Pending before this court are Bariven, S.A.s (Bariven) motions for recognition of its rights

as a victim and entitlement to restitution. Dkt. 95, 97. After considering Barivens motions, the

Governments response and defendants responses, Barivens motions are DENIED without

prejudice as premature at this time. The motions may be re-urged at the time of sentencing. The

Governments motion to stay briefing and hold in abeyance Barivens motions (Dkt. 103) is

DENIED AS MOOT.
