A.CityofSt.CharlesMunicipalElectricalUtility(SCMEU).TheCityofSt.CharlesMunicipalElectricUtility(SCMEU)isan
"IllinoisMunicipalUtility"which,since1892tothepresenttime,hasbeenownedandoperatedbythecityofSt.Charles,
IllinoispursuanttoacontinuumofStateofIllinoisConstitutionalandStatutoryAuthority(e.g.,CommonLaw,Statutesprior
to1913"MunicipalOwnershipAct"of191365ILCS5/111171to1111714and111191to111195).

B.Customer.Anyperson,partnership,corporationorotherlegalentitythathasacontractualorotherarrangementwithSCMEU
wherebySCMEUprovidesservicetocustomerpremises.
C.Customerpremises(CP).Anyland,spaceorarea,e.g.,singlefamilyresidence,apartment,condominium,store,office,factory,
etc.,whichistobeoccupiedbyacustomerandwhichisservedbyoneormoreseparatecustomerelectricaldistribution

V.ServiceOriginationConnectionCharge(SOCC).AChargecorrespondingtotheInPlaceCostoftheCustomerElectrical
DistributionSystemallocatedtoserveaCustomerPremises.
W.AdministrativeEnrollmentCharge(AEC).AChargecorrespondingtothecostsincurredinprocessinganapplicationfor
electricservice.
X.ServiceEnrollmentConnectionCharge(SECC).AChargecorrespondingtotheInPlacecostofaCustomerConnectionand
anAdministrativeEnrollmentCharge.
Y.ServiceUpgradeCharge(SUC).AChargecorrespondingtotheInPlacecostofprovidinganyrequestedUpgradedElectric

13.08.020PublicWorksDepartmentElectricitySupervision

ThePublicWorksDirectorordesigneeshallhavesupervisionoverthepoliciesandproceduresgoverningtheinstallation,operation,
maintenance,andrepairoftheCityselectricaldistributionsystem.AllinstallationsontheSCMEUsystemshallbesubjecttoSCMEU
policies,standardpractices,andprocedures.

13.08.030Contractforpurchaseofelectricity

Therates,termsandconditionsofthepurchaseofelectricalenergyasstatedinthischaptershallbeapartofthecontractwithevery

13.08.050EquipmentFurnishedandmaintainedbycustomer

Allwiringandotherelectricalequipmentonthepremises,orconnectingthepremiseswiththecity'sservice,furnishedbythe
customers,shallbesuitableforthepurposeshereof,andshallbeinstalledandmaintainedbythecustomeratalltimesinconformity
withtherequirementsoftheNationalBoardofFireUnderwritersasstatedinthe2008editionoftheNationalElectricalCode.

13.08.060EquipmentCitypropertyProtectionbycustomerRelocation

Allmeters,transformers,poles,structures,andotherfacilitiesplacedonthecustomer'spremisesbytheCityforthepurposesof
renderingelectricservicetosaidpremises,unlessotherwiseexpresslyprovided,shallbeandremainthepropertyoftheCity,andthe
customershallexercisereasonablecaretoprotectsuchpropertyfromalterations,misuse,modification,foreignobjects,vegetation,
lossordamage.Whenthereisachangeinthecustomer'soperation,orconstruction,whichinthejudgmentoftheCitymakes
relocationofthefacilitiesnecessary,orifthecustomerrequestsrelocation,theCitywillmovesuchfacilitiesatthecustomer'sexpense
toanacceptablelocationonthecustomer'spremises.

13.08.062Existingtransformerupgrade

Thecustomershallpaytheexactcostofupgradestoequipmentservingthecustomerfacility.ATransformerCostCredit(TCC)
maybegivenforthefuturereplacementofexistingtransformersbasedontheaccumulateddepreciationoftheexistingasset.
ApplicabilityoftheTCCandtheamountwillbedeterminedbytheSt.CharlesMunicipalElectricUtility(SCMEU).

13.08.065EquipmentUnauthorizedattachment

TheCityprohibitsunauthorizedattachment(includingpaintingormarking)ofanywires,signs,clotheslines,antennas,fences,etc.to
itspoles,pedestals,padmountedtransformersorotherstructures.TheCityalsoprohibitstheuseofitspolesforplacardsorother
advertisingmatterandwillremoveanysuchunauthorizedattachmentswithoutnoticeandmayprosecuteanysuchtrespassing.The
Citymayremoveorcausetoberemovedwithoutnoticeanyunauthorizedforeignmatterfromitspoles,pedestals,padmounted
transformersorotherstructuresattheexpenseofthepropertyowner.

13.08.070MeteringequipmentCitymaintenanceAccessibility

TheCitywillfurnishandmaintainallmeteringequipmentnecessaryformeasuringandbillingtheelectricitysupplied.Thecustomer
shallprovideasuitableplaceforreading,testing,inspectingorexchangingsuchmeteringequipment.

13.08.075Submeteringallowedforcommercialaccounts

A.Submeteringisallowed,asanoption,oncommercialbuildingsreceivingserviceunderoneoftheCitysstandardcommercial
rates(rate3andrate5).Amultiusebuilding,containingcommercialandresidentialunits,mayonlysubmeterthe
commercialunits.Submeteringisnotallowedwithoutpriorreview,inspectionandapprovalbyCitystaff.
B.Themastermeter(meterdirectlyconnectedtoCitysystemwhichfeedsallsubmeters)willbeCityownedandmaintained.All
submetersmustbeownedandmaintainedbythebuildingowner.Ifanysubmetersareinstalledinabuilding,allusageinthe
buildingmustbesubmetered(nousageinasubmeterinstallationcanbemeteredonlybythemastermeter).Thebuilding
ownershallbebilledandisfullyresponsibleforallchargesforserviceprovidedtothebuilding/propertyandmeteredbythe
mastermeter.
C.TheCitytakesnoresponsibilityforthesubmetersortheirreadingorbilling.TheCityshallnotbepartytoanymetering
accuracyorbillingdisputebetweenoccupantsofthepremisesbeingsubmeteredandthebuildingownerordesignee.The
mastermeterwillbereadbytheCityaccordingtotheCitysreadingschedule,whichmayvaryatCitysdiscretionwithout
noticetothebuildingowner.
D.Submeteringequipment,wheninstalled,mustbeinnewcondition,utilitygradeequipment,ofreputablemanufacturer,
designedforthepurposesused,andmustmeetappropriatestandardsforutilitymeteringaccuracyasdefinedbytheANSI
(AmericanNationalStandardsInstitute),IEEE(InstituteofElectricalandElectronicsEngineers),orotherappropriatestandards
agency.
E.AllsubmeteringinstallationsaresubjecttoCityinspectiontoassurecompliancewithelectricalcodesandstandards.City
reservestherighttoapproveorrejectsubmeteringequipment,beforeorafterinstallation,basedonadherencewithcodes,
installationcriteria,applicablestandardsandthisordinance.Useofanyunapprovedsubmeterequipmentshallmaketheentire
buildingsubjecttodisconnectionofserviceuntilapprovalofthemeteringinstallation.
F.Allsubmeterdevicesshallbeinstalledpermanufacturersrecommendations.Submeteringshallnotimpactthedeliveryof
servicetothesubmeteredpremises,i.e.improperinstallationorimpropersizingofmeters.Testingofsubmeterequipment,
byqualifiedmetertester,isrequiredatinstallationandperiodicallythereafterpermanufacturersstandardsandmustmeet
industrystandardsformeteraccuracyasdefinedbytheAWWA,ANSI,IEEE,orotherappropriatestandardsagency.
G.ThecityreservestherighttoterminateservicetothebuildingforlackofcompliancewithanyprovisionofthisSection.

13.08.080Landlord'sconsentrequiredforinstallationofequipment

Incasethecustomerisnottheownerofthepremisesorofinterveningpropertybetweenthepremisesandthecity'slines,the
customershallobtainfromtheproperowner,orowners,thenecessaryconsenttotheinstallationandmaintenanceonthepremises
andonsuchinterveningpropertyofallwiringandotherelectricalequipmentrequiredforsupplyingelectricitytothecustomer.

13.08.090Effectofcustomersequipmentonpowerquality

Certaintypesofequipment,whichmaybepurchasedandusedbythecustomer,mayhaveoperatingcharacteristicsthathavea
detrimentaleffectonotherequipmentofthecustomerormayinterferewiththesatisfactoryuseofservicebyothercustomers
connectedtothesamedistributionsystem.Itisintheinterestofallcustomersthattheuseofsuchequipmentbeavoided.Whereany
ofthecustomer'sutilizationequipmentmanifestscharacteristics,which,intheCity'sjudgment,maycauseinterferencewithserviceto
othercustomersorresultinoperationatalowpowerfactor,thecustomershall,attherequestoftheCity,providesuitablefacilitiesto
precludesuchinterferenceorimprovesuchpowerfactor,orboth,asthecasemaybe.Otherwise,theCityshallhavetherightto
provide,attheexpenseofthecustomer,thefacilitiesnecessarytoprecludesuchconditionorconditions.TheCityreservestheright
torefuseservicewheresuchequipmentisinstalledunlessthecustomerprovidessuitablecompensationorprotectivedevices,or
makessatisfactoryfinancialarrangementswiththeCitytoprovidethenecessarycapacityorprotectivemeasures

13.08.100Accesstopremises

TheproperlyauthorizedagentsoftheCityshallatallreasonablehourshavefreeaccesstothepremisesforthepurposeofreading,
examining,repairingorremovingthecity'smetersandforinstalling,testing,inspecting,repairing,removingorchanginganyorall
equipmentbelongingtotheCity.Shouldaccessbedenied,orpropertyownerunavailableorunabletoprovideaccessmorethan6
timesinacalendaryear,Cityequipmentshallberelocatedoutsideoftheinaccessibleareaatownersexpense.Inthecaseofmeters,
thecustomershallmaintainaminimumof3feetclearworkingspaceinfrontofeachmeter.Additionalspacewillberequired
adjacenttomovingmachinery.Inthecaseofpadmountedequipment,clearandlevelworkareasarerequiredaroundpadmounted
equipmenttoprovideanadequatesafeworkingspacetooperateandmaintaintheequipment.An8footminimumworkspaceis
requiredinfrontofallequipmentdoorstoprovideroomtooperatewithhotsticksandtoreplacetheequipment.Athreefoot

13.08.135Applicationproceduresandcharges

A.AnapplicationrequestingelectricserviceshallberequiredofallCustomers.Anapplicationshallprovideallinformation
requiredbySCMEUtoprocesstherequest,includingbutnotlimitedtothefollowing:

1.ResidentialName,serviceaddress,billingaddress,homephone,driver'slicensenumber,and,ifnotanindividual,the
taxpayer'sidentificationnumber
2.GeneralNameofbusiness,typeofbusinessorganization,serviceaddress,billingaddress,phonenumber,ownerand/or
president,manager,taxpayer'sidentificationnumber.

13.08.140DepositRequiredRefundExemption

A.Depositshallbechargedtoanycustomer,whetherownerornonowner,atanytimeifsuchcustomermeetsanyofthe
followingcriteria:

1.thecustomerpayslatefourtimesduringthepriortwelvemonthperiod,or
2.theutilityhasdisconnectedservicewithinthelasttwelvemonthperiodforviolationoftheprovisionsoftheSt.
CharlesMunicipalCode,or
3.theutilityfindsoutthattheapplicationforservicewasfalsified,or
4.thecustomerhastwoormorereturnedchecks(NSF)duringthepriortwelvemonthperiod.Theadditionaldeposit
chargedshallbeintheamountequaltotheaggregateofthetwohighestmonthlybillingsforthetwelvemonth
periodendingimmediatelypriortotherequestfortheadditionaldepositorifatwelvemonthperiodisunavailable,then
anyportionthereof,whichamountshallbereducedbytheamountofthedepositonhand.

Thedepositssetforthaboveshallberepaidtosuchapplicantwhenthecityhasdiscontinuedorrefusedtheservicefor
whichsuchapplicationwasmadeandwhenallbillshavebeenpaidinfullprovided,however,thatiftheapplicanthas
notpaidallbillsowingthecityforsuchservicewithinthirtydaysaftersuchservicehasbeendiscontinued,thenthecity
clerkshalldeducttheamountofthebillssoowingfromthedepositandremitthebalance,ifany,tosuchapplicant.

B.AlldepositsmadebyapplicantsasprovidedinsubsectionAofthissectionwhoarenotdelinquentshallberefundedbythecity

1.Thecustomerswiringshallbesoarrangedthatallservicehereundermaybesuppliedthroughasinglemeteringinstallation
adequateforanormalloadequaltothemaximumthirtyminutedemandofthecustomer,atapowerfactorofeightyfive
percentlagging.Exceptinmultioccupancybusinesspremiseswhereeachbusinessshallbeservicedasanindividual
customer.Nothinginthisrateshallbedeemedtoprecludearesidentialoccupancyonthecustomerspropertyfrombeing
servedasaseparatecustomeronaresidentialrate.
2.MeasurementofDemandandKilowatthoursSupplied.Wheretwoormoremeteringinstallationsareprovidedonthe
customerspremises,thedemandinanythirtyminuteperiodshallbedeterminedbyaddingtogethertheseparatedemandsat
eachmeteringinstallationduringsuchthirtyminuteperiodexceptthat:
Incasethedemandatanymeteringinstallationisregisteredbyanindicatingorcumulativedemandmeter,thedemandatsuch
installationineachthirtyminuteperiodofanymonthshallbeassumedtobethesameasthehighestdemandinanythirty
minuteperiodofsuchmonth.Wheretwoormoremeteringinstallationsareprovidedonthecustomerspremisesandarefor
thesamecustomer,andifoneormoreinstallationsqualifiedforrate5andoneormoreinstallationsqualifiedforrate9,then
themeteringinstallationreadingsshallbecombinedandbilledatrate9.
3.ThetermsandconditionsstatedSections13.08.010through13.08.210applytothisrateandservicehereundershallbesubject
thereto.

13.08.295Watthourpulsemeteringservice

Watthourpulsemeteringwillbeprovided,uponcustomersrequest,forapplicablesystems,underthefollowingconditions:

A.Customershallsubmitrequestforwatthourpulsemeteringinwriting,includingdetailedspecificationsofthecustomers
proposedmonitoringequipment.
B.CustomershallsignacontractagreeingtoparticipateinWatthourPulseMeteringforaperiodofnolessthan18months.
C.St.CharlesMunicipalElectricUtilitystaffwillreview,atcustomersexpense,applicabilityandcompatibilityofthecustomers
proposedsystemwiththeCityequipment.Normalelectricengineeringratesshallapplyforthereviewandanysubsequent
workrequested.Paymentforallengineeringworkisduewithin30daysofthebillingregardlessofwhetherthecustomer
installsthesystem.
D.Citywillprovideanappropriatewatthourmeteroradditionalequipmentwithinthemeterandasingleisolationrelay,at
customersexpense.
E.Customershallpay$20permonth,oranypartofamonthlybillingperiod,pereachmeterinstallation,forthedeliveryofthe
watthourpulses.
F.Cityshallprovidenormalmaintenanceandrepair,includinglightningdamage,ofthemeterandisolationrelay.Citymaterial
andlaborcostsshallapplyforallotherdamagetoCityequipmentandshallbebillabletothecustomer.
G.ThecustomershallbebilledforlaborandmaterialexpendedbytheCityrespondingtowatthourpulsemeteringtroublecalls
whereitisconcludedthattheCityequipmentwasnotmalfunctioning.
H.TheCityshallremovewatthourpulsemeteringequipmentwithin30daysofreceiptbyCityofawrittenrequestfor
discontinuationofwatthourpulsemeteringservicefromthecustomer.Afterdiscontinuationofwatthourpulsemetering
service,thecustomercannotreapplyforwatthourpulsemeteringservicefor18months.

A.Applicabilityallrates.
B.Definition.APowerCostAdjustment(PCA)willbeappliedtoenergyconsumptiontoaccountforfluctuationsinthecostof
power.PCAvaluescanbepositiveornegativeandwillbeappliedonaquarterlybasisusingthefollowingformula:

1.Quarterlyestimatedpowercostwillbesubtractedfromestimatedrevenuefromsalestocreateatargetquarterlyincome
number.
2.Quarterlyactualpowercostwillbesubtractedfromactualrevenuefromsalestocreateanactualincomenumber.
3.Theactualincomewillbesubtractedfromthetargettocreateaquarterlyincomedeltanumber.

St.CharlesMunicipalElectricUtility(SCMEU)shallmakeavailable,uponrequest,interconnectionservicestoanycustomerthat
meetstherequiredguidelines.InterconnectionservicesinthisSectionreferstoonsitegeneratingfacilitiesconnectedtoSCMEU
distributionsysteminamannerthatwillallowexcesselectricitygeneratedbytheeligibleonsitegeneratingfacilitytobesafely
deliveredontoSCMEUselectricdistributionsystem.Guidelinesforinterconnectingtotheutilitysystemareasfollows:

A.OnlygeneratingfacilitiesthathavebeenapprovedbySCMEUshallbeinterconnectedwithSCMEUselectricdistribution
system.
B.Interconnectionservicesshallonlybeavailabletopremiseswithaggregatedtotalgenerationatasinglecustomerpremiseofless
than1MW.
C.AllinterconnectionsshallcomplywithIEEEStandard1547forInterconnectingDistributedResourceswithElectricPower
Systems(IEEE1547)asamendedfromtimetotime.
D.SCMEUisundernoobligationtopurchaseenergysuppliedtoitunderthissection.Thisdoesnotprecludethecustomerfrom
meetingapplicablestandardsthatwouldallowthecustomertosupplypowerontotheutilitiessystemandreceivecreditforsuch

intervalsspecifiedbythemanufacturersystemintegrator,ortheauthoritythathasjurisdictionovertheDistributedResources
interconnection,oralltestsshallbeperformedeverythree(3)years,whicheverisshorter.Periodictestreportsshallbe
maintainedandsubmittedtotheSCMEUEngineeringDepartment.
H.Systemsofgreaterthan10kWshallperformallinterconnectionrelatedprotectivefunctions,equipmentandassociatedbattery
testingonayearlybasis.AlltestreportsshallbesubmittedtotheSCMEUEngineeringDepartmentaftercompletionofthe
yearlytesting.
I.ReportsrequiredunderSection13.08.315paragraphsG.andH.,mustbesubmittedwithin30daysoftheanniversarydateof
theenergizingoftheinterconnectgeneration.Iftherequiredreportsarenotreceivedwithinthe30dayperiod,thegeneration

13.08.320Renewablegenerationenergypurchasepolicy
St.CharlesMunicipalElectricUtility(SCMEU)shallmakeavailable,uponrequest,renewablegenerationenergypurchase(RGEP)
servicetoanycustomertakingservicefromSCMEUandwhomeetstherequirementssetforthinthispolicy.Forpurposesofthis
SectionRGEPservicemeansservicetoanelectriccustomerunderwhichelectricenergygeneratedbythatelectriccustomerfrom
aneligibleonsiterenewableenergygeneratingfacility,ownedbythatcustomerand,undersomecircumstancesdeliveredtothelocal
distributionfacilities,maybeusedtooffsetelectricenergyprovidedbytheSCMEUtotheelectriccustomerasprovidedforinthis
policy.Suchserviceshallbesubjecttothefollowingprovisions:

A.Forpurposesofthispolicyaneligibleonsitegeneratingfacilityshallbedefinedasarenewablegeneratingfacilitysuchasa
photovoltaicfacilityorsmallwindturbines.Otherformsofrenewablegeneration,suchassourcesfueledbylandfillmethane,
fuelcells,ormicroturbinesfueledbyrenewablefuelsshallbeconsideredonacasebycasebasis.Inallcasesfacilities
interconnectedmustbedeemedtoberenewablebySCMEUtoqualifyforthispolicy.
B.TheelectricgeneratingfacilitymustalsoabidebySCMEUInterconnectionStandards(13.08.315).
C.Subjecttothelimitationssetforthherein,SCMEUshallmakeRGEPserviceavailableuponrequesttoanySCMEUelectric
customerwithaqualifyinggeneratingfacilityof10kWcapacityorless.
D.Anygeneratingfacilitygreaterthan10kWbutlessthan1MWshallbeconsideredonacasebycasebasis.Thedecisionwith
respecttosuchfacilitiesshallbemadebySCMEUbaseduponitscontractualobligations,systemsafetyissuesandother
relevantinformation.
E.TotalRGEPcapacityinterconnectedunderthispolicyfortheSCMEUsystemshallnotexceed2%ofthesystemspeak,asit
existedinthepriorcalendaryear.Intheeventthatthesystempeakisreducedsuchthattheexistingnetcapacityexceedsthe
2%level,thoseexistingRGEPcustomersshallbeallowedtocontinueunderthispolicy.However,nonewinterconnections
willbealloweduntilsuchtimeasthesystempeakgrowssuchthatRGEPcapacityisagainnogreaterthan2%ofthesystems
peak.
F.Energygeneratedbythecustomerownedgeneratorwilloffsettheenergyrequiredbythecustomersloadduringthebilling
period.Foranyenergygeneratedbythecustomerinexcessoftheenergyrequiredbythecustomersloadsforagivenbilling
periodacredit(assetforthinparagraphG.below)shallbecarriedforwardtothecustomersnextbillingperiod.Innocase
shallcreditsforexcessenergybecarriedforwardforaperiodgreaterthanthreebillingperiods.Intheeventofterminationof
anaccountqualifyingforRGEPunderthispolicy,anyoutstandingcreditsaresurrendered.Undernocircumstanceswillthere
bepayments,orcredittransfersforexcessenergy.Creditsshallbeforenergyonlythereisnocreditforcapacity(demand).
G.ExcessenergywillbecreditedbasedonthewholesalecostSCMEUpays.ForcustomersservedunderresidentialRate1,small
generalserviceRate3,andGovernmentalOutdoorSportsLightingRate6,thecreditwillbedeterminedbytheaverage
wholesalecostperkilowatthourpaidbySCMEUtoourenergysupplierinthepreviousfiscalyear.Thecreditforcustomers
servedundergeneralserviceRate5andIndustrialRate7willbethekilowatthourchargespecifiedintherespectiveratesset
forthinthisChapterforthemonthinwhichthecreditisearned.
H.AnycostsSCMEUincursassociatedwiththeRGEPprogram,includingbutnotlimitedtochangesinmetering,otherphysical
facilitiesorbillingrelatedcosts,shallbebornebytheparticipantsintheRGEPprogram.

13.08.330Biddingorsellingofsystemdemandresponse

A.Generalprohibitionagainstbiddingorsellingsystemdemandresponse.ExceptasprovidedinsubsectionBofthissection,the
customersoftheSCMEUareherebyrestrictedandprecludedfrombiddingorsellingdemandresponseintoanyorganized
electricorancillaryservicesmarketsoperatedoradministeredbyPJM(oranysuccessorindependentsystemoperatoror
regionaltransmissionorganization)orotherwiseparticipatinginsuchmarketswithanydemandresponseresourceswhether
directlyorthroughathirdpartyaggregator.
B.Exceptiontogeneralprohibition.NotwithstandingthegeneralprohibitionstatedinsubsectionA,above,theSCMEU,acting
withandthroughitspowersupplier,IllinoisMunicipalElectricAgency(IMEA),isherebyapproved,authorizedandpermitted
tooperateasaCurtailmentServiceProviderwithrespecttodemandresponseresourceswithintheCitysmunicipalelectric
utilitysystem,includinganygenerationownedbytheCity,andtoofferandsellsuchdemandresponseresourcesintoprograms
andmarketsofPJMInterconnection,L.L.C.oritsdulyauthorizedsuccessor.Participationshallbesubjecttothetermsand
conditionsoftheIMEAsDemandResponseProgram,acopyofwhichisattachedasAppendixA,assuchprogramisamended
bytheIMEAfromtimetotime.
C.AllcostsincurredbytheSCMEUforimplementationandcontinuedoperationoftheDemandResponseProgramwillbethe
directresponsibilityofthecustomer.Costswillbebilledtothecustomeratthetimetheexpenseisincurred.Thesecosts
includethecostofmeteringequipment,monitoringequipment,communicationdevices,communicationservices,extrameter
reading(ifrequired),maintenanceofequipment,equipmentreplacement,billingexpenseandanyotheradditionalcosts
directlyorindirectlyrelatedtothisprogram.Chargesincludecostforequipment,labororboth.
