QUESTION 1

Suppose you are managing the project and the Contractor has submitted the
claims for the following. According to PAM Form, justify whether the contractor
is eligible to an Extension of Time and a Loss and/or Expense claim and give the
reasons.

a) The contractor was intended to commence the piling works but need to
stop for a while due to extremely raining. With that reason, it delayed him
about 7 days and therefore the project has been prolonged until one and
half month to complete the piling work.

b) Flooding on site because the Clerk of Work did not advise the Contractor to
provide temporary drains on site.

c) Bore piling machine broke down unexpectedly after 8 points out of 35


points had been set-off. It may require two weeks to fix it.

d) The tiler was wrongly interpreted the drawings and the specifications, then
fixed the wrong materials to the bathroom floor. The Architect did not
notice and only commented after the work has been completed. The Main
Contractor has to make a rectification.

QUESTION 2

In most construction contracts, the contractor is expected to complete the


contract works by a specified time. Failure to complete the project by the due
date of completion will result in liability for damages for breach of contract.
Explain the obligations of the Contractor to avoid delay.
