government and international
society toward those actions done by the American forces by putting
barbed wires and daily blocking the roads in front the road that leads to
the college as well as occupying the old building of the college and
confiscating all the furniture and possessions of the college which were
estimated about $ 600.000.000 (Six hundred millions American dollars)."
He added that: " The forces shot missiles from the air and tanks cannons
yesterday and to pulled down the big building of the college in the
middle of Ramadi city.".
Iraqi Minister of Education, Mr. Abdul-Falah hassan Al-Sudani said in a
press-conference in London within a visit to the UK that the security
situation is hindering the rehabilitation of Iraqi education like it was
before, and that the forces responsible for protecting schools were
unable to do that in addition to stopping in building schools in Samarra
city because of the increased violence and threatening sent to workers
two months ago. He also pointed out to the Ministry of Education which is
responsible for primary and secondary schools that it couldn't adjust the
educational curriculums since the fall of Saddam Hussein regime in
20003 and had enough of canceling some texts from the curriculums
which were pointing to the x-regime.
The minister declared that the confused security situation and the tumble
of economic situation in some areas led to the dropping of education
level in Iraq. That came after: "Years of negligence, wars and blockade
that harmed educating more than six millions Iraqi students in the
primary and secondary schools." He also said that: "The forces
responsible to protect schools in Iraq haven't been supplied with enough
weapons" adding: "Some of those elements escape when they are
attacked like what happened in the Ministry center three weeks ago."
Many of the people working in the Ministry of Education have been
assassinated like the rest of the Iraqi Ministries. Al-Sudani told about the
killing of a general manager in his Ministry last month while another
general manager was exposed to an assassination attempt last week what
made him badly injured. He also added that gunmen killed five teachers
in a school to the west of Baghdad last month and two teachers have
been killed in the studying hall of the final examinations of the year last

that: "Some teachers were getting threats in the confused neighborhoods

schools, no good planning and lack in the financial amounts we need." He
also said that the primary teaching in Iraq is compulsory while some of

are looking to make the last three years of the secondary school as
compulsory until age 14 to every Iraqi. From the challenging facing the
Ministry of Education is qualifying male and female teachers where only
%10 from the total staff of the primary and secondary teachers was
trained since 2003. Al-Sudani said that the damage in the schools
buildings is hampering the teaching process in Iraq that it was estimated
that %85 of those buildings which its number is 14.300 buildings need
repairing in a way or another and also %(10-15) of them need to be
pulled down and rebuilding again starting from zero. There are 19.270
schools in Iraq but only 14.300 buildings are qualified, therefore some
schools depend on alternation in teaching times to give a big number of
opportunities to the students. The Minister estimated the expenses of
rebuilding every school at about $ (30.000-300.000) which depends on
the damages. He also added that building new schools may cost about $
(500.000 - 900.000). Ministry of Education has fixed an mount of 50
millions American dollars to build 383 schools where 85 of them in
Baghdad and 297 built by the Ministry of Labor out of Baghdad. It's
expected to open those schools before the next year.
In replying to the (Middle East) newspapers that the changing in the
educational curriculums since the fall of the x-regime is just like a
revision because we require enough financial support to print new
textbooks. He added that his Ministry is working to develop
curriculums in three fields that on top of them is: "Getting rid of violence
knowledge spread in our books that taught violence to the children and
we have to make them love peace and respect human rights." The other
two changes fields are about the changing of: "Old teaching method" and
qualifying teachers. He continued: "Teachers have been trained before to

only give information, but they must teach the students to think of
themselves and analyze information." He also added that he met
textbooks publishers during his visit to Britain and looked for the
opportunities to print new textbooks to the Iraqi schools within the start
of 2006 / 2007. The Iraqi Minister praised the cooperation with the
Kurdish Education Ministry in Kurdistan of Iraq region, while he followed
saying that:" The two Ministries in Erbil and Sulaimania governorates are
responsible to administer education in the region." He added that Arabic
language is taught in the three Kurdish governorates as a second
language while other current languages in Iraq like Kurdish, Assyrian and
Turkish are taught in other Iraqi schools "If there are 25 students in the
school ask for that like we have now in hundreds schools in Mosul and
Diyala and Baghdad governorates and others." He continued that:
"Teaching the female citizen is important to the children of Iraq to solve
the questions about religious or secular education and differences
between Iraqi people groups.

3. Cultural Rights:

The specialized committee in removing the effects and symbols of the x-


regime started its work in 21. Oct. 200 by pulling down the statue that
was called the March Statue which's in Alawi neighborhood in the Karkh

Abu Jaffar Al-Mansuor was destroyed by bombs were hidden under the

destroy a shining ear from the history of Iraq under false names same as

4. Emigrates and refugees rights:

A spokesman of the allied forces in Iraq said yesterday Thursday, 20. Oct.
2005 that there were 376 foreigners arrested in Iraq since the start of
this year including an American. Major general Rick Lynch said that he
had no in details information about each of the detainees arrested in
breaking in operations. He added that Egyptians were the most (78),
Syrians (66), Sudanese (41), Saudis (32), Jordanians (17) and (13) Iranians
while from the other nationalities there were two British, one Danish, one
French, one Israeli, one Irish and one American. Lynch said: "Making sure
was done about the detainees nationalities during the investigations and
documents which they had. We can trustfully say that they were citizens
of those countries."

unit orders to release him or moving him into a "Executive arresting


center" like Buca Camp and mostly the American forces release %50 of
the detainees between those two stages. The occupation forces had the
decision to follow the civil people arrest after searching for their files
according to the procedures of the Common Council for Reviewing and
release detainees. The Common Council for Reviewing is a new created
authority with cooperation and coordination with the Iraqi government
that it included six representatives (Representatives of the Justice, Interior
and Human Rights Ministries) aside from three officers from the allied
forces in Iraq. That court or council was established in August / 2004 and
the searching procedures should be done within the next 90 (Ninety) days
after the arrest and that it should be continuous on the rule of re-
searching every 180 (One hundred and eighty) days. They are
administrative procedures where the detainees don't be represented as a
single. The common council orders the reviewing and releasing the
detainees either by releasing the detainee -unconditional or conditional
with a sponsor- or keeping arresting him if he's been considered that he
represents "A threat to the occupation forces and security in Iraq". The
detainee's file can be transferred to the Central Court of First Instance in
Iraq if the file includes enough of "Burden of Proof". It's to be mentioned
that files of some dangerous persons aren't transferred to the court, but
the common council for reviewing and releasing detainees doesn't have
but only a consultative value because the last word goes to the
headquarters of the occupation forces in Iraq. In case of releasing under
conditional guarantor, then the detainee must sign a paper indicating
that he denounces violence and submitted to Iraqi laws. Between the
foundation and November / 2005, the Common Council for Reviewing
and Releasing detainees discussed about 22.000 (Twenty two thousands)
cases and demanded for about 12.000 (twelve thousands) cases to be
released according to the occupation forces numbers in Iraq. The
Common Council for Reviewing and Releasing Detainees was founded as
it's alleged according to the article 78 from Geneva 4th Convention and
two resolutions 1556 and 1637 issued by the Security Council of the
United Nations, and to your knowledge, those two resolutions allow the
occupation forces in Iraq to cooperate with the Iraqi government "to take
all the necessary arrangements to participate in keeping security and
stability in Iraq" specially of what concerned of arresting individuals "for

binding security reasons". Geneva 4th Convention (article 43, 1st item),
the principle of reviewing detainees situations every six months. In spite
of the occupation forces declaration about working inside the frame of
the international law, but it seemed they don't apply but only in a
selective method to use it for justify the foundation of the Common
Council for Reviewing and Releasing Detainees, while they overlook the
legal guarantees that is gives to the detainee. The common article 3 in all
Geneva conventions is applied in Iraq preventing "issuing judgments and
executing them without any previous judgment presented by a personal
status court attached with legal necessary guarantees for civilized
people." Besides, the international documents concerned with human
rights protection and ordinary suitable criterions in any time and
circumstances. In times of non international armed conflicts, the
countries have the right to breach most of the rights included in the
mentioned documents except the "hard nucleus" from human rights. In
this frame, Human Rights Committee showed respecting countries to the
international commitments of the civil and political issued in 1966 in a
review of 2001, the breach conditions and widened the content of the
"hard nucleus." In a declaration issued in 1987, the common court
between the USA for human rights which's considered as the judicial
society charged with caring of American agreements of human rights, San
Jose era, 1969, that it's impossible to suspend some guarantees, specially
the mentioned in article 8 from the convention. This wording guarantees
a "fair judgment" to every individual in front of an "independent, honest
and specialized court." This article shows that accused have to realize the
charged directed against him as it also reminds the possibility of his
refugee to a legal consultation so the defense will have a right to the
appearance of any person whether as a witness or an expert who can
show facts. The Common Council for Reviewing and Releasing Detainees
records violations of some basic principles of the International Human
Law and International Law of Human Rights, so the detainees will not
make use of any legal assistance, and also no accusation or lawsuit will
be directed to them. The sessions are closed-door sessions while the
existence of the allied forces officers in the Common Council for
Reviewing and Releasing Detainees doesn't guarantee "independence and
honesty" showed in the Geneva 4th convention (article 43 / 1st item). In

sees that: "Occupation forces in Iraq are violating the basic human rights
of tens of thousands of detainees. Detainees are so many since months
or years and they haven't been incriminated yet. Occupation forces have
used procedures that divest detainees from human rights included in the
international conventions, specially the right of appearance in front of a
judge and the right of the legal disputation of their being arrested in
front of a court of justice." James Ross, the legal counselor of the Human
Rights Monitoring added in an interview in the 6th of January that: "The
USA confirms that detaining individuals in Iraq is according to the
international criterions, while it detains individuals without applying
principles of Geneva convention or human rights."
Al-Ferdos square in the center of Baghdad witnessed a wide
demonstration in 12. Nov. 2005 where many NGOs, syndicates and
unions participated and demanded to cancel the Council of Ministers
resolution of the NO. 8750 which imposed of the government occupancy
on the real estates and their organizations properties.
The researcher (L.J.A.) who's one of our net researchers has done a
study about the negativity of the new Iraq elections law where there were
many negative parts contrary to the laws and international traditions. We
attach a copy of the study and keep the full name of the researcher for
security purposes concerned with him. (Attached the appendix No. 2
showing the study).
A big number of lawyers have concentrated in Mosul, 28. Dec. 2005 to
show their anger and condemnation against the Minister of Justice
resolution Abdul-Hussein Shandal which included the dissolution of the
Council of Iraq lawyers Syndicate and appointing a committee of five
members to administrate the Syndicate affairs according to the resolution
issued by the canceled Iraqi Governing Council appointed by Bremer in
07. Jan. 2004. The demonstrators expressed their being astonished and
surprised in Ninawa court square about the Minister carrying out an old
resolution issued by the canceled Governing Council and he knows more
than the others that the Governing Council didn't have any legality
because it hasn't been founded according to the Iraqi constitution and
wasn't elected, while some other lawyers expressed a clear legal situation
that the Ministry of Justice has no power on the lawyers syndicate
because the syndicate was found according to the legal profession, and

it's staff was elected by all Iraqi lawyers and the election was supervised
by a legal supervision and the supervision of the UN and the Arab
Lawyers Union, and also that the government have the authority to
dissolve it but only by the ways specified in the legal profession law and
to know that the next election of the syndicate will be soon which will
doubt of the aims of the resolution that it has political intentions more
than other reasons which pushed Iraqi lawyers to condemn that
procedure and demanded the international and regional organizations
and specially the UN, League of Arab States, International Union of
Lawyers, Arab Union of Lawyers and all human rights organizations in the
world to refuse and condemn that resolution and support the procedures
that the Lawyers Syndicate have taken about refusing and carrying out
the resolution because it's not based to any legitimacy. The Arab Union of
Lawyers condemned the dissolution of the elected Lawyers syndicate
Council in Iraq in 28. Dec. 2005 and refused to recognize the recognition
of the appointed association. The Secretariat-General also declared that it
will not recognize any appointed association and will only deal with the
elected Syndicate Council headed by the chief Kamal Hamduon Mulla
Allaw until the session of the general council and electing a new chief in
16. March. 2006 according to the democratic rules and away from any
outer interference. The lawyers' team in Mosul is prosecuting the
Independent Electoral Commission and brings out the forgery proofs in
front of the judge.
