When Disability Benefit Recipients Must Contact Social Security

Newsletter Fall 2016 Contact Us 1-888-WIN-SSDI Welcome Welcome to the Olinsky Law Group Newsletter. We would

Beneficiaries receiving Social Security Disability (SSD) benefits must keep in touch with the Social Security Administration (SSA).

Let the SSA Know of Any Changes to Your Personal Information

Make sure that the SSA always has your current address.

Notify the SSA of any dependent status change, for example marriage or a student

status change for a dependent who is receiving SSD payments based on your benefit. Inform the SSA of any change to your banking or direct deposit arrangement - be sure to do so in time for your next payment.

You can contact the SSA at their website or by calling 800-772-1213.

You Must Notify the SSA if You Begin Working

If you begin a new paying job or return to one, you must report this activity.

You are allowed to work while still receiving your full SSD benefits - no matter what you earn - in a "trial work period" of at least 9 months. After this trial period, you will have 36 months during which you can earn up to a "substantial" amount without losing all or some of your SSD benefits. In 2016, the "substantial" monthly amount is $1,130 or $1,820 if you are blind.

Learn more on SSD benefit eligibility while working in the SSA online brochure Working While Disabled – How We Can Help as well as a quick summary on reporting income.

You Must Repay SSD Overpayments If You Have Been Overpaid

If you do not report that you are working right away, you may be overpaid SSD benefits and you'll have to pay them back.

After receiving an overpayment notice, check it carefully to make sure all the information is correct, then take action based on your individual situation:

Ask the SSA for a reconsideration if you believe the reason for the overpayment

notice or the amount is wrong. Ask for a waiver if you feel the overpayment wasn't your fault, or if you can't afford

to pay the money back. Request a payment arrangement so that you can repay what you owe over time.

We can help if you believe that your SSD benefits have been stopped incorrectly - please contact our experienced attorneys for assistance.

Do Social Security Disability Benefits Continue Indefinitely?

Social Security Disability (SSD) benefits will be paid as long as your medical condition has not improved and you are unable to work.

Periodically, the Social Security Administration (SSA) reviews each SSD recipient's medical condition. If your condition improves so that you are no longer disabled according to the law, your benefits will stop.

The reviews are scheduled based on your medical condition and health outlook:

If improvement is expected, the first review will be 6 to 18 months after your SSD

benefits began. If improvement is possible, your case will be reviewed every 3 years.

When no improvement is expected, the SSA will review your case every 7 years.

Once you reach full Social Security retirement age and your SSD benefits change to Social Security retirement benefits, the disability reviews will stop.

Read more about SSA medical condition reviews here.

https://www.ssa.gov/pubs/EN-05-10068.pdf

You have the right to appeal an SSA decision to suspend or reduce your disability benefits.

Returning to Work May Stop Your Benefits

As explained above, your SSD benefits may end if you are able to return to work at a "substantial" level after your "trial work period" has elapsed. Remember that you must pay back any overpayment, but you can appeal this situation to avoid problematic repayments.

What Happens to Your Benefits if You Relocate Outside of the U.S.

The law prohibits Social Security payments to be made to beneficiaries who live in certain countries. The list of countries is very limited. If you are considering moving out of the U.S., check the SSA website on International Programs - Social Security Payments Outside the United States.

Recipe of the Month Mexican Pumpkin Punch

Newsletter Fall 2016 Contact Us 1-888-WIN-SSDI Welcome Welcome to the Olinsky Law Group Newsletter. We would

Here's a great recipe for your Halloween gathering. Perfect for the fall holidays!

Ingredients

2 cups packed dark brown sugar

4 cinnamon sticks, preferably Mexican

1 29 -ounce can pure pumpkin (about 3 1/2 cups)

2 limes

Splash of rum (optional)

Pineapple chunks and/or pecans, for serving (optional)

Directions

Combine 12 cups water, the brown sugar and cinnamon sticks in a large pot and

bring to a boil over medium-high heat, stirring until the sugar dissolves. Stir in the pumpkin and return to a simmer. Meanwhile, remove the zest from the limes in wide strips using a vegetable peeler; add the zest to the pot and simmer 15 minutes. Let cool, then refrigerate until the liquid is cold and the pumpkin pulp settles to the bottom, 2 to 3 hours. Working in batches, ladle the liquid into a fine-mesh strainer set over a pitcher

(repeat if necessary to strain out all the pumpkin pulp). Discard the pulp and lime zest. Return the cinnamon sticks to the punch and refrigerate until ready to serve. Pour the punch into ice-filled glasses. Add rum, pineapple and/or pecans, if desired. Serve with the cinnamon sticks.
