1. INTRODUCTION
a. Purpose

This Supervision Management Plan (SMP) is to confirm SSHs understanding of the Al


Mutawir requirements as fully defined in our Consultancy Agreement dated ???.

This SMP defines the framework around which SSH will Manage, and supervise the
Construction Contract between the Contractor and the Al Mutawir and how SSH will
assist the Contractor in meeting the cost, time, quality and health & safety requirements of
the Contract.

In the Construction Contract, SSH are acting as the Engineers Representative.

When SSH are acting as the [Engineer / Engineers Representative], and the Delegated
powers under the Contract have been received (in writing), from the [Employer/Client], these
specific responsibilities must be included in the Scope of Works and Responsibilities for this
SMP.

Notwithstanding the above, the Resident Engineers Team must also satisfy SSH internal
QSE, delivery, resourcing and financial Objectives, including SSH Management Policies.
Herein, this SMP satisfies the intent of Quality, Safety and environment for ISO 9001,
OHSAS 18001 and 14001. SSH Policies for Risk & Opportunity, Quality, Information
Security, Health Safety and Environment are recorded at Appendix H.

As such, this SMP makes reference to 2 contracts, the Construction Contract and the
Consultancy Agreement. References to the Contract, refer to the Construction Contract
whilst references to the Agreement refer to the Consultancy Agreement.

b. Project Description
The site is located near Daiya area surrounded by Embassies district (Adan
Street) on the north, Arabian Gulf Street (Road 25) on the east, 3rd Ring road
on the south and Istiqlal motorway (Road 30) on the west.
The Contractor shall, before submitting his tender, make himself familiar with the area
and ascertain any restrictions that may be imposed due to the location of the sites. No
claim arising from lack of knowledge in this respect will be entertained.
i) Scope of Works
The Works comprise the Construction, Completion and Maintenance of the
Roads, Utilities, Irrigation tank with Pump room, Substations and
Demolition works.
The Scope of Works under this Contract shall be to the true meaning and
intent of the Drawings and Specifications, but briefly are as follows:
ii) Permits for Temporary Works
a) Obtain from the Municipality Area and all necessary permits and pay all
fees to allow the construction of all required temporary facilities
including temporary offices for Engineer including site storage,
workshops, etc.

b) Obtain all permits and pay all fees statutorily required in connection with
services connection.
iii) Services Protection
a) Protect and/or divert existing services, if any.
b) Temporary protection for site and Works.
c) Protection of existing utilities.
iv) Temporary Facilities
Construct, maintain and operate all temporary facilities required for his
Works and those of the Engineer throughout the Project including
temporary offices, site storage, workshops etc.
v) Infrastructure Works
Construction, completion, maintenance, testing and commissioning of
proposed Infrastructure Works including but not limited:
a) Roads
All roads associated works including but not limited to cut and fill,
asphaltic concrete pavements, kerbs, pavers, Traffic markings and
signs, chain link fence and guard rails.
b) Utilities
Utilities including but not limited to combined fresh water and
firefighting network, irrigation water network, sewage water network,
storm water network, electrical infrastructure works and
telecommunication.
c) Underground Irrigation Tank and Pump room
All associated structural, architectural, mechanical and electrical works.
d) Electrical Substations
All associated structural, architectural, mechanical and electrical works.
e) Site demolition works
Site demolition works includes removal of existing bus stop and fence,
pavers, kerbs, trees, stripping of coralline inclusions in rock area and site
stripping as noted on the drawing.
vi) Authorities Approval
Allow for obtaining all required authorities approvals including but not
limited to KFD, MPW, Ministry of Energy, Ministry of Communication and
Kuwait Municipality.
vii) Temporary Roads and Services
Temporary entrance and exit roads including all associated temporary
electro-mechanical works, temporary traffic signs, temporary fence and
protection of existing services.
viii) Co-ordination
To provide coordination of Works of other Direct Owner Contractors, if any.
ix) Cleaning
Removal of all rubbish and debris including surplus excavated material
from and around the site on a day to day basis.
x) Commissioning and Handing Over to the Authorities

On completion of the works, all final cleaning shall be done and services
are to be tested and commissioned by the Contractor and handing over
all the works to the relevant authorities.
xi) As-Built Drawings
On completion, supplying all as-built drawings and
Operation/Maintenance Manuals for his installations.
xii) Maintenance of Site Fence
The Contractor to receive Site Fencing including gates, billboards, gate
boards, temporary roads, security booths, lighting and all associated
electrical works from the Enabling Package Contractor and shall maintain
and make good any defects (including provision of temporary power for
the lighting works) for the Contract duration and on completion to
handover the subject works to the Landscape Package Contractor.

All works to be carried out to the true extent, meaning and intent of the
drawings and specification.

c. Parties to the two Contracts

The parties to the Construction Contract and their details are as follows:

o The Employer/Client is [insert name of Employer/Client]

o The Contractor is Ahmadiah Contracting & Trading Co. K.C.S.C.

Named in the Construction Contract are:-

d. SSH Site team Goals/Objectives

The key goals of the onsite SSH Team are to:

o Manage the SSH Supervision Services effectively to meet the requirements as defined
in our Consultancy Agreement.

o Fulfil the Engineer/Engineer Representative/Supervision role as described in the


Construction Contract.

(Further define other SSH Goals/objectives pertaining to the Agreement between SSH
and the Client/Employer. Describe key goals of the client including their aspirations and the
constraints.)

e. Project Structure (external stakeholders)

Relative to our Consultancy Agreement, refer to Appendix A for Project Stakeholder


Organisation Chart(s) for position, title and contact details of key stakeholders and the SSH
interface persons for particular disciplines/functions.

f. Statutory Authorities

The [Engineers Representative/Resident Engineer] is to proactively manage the coordination


of the Contractor with all relevant statutory and regulatory compliance bodies and assist the
Contractor in obtaining approvals with all parties with specific focus towards ensuring that
project time schedules are not adversely affected.

Refer to Appendix C for list of applicable legal requirements, and Statutory Authority
approvals required for the construction works.

2. SCOPE & CHANGE MANAGEMENT


a. Scope of Services

The SSH Scope of Services are defined within our Consultancy Agreement and are
broadly as follows:-

Note:-The Engineers Scope of Services are defined within the Construction Contract and
may or may not be applicable to SSH. Where SSH are engaged as the Engineer or
Engineers Representative, the scope is to be defined. When SSH are engaged purely in a
supervision role, then the duties associates with the Engineers assistants indicate our
duties.

Where we are not the Engineer or the Engineers Representative, our duties will be purely
technical.

Unless indicated otherwise, the entity as SSH when recorded in this plan refers to the SSH
team based on the site as managed by the Engineer Representative/ Resident Engineer.

b. SSH Document Deliverables

Under the Consultancy Agreement, and unlike a design commission, deliverables in terms
of hard copy deliverables will be minimal. SSH will be required to produce Monthly Progress
and Cost Reports together with reports and recommendations on time, delay and claim
issues as identified under the Agreement as follows:-.

Under the Construction Contract, the Engineer/Engineers Representative will be


responsible for numerous documents in the form of:-

Issue of drawings
Issue of Instructions
Responses to RFIs
Responses to Submittals
Issue of payment certificates
Issue of the Taking Over Certificate

c. Change Management

The term Change refers to any change to the contracted scope of work. Under the
Consultancy Agreement, change is anticipated as minimal and will follow the issue of a
Client Change Instruction (CCI) from the Employer/Client. Such changes are likely to be
limited to staffing numbers, rates and durations. When Change causes Commercial Change,
then Commercial Changes will be recorded in the Change Register in Deltek.

(Note here the procedure/processes for change contained within the Consultancy
Agreement)

In addition, there is normally an obligation within the Consultancy Agreement to obtain prior
approval from the Employer/Client prior to the issue of any Instruction to the Contractor.

(If so, state the procedure/process for obtaining approval prior to issue of Instructions to the
Contractor. If not applicable insert N/A)

Change as it affects the Construction Contract is one of the most significant issues that the
supervision team will face. A change of any type and any magnitude may (if we are not
careful) open the door to the Contractor for a claim against the Employer/Client which in turn
may impact on SSH. Where appointed as the Engineer/Engineers Representative, there is a
procedure to follow that will be outlined in the project Specification.

(State the procedure for raising a change, seeking approval to change, issuing of Instructions
to the Contract and state how we will manage any impact arising).

d. Mutual Agreements

(To confirm if informal mutual agreements will occur. Hence, if acceptable, the
Engineers Representative/Resident Engineer will describe when various activities are on
hold/delayed as initiated and requested by the client, and informally acknowledged by the
SSH Resident Engineer. These decisions will be highlighted in the Project Risk Register.)

3. DOCUMENT CONTROL
a. Contract Document Control Structure and Traceability

It is a fundamental task that the SSH supervision team actively manage all documents
pertaining to the Construction Contract. This entails receiving, issuing, filing and achieving.

If not already specified in the Construction Contract, the Engineers


Representative/Resident Engineer at commencement of the project is to engage with the
Contractor and the [Employer/Client] and agree to a formal document and record control
management system for the submission, exchange, review and hand over of data and
documentation so that data, documents and records have full integrity and can be managed
to appropriate traceability, preservation, access and security for all stakeholders.

(List here the Document Management Tool that will be used to manage document exchange.
This will be typically Primavera Contract Manager, Aconex or Newforma)

There will be occasions where the Document Control team for SSH must use multiple
Document exchange systems, as distinct from document management (i.e. Primavera,
Aconex and/or Newforma). Document exchange relates to exchanges between off site teams
and on-site teams, the control of which is somewhat outside the Contract. Once received at
site, all documents must thereafter be integrated into the formal system of which there will be
only one.

(The process for the integration of these Document Management Systems (DMS) must be
outlined here as history suggests that such systems do not talk to each other, hence human
control is required. This process is to be recorded here when 2 or more DMS are utilized.)

The individual Document Management Systems will contain all the forms, templates, plans
and procedures, logs and registers which are required for this project.

Each and every document of any kind will have a unique ID, document title and version
number.

The SSH Sit Document Control team is responsible for ensuring that all paper copy
document communications are received, stamped, timed and dated and entered into the
formal received log. Where documents are received that do not contain a unique reference
number, one is to be given. Where documents are received without a formal signature, they
are rejected immediately and returned to source without logging on the registers.

Documents will typically include letters, reports, transmittals, drawings and schedules,
submittals, RFIs, responses to NCRs and many more. It is fundamental that each and every
document is logged and can be retrieved within 5 minutes of a request from the
[Engineer/Engineers Representative].

The filing of paper documents shall be carried out in an orderly manner, as defined by the
SSH senior document controller for the supervision team.

On completion of the project, all documents will be transferred to a specific archive location
where they will be retained for 10 years or other time as specified in the Construction
Contract.

b. Compliance with SSH the IMS/Quality Manual and our ISO 9001 registration

SSH will be audited by our third party QA accreditors at regular intervals. They will expect
that our site supervision team are familiar with the systems and procedures that SSH use
and other than where defined in the SSH IMS/Quality Manual, and associated procedures
will have maintained such procedures on site.

In many if not all instances, this leads to duplication in effort unless specifically written out in
the SSH IMS/Quality Manual.

Examples of this would include, document referencing, i.e. the reference on a letter written at
site. If the letter is written in Aconex/Newforma the reference may be different to one that was
written outside Aconex/Newforma hence inconsistency.

Internally, a list of all approved databases and registers to be used for submitting, issuing,
storing and receiving information will be maintained via Newforma within each project folder.

c. Information Technology

SSH will operate from a site based, stand-a-lone server, with no connection whatsoever to
any systems used by the Contractor. This will ensure the security of information under our
control. On large sites, WIFI will be maintained such that our site personnel can keep up to
date via mobile devices. This may be critical in the instance of photographs and to permit
access for our staff to Delteck and Newforma.

(Please define here the means of obtaining bandwidth access and utilise, i.e. WiFi, data
cabling etc. and details of the server is use).

Where a common Document/Contract Management platform is in use, this would typically be


stored on the Employers/Clients server to ensure confidentiality and security of information
contained. Access to the stored information, via licenses, is obtained via the internet with no

direct connection.

Internet connection ensures the smooth running of the DC system in that access can be
obtained from anywhere, at any time, provided the system is running.

d. Data Backup

The SSH site server will contain all the soft copy documents, registers and the like and is of
course subject to virus attack, failure and loss of irretrievable data.

To ensure protection of the data, backup in the form described below Data Backup shall
carried out hourly/daily/weekly depending on the folders.

(Describe here the backup medium, the frequency of backup for different folders and the
independent storage location of backup media, for those folders/application that are stand
alone and not connected to the primary SSH servers at SSH office at Subhan.)

Note: The categories and type of information/data to be backed up and the frequency of data
backup and data protection measures are to be in accordance with SSH IT procedures.
Refer to SSH Backup & Retention Policy (IS-PO-011-00).

4. COMMUNICATION MANAGEMENT
a General

Responsibility for ensuring that the appropriate individuals/organisations/departments are


included in the communication loop falls to the Engineer/Engineers Representative.
Thereafter, it is the responsibility of Document Control to ensure distribution is effective and
replied submitted within contractual time restraints.

b Approval and Distribution Matrix

There will be approval and distribution matrix applicable to the site organisation
(Contractor/Employer) and possibly another for internal SSH exchanges. If information is
required for the project includes a decision approval or Cc from Resident Engineer team to
contractor/client, this will be on the same matrix.

Refer to Appendix E for Approval and Distribution Matrix listing key project activities and
stakeholders who advise, monitor, review and/or approve various activities, documents or
deliverables.

a Project Directory

Internally, all information concerning the [Employer/Client] and stakeholder key contact
details are recorded by the office based SSH Project Director/Project Manager in the Team
tabs of Deltek and updated on the client data file held in the Deltek CRM.

b Communication Protocols

All communication, (both written and verbal correspondence) by the Engineers


Representative/Resident Engineer team is to be timely, concise and relevant to the fullest
satisfaction of relevant key stakeholders and contract requirements.

5. TIME & COST MANAGEMENT


a Introduction

Time and cost monitoring with respect to the Construction Contract is under the control of
the Engineer/Engineers Representative. Where SSH are not engaged either as the Engineer
or his representative, then SSH have no formal function here under the Construction
Contract.

Nonetheless, SSH will be expected to carry out our duties being aware of the effect of SSH
attitude, attention and awareness to the potential that our actions may be implicated in a
claim by the Contractor for additional time or cost.

With respect to our Consultancy Agreement, SSH have an obligation to the


[Employer/Client] to manage our own time effectively, mitigating SSH exposure to additional
time and cost with respect to the supervision service, and ensure payment is received from
the client within Project Collection Limitation as prescribed by SSH Management contract
Agreement (30 Days). SSH Management collection limitation, then in (??? Days) as agreed
by SSH Operations Director.

b Managing our time

The preparation, collection and issue of documents and the carrying out of reviews and
inspections, all take time. It is fundamental that all these activities are carried out within the
time frames as described in the Construction Contract.

(List here the times for responses to RFIs (typically 7 days), Submittals (14 days),
Inspections (typically 24 hours on site/local off-site, or 5 days if out of Kuwait)

(Describe the control method for who and how the status and achievement of the SSH
document deliverables (internal by SSH) are processed and that daily monitoring is available
to identify which documents are due and overdue. These are to be recorded in the agreed
document management software

Describe the control method and document control system for who and how the
Contractors Deliverables are received, reviewed and processed by SSH) based on weekly
and monthly reporting and the ability to identify daily whether certain deliverables are due
and/or overdue.

Note: The Resident Engineer is to make the distinction between project controls for the
Project over the Contractor, in comparison to the SSH Scope of Works. These are
independent as one is internal for SSH and the other is external as monitoring the
Contractor.

a. Schedules

Where appointed as the [Engineer/Engineers Representative], SSH will review, consent,


monitor, report and make recommendations with respect to the Contractors Progress based
on their Construction Program.

The Engineers [Engineer/Representative/Resident Engineer] will maintain actual SSH


Resource Schedules mapped to both the Construction Contract and the Consultancy
Agreement.

With the aim of assisting the Contractor to complete on time, the [Engineer/Engineers
Representative/Resident Engineer] will keep the [Employer/Client] informed of any shortfalls
or additions to Consultancy Agreement and gain written agreement on any changes.

b. Cost

When appointed as the [Engineer/Engineers Representative], SSH will carry out


measurement and valuations of the Contractors work. This may include installed work or
materials on site, or both. SSH will certify payments for work done in accordance with the
contract and will prepare and maintain a Cost Report presenting this to the Employer/Client
on a monthly basis. The Cost Report will identify variances from the contract sum, schedule
approved Variations, schedule early warnings of variations on the horizon and keep the
Client aware of not only the estimated out-turn cost, but on the position of his contingency
sum.

Risks will be itemized together with a schedule of all claims.

Internally, SSH will accurately book our time to the allocated work stage in Deltek. On a
monthly basis the SSH Cost Report will identify the costs accrued together with an estimate
for the cost to complete [ETC]. A Cost Variance Report will be prepared and together with the
Risk Register, be presented to the SSH Board, monthly.

6. ORGANISATION & RESOURCE MANAGEMENT


a. SSH Team Internal Organisation Structure

Refer to Appendix B for SSH Team Internal Organisation Chart reflecting positions title and
contact details of key SSH Supervision personnel and their reporting relationships. This will
also align to the Project Organisation Chart identifying SSH relationship with all stakeholders.

a Roles & Responsibilities

All technical members of the SSH Supervision team will use the Team tab in Deltek to
confirm who has SSH authorisation/delegation for different activities during the construction,
commissioning, and closing out.

General guidelines of responsibilities for all SSH team members are recorded in the SSH
Manuals for Construction Supervision with specific responsibility for the Engineers
Representative / Resident Engineer attached as appendix F.

c. Project-specific Training & Development

All SSH training needs and requirements for the SSH Supervision team are the responsibility
of the SSH Engineers Representative/Resident Engineer applicable for Construction /
Supervision works.

All training needs will be recorded via Newforma and details submitted to the SSH HR
Director for update of staff proficiencies/competencies. Specific QSE training needs for
construction / supervision will be liaised between the Engineers Representative/Resident
Engineer and the QSE Director.

d. On-site Support Facilities

The [Engineers Representative/Resident Engineer] will confirm and document if current


information technology capability / facilities, working environment and safety / health
requirements have been met for new site office locations and onsite construction activities. If
not suitable, nor anticipated to deliver facilities as per schedule, these risks are to be
highlighted in the risk register.

e. SSH Processes

SSH maintain a series of Policies, Plans, Procedures/Instructions, Checklists/Forms,

7. RISK AND OPPORTUNITY MANAGEMENT


a. Risk and Opportunity Register

Internally, the [Engineer/Engineers Representative/Resident Engineer] is to ensure his own


Supervision Teams risks and opportunities are identified and logged via Newforma to the
appropriate level (resources and controls) to eliminate their cause and/or reduce impact
(risks) and to exploit opportunities where applicable in collaboration with other key
stakeholders. This SSH Risk and Opportunity Register is internally managed for each project
and not provided to the Client/Employer.

At whole of site project level, the project Risk Register is to be managed by the
Employer/Client and the Contractor. The [Engineer/Engineers Representative/Resident
Engineer] is to provide input into the Project Risk Register and manage any actions on SSH
which may arise. Where, due to SSH experience of similar events, SSH are able to identify
possible risks on the horizon, SSH shall do so and actively involve the Contractor and the
Employer/Client in early mitigation measures.
SSH shall agree how risks identified will impact on Construction schedules, budgets for both
the contractors and our resources.

The [Engineers Representative/Resident Engineer] is to note the distinction between


Risks/Opportunities for the Project and the internal Risks/Opportunities managed by SSH.
These are to be addressed independently with the latter to be identified, monitored and
recorded through a summary Risk and Opportunity Register in Deltek and supported by a
detailed Risk and Opportunity Register maintained in Newforma.

The Engineers Representative/Resident Engineer is responsible for ensuring the Risk


Register is updated and reported at the end of each month prior to each monthly report and
to communicate the outcomes with senior management.

Where applicable, responsibility for each risk is as nominated per each line of Risk and
opportunity register.

8. DESIGN INTERFACE

There is almost always an interface between the work of the SSH site team and SSH Head
Office design. Whilst in theory, the site time only has to ensure that the design as
documented is carried forward by the Contractor into construction, there are many instances
were design decisions may be sought. These will be typically in regard to alternative
materials (cheaper, easier to procure, more appropriate in the eyes of the Contractor). There
may be designs that deviate from ours and beyond the experience and qualification of the
site team to address.

(Describe how each major design activities including but not restricted to as RFIs,
Design Verifications, Design Validations, Design Variations, etc. are managed by the
Engineers Representative/Resident Engineer and liaised / submitted / reviewed by the SSH
Design Team Head Office.)

Where changes and variations occur and there is a requirement to amend drawings, this will
be done in the SSH design office. It is the sole responsibility of the design team to make any
amendment to the design drawings. The site team should only ensure that the design intent
is carried out by the Contractor

Tracking any design interface processes and decisions along with formal and informal
reviews will be managed through Newforma.

Changes are managed per the process described in the Scope & Change Management
Section.

9. PROCUREMENT (IF APPLICABLE)


a Resource Strategy

b. Sub-Consultants Services

(If consultants are utilised for SSH Supervision Services, the Engineers
Representative/Resident Engineer is to describe the selection and monitoring method, as

10. CONSTRUCTION SERVICES


a. Our service

Depending on whether SSH are appointed as [The Engineer/Engineers Representative], or


in a purely supervisory capacity AS Resident Engineer, SSH will have either Quality Time,
Cost and HSE duties, or solely Quality and HSE duties.

b. Contract Time and Cost Management [Engagement as the Engineer/Engineers


Representative]

Where appropriate, the [Engineer/Engineers Representative] is to establish efficient


procedures (all as discussed above) for verifying Contractor performance and reporting
progress in a timely manner.

Where SSH are responsible as the Engineer or the Engineers Representative, this may
include the Construction Program, Financial Position, Variations/Change Orders Claims,
Contractors Payment Applications and Invoices, Contractors actual and probable Claims as
well as the Overall Construction Progress and to report these findings in the relevant daily,
weekly and monthly reports.

c. QA/QC

The [Resident Engineer] is responsible for taking all necessary steps as may be required to
ensure that the works are constructed in accordance with the Contract Documents. He will
be delegated this task by the Engineer. This includes but not limited to the drawings,
specifications, test requirements, authorised instructions as well as the relevant local and
international standards and regulations.

d. Health, Safety, and Environment on the Project.

The Engineers Representative/Resident Engineer has three scopes of HSE responsibilities


on the Construction site, as follows:

Internal to safeguard SSHs own staff to SSH and also comply with Statutory
requirements. Key points are as follows:

o SSH staff are not to be placed in any dangerous situation on a construction and/or
fabrication site and/or any site maintained by the Contractor or his subcontractor
that may adversely affect the safety and health of any SSH employee.

This includes ensuring SSH staff operate with a mind set to live and demonstrate
effective safety practices, and if the Contractor and subcontractors are not
displaying sufficient safety and health on a site, the issues are to be escalated to
the Client/Employer and SSH staff forbidden are to enter any aspect of the
construction will suite which is considered as not safe to do so.

o SSH staff take into account the environmental footprint, including managing their
own material resources and energy and recycling wisely, where applicable as per
SSH QSE Policy. Refer to Appendix G for specific HSE controls to be applied by
the SSH Resident Engineers team.

External to the Employer/Client and Contractor. This includes ensuring SSHs due
diligence under our contractual, statutory and moral obligations throughout the duration
of the project. This includes identifying, issuing and managing safety environmental
violations to a point, that if Contractor does not remedy any HSE breeches in the
nominated time frame, SSH are to formally escalate the HSE issues to the Client and
not to enter that aspect of the Construction site considered dangerous.

SSH carries no contractual responsibility for the Contractors Health and Safety, but will
ensure to the best of SSH abilities, that safe forms of construction are maintained and
that works will be stopped where an infringement of Health & Safety standards are
discovered.

The suite of Forms/checklists used by Engineers Representative/Resident Engineering /


Construction Supervision team as well as SSH QSE related checklists and Forms are listed
in Appendix D.

11. INTERNAL PERFORMANCE MEASUREMENT & REPORTING


a. Internal Performance Evaluation

The project performance for ALL SSH services, including scope, time, cost and budgets is
recorded in Deltek with Reports produced, to be accessed from and stored via Newforma.

Key QSE Metrics for design and supervision services will be via the Project Manager and
Resident Engineer, utilising QSE Metric Report templates to be accessed via Newforma.

The Engineers Representative/Resident Engineer is to request from the Employer/Client on


a 6 monthly basis, a summary of their contractual performance, using a SSH Client
Satisfaction Form accessed via Newforma.

The Resident Engineer shall complete QSE metrics via a Monthly Report to the SSH QSE
Director and Senior Operations Manager using the SSH Supervision Monthly Report
template in Newforma.

b. Continual Improvement

Strategy for continual improvement of SSH services including QSE practices and controls
will be maintained by the SSH QSE Director via the following processes:

Lessons learned conducted at specific points in the project life cycle.

Non-conformance/Corrective action Reports to prevent recurrence of defects, non-


compliances, etc.

Audit findings including opportunities for improvement and adverse findings to be


actioned.

Recording and acting on customer and stakeholder complaints and noncompliance.

All applicable Logs and forms for continual improvement are accessed from and stored via
Newforma.

c. Reports

(The Engineer / Resident Engineer to identify and list all report types as per the contract
with client and SSH requirements, the distribution process, and which and when any issues
are to be escalated. All Report templates are to be accessed via Newforma.

The Engineer / Resident Engineer to clarify details of the monthly report to the
Client/Employer and whether SSH Head Office receives a copy.

The Engineer / Resident Engineer to clarify details of the monthly report to SSH Head
Office detailing SSH specific requirements including Contractor and subcontractor
performance, progress, outstanding risks, and various QSE metrics.

12. INTERNAL PROJECT HANDOVER & CLOSEOUT


a. Project Handover to Construction

For design and review processes managed by SSH, the SSH Engineer/Resident Engineer
will seek from the SSH Project Manager a project Handover Document to includes a
summary status and report including the proposed SSH Deliverables, outcomes of
constructability reviews, Schedule, Cost, Lessons Learned and Recommendations, in order
for the Engineer/Resident Engineer to manage the SSH supervision works more effectively.

The Resident Engineer will utilise the Handover Report to develop and customise as
necessary the SSH Supervision Management Plan.

b. Project Closeout for Construction

The Engineer is responsible for evaluating and recommending the Substantial Completion
and Handing Over of the Works in accordance with the Project and Contract requirements.

The Supervision Management Plan must provide specific detail on the Handover Documents
not restricted to the following:, Substantial Completion Certificate, Operation & Maintenance
Manuals, As-Built Drawings, Guarantees and Warranties, Material and Spare Parts, End-
user Training, Final statement of Account, Project Close Out Report, Permits and Licenses
from statutory authorities etc.

The Project Closeout Report shall include minimally the triggers for initiating release of any
retention, a summary of completed supervision works, archives, capture and distribution of
lessons learned back into the Bidding and Design workflows and to provide promotional
items and site photographs for acceptance by Business Development & Marketing.

Resident Engineer to conduct a final review of the Contractors and subcontractors


performance and provide to SSH operations Construction Manager. The result shall be
included on a database to consider for future Contractor / subcontractor tender evaluation.

The Resident Engineer is responsible for handing over all relevant reports, documents and
certificates necessary to conclude the Defects Liability Period (DLP) obligations to the Site
Operations Manager on commencement of the DLP in a concise and conclusive format.

Road Permit [(temporary by Contractor), and (permanent by Consultant)] access to public roads) .

The Contractor/Owner/Supervising Consultant must submit Application Form 1 for a building license
and attach the following documents (including the documents described in the procedures above):

A copy of the deed of title to the land, allocation decree, or lease agreement. In the case of an

Appendix F

Responsibility of Engineer, Engineer Representative and Resident Engineer Background.


As all Construction Contracts are different in the Middle East concerning general terms, the SSH
approach is to use FIDIC or FIDIC variations thereof. Hence, the definitions for Engineer below are
taken from FIDIC.

Under FIDIC there are 2 parties to the Contract, the Employer and the Contractor. The Engineer is the
administrator of that Contract and is at liberty to make amendments to that Contract, via the issuance
of Engineers Instructions.

The Engineer (normally a company) may delegate all or some of his responsibilities to the Engineers
Representative

Likewise, the Engineers Representative may delegate some of those powers to his assistants.

Under FIDIC, there is no Resident Engineer (RE), the term RE being used to identify the leader of the
supervision team.

On any one Contract, there is only one Engineer, maybe one Engineers Representative and countless
assistants, these been REs, inspectors etc.

Duties of the Engineer

a. To administer the Construction Contract. In other words, he is responsible for fair play across
every Clause in the Construction Contract.

b. Full details of his responsibilities are contained within the Construction Contract.

c. He may delegate all or some of these responsibilities to his representative.

d. In most instances, whilst he can instruct change to the contract, he may only do so with the
written approval of the Employer. This clause is traditionally written into the Consultancy
Agreement between the Employer and the Engineer.

e. In many Government Contracts, the Engineer and the Employer may be one and the same.
In this case, the department may well appoint an Engineers Representative to administer on
their behalf.

f. Under FIDIC 4th Edition, the Engineer is impartial and is the first point of Conflict Resolution
between the Contractor and the Employer, hence the need for a Government department to
attempt to distance itself and show impartiality by engaging the Engineers Representative.

g. As an example, on OCEC in Oman, SSH are engaged as the Engineer. On KCC Theatres,
we will be engaged as the Engineers Representative

h. There is not necessarily any connection between the Engineer, his Representative and their
assistants. There are many Construction Contracts in place where individual consultancies
could take one or more of these 3 roles.

Duties of the Engineers Representative

a. These are mostly delegated powers from the Engineer, such that when reading the Contract,
every reference to the Engineer may be taken as a reference to the Engineers
Representative, other than where delegation has not been given. It is often the case that it is
only the Engineer who may recommend issuance of the Taking Over Certificate because it is
only at this time that any and all of the preceeding works are approved.

b. The Engineers Representative has the multiple roles of:-

i. Consent to the Contractors Program

ii. Amendments to the program

iii. Issuing Delay Notices with respect to the Program

iv. Analysing Claims for EoT with respect to the Program

v. Measuring completed works and materials on site

vi. Valuing the above

vii. Approving and recommending to the Employer, monthly payments

viii. Issuing Variations

ix. Valuing Variations

x. Determining a fair value for variations where disagreement with the Contractor did not
produce an acceptable result by negotiation

xi. Mediating informally on disputes between the Employer and the Contractor and
attempting to find a resolution that will avoid arbitration

xii. Interim approval of the works as work proceeds including approval of shop drawings,
materials and completed construction

It is this last item where the role of the Engineer/ Engineers Representative passes to the so called
Supervision Team, this team being led by one or more Resident Engineers.

It is up to the Resident Engineer to list the specific Engineer roles that he has concerning the
above. If such no authority occurs within SSH. This is to be stated here in the SMP.

Resident Engineer is to maintain and align SSH services and deliverables within their contractual
obligations ensuring this is expedited in accordance with the high levels of quality under their
policies and to manage any changes to the contract accordingly. Specific accountabilities are as
follows:

a. Develop and manage a documented Management Plan to ensure project scope, time, cost
and QSE delivery is in accordance with contract requirements and SSH corporate
requirements.

b. Ensure that key stakeholder expectations are identified, understood and communicated within
the project team and managed accordingly to improve stakeholder satisfaction.

c. Ensure project risks and opportunities are identified and managed to the appropriate level
(resources and controls) to eliminate their cause and/or reduce impact and/or mitigate SSH
liability and safeguard SSH commercial interests.

d. Timely management of changes/variations, RFIs, document reviews and invoicing receivables,


payment, etc., as per contract and SSH requirements.

e. Proactively manage coordination of all relevant statutory and regulatory compliance and
approvals with all parties, so that program and cost schedule are not adversely affected and
ensure these are coordinated with the tender/contractor.

f. Review and ensure that the project construction, methodology, planning, inspection, testing
and record documents submitted by Contractors are reviewed and endorsed/rejected in
accordance with project Codes, Standards and client specifications.

g. Ensure SSH project staff are managed by team building skills (i.e. includes motivation and
personal development) so their full potential is realised within a creative/innovative setting.

h. Ensure a formal document and records management system is implemented so that data,
documents, and records have full integrity and managed to appropriate traceability,
preservation, access and security for all stakeholders. Accordingly to contactor and SSH
agreement.

i. Ensure that all communication, (both written and verbal correspondence) is timely, concise
and relevant to the fullest satisfaction of relevant key stakeholders. Accordingly to contactor
and SSH agreement.

j. Ensure formal Reports submitted to all key stakeholders (includes Client) are concise,
conclusive, timely and compliance to contract and SSH corporate requirements.

k. Evaluate and recommend the Substantial Completion and Handing Over of the Works in
accordance with the Project and Contract requirements and for handing over all relevant
reports, documents, certificates and lessons learned necessary for SSH to conclude the
Defects Liability Period obligations.

l. Ensure SSH resource levels and costing remains within the contract budget and that
invoicing and payment remains within the Contractual Terms and Conditions of Contract.

Appendix G SSH Internal QSE Controls for Supervision Projects


All SSH staff dedicated to a construction site / Supervision Project are to be inducted by the SSH
QSE team following an approved induction by the Contractor.

The induction given to them by the SSH QSE Team with all SSH site inductions to be recorded
and the records kept on Site by the Resident Engineer.

All product non-conformances and defects, are to be documented. SSH are to ensure that any
NCRs raised include the fix it action and action to prevent reoccurrence, and are signed off by a
SSH supervision team member for both approval and closeout of SSH generated NCRs.

The Engineers Representative / Resident Engineer both have the authority to STOP WORK if it is
believed that serious harm or property damage may occur from contractors activities.

All stop work notices / instruction must be strictly obeyed until investigations and remedial action
has been carried out. Once a stop work notice has been applied an urgent meeting will be called
between Engineers Representative / Resident Engineer and senior contractor management on
site.
