ORDER

For action is the Application for Probation and Motion for Release on
Recognizance Pending Resolution of Petition for Probation filed by the accused
through counsel.

The records show that during the arraignment of the accused on even date,
August 26, 2014, he pleaded guilty to the lesser offense of Simple Seduction and was
sentenced to suffer the penalty of imprisonment for a period of One (1) month and
One (1) day to Six (6) months of Arresto Mayor, straight penalty, in accordance
with the Plea Bargaining Agreement.

Relatively, the accused filed an Application for Probation and Motion for
Release on Recognizance Pending Resolution of Petition for Probation of which, the
Provincial Prosecutors Office, through Assistant Provincial Prosecutor Adolfo M.
Doroy did not object.

WHEREFORE, the Tagbilaran City Parole and Probation Office is hereby

ordered to conduct a post-sentence investigation on the accused and to submit its
report to the Court within sixty (60) days from receipt of this Order, considering
that the offense complained of in this case was committed in Balilihan, Bohol.

The Motion for Release on Recognizance Pending Resolution of Petition for

Probation is hereby granted in consonance with Section 7 of Presidential Decree No.
968, as amended. Corollary thereto, the Jail Warden of Bohol District Jail, Cabawan
District, Tagbilaran City is hereby ordered to effect immediately the release accused
ALEXANDER DAWANG to the recognizance of Barangay Captain Tito T. Libatona
and Barangay Kagawad Paterna L. Digal both of Baucan Norte, Balilihan, Bohol.

 Accused ALEXANDER DAWANG is directed to report to the Tagbilaran City
Parole and Probation Office within seven-two (72) hours from receipt of this order.

Let copies of this order be furnish to the Provincial Prosecution Office of

Bohol; Tagbilaran City Parole and Probation Office; counsel for the accused Atty.
Teodoro M. Lagang; the Jail Warden of Bohol District Jail; Barangay Captain Tito T.
Libatona and Barangay Kagawad Paterna L. Digal both of Baucan Norte, Balilihan,
Bohol.

SO ORDERED.
