. instituted in the Subdivisions! Court by the plaintiff who died
during the pendency of the case on revision in the District Court.
On the day the record was received back by the trial court, the
appellant applied to the court to substitute him as the plaintiff
in the suit as heir and legal representative of the deceased plaintiff.

U KYAW ZAN U, J.- ln Civil Regular Suit No. 2 of
r964 of the Court of the Subdivisional Judge of Kyaiklat:
sitting at Pyapon, Daw Nyo (since deceased) sued the·
respondents for possession of the suit house under section
9 of the Specific Relief Act. It is most regrettable that:
the suit was unnecessarily delayed due to protracted and'
undesirable pleadings. Be that as it may, the trial Court,.
in the course of the pleadings, exercising its powers under
section ro of·the Code of Civil P!ocedure stayed the suit
pending the disposal of the connected cross suit being No ..
r of 1964 of the same Court in which the respondents
sued Daw Nyo for a declaration that they were the rightfuL
owners o.f the suit house. Being dissatisfied with the order·
Daw Nyo went up to the. District Court in revision being.
Civil Revision No. I of 1965; but, while it was pending.
she died on r7th january 1965. It is said in the order·
dated 22nd July 1965 of the trial Court that the applicant·
merely stated .~n his application that he continued the·
revision application in the District Court as her heir and
legal r-epresentative when the District Court by its order·
dated 8th April 1965, set aside the order of the trial Court
staying the suit and <firected to continue to p:roceed with
the suit. The record was received back on 24th May 1965
by the triaJ Court and on the same day the applicant
applied to the trial Court as heir and Iegai representative
of the deceased Daw Nyo to substitute ~ as plaintiff in.
the suit. The trial Court disallowed the application hold- . ~9~
ing that even ·if he had applied- to be substituted in the

revision case in the District Court that would not save him HLA

of Daw Nyo under Article 176 of the Limitation Act. The
trial Court also held that since the appellant had failed to
apply for substitution within time as required by Order
22, Rule 3 of the Code of Civil Procedure, the suit had
abated under Order 22, Rule 9 (r) of the said Code. The
application was accordingly dismissed with costs. On
appeal against the order the District Court in its Civil
Appeal No.4 of 1965 confirmed the order on 25th March
1966. Hence this. Second Appeal.
The learned District Judge in his judgment stated that
the applicant did apply on 5th February 1965 for sub-
stitution in the revision case before him. He ·was of the
opinion that it was wrong to say that since substitution
was made in the appellate Court there was no need to·
apply for substitution again in the trial Court, and that
this wrong view would not save .limitation under section
5 of the Limitation Act. The learned Advocate for the
appellant submitted before me that there was no laches
on the part of the appellant in not applying for substitution
under Order 22, Rule 3 of the Code of Civil Procedure,
and that the failure was due to the fact that the proceed-
ings were nQt before the trial Court within the time
required to enable ·h im to apply. He refeitred to me
to GsT~J~a~~~ G:~>TOJG~ o1_J (1). In :that case the trial Court
sent intimation to the plaintiffs when it received
the proceedings back from the Chief Court which heard the
revision application arising out of the suit, but four days
before the intimation was sent the plaintiff ·had applied
to substitute the legal representatives of the deceased

Act shall apply to ·the application under sub-rule (2)."
In view of the authorities ·shown above it. must be held
that the appellant had a good and .. sufficient cause " in
his failure to apply for substitution in the trial Court.
·The very fact that he applied on the day the proceedings·
were received back from the District Court shows his
·diligence. He was attentive to his duties. . In the circum-
:starices the application must, and should have been

admitted after the period of limitation by the trial Court c.c.

under section 5 of the Limi~tion Act. The headnote in U -KYAW

.. • . . Where the defend~nts in the suit go in revision
against interlocutory orders in the suit, the suit cann~t be
said to be pending in the original Court and therefore no
question of substitution of legal representative of the deceased
would arise in the original Couit. Where, therefore, one of
the applicants in revision dies during the pendency of the
revision and his name is struck off and the revision allowed
in respect of the remaining applicants, and the case sent back
to the original Court for trial on merits, ·an application for
substitution of the legal representative of the deceased is
maintainable in the o_riginal ·Court within reasonable time.
In such a case no question of limitation entailing abatement
can arise.''

In view of the law and the authorities being in favour of
the appellant the learned Advocate for the respondent did
not press this point but he submitted that since no appeal
lay to the District Court against the order of the trial
Court under Order 22, Rule 3 (2) of the Code of Civil
Procedure this Second Appeal must fail. It will be seen
in Venkat Narsimhan Reddy's case quoted above the
learned· Judges gave relief to the appellant in the interest
of justice by conver~g the appeal into a revision. I do
not understand why I should not give the ap_pellant the
same relief by converting this appeal into a revision if no
appeal lay to the. District Court. The powers ·of revision
under section r r5 of the Code of Civil Procedure is dis-
cretionary. If the appe_llant is left without remedy .i t is
unquestionable that a grave ri.sk of injustice is involved.
A person cannot be finally debarred from seeking his
remedy unless the law depriVes him of his right in .clearest
possible terms. In the present case I think the order of

POUR oTBBBS. Rule r (k) of the Code allows an appeal against· such an

order r~fusing to set aside the abatement or dismissing
the suit. In Bhartu v. U dmi and others (3) it was held ;
"An application to .bring on the recor~ the legal representa-
tives of a deceased party after the eXpiry of the time fixed
~or this purpose must be deemed to be an application to set
·aside the abatement and an order refusing to set aside an
abatement is·appealable under Order 43, Rule 1 {k)."

I may mention here the difference between the present
Code of Civil Procedure and its predecessor. Un'der the
present Code the abatement of the suit follows ipso facto
under Order 22, Rule 3 (2) whereas under the old Code
... the Court may pass an order that the suit shall abate "
under section 366 [now Order 22, Rule .3 (2)]. The abate-
ment is automatic under the present law. The case of
Badlu v. Mt. Naraini (4) is very similar to the pre~ent case.
In that case the plaintiff filed a suit in the Court of the
Subordinate Judge and while it was pending he was
murdered. About 130 days after the death of the plaintiff
his widow applied to be substituted in his place as plaintiff
but the Court rejected the application as barred by time.
A.n appeal was preferred to the District . Court who set
aside the abatement holding that under section 5 of the
Limitation Act there was sufficient cause for extending
the period of limita~on. It was argued that no appeal
lay to the District Judge from an Order rejecting the
applk:ttion to brLng the legal representative of the deceased
on · the record. It was held by the High Court that this
contention has no force and must be overruled. It said

In Thadikonda Gopalaratnam v. Thadikonda Lo.kshmi-
kantam and another (5) where on the death of the plaintiff
an application to be brought as a legal representative of
the deceased is dismissed by the trial Court and con-
·sequently the suit having been abated is also dismissed,
it wa<> held that an appeal and not a revision lies to the
'lower appellate Court from the order of dismissal. There
"is ample authority to support the view I hold. · I need only
mention one more authority in which a series of decisions
holding the same view is given and it is the case of
'Purushottamdas Sakalchand v. Devkaran Kesheo]i and
IQtbers (6) where it was held that an order that a suit abates
is appealable as a decree.
In t~e result, the judgments and decrees of both the
lower Courts are set aside with costs throughout with the
direction that the application of the appellant to substitute
himself as the legal representative of Daw Nyo (deceased)
be restored and the suit proceeded without any further

This I must say was rather an unusual procedure adopted
by U Ba Kun.
On the next hearing date 23rd August 1965 neither
U Ba Kun nor any of the defendants including the present
appellant appeared, but again in the course of the hearing
of the suit the present appellant appeared and filed an

oNn. between 28th July 1965 and the next hearing date, namely,
~roth August 1965 no steps were taken by the appellant or
his lawyer, who, deposed in his affidavit that he was not
aware that the suit would be heard ex parte on roth August
:1965. If he or his client took enough interest in the suit
they would have found out previously that the suit Was
fixed for ex parte hearing on roth August 1965. It is no
excuse nor is it sufficient cause to say merely that he as a
lawyer was not aware of the suit being fixed for ex parte
hearing on roth August 1965. His duty as a lawyer
towards his client is thus involved. I do not know under
what provisions of law this application to stop the hearing
and to hear the suit . afresh was made by the appellant's
lawyer. Be that as it may, the Court did not consider the
application and after continuing the hearing of the suit
:as previously fixed passed a decree ex parte in favour of
the respondents (plaintiffs) Clgainst the present appellant
.a nd two others with costs on uncontested scale on the
·same day ·23rd August 1965.
The appellant preferred an appeal against the judgment
and decree in the District Court of Pyapon being Civil
· Appeal No. 6 of 1965 paying the same amount of court
fees as in the Trial Court. It was contended in the appeal
that the mode of adding the heirs and legal representatives
·of the deceased defendant (Daw Nyo) was wrong in law
and though the appellant's agent U Ba Shein was present
'in ·court on all the days fixed he was not allowed to speak
.and shouted at by the learned Advocate for the respond-
<ents. I have pointed out above that U Ba Shein never

·ing the only witness present, but, the Court rejected the
-offer. This contention also is not substantiated. A Court
is not a place to bargain. It was also contended in
·paragraph 6 that it was wrong to hold that notices on
·the other two defendants were deemed to have been served.
I have pointed out above that the trial Court and the
learned Advocate for the respondents in that Court were
correct in their views. The record speaks for itself. The
appellant's pleader attacked the trial Court as being partial
·but I do not see on record how such an attack could be
·made. Reading the memorandum of appeal before the
lower Appellate Court it is clear that appeal was against
the ex parte decree itself showing there was no justification
to pass that decree ex parte on the grounds set forth
-therein. The grounds of appeal were not based on merits
--of the suit but on the alleged lack of sufficient cause for
passing that ex parte decree. The learned District Court.
·relying. upon Raj Chandra Dhar v. Messrs. K. D. 0. C. Ray
' (I) a decision of the late High Court of Rangoon dismissed
the appeal on the ground that the Appellate Court could
not consider whether the trial Court had sufficient cause
·or not to hear the suit ex parte. The head note in that
-case reads :
" lbat in an appeal from an ex-parte decree the only

ence to the Full Bench of the Calcutta High Court and·

I am in entire agreement with the Bench decision of the·
Patna High Court in Ram Lal Gope and others v. KalE

The decision of the Allahabad High Court in Hummi and

was dissented from by the Bombay High CQurt in Jethalal

lower Appellate Court has_ the power to consider the
question whether the suit was heard ·ex parte against the
appellant on sufficient grounds, and its power of remand

Bombay case as in the present case-the defendant appealed

and others (6). ·Mukherji, J, who wrote the judgment
said:

"Now, with the utmost respect for the learned Judges who'
decided the case in Hummi v. Azizuddin ~3) and the case int
Raj Chandra Dhar v. K.D.O .C. Ray (r), I must say that if they·
intended to lay down as a broad proposition that in a case in·.
which an ex-parte decree has been passed and the aggrieved'
party has not availed of the remedy by way of an applica-
tion under Order 9, Rule 13 he is precluded from raising the·
question of propriety of the refusal to adjourn 1iis case in
appeal wJ?.ich he prefers from the ex-parte decree 'itself, I am
unable to agree in the view which the learned Judges had!
taken in the case.''

Thus the two authorities followed by the Rangoon case~
viz. the Calcutta and the Allahabad authorities did not.
find favour ''Vith the later. decisions of the Calcutta High
Court itself and Bombay as well as Patna High Courts as
shown above. They preferred to follow the Full Bench
decision of the Madras High Court in Sadhu Krishna Ayyar
v. Kuppan Ayyang_ar and others (4) which the Rangoon c.c.
1967
case declined to follow. The Full Bench laid down that: U Knw

This must be taken as the law that stands now. I think
the Rangoon case took a very narrow and strict view of
the law. Order 41 Rule 33 of the present Code of Civil
Procedure gives an Appellate Court power to pass any
decree and make any order which ought to have been
passed or made and to pass or make such further or other
decree or order as the case may require. Lastly I may
refer to the latest authority available on the point and
that is, Barna Charan Dad v. Gadadhar Das (8). The Bench
of the Calcutta High Court in that case held :
" There is no~ng in the Code which confines the power of
the Appellate Court in appeal from ex parte decree only to
the investigation of the cause of non-appearance."

The Bench did not agree to the proposition that the only
point to which enquiry should be directed by the appellate
Court was whether the decree passed ex parte was right
or wrong as the appeal by the defendant was against the
ex parte decree. The trend of later decisions of the
majority of the High Courts in Indj.a now js in a case
in which the ex parte decree has been passed and the
a.ggrieved party has not avaUed of the remedy by way
of an application under Order 9 Rule 13 of the Code, he
is not precluded from raising the question of propriety
of the refusal to adjourn his case, in the appeal under
section 96 of the Code.

heard the learned Advocate of the parties_whose salient

of recor~ only. I have. discussed all the material points
raised in the appeal and given my views above. l have
said that the }earned trial judge was not partial in _his
-dispos~l of the suit. The contention .o f the ·appeil~nt's
lawyer lias no substance at all. With regard to the
absence of 'the appellant or his lawyer on the date fixed
for ex parte hearing the learned Advocate for the appellant
also argued before me. that there was sufficient cause for
non-appearance because the appellant's lawyer resided in
Kyai_klat while the suit was before the Sub-Divisional judge
at Pyapon. The two places are a few hours journey by
'bqat within ~he same district. This submission is not .
tenable at all. I find the appellant could not show any
-sufficient or good reason for his absence in the trial Court
on roth August 1965.

In . the result the· appeal is dismissed with costs
throughout. Advocate's fee five gold mohurs.

" The onus probandi lies on the person who propounds the
Wilt and this onus is in general discharged by proof of
capacity, and the fact of execution, from which the knowledge
and the assent to its contents by the testator will be assumed

" There is no presumption either in fact or in law as seems
to be too commonly supposed, that a will if propounded,
must be forgery. The party who applies for probate or for
letters of administration with a will annexed is no doubt
required to prove the Will. Such proof is usually furnished
by the evidence of persons in whose presence the Will was
-actually executed or who subscribed their names to the
document. that is to say, of persons who saw the testator
executing it and who put their own names to the document
as attesting witnesses. In a case where such attesting
witnesses are produced., and they give clear and cogent
testimony regarding execution, one should require very strong
·· circumstances- to repel the effect of such testimony. It will
not do to talk airily about circumstances of suspicion. It is
no doubt true that a person who takes it upon himself to
dispute the genuineness of a Will cannot be expected to
prove a negative in many cases. At the· same time, the
difficulty in which on his own seeking, he places himself,
will not relieve him of the burden ; it may be a heavy burden
of displacing the positive testimony on the other side. If he
rests his case on suspicion, the suspicion must be a suspicion
inherent in the transaction itself which is challenged and

" Section 263 of the SucceSsion Act enacts that the grant
of probate or letters of administration may be revoked o.r
annulled for just cause. The explanation to that section says
that ' just cause ' shaU be deemed to exist in the instances
cited. However, the explanation is not exhaustive and is
therefore not meant to cover cases like the present.
In the case now under consideration, the grant of letters o~
administration to the appellant being a limited one, we see
no reason why it cannot be revoked if the person on whose
behalf the appellant has been acting is dissatisfied with his
