UPON the first hearing of Part 8 claim


AND UPON HEARING the Claimant in person and Jonathan Moffett of Counsel for the Defendant
AND UPON the Claimant's applic~tion by notice dated 16 January 2017 for a protective costs order
and other relief
IT IS ORDERED that:
1.

The case shall proceed under Part 7 and shall be allocated to the multi-track.

2.

The Claimant must by 4 p.m. on 17 February 2017 file and serve (i) a Part 7 claim form,
which shall stand in these proceedings in substitution for the existing Part 8 claim form, and

(ii) Particulars of Claim, and must by the said time and date pay any additional court fee that
may be required (308 having already been paid).
3.

The Defendant must by 4 p.m. on 10 March 2017 either (a) file and serve a Defence or (b)
make an application for Part 24 judgment and/or an order for strike-out under r. 3.4. For
the avoidance of doubt, if such application be made, the Defendant shall not be required to
file or serve a Defence until further order.

4.

There will be a case (not costs) management conference on the first available date after 31
March 2017, when the Court will consider (a) any necessary case management, (b) any

applications that are before it, (c) any need for re-allocation to the fast track or the small
claims track, and (d) the appropriate directions for the costs management of this case. Time
allowed: day.
5.

The Claimant's application by notice dated 16 January 2017 for a protective costs order be
and is refused and is certified as totally without merit.

6.

The costs of (a) the Defendant's application by notice dated 11 January 2017, (b) the
Claimant's application by notice dated 16 January 2017, and (c) this hearing shall be paid by
the Claimant to the Defendant on the standard basis If not agreed. The assessment of those
costs is adjourned for consideration at the hearing mentioned in paragraph 4 above.
