Decree number 2830 May 1st, 2017

NICOLÁS MADURO MOROS
President of the Republic

With the power vested in me by Article 348 of the Constitution of the
Bolivarian Republic of Venezuela, according to Articles 70, 236(1) and
347 of the Constitution, with the blessing of Almighty God and inspired
in the great historical heritage of our forefathers, indigenous peoples,
heroes and heroines of the Independence struggles, headed by the
Father of our Homeland, the Liberator Simón Bolívar, and for the
fundamental purpose of guaranteeing the preservation of peace in the
country in view of the current social, political and economic
circumstances where severe domestic and foreign threats posed by
anti-democratic factors with a marked position against the Homeland
loom over its constitutional order, I deem it an unavoidable historical
duty to call for a NATIONAL CONSTITUENT ASSEMBLY, based upon
the constituent popular process, a Legacy of Commander Hugo
Chávez, and the pioneering and founding Constitution of 1999, so that
our people, in the capacity of Original Constituent Power, expresses its
iron will and the highest guarantee of defense of the sacred rights and
social achievements attained, which I have endeavored to maintain
and deepen during my tenure. Therefore, I propose as programmatic
objectives of the National Constituent Assembly, the following:

1. Peace as a need, a right and a desire of the nation. The
constituent process is a great call for a nation-wide dialogue to
contain the escalation of political violence through mutual political
recognition and through a re-organization of the State to recover
the constitutional principle of cooperation among the Branches of
Government as a guarantee of the full operation of the
democratic and social Rule of Law and Justice to overcome the
current climate of impunity.

2. The perfection of the national economic system moving towards
a Venezuelan Power by conceiving the new post-petroleum,
mixed, productive, diversified and integrating economic model,
based on the creation of new instruments to streamline the
development of the productive forces, as well as the
implementation of a new and transparent distribution model that
fully meets the supply needs of the population.

3. To enshrine the Missions and Grand Socialist Missions in the
Constitution, thus developing the democratic and social Rule of
Law and Justice into the State of the Supreme Social Happiness
in order to preserve and broaden the legacy of Commander Hugo
Chávez in the realm of the full enjoyment and exercise of the
social rights by our people.

4. The broadening of the responsibilities of the Justice System to
eradicate criminal impunity, particularly regarding crimes
committed against the people (manslaughter, kidnapping,
extortion, rape, gender violence and violence against children
and adolescents); as well as crimes against the Homeland and
society, such as corruption; smuggling, speculation, terrorism,
drug-trafficking, promotion of social hatred and foreign
interference.

5. To enshrine in the Constitution the new forms of participative and
protagonist democracy through the recognition of the new
subjects of the People’s Power, such as the Communes,
Communal Councils, and Workers Councils, among other
territorially and socially based forms of organizations.

6. The defense of the sovereignty and integrity of the nation and
protection against foreign interventionism, broadening the
responsibilities of the democratic and social Rtate of Law and
Justice for the preservation of citizen security, the guarantee of
the comprehensive exercise of human rights, the defense of
independence, peace, immunity and the political, economic and
territorial sovereignty of Venezuela. Further, the promotion of the
consolidation of a multi-polar and multi-centric world that ensures
respect for law and for international security.

7. Recognition of the multicultural character of the Homeland
through the constitutional development of the spiritual values
enabling us to recognize each other as Venezuelans in our
ethnical and cultural diversity as a guarantee of peaceful
coexistence today and in the future, thus inoculating us from
social and racial hatred that is today incubated in a minority of
society.

8. The guarantee of the future, our youth, through the inclusion of a
constitutional chapter to enshrine the rights of the youth, such as
the free and conscious use of information technologies; the right
to a dignified and creativity-liberating job; the protection of young
mothers; the affordability of a first home; the recognition to the
diversity of tastes, styles and thinking, among others.

9. The preservation of life in the planet by constitutionally
developing with a greater degree of specificity the sovereign
rights to protect our biodiversity and the development of an
ecological culture in our society.

I invoke the Original Constituent Power so that with its deeply
patriotic spirit, it may form a National Constituent Assembly to
become a participative and protagonist forum of the whole of our
society where the most diverse social sectors may make their
voices heard. A National Constituent Assembly whose composition
reflects the geopolitical structure of the Federal Decentralized State,
based on the primary political unit of the territorial organization
enshrined by our Charter.
It is the duty of the Original National Constituent Assembly to
guarantee the Social Rule of Law and Justice, as well as to channel
the popular demand of those who today ask that their rights,
accomplishments and achievements enjoy a constitutional rank, a
level to which they shall undoubtedly be raised, thus perfecting the
humanist, political, legal and economic development model
contained and enshrined in our Constitution. Based on these
historical reasons and instilled with the most sacred moral and
loving commitment to the Venezuelan people, I hereby take the
constitutional and exclusive initiative to convene, gathered in a
Council of Ministers, a National Constituent Assembly, as follows:
DECREE

Article 1. With the powers vested in me by Articles 348, 347, 70,
and 236(1) of the Constitution of the Bolivarian Republic of
Venezuela, I HEREBY CONVENE A NATIONAL CONSTITUENT
ASSEMBLY, with profound popular and citizen participation, so that
our People, as trustee of the Original Constituent Power, with its
supreme voice may decide the future of the Homeland, thus
reaffirming the principles of independence, sovereignty, equality,
peace, and participative, protagonist, multi-ethnic and multicultural
democracy.

Article 2. The representatives to the Original National Constituent
Assembly shall be elected per sectors and territories under the
guidance of the National Electoral Council through universal, direct
and secret ballot, with the supreme interest of preserving and
deepening the constitutional values of liberty, equality, justice, and
immunity of the Republic and the self-determination of the people.

Given in Caracas on the first day of May, 2017. 207th year of
Independence, 158th year of the Federation and 18th year of the
Bolivarian Revolution.

President of the Republic

With the power vested in me by Article 348 of the Constitution of the
Bolivarian Republic of Venezuela, according to Articles 70, and 347 of
that Constitution, for the purposes of preserving the peace,
independence, integrity and sovereignty of the Republic so that the
Venezuelan people with its original power and with its supreme voice
resolves its destiny, as a sovereign and independent Homeland, and
marks the course of our history following the path inherited from our
Liberators; in Council of Ministers,

WHEREAS

The President of the Bolivarian Republic of Venezuela has convened a
National Constituent Assembly so that it carries out the consultation of
the proposal with the people and clarifies any doubts about the original
constituent power,

WHEREAS
In defense of the most precious good that we have achieved, that is,
the political Independence and the reaffirmation of our identity with a
view to confronting with the new national reality so as to further
consolidate the basis of the 21st Century Bolivarian Socialism, I hereby

DECREE

Article 1. The creation of a Presidential Commission in charge of
preparing a proposal for the territorial and sectorial election basis, as
well as the main aspects which shall serve as a basis for the
composition and operation of the National Constituent Assembly
following a consultation with the broadest sectors of the country, thus
guaranteeing the principle of direct participation set forth in the
Constitution of the Bolivarian Republic of Venezuela.
Article 2. The Presidential Commission created under the preceding
article shall be made up by the persons listed below:

1. ELÍAS JOSÉ JAUA MILANO, holder of the Identity Card
Number V-10.096.662, who shall chair the Commission.
2. ADÁN COROMOTO CHÁVEZ FRÍAS, holder of the Identity Card
Number V-3.915.103, who shall be in charge of the Secretariat of
this Commission.

Article 3. The Presidential Commission within an urgent term, starting
with the enactment hereof, shall submit to the President of the
Republic a report with the basis, results and recommendations
gathered in the exercise of the power entrusted to it in accordance with
Article 2.

Article 4. The expenses of the Presidential Commission shall be
charged to the budget of the Ministry of People’s Power for the Office
of the President and Monitoring of Government Management.

Article 5. The Presidential Commission may create the subcommittees
or work groups necessary with a broad and collegiate participation of
national and international advisors from disciplines related to each
topic, as well as representatives of the organized communities who
may help the attainment of its goals.

Article 6. The enforcement of this Decree corresponds to the People’s
Power Ministry of the President’s Office and Monitoring of the
Government’s Management.

Article 7. This Decree shall come into force as from the date of the
publication hereof in the Official Gazette of the Bolivarian Republic of
Venezuela.
