OPERATIONALREQUIREMENTS

TherequirementssetforthinArticleIofthisAppendixshallapplytoeachServiceforwhichNewSatdoesnotprovideallearthstation
facilitiesfortransmittingsignalstotherelevantSatellite.
TherequirementssetforthinArticleIIofthisAppendixshallapplytoallServices.

ArticleI.EarthStationTransmit/ReceiveRequirements
1.NonInterferenceandUseRestrictions
TheCustomer'stransmissionstoandfromtheSatelliteshallcomplywithallapplicablegovernmentallaws,rulesandregulations.The
CustomerwillfollowestablishedpracticesandproceduresforfrequencycoordinationandwillnotusetheService,oranyportionthereof,
inamannerwhichwouldorcouldbeexpectedto,understandardengineeringpractice,harmtheServiceorinterferewiththeuseofor
harmanyportionoftheTransponderfromwhichtheServiceisprovided,anyotherTransponderontheSatellite,theSatellite,oranyother
inorbitsatelliteortransponderonsuchothersatellite.NewSatreservestherighttorequirethatanyprogrammingserviceorother
transmissionsbeencrypted.

2.TransmissionPlan
PriortocommencingtransmissionstoandfromtheSatellite,theCustomershallsubmititstransmissionplanforNewSatspriorwritten
approval.TheCustomershallbepermitted,subjecttoNewSatspriorwrittenapproval,tomodifythistransmissionplanfromtimetotime.

3.TerrestrialFacilities
TheCustomershallberesponsiblefortheprovision,installation,operation,maintenanceof,andforsecuringallnecessarylicensesand
otherconsents,permissions,concessions,permitsandauthorisationsfor,theearthstationandantennafacilitiesandequipmentthatare
usedfortransmittingsignalsto,orreceivingsignalsfrom,theSatellite(CustomerProvidedFacilities).

4.EarthStationRequirements
4.1 GeneralRequirements
(a)

TheCustomerwillconfigure,equipandoperateitstransmitfacilitiessothattheinterfaceofthesefacilities,inouterspace,
withtheSatelliteshallconformtothecharacteristicsandtechnicalparametersoftheSatellite.TheCustomerwillfollow
NewSatsproceduresforinitiatingandterminatinganytransmissionstotheSatellite.TheCustomerwilloperateall
transmitfacilitiesinamannerthatallowsforcessationof,andwillcease,transmissionsimmediatelyuponreceiving
electronic,telephoneorfacsimilenoticefromNewSatinaccordancewithsection11,orifothertechnicalrequirementsare
notbeingadheredto.TheCustomerwillfurnishinformationregardingthetechnicalparametersofitstransmissionsona
continuingbasisasrequiredbyNewSattopreparefor,initiate,maintainandimmediatelydiscontinuetheuseofthe
ServicesuponnoticebyNewSat.

(b)

NewSatshallhavetheright,butnottheobligation,toinspectanyCustomertransmitfacilities,togetherwithassociated
facilitiesandequipmentusedbytheCustomer,orbyathirdpartyundertheauthorityoftheCustomer,totransmittothe
Satellite.NewSatwilluseallreasonableeffortstoscheduleinspectionstominimisethedisruptionoftheoperationofsuch
facilities,andtheCustomershallmakesuchfacilitiesavailableforinspectionatallreasonabletimes.TheCustomershall,
uponNewSatsrequest,providemeasuredproofthatanytransmitfacilitymeetsorexceedstherequiredsidelobe
envelope.

4.2 EarthStationEIRP

ForsaturatedTransponderoperations,theCustomersearthstationsmustbecapableoftransmittingamodulatedcarrier
withamaximumEIRPsufficienttoachievethenominalEIRPassignedinthetransmissionlineupmessagewithamarginof
atleast3dB.FormultiplecarrieroperationthroughthesameHPA,theCustomersearthstationsmusthavesufficient
powertoenableoperationatnominalpowerwithnominal6dBoutputbackofffromsaturation.ForpartialTransponder
allocationstheactualassignedoperatingEIRPforagivenearthstationwillbedeterminedbyNewSatinconsultationwith
theCustomer,takingintoaccounttheactualTransponderperformanceandloadingpriortothetimeofthetransmission.

4.3 UplinkEIRPStability

Inclearskyconditions,theuplinkEIRPinthedirectionoftheSatellitemustbemaintainedtowithin+/0.5dBofthe
assignedoperatingEIRP.UndernocircumstancesmaytheEIRPexceedthevalueassignedinthetransmissionlineup
messagebymorethan1dB.AutomaticuplinkpowercontrolsystemsmaybeemployedbytheCustomerprovidedthat
priorapprovalfortheparticularsystemanduseisobtainedfromNewSat.

4.4 HPARequirement

IndeterminingtheHPAsizeforagivenearthstation,itisnecessarynotonlyfortheCustomer'stransmittingearthstation
tomeetthemaximumEIRPrequirements,butalsotomeettheemissionconstraintssetforthinSection5.3andcomply
withtheuplinkrestrictionssetforthinSection4.7.

4.5 AntennaSidelobes

Allearthstationsshallsatisfythefollowingtransmitsidelobeperformanceenvelopes:

whereGisthegainofthesidelobeenvelope,relativetoanisotropicantenna,inthedirectionofthegeostationaryorbit

envelopemaybeexceededby10%ofthesidelobes,butnoindividualsidelobemayexceedtheenvelopebymorethen3
dB.Thereceivesidelobesshouldalsoconformtotheenvelopedescribedabovetoprovideadjacentsatelliteinterference
isolation.

4.6 EarthStationPolarization

Earthstationstransmittingsignalsto,andreceivingsignalsfrom,theSatellitemustbecircularlyorlinearlypolarizedon
boththeuplinkanddownlinkasdeterminedbyTransponderassignment.Allsuchearthstationsshallbepolarizationagile
ineithercircularorlinearmodesandshallbeabletosimultaneouslytransmitandreceiveinthesamepolarization.Except
asmaybeexpresslypermitted,theearthstationcrosspolarizationisolationmustbeaminimumof30dBwithinthemain
beamoftheearthstation'stransmitantennapattern.

4.7 UplinkRestrictions

ExceptasmaybeexpresslypermittedbyNewSatduringacoordinatedtestperiod,noearthstationoperatorshalltransmit
anunmodulatedcarrierthroughaTransponder.Theoperationofeachearthstationmustbeinstrictadherencewitha
transmissionplansubmittedbytheCustomerandapprovedbyNewSat.Anydeviationfromthattransmissionplanmustbe
approvedinadvancebyNewSat.UndernocircumstancesshalltheearthstationtransmitanRFcarriertotheSatelliteona
frequencynotauthorisedbyNewSat,whetherornotthatfrequencyisinusebyotherstations.

5.ServiceRequirements
5.1 VideoServiceRequirements

TheCustomermayuseanyvideoexciterwhichmeetstheminimumrequirementslistedbelow,providedthatIFfilteringis
includedtoconstraintheoutputspectrum.Foranalogvideotransmissions,anenergydispersalwaveformshallbeused.
TheCustomermayaddoneormoreaudioordatasubcarrierstothenormalvideobaseband,providedthat:(a)theEIRPof
thecompositecarrierdoesnotexceedthevaluespecifiedinthetransmissionlineupmessage,and(b)theemission
constraintssetforthinthisAppendixaremaintained.

5.2 DataServiceModemRequirements

TheCustomermayuseanydigital,SCPC/PSK,MCPC/PSKsatellitemodemthatmeetstheirparticularrequirements,subject
tothefollowingconstraintswhicharedesignedtoensureexcessinterferenceisnotexperiencedbyadjacentsatellitesorby
otherusersoftheSatellite:

(a)

DigitalModemsScramblingmustbeprovidedtoensurethatuniformspectralspreadingisappliedtothetransmitted
carrieratalltimes.AdatascramblerbuiltinaccordancewithITUTRec.V.35,orafunctionallyequivalentunitwithsimilar
spectrumspreadingcharacteristics,mustbeemployed.

(b)

SCPCandMCPC/PSKIngeneral,anySCPC/PSKorMCPC/PSKmodemwhichmeetsallrelevantITURandITUT
recommendationsisallowed,subjecttopriorapprovalbyNewSat.

(c)

OtherModemsTheuseofothermodemtypesisalsopermitted,subjecttopriorapprovalbyNewSat.

5.3 EmissionConstraints

Thetransmitearthstationmustbeequippedandoperatedinsuchamannerthatspuriousemissionattheoutputofthe
antennaduetoallsourcesdoesnotexceed4dBW/4kHzoutsideoftheassignedTransponderbandwidth.TheEIRPdensity
ofeachcarrier,outsidethebandwidthallocationoftheTransponderorpartialTransponder,whichresultsfromspectralre
growthduetoearthstationnonlinearitiesshallbeatleast26dBbelowthemaincarrierspectraldensity,andshallnot
exceed4dBWinany4kHzbandwithintheCandKubandfrequencyrangeoftheSatelliteasmeasuredattheoutputof
theHPA.

6.CustomerUplinkProviders
TheCustomermaycontractwithotherpartiestotransmititssignalsto,orreceiveitssignalsfrom,theSatellite;provided,thatthe
CustomerrequiresitscontractorstocomplywithalloftherequirementsofthisAgreementregardingtransmissionsto,orreceptionfrom,
theSatelliteandmakesNewSatanintendedthirdpartybeneficiaryentitledtoenforcesuchagreement(ortotheextentthatitmaybe
requiredforenforceability,givesNewSatdirectprivitywithrespecttosuchagreement).IftheCustomerretainsthirdpartiesaspermitted
bytheprevioussentence,thosethirdpartiesfacilitiesshallbedeemedtobeCustomerProvidedFacilitiesandtheactsandomissionsof
thosethirdpartiesinconnectionwiththetransmissionorreceptionoftheCustomerssignalsshallbedeemedtobetheactsandomissions
bothofsuchthirdpartiesandoftheCustomer.

7.CustomerCooperation
IfaServicefailstomeettherelevantServiceSpecifications,theCustomershalluseallreasonableeffortstocooperateandaidNewSatin
curingsuchfailurebymodifyingtheterrestrialfacilitiessothatthereisnonetlossinperformance,inwhicheventtheService
Specificationsshallbedeemedstilltobemet;providedthatallreasonableeffortscanbedoneatnoexpensetotheCustomer,unless
reimbursedbyNewSat.TheseobligationsoftheCustomershallinclude,butshallnotbelimitedto,thefollowing:
7.1 attherequestofNewSat,ifthereisaproblemthatcanbecompensatedforbyincreasingthepowerofitstransmission(s)
totheSatellite,withoutaffectingitsuseoftheServices,theCustomershalldosototheextentitcanwithexisting
equipment;and
7.2 permittingNewSat,atNewSatsolediscretion,andatNewSatcostandexpense,toupgradetheCustomerProvided
Facilities.

8.CarrierFrequencyAssignments
TheassignedcentrefrequencyofeachcarrierwillbedeterminedbyNewSatinconsultationwiththeCustomer.Itisrequiredthatall
transmitandreceiveearthstationsbecapableofoperationacrosstheentiresatellitefrequencybandandinbothsensesofpolarization.It
may,fromtimetotime,benecessarytochangecarrierfrequencyassignments(a)tomeetunforeseenchangesintheCustomers
requirements,(b)toavoidmutualinterferencewithcarriersinadjacentorcofrequencytransponders,or(c)toenableefficientcapacity
utilisationandTransponderloading.

9.ThirdPartyUse
WithoutimplyinganyrightoftheCustomertopermitanythirdpartyuseoftheServices,theCustomershallberesponsibletoNewSatfor
anythirdpartyuseortransmissionsthatispermittedbytheCustomertothesameextentasitwouldbefortheCustomersownuseor
transmissionsandreferencesinthisAgreementwithrespecttotheCustomersresponsibilitiestoNewSatregardingtheCustomersuseor
transmissionsshallbeinterpretedaccordingly.

10.SatellitePowerConstraint
AstheSatelliteincreasesinage,becauseofanoverallpowerconstraintontheSatellite,itmaybenecessaryinordertoprotecttheoverall
healthandperformanceoftheSatellitetoceaseoperating(orinterruptoperationof)oneormoreTranspondersontheSatellite.Ifa
Servicewillbeaffected,andsuchactionreasonablycanbeanticipated,NewSatwillgivetheCustomerthirtydaysnotice,orsuchlesser
periodofnoticeasispracticalunderthecircumstances.

11.PreemptiveRightsInAbnormalCircumstances
TheCustomerrecognisesthatitmaybenecessary,inunusualorabnormaltechnicalsituationsorotherunforeseenconditions,forNewSat
todeliberatelyceaseorinterrupttheCustomersuseofaService,solelyinordertoprotecttheoverallhealthandperformanceofthe
Satelliteand/ortoreassigncertainamplifiersamongTranspondersontheSatellitetomakeuseofaspareorredundantequipmentunit.
SuchdecisionsshallbemadebyNewSatinitssolediscretion.TheCustomershallimmediatelyceasetransmissionstotheaffected
Transponder(s)ontheSatelliteatsuchtimeasitsServiceisceasedorinterruptedpursuanttothisSection.TheCustomeracknowledges
andagreesthatthespareredundancyplanoftheSatellitemayrequireNewSattoreassigncertainSSPAsorTWTAs,asapplicable,among
Transponderstomakeuseofaspare.IncircumstancesinwhichaspareSSPAorTWTAisrequiredtobeemployedandtodosorequiresa
changeintheSSPAorTWTAassignedtotheCustomer,theCustomershall,onnoticefromNewSat,immediatelyceasetransmittingtothe
SatellitetoallowtheSSPAorTWTAthatisassignedtoitsTranspondertobereassignedandadifferentunit(thatmeetstheServices
Specifications)tobeputinitsplace.

12.TestingintheEventofTransponderFailure
IfaTransponderthatisusedtoprovideaServiceisnotmeetingtheServiceSpecifications,buttheCustomerelectstocontinuetouse(and
payfor)suchService,asdegraded,NewSatmayinterrupttheCustomersuseasnecessarytoperformtestingortakeanyotheractionthat
maybeappropriatetoattempttorestoretheaffectedTranspondertotheServiceSpecifications.

13.TelephoneNotices
ForthepurposeofreceivingnoticesfromNewSatregardingpreemption,interferenceorothertechnicalproblems,includingwithrespect
toTransponderfailureandrestorationanddenialofaccess,theCustomershallmaintainateachearthstationtransmittingsignalstothe
Satellite,atelephonethatiscontinuouslystaffedatalltimesduringwhichtheCustomeristransmittingsignalstotheSatelliteandan
automaticfacsimilemachineinoperationandcapableofreceivingmessagesfromNewSatatalltimes.Thosepersonsstaffingtheearth
station,forthepurposesofreceivingsuchmessagesfromNewSat,musthavethetechnicalcapabilityandabsoluteauthority
immediatelytoterminateormodifythetransmissionsifnotifiedbyNewSat.NewSatshallalsomaintainatelephonethatiscontinuously
staffedforthepurposesofreceivingnoticesregardingthemattersidentifiedabove.AllsuchnoticesshallbemadeinEnglishandshallbe
effectiveupontheplacementofatelephonecallfromonepartytotheother.
