1. Are the address given in the problem fictitious? (the place where the murder
occurred)

Yes, the address is fictitious.

2. When did PW1 come to know about the photos that were released by the
accused A1?

Immediately after the circulation of the photos.

3. Can the post mortem doctor be summoned as a witness?

This query is based on law and thus, it is for the participants to find out whether
a post mortem doctor can be summoned as a witness.

4. Whether the discrepancy in the date of release of the photos is intentional.


Please refer to the statement of the mother and the statement of the friend
and DW1 in respect to the same.

The point needs no clarification.

5. Whether jurisdiction under IT charges is being contended since the photos


were circulated via Australian website. (So are we to assume photos were
posted while in India)
It is open to the participants to contend the jurisdiction, if they find valid
arguments in that regard.

6. I have query that in moot preposition there is no FIR only statement of


mother is considered as FIR but how before lodging a FIR statement can be
recorded we are unable to frame the question so kindly clarify the problem
and inform us if there is any other problem and inform us about new rules.

The FIR is given in the proposition. The statement of mother is not considered
as FIR.

7. Can the prosecution be allowed to file for modification of charges via


addition of another charge?

Yes, but modification either by deletion of charges or by withdrawal or charges


is not allowed.

8. Is the statement of IO Chand Singh, under section 161, a part of the


Investigation report under section 173 of CrPC?

Yes, it will be considered as a part of investigation report.

9. Is the IOs statement present under Section 173? (please clarify the
provision)

12.Can we amend the charges or use any of the other provisions as per the
procedure? Are there any limitations apart from introduction of new
evidence or witnesses?
