INFORMATIVE SPEECH OUTLINE


Introduction
1.1 Almost 31% of the worlds population are using social networking
sites, which is equivalent to 2.3 Billion people in the world (Statista,
2016). According to Rappler (2015) In the Philippines there are
about 47 million facebook accounts that are active and
approximately 47.13% of the countrys population are internet users
as of 2015. Without us even knowing, As of 2013, According to the
Department of Justice 87% of the Philippine population is a victim of
Cyber Crime (Philippine Daily Inquirer, 2013).
1.2 From 2013-2015 there are a total of 1,211 complaints filed to the
Philippine National Police, Anti-Cybercrime Groups (PNP-ACG). And
the top 5 complaints are namely:
1.2.1 Online Scams with a total of 366 complaints
1.2.2 Online libel with a total of 240 complaints
1.2.3 Online threats with a total of 129 complaints
1.2.4 Identity theft with a total of 127 complaints
1.2.5 Photo and Video Voyeruism with a total 89 complaints
1.3 Onel de Guzman, the computer programmer charged with
purportedly writing the ILOVEYOU computer virus, was ultimately
not prosecuted by Philippine authorities due to a lack of legal basis
for him to be charged under The Electronic Commerce Act of 2000.
So, the Technology and eCommerce Council first drafted The Cyber
Crime Prevention bill in 2001 and it was only on September 12,
2012 was it signed as an official law which then became The Cyber
Crime Prevention Act of 2012 or R.A. 10175.
1.4 To fully understand this Law, today I will discuss some of the
Acts grounds, some of the important crimes and its punishments
that we millennial must be for other purposes. aware of.
Body
2.1 What is RA 10175?
2.1.1 An act defining cybercrime, providing for the prevention,
investigation, suppression, and the imposition of penalties
therefor and other purposes.
2.2 How is this different from other related existing laws?
2.2.1 R.A. 8792 or the Electronic Commerce Act of 2000 is an act
of providing for the recognition and use of electronic
commercial and non-commercial transactions and
documents, penalties for unlawful use thereof and other
purposes.
2.2.2 The current law during the case of Onel De Guzman, which
is on the year 2000 did not provide legal basis for
criminalizing offenses committed on a computer in general.

2.3 What are the computer related-offenses under The Cybercrime


Prevention Act of 2012?
2.3.1 Computer Forgery which is the intentional input, alteration,
deletion or suppression of any computer data, without
right, resulting in unauthentic data with the intent that it
be considered or acted upon for legal purposes as if it were
authentic.
2.3.2 Computer-Related Fraud as defined by the law The
unauthorized input, alteration, or deletion of computer
data or program or interference in the functioning of a
computer system, causing damage thereby with fraudulent
intent.

Computer-related Identity Theft is the
intentional acquisition, use, misuse, transfer,
possession, alteration or deletion of identifying
information belonging to another, whether natural or
juridical, without right.
2.4 What are the penalties of the said Offenses?
2.4.1 Imprisonment
2.4.2 Fine, minimum of 200,000 PhP and a maximum amount
commensurate to the damage incurred.

Conclusion
3.1 RA 10175 is indeed important for us to understand because us
millennial we need to be aware of our surrounding not only in the
real world but also in the cyber world, which has become our 2nd
world, we need to keep in mind that all we do in the internet, like in
the real world, is governed by law.
