JUDICIAL AFFIDAVIT

That I, NAPIPI PILAY, of legal age, Filipino Citizen, and a resident of No. 11 Lopez
Jaena Street, Aurora Hill, Baguio City, after having been sworn in accordance with law,
hereby depose and say:

PRELIMINARY STATEMENT

The person examining me is Atty. Mae Ann Y. Badua with office address at the
2nd Floor Security Bank Building, Abanao cor. Shagem Streets, Baguio City. The
examination is being held at the same address. I am answering his questions fully
conscious that I do so under oath and may face criminal liability for false testimony and
perjury.

you the same NAPIPI PILAY one the of the accused in this case?
A1: Wen, Sir.(Yes, sir.

Q2: Amamum ni CHARUT ARUY, diyanay padam nga naidarum?(Do you know CHARUT
ARUY, your co-accused?

A2: Wen, Sir. Agkaaruba kami ejay Lopez Jaena Barangay, Baguio City(Yes, sir. We are
neighbors at Lopez Jaena Barangay, Baguio City.

Q3: Ayan mo idi Pebrero 18, 2012?(Where were you on February 18, 2012?

A3:iti agsapa na dayta nga aldaw, adanak lang ijay balay, Sir, ijay Lopez Jaena (I was just
at home , sir, at Lopez Jaen),

Q:4 Anya araramidem kadayjay nga agsapa?(What were you doing that morning)

A4: Adda nak lang ejay sangwanan ti balay mi idi napansin ko nga adda trabahador nga
mangkakaut ejay agdanan sangon ti balay diyay kaarubak, edi kwa ket immasidegak

kinda Charut Aruy ken Enteng Kabisuti ta dinamag ko nu inya diyay iririri da. (I was
infront of our house at Loez Jaena and I noticed that CHARUT ARUY, and ENTENG
KABISUTI talking to the workers digging their stairs then I approached CHARUT ARUY,
and Enteng Kabisuti to know what they are complaining about)

Q5: Ket inya pay nangyari?(What else happened?

A5: Damdama bassit ket immay ni Mr. KAPITANTADO, isunga inasikgan ni Charut Aruy
ta dinamag na nu apay nga kalkalien da diyay dalan nga awan ti impakada da kadagijay
akin bagi ti babalay ijay sangwanan dijay dalan nga kalkalien da Santo na imbaga nga
Apay adda Notice to Procee at Work Program, ket kakuna ni Kapitantado nga adda
ngem on-Hold paylaeng tapos pimmanaw metlang suna (After a while, Mr.
Kapitantado arrived at the site and upon seeing him, CHARUT ARUY asked him why were
they digging the road without asking permission from the owners of houses fronting the
said road then she also said do you have Notice to Proceed at Work Program? Mr.
Kapitantado said that there is but on hold. Then he left us.

went to the City Engineers Office then, Alfonse D. Dy, Mikael Sy, Antonia Trillanes, Alfred
Cayetano, ken Alfreda Lim followed us then we informed Engr. Jus Miyo our complaint so
he called him and said We told you that you should not start yet since you do not yet
have a Notice to Proceed. Why did you start?

Q7: Inya pay ngay napasamak idi nalpas nga kinasao ni Enr. Miyo ni Mr. Kapitantado?
(What happened next after Engr. Miyo talked to Mr. Kapitantado?

A7: Nagawid kamin ta kuna ni Engr. Miyo nga umay ijay Lopex Jaena kinabigatan ta
kitan na nu inya napsamak ejay daldalan.( We went home because Engr. Miyo told us
that he will come to Lopez Jaena to check what happened with the roads.)

Q8: Inya pay nangyari?What happened after that?

A8: Nagsubli kami Lopez Jaena, ket nkita mi ni Mr. Kaptantado nga agbabaun kadagijay
trabahador nga agbakbak da Sunga tinawagan mi ni Engr. Miyo, kunana met nga umay
da kini Engr. AYAI APU. (We went back to Lopez Jaena and there we saw Mr. Kapintado
instructing the workers to dig so we called Engr. Miyo and he said he will come with Engr.
AYAI APU.)

Q9: Sinu kakadwan edi uruyem da ngr. Miyo ken Engr. Apu?Who were with you when
you waited for Engr. Miyo and Engr. Apu?
A9: kadwak da Alfonse D. Dy, Mikael Sy, Antonia Trillanes, Alfred Cayetano, ken Alfreda
Lim. I was with Alfonse D. Dy, Mikael Sy, Antonia Trillanes, Alfred Cayetano,and Alfreda
Lim.

Q10: Inya napasamak edi ururayen yu da Engr. Miyo? What happened while you were
waiting for Engr. Miyo?
A10: Adda kami ejay sangwanan ti balay mi edi immasideg ni Mr. kapitantado, Kinasaok
isuna kunak nga awan met pay approval na jay road widening project na, eksakto nga

immay da Engr. Miyo isuda met ti nagsarita .(We were in front of my residence when Mr.
Kapitantado arrived and approached us. I talked to him and told him that there was no
approval yet of his road widening project, then Engr. Miyo arrived and they discussed
the matter)

Q11. Inya nagyari idi February 21, 2012? What happened on February 21, 2012?
A11: Idi February 21, 2012 napan mi kinita ni Engr. Hans Kadi , santo na impakita
kanyami jay proposed project ken kuna da nga han pay kanu nga naapruban diyay. (On
February 21, 2012, we went again to see Engr. Leo Bernardez, the City Engineer, and he
showed us papers of the proposed project and said that it is not yet approved.

A12: Nagsubli kami ejay Lopez Jaena, nakisao kami kini Engr. Miyo nga adda metlaengen
ejay ayan ti bagbagen da nga dalan, di kwa kitdi ket ni adda metten ni Mr. Kapitantado
nga adda kadwa na nga talu nga pupulis. (We went back to Lopez Jaena and talked to
Engr. Miyo who was already at the excavation site, thereafter, Mr. Kapitantado arrived
with three policemen.

Q13: Inya nangyari ejay nga oras?(What happened then at that time?
A13: Imabagan Engr. Miyo kini Mr. Kapitantado nga Engr. Miyo again told Mr.
Kapitantado, Awan pay ti Notice to Proceed na dayta. Haan yu kadi nga ipapilit.

Q14: Di pimmanaw dagijay pulis santo ni engineer Miyo, binagaan dak ni Kapitantado
nga Bullshit agawid ka idiyay Abra. Baka ditoy ka pay nga matay ti ataken ti puso.
Nangngeg ken nakita da Alfreda Lim ken Antonia Trillanes dyay nga inaramid ken
imbaga na. ( When the policemen left, as well as Engr. Miyo, Kapitantado said Bullsit go
home to Abra, You might die here of Heart attack

Q15: Kunan ni Mr. Kapitantado, kinasaom kanu jay secretary na nga ibaga na kiyana nga
Ipatalna na jay bakbaken na nu saan ket idarum mu isuna.Agpayso? (According to Mr.
Kapitantado, you told his secretary to relay that he should stop the digging or else you
will sue him. Is that true?

A14: Haan nga agpaysu dayta, haan ko nakasasao jay sekretarya na, apay amok nu
assinnu ngata met diyay.(That is not true, I never talked to his secretary, I dont even
know who the secretary is..

Q15: Awanen damagek, adda kayat mo inayun ditoy Judicial Affidavit mo?( I have
