Severino Valdes

Facts:

Accused Severino Valdes set fire to some jute sacks and rags soaked in kerosene and placed them near a
partition of the house. No part of the house got burned since someone immediately doused the fire
upon noticing it.

Issue: Whether or not accused Severino Valdes is guilty of arson.

Held:

The crime is classified only as frustrated arson in as much as the defendant performed all the acts
conceived to the burning of said house, but nevertheless owing to causes independent of his will the
criminal act which he intended was not produced.
