Application under section 340 of the CRPC

I, Dr.Swagath.N resident of LIG255, 25th cross, kuvempunagar, Hassan, state that I am


the applicant and state as follows

1. I sate that I married the petitioner Chaitrapallavi on 29/05/09and the address of


the petitioner and the respondent is as shown in the cause title, I may be served by
any summons or notice by the honorable court to LIG255, 25 th cross,
kuvempunagar, Hassan.
2. I state that and humbly submit to the honorable court that the petitioner in the
C.Mis case 90/10 has also filed a vexatious 498A case against me and my family
which is yet to be charge sheeted. It also reads with
143,147,148,324,323,506,498(A), R/W, and 149 IPC 3 & 4 DP ACT.
3. The petitioner of C.Mis case 90/10 submits in her petition that she has been
subjected to physical and mental cruelty. I being a physician cannot under any
circumstance quantify physical and mental cruelty. The petitioner with the sole
interest of harassing me and my family has given information to the police officer
hence committed an offence punishable under IPC 182.
4. The petitioner C.Mis case 90/10 has fabricated and given false evidence to the
police officer and hence committed an offence punishable under IPC 195.
5. The petitioner C.Mis case 90/10 along with the other prosecution witness in the
498A case have caused the disappearance of evidence with regard to an offence
committed , there by committed an offence punishable under IPC 201.
6. The petitioner C.Mis case 90/10 along with the other prosecution witness in the
498A case have caused the disappearance of evidence with regard to an offence
committed , there by committed an offence punishable under IPC 206.
7. The petitioner C.Mis case 90/10 along with the other prosecution witness in the
498A case have caused the disappearance of evidence with regard to an offence
committed , there by committed an offence punishable under IPC 208.
8. wherefore the applicant prays that the honorable court take cognizance of
offences 182,195(A), 201, 206, 208 and any other offence during the course of
trail and punish the accused in accordance to law in the interest of equity and
justice.

I, Dr.Swagath.N resident of LIG255, 25th cross, kuvempunagar, Hassan, do hereby


solemnly affirm and state on oath as follows:

The respondent has filed a false and vexatious DV case against me and my family
members to harass and defame me and my family members. Aggrieved by this I have
filed an application under section 340 of CRPC seeking for enquiry against the
respondents. All the averments made in the petition are true to the best of my knowledge,
belief and information.
Wherefore it is humbly submitted to this honorable court that an appropriate action is
taken against the respondent under the above said sec 340 of CRPC in the ends of justice
and equity.
