Wheeler-Howard Act, June 18, 1934 (The Indian


Reorganization Act)
An Act to conserve and develop Indian lands and resources; to
extend to Indians the right to form business and other
organizations; to establish a credit system for Indians; to grant
certain rights of home rule to Indians; to provide for vocational
education for Indians; and for other purposes.

An Indian nation possesses in the first instance all of the powers of


a sovereign state. Those powers that are lawfully vested in an
Indian nation are not, in general, delegated powers granted by
express acts of Congress, but rather inherent powers of a limited
sovereignty that has never been extinguished. This sovereignty
preexisted the formation of the United States and persists unless
diminished by treaty or statute or, in certain instances, by federal
common law. Because of their retained sovereignty, the tribes have
a government-to-government relationship with the United States.

AN APPEAL TO THE DENIZENS, CITIZENS,


AND PEOPLE OF INDIAN COUNTRY
AMERICA

WHAT THE PROBLEM IS:

1. An implied contract has been forced upon all of us the


day we were born when our unsuspecting parents were
subtly cajoled and gently coerced into applying for and
receiving a birth certificate. That document, a moral
hazard per se, and a fungible bond worth hundreds of
millions of dollars, evidences you as chattel (property of
the government) with which you will in due course apply

for a social security number and card; a driver license
when you are old enough; and enter an institution of
learning or earning.

That defines your modern-day serfdom. A new form of


slavery where the chains and shackles are represented
and replaced by your tacit obedience to the rules,
regulations, policies, and laws of the government.

2. Why didnt your parents issue a Certificate of Evidence


of Conception based on a gynecological examination when
your mothers pregnancy was confirmed? Without
conception there is no birth ! Why is conception relegated
to a non-issue ?

3. When you disobey a government made law, you get


punished. But, when you obey the law, what reward,
benefit or advantage do you receive? This is a huge deficit
in the order of things. Another moral hazard.

4. WE, the People, are assured, guaranteed and promised


certain rights (read: claims, privileges and immunities
enforceable in a court of conscience and equity, NOT
in a court of law) under the United States Bill of Rights
incorporated into the United States Constitution. By the
way, we have no courts of equity although mentioned in
Article III of the U.S. Constitution. Our rights, both from

natural law and U.S. and State constitutions are
frequently and constantly in the Court of Bankruptcy.

5. When it comes to enforcing our rights in a court of


law, We, People, are left hanging and stranded in an
impossible situation where our rights are never
recognized, respected, regarded, validated or enforceable.
The judgments issued by judge-made decisions swing like
a pendulum depending on the family backgrounds,
education, training, political leaning, experience, and
personal feelings of state and federal judges depending on
the era. The United States Supreme Court has overruled
itself in more than two hundred occasions. See

6. What then is the point of looking up to the supreme law


of the land (the U.S. Constitution, Article VI, sec.2) when
our basic God-given and legislatively endorsed rights are
ignored and denied? It stinks like a supreme flaw.

7. We, the People, have given our consent to be governed,


but good governance is yet to be witnessed or experienced.
America seems to be an ongoing experiment with bad
experiences. We are yet to form a more perfect Union
We dont have a perfect Union as yet, but we aspire to
build a more perfect Union! The time has come.

8. All we have is a government of men and women, not
laws that protect, preserve and propagate the peoples
rights. In America, the class system is made up of the :

a) rich, powerful and influential (power brokers who


decide what sort of government they want and need;
campaign financiers see Citizens United v. Federal
Elections Commission, 558 U.S. 310 (2010), 130 S.
Ct. 876);

b) the haves; (predictable voters, often fearful)

c) the have-nots; (unpredictable voters, often fearful)

d) welfare recipients (always vote for the government,


always fearful their handouts will run out);

e) homeless (hardly care except for where their next


meal comes from);

f) truly free and liberated denizens who stay out


of the governments jurisdiction by not
disobeying even traffic laws; never vote; stay
below the radar; real material for a super
think-tank; high perception rating as to
government-run scams; have all the tools to

make a change; a minority at best lacking huge
support.

9. A majority of the people are suffering from the


Stockholm Syndrome. They love capture and their captors;
they endorse and endure slavery as their God-given right.
Welfare is a carrot that works making people believe there
is no big stick in the shadows.

10. Just read and see how the government though their
courts refuse your claims and rights when you fight
foreclosure and eviction evidencing mortgage fraud
through unjust enrichment practices when lenders
blatantly use the securitization process to gain enormous
profits with nothing for the homeowner except to faithfully
pay the monthly mortgage. In the bargain, you lose your
home for which you have religiously and faithfully paid
the monthly mortgage for several years. You dont pay the
mortgage, for say 8 months, you lose your equity, your
home and all your faithful payments for over 80 months!
THAT is called freedom and liberty in the land of the fee
and the home of the brief !!! ??? There is absolutely no
justice but just us when the banksters, investors,
lenders, and speculators resident in Wall Street make hay
while the sun shines.

WHAT WE OUGHT TO DO:

We, the People must:

1. Replace and substitute this government of men and


women with government by the people chosen by the
people and NOT the Electoral College. This is
encouraged and endorsed by the Declaration of
Independence authored by Thomas Jefferson. When
we, the People, are denied running our own
government, we must run the existing government of
politicians, by politicians, and for politicians out of
town. The relevant part of the Declaration of
Independence says:

. . . That whenever any Form of Government becomes destructive of


these ends, it is the Right of the People to alter or to abolish it, and to
institute new Government, laying its foundation on such principles
and organizing its powers in such form, as to them shall seem most
likely to effect their Safety and Happiness . . .

2. Form militias in every community. Energize and


activate the Second Amendment, Bill of Rights, U.S.
Constitution. Otherwise, the 2nd Amendment is a
weekend fun exercise at the shooting range. We, the
People, need our very own police force and
peacekeepers. Ancient and primitive communities

had no need for soldiers or police. Today we need
peacekeepers to keep government out of our homes.
The power of citizens arrest is still very much here
to stay. The People have not thought about using it.

3. Activate and energize the 3rd Amendment, Bill of


Rights, U.S. Constitution, and invite at least one
soldier to live in your home if you choose security and
safety for yourself and your family.

4. Refuse the government its forced contract thrust


upon you. DO NOT RECOGNIZE this tyrannical
government which erodes and destroys all your
rights. When you demand for your rights in a court
of law, you are viewed as an extremist. When you
quote the Constitution, the judge will apply the
constitutional avoidance doctrine, and further
frustrate your attempts at seeking justice. If you
persist, you will be gagged and bound. So much for
the freedom of speech and the freedom of seeking
redress for your rights (First Amendment, Bill of
Rights, U.S. Constitution).

5. The time is now to do something. We have had


enough talk, debate, discussion, books, essays,
articles, movies, op-eds, etc. extolling WHAT the
problem is.

6. Join a church or a Native American Tribe to enjoy a
distinct and different jurisdiction. Its you call, your
right. Invoke it now.

7. Whenever you need to, sue the government up to its


gills in an ecclesiastical (church) or tribal court, and
seek multi-million dollar judgments. Church courts
are recognized under a federal law PL 97-280, 96
Stat. 1211 of 1982 which declared the Holy Bible as
the Word of God. The Holy Bible is very clear at 1
Corinthians 6: 1-8 that Christians are not to seek,
use, invoke, or participate in secular court
jurisdictions. Jurisdiction means law expression.

The military has its own courts where court martials are
conducted under their very own jurisdiction. So do the
Native American Tribes and the Church. Some American
pastors are afraid of obeying the Holy Bible especially 1
Corinthians 6: 1-8. They are afraid they will lose their
power over their flock!

These pastors should become familiar with Ephesians


4:11 (So Christ himself gave the apostles, the
prophets, the evangelists, the pastors and teachers).
Pastors tend to singularly play the plural roles of all five

calls to the Ministry of Christ. That is not what Christ
commanded or taught.

Tribal court judgments are entitled to full faith and credit


under 28 United States Code 1738. Native Americans
are also afraid of the power of the federal government
especially when there are enough federal laws offering
Native Americans freedom and liberty at self-government.

So, the law is on your side. USE it or lose it ! !

8. Now, its time We the People found and


implemented the HOW we aim to fix the
problems galore assailing our senses everyday.
