DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

That this Deed of Absolute Sale made and executed by:

77 LIVING SPACES, INC. , a corporation organized and existing under and by


virtue of the laws of the Philippines, with principal address at G/F, Portal West Bldg.,
Silliman Ave., Dumaguete City, represented in this Act by its _Executive Assistant__,
EMELITA V. SUYCANO , hereinafter referred to as the SELLER,

- and -

MARK ANTHONY PIA QUIRONG, Filipino, of legal age, married to IRISH ADOPTANTE
QUIRONG, with residence address at 178 Femanel Bldg. Sanciangko Street, Cebu City,
Cebu, Philippines, hereinafter referred to as the BORROWER/S.

WITNESSETH:

WHEREAS, the SELLER is absolute owner of parcel of land located at _Biasong, Talisay City,
Cebu together with the housing unit constructed thereon in accordance with the drawings, plans and
specification approved by the Housing and Land Use Regulatory Board (HLURB) and other regulatory
bodies, covered and embraced under Transfer Certificate of Title No. 102-2016007546_ of the Registry
of Deeds of _Talisay City and more particularly described as follows:

WHEREAS, the above-described property is the subject of a Contract to Sell dated


_SEPTEMBER 04, 2017_ executed between the SELLER and the BUYER/S, acknowledged before
Notary Public __Atty. Mark Werner J. Rosal__, and entered in his/her Notarial Register as Doc. No.
_122_, Page No. _25_, Book No. _11_, Series of _2017_.

WHEREAS, the said Contract to Sell involving the above-described property has been assigned
by the SELLER to the Home Development Mutual Fund pursuant to a Deed of Assignment/Deed of
Assignment with Special Power of Attorney dated _SEPTEMBER 04, 2017_, acknowledged before Notary
Public __Atty. Mark Werner J. Rosal__ entered in his/her Notarial Register as Doc. No. _126_, Page No.
_26_, Book No. _11_, Series of __2017__.

WHEREAS, it is provided in the said Deed of Assignment/Deed of Assignment with SPA that the
SELLER shall execute the Deed of Absolute Sale covering the above-described property in favor of the
BUYER/S upon conversion of the subject Contract to Sell to Real Estate Mortgage which shall not be later

than the 24 month from date of loan takeout.

WHEREAS, the said Contract to Sell is now due for conversion to Real Estate Mortgage.

WHEREAS, the Home Development Mutual Fund, as assignee of the said Contract to Sell, has
given its consent to the sale of the property subject thereof to the BUYER/S and has agreed to execute the
corresponding Cancellation of the Deed of Assignment/Deed of Assignment with SPA mentioned above.
NOW, THEREFORE, for and in consideration of the sum of _TWO MILLION EIGHT HUNDRED
FIFTY SIX THOUSAND ONE HUNDRED FIVE_ PESOS ONLY (P 2,856,105.00), Philippine Currency, the
SELLER hereby sells, transfers and conveys, in a manner absolute and irrevocable, to and in favor of the
BUYER/S, his heirs, successors and assigns, the parcel of land/improvements hereinabove mentioned
and described free from any and all liens and encumbrances and unpaid taxes.
All expenses for the registration of this Deed of Absolute Sale, documentary stamp tax and
transfer of title to the BUYER/S shall be borne by the BUYER/S.
The SELLER hereby warrants unto the BUYER/S the peaceful possession of the property subject
hereof, and shall defend his title thereto against the claim of any other person.
