 Pad a hari ini, Kamis, tanggal lima belas Desember, tahun Dua Ribu Enam Belas,
bertempat di Putussibau, yang bertanda tangan di bawah ini:

Today, Thursday fifteen December year two thousands sixteen in Putussibau, here
undersigned by :

1. Ir. MUHAMMAD SUKRI Sekretaris Daerah Kabupaten Kapuas Hulu, dalam hal
ini bertindak untuk dan atas nama Pemerintah
Kabupaten Kapuas hulu, yang selanjutnya disebut
PIHAK KESATU.
The District Secretary of Kapuas Hulu, acting for and
on behalf of the Government of Kapuas Hulu,
hereinafter referred as the FIRST PARTY.

2. GEORG BUCHHOLZ Direktur Program GIZ Forclime, dalam hal ini bertindak
untuk GIZ, yang selanjutnya disebut PIHAK KEDUA.
Program Director GIZ Forclime, acting for and on
behalf of GIZ, hereinafter reffered as the SECOND
PARTY.

PIHAK KESATU dan PIHAK KEDUA untuk selanjutnya secara bersama-sama disebut PARA
PIHAK dan secara sendiri-sendiri disebut PIHAK.
THE FIRST and THE SECOND PARTY here in after jointly referred THE PARTIES and
individually called PARTY.

PARA PIHAK sepakat untuk membuat Nota Kesepahaman tentang Dukungan terhadap
pelaksanaan pendekatan yurisdiksi dalam pencapaian produksi pertanian berkelanjutan
yang tidak merusak hutan dan perlindungan hutan di Kabupaten Kapuas Hulu, Kalimantan
Barat dengan ketentuan sebagai berikut.
THE PARTIES agreed to sign a Memorandum of Understanding on Support for the
Implementation of A Jurisdictional Approach to Achieve Verifiable Sustainable Agricultural
Production and Forest Protection in Kapuas Hulu, West Kalimantan, with the following
Provisions.

Pasal 1 / Article 1
MAKSUD DAN TUJUAN / PURPOSE AND OBJECTIVES

(1) Nota Kesepahaman ini dimaksudkan untuk mendukung kerja sama antara Pemerintah
Kabupaten Kapuas Hulu, sektor swasta, sistem sertifikasi dan GIZ yang bertindak
sebagai lembaga pelaksana bantuan Kementerian Kerjasama Ekonomi dan
Pembangunan Pemerintah Federal Jerman.
(1) This Memorandung of Understanding is intended to support the cooperation between the
Government of District Kapuas Hulu, private sector, sertification system and GIZ acting
as implementing agency on behalf of German Federal Government Ministry of Economic
Cooperation and Development.

(2) Nota Kesepahaman ini bertujuan untuk menciptakan lanskap yang lestari dimana
pembeli global minyak sawit dan karet alam serta produk pertanian lainnya dapat yakin
bahwa produk yang diperoleh adalah berkelanjutan.
(2) The objective of this Memorandum of Understanding is to create sustainable landscape
where global buyer for oil palm, rubber and other agricultural products convinced that the
products are sourced sustainably.

Pasal 2 I Article 2
RUANG LlNGKUP I SCOPE

Para Pihak sepakat untuk mengembangkan kegiatan kolaboratif di bidang berikut dalam
kepentingan bersama:
The Parties agree to develop the following collaborative activities in areas of mutual interest:

1. Identifikasi area produksi komoditas.

Identification of areas for commodity production.

2. Aplikasi konsep lansekap Nilai Konservasi Tinggi (NKT) dan Stok Karbon Tinggi
(SKT).
Landscape-wide application of High Conservation Value (HCV) and High Carbon
Stock (HCS) concepts.

3. Membuat peta tutu pan lahan terkini untuk seluruh kabupaten untuk mendukung
perencanaan penggunaan lahan terpadu.
Creation of an up to date land cover map for the entire district to support integrated
land-use planning.

4. Menyiapkan sistem pemantauan untuk memastikan kepatuhan terhadap komitmen

tanpa deforestasi, baik di perusahaan perkebunan skala besar maupun petani
perkebunan skala kecil.
Setting up a monitoring system to ensure compliance with no deforestation
commitments, both at the company and smallholder level.

5. Identifikasi bio-koridor (termasuk mengidentifikasi potensi pemulihan I daerah

reboisasi yang diperlukan).
Identification of bio-corridors (also to identify potential restoration/reforestation areas
required).

6. Mengangkat isu-isu sosial dan lingkungan dalam produksi berkelanjutan baik kelapa
sawit maupun karet alam.
Address social and environmental issues in the sustainable production of both palm-
oil and natural rubber.

-1. Dukungan agar hak-hak masyarakat diakui dan dilindungi dan semua proses
berdasarkan pada konsep "Free, Prior and Informed Consent (FPIC)".
Support so that community rights are recognized and protected and all processes are
based on the concept of Free, Prior and Informed Consent (FPIC).

8. Meningkatkan kapasitas petani skala keeil dalam rangka meningkatkan produktivitas

dan kualitas.
Build capacity of smallholder farmers in order to increase both productivity and
quality.

9. Mengangkat isu kepemilikan tanah.

Address land tenure issues.

10. Berkolaborasi aktif dengan sistem sertifikasi seperti ISPO, RSPO, Rainforest Alliance,
FSC dan lain-lain.
Collaborate actively with certification systems such as ISPO, RSPO, Rainforest
Alliance, FSC etc.

11. Mengembangkan percontohan "penelusuran" kelapa sawit dan karet dari pabrik
hingga ke perkebunan rakyat pihak ke-3 dan kemudian akan direplikasi di seluruh
kabupaten.
Develop an oil palm and rubber traceability pilot from mill to 3rdparty smallholder
plantation level for later replication across the district to support segregated oil palm
objective.

12. Lokakarya dan pelatihan.

Organization of workshops and lectures.

13. Pertukaran informasi dan publikasi.

Exchange of information and publications.

14. Menghubungkan kabupaten ke pasar Eropa untuk agro-produk yang berkelanjutan

Link the district to European markets for sustainable agro-products.

Tujuan akhir dari kegiatan di atas adalah untuk mengidentifikasi dan mengatasi risiko
terhadap produksi yang keberlanjutan di Kapuas Hulu, yang bebas dari gambut, kebakaran,
deforestasi, dan ketidak legalan. Hal tersebut selain dapat mengidentifikasi faktor risiko,
juga melihat para pihak terkait serta lokasi untuk pengembangan di lapangan selanjutnya.
Selanjutnya Produsen produk berkelanjutan di Kapuas Hulu dapat terhubung ke pasar
ekspor global, dan rantai pasokan yang transparan akan memungkinkan untuk penelusuran.
The ultimate purpose of the activities above is to identify and address the critical risks to
sustainability in Kapuas Hulu, stemming from peat, fire, deforestation, and illegality. It
identifies the location of the risks, but also prioritizes actors and locations for further
investigation of the causes in the field. Eventually sustainable producers in Kapuas Hulu will

be connected to the global export market, and transparent supply chains will allow for
traceability.

Pasal 3 I Article 3
PELAKSANM,-N IIMPI,.EMENTATION

(1) Para pihak akan menunjuk seorang petugas yang akan mengembangkan dan
berkoordinasi dalam melaksanakan kegiatan.
The parties shall appoint an officer who will develop and coordinate in conducting the
activities.

(2) Kegiatan yang akan dilaksanakan dan dituangkan dalam rencana kerja yang disepakati
oleh para pihak dan diketahui oleh Direktorat Jenderal Perkebunan Kementerian
Pertanian.
Activities to be carried out and set forth in the work plan agreed upon by the parties and
known by Directorate General Corp Estate Ministry of Agriculture.

Pasal 4 I Article 4
PEMBIAYAAN I FINANCING

Pembiayaan yang timbul dari Nota Kesepahaman ini dibebankan kepada PIHAK KEDUA
yang bersumber dari GIZ-Sector programme Nilai rantai pasokan berkelanjutan dan standar.

Financing associated with this Memorandum of Understanding is derived from SECOND

PARTIES which is from the GIZ-Sector programme Sustainable value chain and standards

Pasal 5 I Article 5
JANGKA WAKTU I TIME FRAME

(1) Nota Kesepahaman ini mulai berlaku sejak tanggal ditandatangani sampai dengan
tanggal 31 Desember 2019.
This Memorandum of Understanding will become effective immediately after signature
by the representatives of both the District authority of Kapuas Hulu and GIZ until 31
December 2019.

(2) Nota Kesepahaman ini dapat diubah dengan kesepakatan PARA PIHAK.
This Memorandum of Understanding may be amended by agreement of THE PARTIES.

(3) Selama dalam jangka waktu sebagaimana dimaksud pada ayat (1), Nota Kesepahaman
ini dapat diakhiri oleh salah satu pihak dengan pemberitahuan tertulis paling lambat 1

 (satu) bulan sebelum tanggal berakhirnya Nota Kesepahaman, yang mana penghentian
tersebut tidak akan mempengaruhi penyelesaian program apapun atau kegiatan yang
sedang berlangsung pad a saat pemberitahuan penghentian disampaikan.

This agreement may, at any time during its period of validity, be terminated by either
PARTY, upon prior notice to the other in writing not later than 1 months before
termination date, provided that such termination shall not affect the completion of any
program or activity underway at the time the notice of termination is given.

Pasal 6 / Article 6
HAK MILIK INTELEKTUALI INTELECTUAL PROPERTY

Hasil yang diperoleh dari Nota Kesepahaman ini termasuk, namun tidak terbatas pada,
laporan, publikasi, peta, akan menjadi kekayaan intelektual bersama para pihak, dengan
memperhatikan kontribusi Pihak lain.
Any results originating from this MOU including, but not limited to, reports, publications,
maps, will be a joint intellectual property of THE PARTIES, taking into. account the
contribution of other Parties.

Pasal 7 / Aricle 7
PENYELESAIAN PERSELISIHAN / DISPUTE RESOLUTION

(1) Apabila terjadi ketidaksepakatan dalam penerapan, penafsiran atau pelaksanaan Nota
Kesepahaman ini, PARA PIHAK akan berusaha melaksanakan upaya terbaik untuk
bernegosiasi menyelesaikan perbedaan tersebut.
In the event of disagreement in the application, interpretation or implementation of this
Memorandum of Understanding, THE PARTIES will strive to implement best efforts to
negotiate in resolving the discrepancy.

(2) Dalam hal terjadi insiden tak terduga selama kegiatan kolaboratif di kedua negara,
PARA PIHAK sepakat untuk menegosiasikan solusi yang dapat diterima bersama.
In the event of unexpected incidents during collaborative activities in both countries, THE
PARTIES agreed to negotiate a mutual acceptable solution.

 Pasal 8 / Article 8
PENUTUP / CLOSING

(1) Nota Kesepahaman ini dapat diubah atau diperbaiki berdasarkan kesepakatan PARA
PIHAK.
This Memorandum of Understanding may be amended or corrected by the agreement of
THE PARTIES

(2) Nota Kesepahaman ini dibuat dalam rangkap 2 (dua), masing-masing bermaterai cukup,
dan mempunyai kekuatan hukum yang sama setelah ditandatangani PARA PIHAK.
This Memorandum of Understanding is made in duplicate 2 (two), each stamped and
have the same legal effect once signed PARTIES
