1 Plaintiffs respectfully submit this response to Defendant Arpaio’s Motion to
2 Extend Deadlines in the Second Supplemental Injunctive Order re Policy Review,
3 filed today.
4 Defendant Arpaio met and conferred with Plaintiffs and the United States about
5 the proposed motion in advance of filing. Plaintiffs communicated to Defendant
6 Arpaio that Plaintiffs’ position on the motion is as follows: “Plaintiffs do not oppose
7 in substance the requested extension of time in order to provide adequate time for all
8 parties and the Monitor to review and confer, but do not agree with the Defendants’
9 characterization of events relating to compliance and do not join in the motion.” The
10 United States communicated to Defendant Arpaio that it concurred in Plaintiffs’
11 position. A copy of the email correspondence of the parties is attached hereto as
12 Exhibit A.
13 However, Defendant Arpaio’s motion, as filed, indicated only that Plaintiffs and
14 the United States do not oppose the motion for an extension of time, without
15 indicating the specific objections to the contents of the motion. Defendants’ motion
16 thus did not accurately convey Plaintiffs’ and the United States’ position.
