Necessarytoprotectpublichealthandpreventthespreadofanimaldiseasesandlivestock
andlivestockproducts,quarantine,importandexportcontrollawsandrelatedmatters.

Sincetheoutbreakofanimaldiseasesandtopreventthespreadoflivestockandlivestockproducts
necessary to protect public health and quarantine, import and export controls and to provide for
mattersincidentalexpedientandnecessary

Itisherebyenactedasfollows:

Shorttitleand 1.(1) This Act Bangladesh livestock and livestock products, quarantine laws,
commencement maybecalled005.

(Ii)ThisActshalltakeeffectimmediately.



Definition II.Unlessthereisanythingrepugnantinthesubjectorcontext,thisAct

: (a) "import" means any animal or livestock products, water, land and air,
bringingthecountry

(B) "certificateofsuitability" means any livestock products, human or animal

foodorsuitabilityofuseofthecertificateofsuitabilityissuedbythequarantine
officer

(C)"prescribed"meansprescribedbylaw

(D)"animal"meansalltypesofanimalsshallincludethefollowing,namely:

(i)allmammalsexcepthumans

(Ii)thebirds

(Iii)reptiles

(Iv)aquaticanimalsotherthanfishAnd

(v) The Government may, by notification in the official Gazette, declare any
otheranimal.

(E) "Animal Products" means the animal or carcass, partially or completely,

thatcollectedormanufacturedproductsandanimalmeat,blood,bone,marrow,
milk or dairy products, eggs, fat, food items produced from animals, semen ,
embryo, veinsveins, hair, skin, intestines pulse, and by the government, by

(F)"CriminalProcedureCode"meansTheCodeofCriminalProcedure,1898
(ActVof1898)

(G)"DirectorGeneral"meanstheDirectorGeneralofAnimalResources

(H)"body"meansanypartofacarcass,anditincludes

(I) "sbasthyasanada" means an animal health certificate issued by the health

quarantineofficer

(J)"export"meansanyanimalorlivestockproducts,water,landandairfrom
Bangladeshsentabroad

(K) "disease" means any infectious or contagious disease, or by the

Government,fromtimetotime,bynotificationintheofficialGazette,declare
anyotherdisease

(L)"Rules"meanstherulesmadeunderthisAct

(M) "quarantine officer" means a quarantine officer appointed under this Act
And

(n) "quarantine" means to prevent the spread of animal disease outbreak or

animal or livestock products sbatantrikarana (isolation) and approved by the
Government for the examination of any place or premises for the purpose of
importationandexportationofsuchlivestockorlivestockproducts,quarantine
officersdetaineduntilthetimespecifiedby.



Livestockand 3.The Imports and Exports (Control) Act, 1950 (XXXIX of 1950) under the
livestock Government, from time to time issued the order contained in the policy of
products, importorexportofanyanimalorhumandiseaseconditionsthatmaycauseany

quarantine, animal or livestock products, quarantine, import or export bans , limited or
importand otherwise,shallbecontrolled.

Theeffectiveness 4.Notificationissuedundersection3shallbevaliditTheCustomsAct,1969
ofnotification (IV of 1969), hereinafter in this section referred to as the said Act, has been
issuedunder issued under section 16, and the importation and exportation of any goods

restrictions upon the ability of the animal or fish products mentioned in the
notification may be applied to the importation and exportation, and the
provisionsoftheActtreatswiththisActshallcomeintoforce.



Arrivalsor 5. Quarantine under this Act, the Government, by notification in the official
departures Gazette, livestock or livestock products, importation and exportation, and its
placement limitshallbedeterminedbytheplaceofarrivalordeparture.

Animaland 6.Alllivestockandlivestockproductsquarantineofficerforquarantinecontrol
AnimalProducts shallbedetained,andheprescribedmanner,shalltakemeasurestoquarantine

Powersand 7.Subject to the other provisions of this Act, quarantine officers, powers and
functionsof functionsshallbeasfollows:

officers (a)heldinquarantineforlivestockorlivestockproducts

(B)detainedforquarantineinspectionoflivestockandlivestockproducts

(C)determinethequarantineperiod

(D)livestockandlivestockproductsfromsanganirodhabastharemoval

(E)tocompletetheprescribedtestsgiveanappropriateorder

(F)Issuanceofsbasthyasanadacattleheldforquarantine

(G)completionofprescribedonlybedetectedafterthediseaseinfectedanimals
orlivestock,orotherwisedisposeofgoodsintheprescribedmanner,makean
orderfordestruction

(H)thatcomeincontactwithinfectedlivestockandlivestockproducts,animal
coat,urine,equipment,grass,straw,andmakeanorderfortheremovalofthe
cage

(I) any vehicle used for the transport of livestock and livestock products,
sterilizationmeasures,orcourtyard

(J)toimposeatravelbanontheexportofunfitanimals

(K) import or export during the transportation of livestock or livestock

products,travelandincidentaltheretoinspectioncertificate

(L) the government banned the import of livestock or livestock products,

animal or livestock products, the importer's expense refund it to settle in the
prescribedmannerorgivingordersAnd

(m) the aforesaid duties and any other measures necessary for the efficient
saspadanera.



Quarantine 8.(1)fortheefficientperformanceofitsfunctionsunderthisAct,theLivestock
officersand Directorate shall appoint the required number of quarantine officers and
employees,etc. employees.

(Ii) subsection (1) of the quarantine officers and employees appointed under
thetermsandconditionsofserviceshallbedeterminedbytheGovernment.

(3) subsection (1) of the officers and employees under quarantine until the
Livestock Department officers and employees from any of the officers and
employeesoftheGovernmentnominatedbyquarantineofficersandemployees
shallactasandperformance.



Byimporters 9. Every importer of the import of animals and livestock products import at
importing least15(fifteen)dayspriortotheamadanitabyalivestockorlivestockproducts
awareness quarantineofficershallinformtheprescribedmanner.



Confiscated 10. Animal products imported animals in quarantine or quarantine officer
livestockand appointedbytheperformanceofthetestpara
livestock
products,etc. (a) the animal is detected to be affected, and the disease can not be cured
throughtreatmentOr

(b)isdetectedtobeinfectedlivestockproducts,anditisunsuitableforhuman
oranimalfoodoruseRecognizedasthediseasedanimalortheanimal'scoat
whichcomeintocontactwithinfectedanimals,urine,equipment,grass,straw,
orofthecageorotherlivestockproductswillbeconfiscated.



Theconfiscated 11.Article10oftheconfiscatedlivestockandlivestockproducts,animalcoat,
animals,disposal urine, equipment, grass, straw, and the cage with the forfeiture order shall be
ordisposal handed over to the concerned district livestock officer and, in the prescribed
arrangementetc. manner, the use, transfer, destruction or removal or disposed of in any other
mannerordisposalshalltakemeasurestodistribute.

Appealagainst 14.(1)ForthepurposesofthisAct,theDirectorGeneraloranyorderissuedby
administrative quarantine officer or any person affected or aggrieved by the judgment are

(thirty)daysforthepurposeofobtainingaremedy

(a)iftheorderhasbeengivenbytheDirectorGeneral,thegovernmentAnd

(b)iftheorderhasbeenprovidedbythequarantineofficer,mayappealtothe
DirectorGeneral.

(Ii) subsection (1) shall be submitted under appeal, the filing period not
exceeding90(ninety)daysshallbedisposedof.



Impunity 15.



Escape 16.TheGovernment,bynotificationintheofficialGazette,livestockanimalor
an animal product class or all or any of the provisions of this Act from the
operation,theconditionsspecifiedinthenotification,exempt.



Offences 17.ThecompanyhascommittedanyoffenseunderthisActisacompanywith
committedby the involvement of every director, manager, secretary, partner, officer and
thecompany, employeeshallbedeemedtohavecommittedtheoffense,unlessheprovesthat
etc. theoffensewithouthisknowledgehasbeencommittedorthatheexerciseddue
diligencetopreventthecommissionoftheoffense.

Theinterpretationofthissection

: (a) "company" means any commercial company, partnership, association,

associationandorganizationAnd

(b)thecommercialorganization"director"meansanypartnerormemberofthe
BoardofDirectors.



Cognizanceof 18.QuarantineofficersanycourtotherthanawrittencomplaintunderthisAct

offense shalltakecognizanceofanycase.



Bythe 19.FirstClassMagistrateoffensesunderthisActor,asthecaseshallbetried
Magistrate bytheMetropolitanMagistrate.

Staff 0.IfanypersoncontravenesanyprovisionofthisActortherulesorregulations
under this Act or fails to comply with the functions in accordance with the

notice, then he is guilty of the same violation or failure U (two) years'
imprisonment,orU10,000(tenthousand)rupeesfine,imprisonmentorboth.



Appeal 1.MagistrateofthefirstclassunderthisActor,asthecaseofanyjudgmentor
order issued by the Metropolitan Magistrate Court appeal against the
jurisdictionofthesessionsmaybecarriedout.

(a)priortotheimportoflivestockandlivestockproducts,orimportthebinding
amadanikaleconditions

(B)landanimalandfishproducts,inspection,quarantine,seizure,detentionand
treatmentmethodstodeterminetheanimals

(C)theappropriatetestmethodforthedetectionofdisease

(D) animal forms and fees for importation and exportation sbasthyasanadera
sbasthyasanadadeterminationoftheneedformedicaltreatmentorvaccinefor
thevaccinationtodeterminefees

(E) import or export fish products to determine suitability for certification

formsandfees

(F)thearrivalsanddeparturesplacelimitsonimportsandexports

(G)thecostoflivestockandlivestockproductsquarantinetodeterminetherate
andtherecoveryprocedure

(H)quarantineallconcernedwiththecourtyard,vehiclesandotherplacesclean

Textpublishedin 5.AfterthecommencementofthisAct,bynotificationintheofficialGazette,
English this Act shall publish an Authentic English lessons, English lessons, which
approvedtheAct(AuthenticEnglishText)shallbecalled:

Providedthat,incaseofanyconflictbetweenthisActandtheEnglishtextthis
Actshallprevail.



Repealand 6. (1) The Livestock Importation Act, 1898 (Act IX of 1898) is hereby
Savings repealed.

(Ii)Notwithstandingsuchrepeal,repealofthislawtakeeffectabyabahitapurbe
anyactionorproceedingpendingundertheActifsuchactionorproceedingin
accordancewiththeprovisionsoftheActshallbedisposedofsothattheyare
notenforced.
