NOTICE OF ADOPTION OF AMENDMENT TO RULES OF KINGSWOOD II

CONDOMINIUM ASSOCIATION, INC.

NOTICE is hereby given that on December 1, 2016, after considering the


comments of Unit Owners, the Executive Board of Kingswood II Condominium
Association, Inc. adopted the Associations Collection Policy as an amendment to the
Rules of the Association. A copy of the new rule, which is the Associations Collection
Policy, is enclosed with this notice.

I.

LEASE RULES

The following Rules pertain to the leasing of units within Kingswood II Condominium:

1.
Written Leases and Lease Addendum: No Unit Owner may lease a unit in Kingswood II
Condominium without a written lease. An addendum in the form attached hereto as Exhibit A
shall be attached to and made a part of all leases (the Addendum). Unit Owners must provide
the Association with a copy of the fully executed Addendum within ten (10) days of the lease
commencement date.
2.
Term of Lease: No unit may be leased for a term of less than thirty (30) days. No unit
shall be rented for transient or hotel purposes.
3.
Partial Lease of Units: Units may not be divided or subdivided into smaller dwelling units.
Only an entire unit may be leased; no portion or fraction of a unit may be leased.
4.
Community Documents To Be Provided To Tenants: Unit Owners must provide their
tenants with copies of the Declaration, Bylaws and Rules of the Kingswood II Condominium
Association (the Community Documents).
5.
Lease Notification: Unit Owners must provide the Association with information about
their tenants within ten (10) days of the lease commencement date. This can be accomplished
by completing this Lease Notification Form attached hereto as Exhibit B, or by a letter which
contains the same information as the form.

Violation of Community Documents:


(a)
After giving the Unit Owner and tenant notice and an opportunity to be heard, the
Association may suspend the right of a tenant of a unit to use the recreational facilities in
Kingswood in the event that the tenant and/or the other occupants of the unit violate the
Community Documents. The Recreational Facilities include, but are not limited to, the
pool, the bathrooms, the tennis court and the playground.
(b)
After giving the Unit Owner and tenant notice and an opportunity to be heard, a
violation by either party of the Community Documents may result in a fine of up to one
hundred ($100.00) dollars per day for each day that the violation continues, being
imposed on the Unit Owner, the tenant or both.
(c)
Subject to the provisions of the Common Interest Ownership Act, if a tenant or
other occupants of a unit violate any of the provisions of the Community Documents or
the Common Interest Ownership Act, the Association has the same power to bring a
summary process action against the tenant of the unit that the owner has for a violation
of the lease.
(d)
The owner and tenants of a unit shall be jointly and severally liable to the
Association for any assessment against the unit, including but not limited to fines,
attorneys fees and costs, charges resulting from misconduct, and any other sums that

may be due to the Association as a result of the occupancy of the unit by the tenant or
by their conduct or the conduct of the members of their household or their guests in the
Common Interest Community.
7.

Violation of Lease Rules:


A Unit Owners violation of these Lease Rules may result in a fine of up to one hundred
($100.00) dollars per day for each day that the violation continues after notice and an
opportunity to be heard.

8.

Use of Recreational Facilities by Unit Owners Who Rent their Units:


For so long as a Unit Owner rents his or her unit, the Unit Owner may not use the
Recreational Facilities.

EXHIBIT A
ADDENDUM TO LEASE FORM
This Addendum is attached to and made a part of a Lease dated
____________________between __________________________(the Landlord), and
____________________________(the Tenant) concerning premises known as
_________________________________, Bethel, Connecticut (the Unit).

1.
The Landlord and the Tenant acknowledge that the Landlord has
provided the Tenant with copies of the Declaration, Bylaws and Rules of
Kingswood II Condominium Association, Inc. (the Community Documents).
2.
The Tenant is aware that the Unit is located in a Common Interest
Community and agrees to be bound by the terms of the Community Documents
as if these terms were contained in the lease of the unit;
3.
The Tenant agrees that the Association has all of the same enforcement
powers against the Tenant of the Unit as it has against the Landlord, including
the power to fine for violations of the Community Documents after providing the
Landlord and Tenant with notice and an opportunity to be heard;
4.
The Landlord and the Tenant acknowledge that if the Tenant of the Unit
violate any of the provisions of the Community Documents or the Common
Interest Ownership Act, the Association has the same power to bring a summary
process action against the Tenant and other occupants of the Unit that the
Landlord has for a violation of the lease;
5.
The Landlord and the Tenant agree that they will be jointly and severally
liable to the Association for any assessment against the Unit, including but not
limited to fines, attorneys fees and costs, charges resulting from misconduct,
and any other sums that may be due to the Association as a result of the
occupancy of the Unit by the Tenant or by their conduct or the conduct of the
members of their household or their guests in the Common Interest Community;

The Landlord and the Tenant agree that copies of any notice relating to
the occupancy of the Unit or the Common Interest Community by the Tenants
which the Association is required to give or may choose to give may, at the
Associations option, be given to both the Landlord and the Tenant and other
occupants; and
7.
The Landlord and the Tenant agree that the Association shall not be
liable to them or to the other occupants of the Unit for any action it takes in good
faith to enforce the terms of the Community Documents or the Common Interest
Ownership Act against the Tenants including, but not limited to, bringing a
summary process action.
8.
The Landlord and the Tenant acknowledge that the Association may
suspend the right of the Tenant of the Unit to use the recreational facilities in

Kingswood II in the event that dues or assessments due to the Association with
respect to the Unit are more than thirty (30) days in arrears. The recreational
facilities include, but are not limited to, the pool, the bathrooms, the tennis court
and the playground.
9.
The Landlord and the Tenant acknowledge that, after giving the Landlord
and Tenant notice and an opportunity to be heard, the Association may suspend
the right of the Tenant of the Unit to use the recreational facilities in the event
that the Tenant and/or the other occupants of the Unit violate the Community
Documents.
10.
The Landlord acknowledges that, for so long as the Unit is rented, the
Landlord may not use the recreational facilities in Kingswood II.

EXHIBIT B
LEASE NOTIFICATION FORM
The Association requires that Unit Owners submit this form within ten (10) days of the
lease commencement date. This form must be updated when there is a change of
information or when there is a change of tenant. Please complete all the sections of this
form. Your current e-mail address is important because most notices and
communications are now transmitted by e-mail. Any information provided on this form
is private and will not be distributed unless the Association is given written permission to
do so.
It is the responsibility of the Unit Owner to provide their tenants with the Declaration,
Bylaws and Rules of the Association Rules and Regulations and Deed Restrictions.
