STATE OF TEXAS AFFIDAVIT FOR ARREST WARRANT COUNTY OF Dallas BEFORE ME, the undersigned authority, om this day personally appeared the undersigned affiant who, afler being duly swom by me, on oath stated: My name is Brent D. Maudlin #6468 and I am a peace officer of the City of Dallas, Dallas County, Texas. I, the affiant, have good reason and do believe that on or about the 12th day of Mareh, 20 17, one (name of suspect) Emmanuel Lewis Kilpatrick (AKA: Buckwheat) did then and there in the City of Dallas, Dallas County, Texas commit the offense of Capital Murder , a violation of Section 19.03 of the ‘Texas Penal Code, a capital felony. Affiant’s belief is based upon the following facts and information which Affiant received from: A ffiant’s personal investigation of this alleged offense. , 8 fellow peace officer of the City of Dallas, Dallas County, Texas, who personally participated in the investigation of this alleged offense, providing this information to Affiant, and whose information Affiant believes to be credible. On Sunday, March 12th, 2017 at about 7:29 p.m. suspects Emmannel Lewis Kilpatrick (AKA: Buckwheat), Jermon Antwon Simmons (AKA:Seven), and Joy Tiara Gray committed the offense of Capital Murder, section 19.03 of the Texas Penal Code, a capital felony against the complainant, Cristobal Zepeda. This occurred at 515 Pontiac Avenue , Dallas, Dallas County, Texas. The facts of this case are as follows: At about 6:30 p.m. the complainant, Cristobal Zepeda, picked up suspect Joy Tiara Gray to make a deal to exchange moncy for sex. The complainant got money out of an automated teller machine (ATM) at an Exxon gas station. The complainant and suspect Gray drove around for about an hour trying to find a location that both of them were comfortable with completing their deal. During this time suspect Gray continually sent text messages to suspect Kilpatrick giving their location. Finally, the complainant drove to the offense location. While he was turning the vehicle around two additional suspects, Jermon Antwon Simmons (AKA; Seven) and Emmanuel Lewis Kilpatrick (AKA: Buckwheat), arrived at the location and blocked the complainant's vehicle from leaving. Suspects Lewis and Kilpatrick got out of their vehicle and one of them told suspect Gray to get out of the complainant's vehicle. Suspects Lewis and Kilpatrick went to the complainant's driver's side door and started patting down the complainant in order to steal his wallet. The complainant tried to drive off with the driver's side door still open. Suspect Kilpatrick fired at least two (2) shots at the complainant as he was driving away. One (1) bullet went through the complainant's head causing his death. The complainant's vehicle drove through a heavy metal gate and continued moving at a high rate of speed until it struck a parked pickup truck. At 5:14 am, the following day an employee at the location called 9-1-1 to report a wreck at the location. It was discovered that the wreck was the result of the complainant being shot in the head. Detectives responded to the location and began the investigation. On Monday, March 20th, 2017 at about 12:31 p.m. Detective Shelton #7760 interviewed suspect Gray at Dallas Police Headquarters. After being advised of the Miranda waming suspect Gray gave a videotaped voluntary statement admitting to her participation in this offense as well as several others. Suspect Gray gave a detailed account of her time with the complainant and described the offense location. In addition she drew a diagram of the offense location as part of her statement. Suspect Gray had knowledge that only someone directly involved with the commision of this offense would have. Suspect Gray told Detective Shelton that she agreed to help rob the complainant but did not want him to get killed. On Thursday, March 23, 2017 at about 8:52 p.m. I, Detective Maudlin #6468, interviewed possible suspect Kidd. He gave a videotaped voluntary statement admitting to overhearing suspect Kilpatrick recounting the events of this offense to suspect Simmons while they were being booked in for another offense at the Dallas County Jail. STATE OF TEXAS AFFIDAVIT FOR ARREST WARRANT COUNTY OF Dallas On Friday, March 24, 2017 at about 10:54 a.m. I, Detective Maudlin #6468, interviewed suspect Simmons about this offense. After being advised of the Miranda warning suspect Simmons admitted to driving the suspect vehicle during the commission of this murder. He also stated that he was going to get gas money for driving his vehicle. Suspect Simmons also said that suspect Gray set up the complainant to be robbed. Suspects Gray and Kilpatrick were sending text messages back and forth so that suspect Kilpatrick would know where to find the complianant, Suspect Simmons said that suspect Kilpatrick jumped out of the vehicle with a handgun. When the complainant drove off suspect Kilpatrick shot at the complainant.
