AN ORDINANCE PROVIDING FOR THE SPEED LIMITS


FOR ALL KINDS OF MOTOR VEHICLES WITHIN THE TERRITORIAL
JURISDICTION OF TAGAYTAY CITY

WHEREAS, Republic Act No. 4135 otherwise known as the "Land Transportation
and Traffic Code" signed into law on June 20, L964, is the governing traffic law of the
Philippines, embodying therein, among others, the speed limits on all highways, which
limits were subsequently incorporated in Tagaytay City's Ordinance No. 2005-347
known as the 'Traffic Management Code of Tagaytay City;

WHEREAS, Republic Act No. 7160 grants local government units the power to
regulate traffic on all streets and bridges with their territorial boundaries, and to enact

such measures that will enhance public health, safety, convenience, maintain peace and \
order, and promote the general prosperity of its inhabitants; \

WHEREAS, it is observed that the existing traffic
laws alffir.OJor$er suited or
responsivb to the current traffic situation in the City due to vardus factors resulting
from rapid urbanization;

WHEREAS, in the interest of public safety and order, it is imperative for the City
Government to immediately address this serious concern through intensified
regulations as well as adoption of local measures responsive to the current si
with a view of reasonably and effectively reducing trdffic accidents restilttin|fil
speeding and reckless driving;

NOW THEREFORE, upon motion of Hon. Reymond A. Ambion, be it ordained by


the Sangguniang Panlungsod ofTagaytay that: P

Ordinance".

SECTION 2. The purpose of this ordinance is to safeguard public safety and ensure the
well being of all its constituents by protecting them from road accidents due to over
speeding and reckless driving.

SECTION 3.ln accordance with Section 35 of RA 4136 (Land Transportation and Traffic
Code), the following speed limits in the City of Tagaytay are hereby imposed:

SECI|ON 4. LEAD AND SUPPORT AGENCIES. The Tagaytay PNP and The Tagaytay Office
of Public Safety (TOPS) shall serve as the lead agencies in implementing this ordinance.
The Land Transportation Office (LTo-Tagaytay City) and the Tricycle Franchising
. Regulatory Board (TFRB) are hereby enjoined to give their full support, assistance and
cooperation in the course of the implementation of the provisions of this ordinance.

SECTION 6. PENAL CLAUSE.

Penalties for violation of this ordinance are as follows:

to exceed two (2) months;

2. Second Offense - P500.00 andlor imprisonment of not less two (2) months but
not to exceed 4 months;
3. Third Offense: PL,000.O0 and/or imprisonment of not less than four (4) rnonths
but not to exceed six (6) months; at the discretion of the court.

Exceptions, however, shall be granted on the following circumstances:


1. A physician or his driver when the former respondsto an emergency call;
2. The driver of a hospital ambulance on the way to and from the place of accident
or other emergencies;
3. Any driver bringing a wounded or sick person for emergency treatment to a
hospital, clinic, or any other similar place;
4. The driver of a motor vehicle belonging to the Armed Forces while in use for
official purposes.
5. The driver of a vehicle, when he or his passengers are in pursuit of a criminal;
6. A law-enforcemEnt officer who is trying to overtake a violator of traffic laws; and
7. The driver officially operating a motor vehicle of any fire department responding t,

8. For security reasons, very important persons (VlP) such as visiting National
Government Officials and other dignitaries.

SECTION 7. SANCTIONS. Violators' Vehicle, if warranted or be subjected to arrest, shall o

be impounded and shall be subject to imposition of fees under City Ordinance No. 2OL4- o

SEgnON 8. SEPARABILITY CLAUSE. lf any part or provision of this ordinance is held 6I

unconstitutional or invalid, other parts or provisions thereof which are not affected shall
continue to remain in force and in effect.

SECflON 9. EFFECTIVITY. This ordinance shall take effect immediately fifteen (15) days
upon publication to local newspapers.
