1 (b) PRESCRIPTION.
2 (1) IN GENERAL.In a State in which mari-
3 juana may be prescribed by a physician for medical
4 use under applicable State law, no provision of the
5 Controlled Substances Act (21 U.S.C. 801 et seq.)
6 or of the Federal Food, Drug, and Cosmetic Act (21
7 U.S.C. 301 et seq.) shall prohibit or otherwise re-
8 strict
9 (A) the prescription of marijuana by a
10 physician for medical use;
11 (B) an individual who is an authorized pa-
12 tient from obtaining, possessing, transporting
13 within the individuals State, or using mari-
14 juana for that individuals medical use;
15 (C) an individual authorized under State
16 law to obtain, possess, transport within their
17 State, or manufacture marijuana, from obtain-
18 ing, possessing, transporting within that State,
19 or manufacturing marijuana pursuant to that
20 authorization; or
21 (D) a pharmacy or other entity authorized
22 under State law to distribute medical marijuana
23 to an authorized patient, from obtaining or pos-
24 sessing marijuana for that purpose, or from dis-

1 tributing marijuana to an authorized patient for
2 medical use.
3 (2) PRODUCTION.No provision of the Con-
4 trolled Substances Act (21 U.S.C. 801 et. seq.) or
5 of the Federal Food, Drug, and Cosmetic Act (21
6 U.S.C. 301 et seq.) shall prohibit or otherwise re-
7 strict an entity authorized by a State, in which mari-
8 juana may be prescribed by a physician for medical
9 use, for the purpose of producing marijuana for pre-
10 scription by a physician for medical use, from pro-
11 ducing, processing, or distributing marijuana for
12 such purpose.
13 SEC. 3. DEFINITIONS.
14 In this Act
15 (1) the term authorized patient means an in-
16 dividual using marijuana in accordance with a pre-
17 scription of marijuana by a physician for medical
18 use;
19 (2) the term physician means a practitioner
20 of medicine, who
21 (A) graduated from a college of medicine
22 or osteopathy; and
23 (B) is licensed by the appropriate State
24 board;

1 (3) the term prescription means an instruc-
2 tion written by a medical physician in accordance
3 with applicable State law that authorizes a patient
4 to be issued with a medicine or treatment; and
5 (4) the term State includes the District of
6 Columbia, Puerto Rico, and any other territory or
7 possession of the United States.
8 SEC. 4. RELATION OF ACT TO CERTAIN PROHIBITIONS RE-
9 LATING TO SMOKING.
